MINUTES OF STUDY MEETING HELD JULY 10, 2023
Meeting was called to order at 9:10 p.m. by Council President Jim Jolly. Present: Vice President Toy Laura Toy, Scott Bahr, Rob Donovic, Scott Morgan, Brandon McCullough, and President
Jim Jolly. Absent: Kathleen McIntyre.
Elected and appointed officials present: Susan Nash, City Clerk; Paul Bernier, City Attorney; Jeannine Laible, Human Resources Director and Todd Zilincik, City Engineer.
Vice President Toy led the Pledge of Allegiance.
Councilmember McCullough announced that he has teamed up with Friday’s Musings to recognize a volunteer monthly. This month’s award of a Bigby Coffee gift card was given to Jim Crowley.

REQUEST TO BARRICADE CITY STREETS: Chris Inch, Stevenson Cross Country Head Coach, re: on Friday, August 18, 2023, from 12:00 p.m. through Saturday, August 19, 2023, at 12:00 a.m., with
a rain date of August 19, 2023, on Perth Street from Stark Road until it dead-ends West of Farmington, for a nighttime high school cross country meet.
Mark Lauzon, representing the Stevenson Cross Country Coach, presented the request to Council.
Councilmember Donovic offered an approving motion for the Consent agenda.

BLOCK PARTY: Carol Dobos and Nimosa Farazza, re: to be held Saturday, August 26, 2023, from 4:00 p.m. to 10:00 p.m., on Cranston Street between Scone and Perth Streets, with a rain date
of Sunday, August 27, 2023.
Nimosa Farazza presented the request to Council.
Councilmember McCullough offered an approving motion for the Consent agenda.

REQUEST TO WAIVE THE DRIVEWAY ORDINANCE REQUIREMENT: Jason Renaud, re: to allow the current driveway approach to remain in excess of seven feet.
Todd Zilincik, City Engineer, explained the ordinance requirements for Livonia driveways. He indicated the contractor didn’t get a permit prior to performing the work or this would
have been denied.
Jason Renaud, 37912 Mason, presented the request to Council.
Councilmember Bahr asked Todd Zilincik if the primary reason for the requirement is for uniformity.
Todd Zilincik said yes. There are thirty some homes being built and allowing everyone to do this would require a change in ordinance. He indicated this is a new house and they don’t
want to set precedence by allowing it and felt it was best to bring the issue before Council.
Councilmember Bahr asked the petitioner why the driveway on Google maps doesn’t match the packet given to Council.
Mr. Renaud indicated they made it straight out.
Councilmember Donovic verified the resident can make the driveway as wide as they want above the sidewalk on their side and that we are talking about the approach here.
Todd Zilincik said they must make sure they don't adversely impact the neighbor for drainage, have a higher curb, or have a higher elevation to put drainage on somebody's property.
It may or may not be approved depending on the situation. He said our goal is to be sure it doesn’t interfere with utilities, sanitary water, gas shut off, and that it is six inches
thick.
Councilmember Donovic asked what happens if Council doesn’t approve this.
Todd Zilincik said the resident would need to pay to take six and a half feet out.
Councilmember Bahr asked if other homes going up have a three-car garage as well. He also asked if he has measured the neighbor’s driveway.
Todd reiterated we need to meet compliance being a new house.
Councilmember Bahr said he appreciates holding standards but this is an unusual situation.
Paul Bernier, City Attorney, said we don’t want to set precedence and the decision here would be only for this case.
Councilmember Toy offered an approving motion for the Consent agenda.

WAIVER PETITION: Planning Commission, re: Petition 2023-05-02-04, submitted by The Axe Parlor, requesting waiver use approval to operate an On-Premise Tasting Room Permit in conjunction
with a Micro Brewer license to allow the sale and consumption of beer at 30959 Five Mile Road, located within the Livonia Plaza shopping center on the south side of Five Mile Road between
Henry Ruff and Merriman Roads in the Northwest ¼ of Section 23.
This item was removed from the agenda at the request of the petitioner.
REQUEST TO APPROVE QUARTERLY BUDGET ADJUSTMENTS: Department of Finance, re: for the first and second quarter of the 2023 Fiscal Year Budget.
Michael Slater, Finance Director, presented the request to Council.
Councilmember Bahr said this has been allotted in the budget and he sees about 17% of this grant and asked for an explanation on the miscellaneous items.
Mr. Slater said the software is a part of this as well. He said there is a state grant amount of $181,000, so that and the $319,000 combined is $500,000.
Councilmember Morgan offered an approving motion for the Consent agenda.

REQUEST TO APPROVE HOURLY RATE INCREASES:Department of Civil Service, re: for the grant classifications of Bus Driver and Dispatcher II.
Jeannine Laible, Civic Service Director, presented the request to Council.

REQUEST TO APPROVE ADVANCED SALARY ENTRANCE STEP: Department of Civil Service, re: for the incoming Library Director.
Jeannine Laible, Civic Service Director, presented the request to Council.
Councilmember Donovic asked who decides that step increase is warranted.
Jeannine Laible said it goes to the Library Commission first and to Civil Service after the Commission approves it. From there, it goes to Council for approval.
President Jolly asked if there is a start date in place.
Jeannine Laible said it will be the end of August as she has some things in Baton Rouge to wrap up before starting here.

REQUEST TO ENTER INTO AGREEMENT BETWEEN CHARTER TOWNSHIP OF CANTON AND THE CITY OF LIVONIA: Department of Parks and Recreation, re: for reimbursement of day pass use of the Jack E. Kirksey
Recreation Center by Summit on the Park members beginning August 1, 2023, and ending five (5) days after the City receives reopening notice of the Summit pool.
Ted Davis, Superintendent of Parks and Recreation, presented the request to Council.
President Jolly asked if the Parks and Recreation Commission voted on this.
Paul Bernier explained that there is a statute that intergovernmental agreements must be approved by the legislative branch.
Councilmember McCullough asked how long the Livonia pool will be closed and how much we are charging Canton.
Ted Davis said it was only closed for one day due to HVAC problems. He indicated Livonia residents will be charged the appropriate resident rate, and non-residents will be charged the
appropriate non-resident rate.
Councilmember Bahr verified with Ted Davis that we don’t know how many people may take advantage of this.
