HomeMy WebLinkAboutPLANNING MINUTES 2015-01-13 MINUTES OF THE 1,066TH PUBLIC HEARINGS AND REGULAR MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, January 13, 2015, the City Planning Commission of the City of Livonia held its 1,066th Public Hearings and Regular Meeting in the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan Mr Lee Morrow, Chairman, called the meeting to order at 7 00 p m Members present: Scott P Bahr Kathleen McIntyre R Lee Morrow Carol A. Smiley Gerald Taylor Ian Wilshaw Members absent: None Mr Mark Taormina, Planning Director, and Ms Margie Watson, Program Supervisor, were also present. Chairman Morrow informed the audience that if a petition on tonight's agenda involves a rezoning request, this Commission makes a recommendation to the City Council who, in turn, will hold its own public hearing and make the final determination as to whether a petition is approved or denied The Planning Commission holds the only public hearing on a request for preliminary plat and/or vacating petition The Commission's recommendation is forwarded to the City Council for the final determination as to whether a plat is accepted or rejected If a petition requesting a waiver of use or site plan approval is denied tonight, the petitioner has ten days in which to appeal the decision, in writing, to the City Council Resolutions adopted by the City Planning Commission become effective seven (7) days after the date of adoption The Planning Commission and the professional staff have reviewed each of these petitions upon their filing The staff has furnished the Commission with both approving and denying resolutions, which the Commission may, or may not, use depending on the outcome of the proceedings tonight. ITEM #1 PETITION 2014-12-02-15 4 STAR STRENGTH �_ Ms Smiley, Secretary, announced the first item on the agenda, Petition 2014-12- °' 02-15 submitted by Matthew Adamcheck requesting waiver use approval pursuant to Section 16 11(f) of the City of Livonia id Y Zoning Ordinance #543, as amended, to operate an indoor :> °- training facility (4 Star Strength & Conditioning) at 30958 Industrial Road, located on the west side of Industrial Road ES between the CSX railroad right-of-way and Schoolcraft Road in La' the Northwest 1/4 of Section 26 ti i January 13, 2015 26693 Mr Taormina This is a request to operate an indoor athletic training facility within an M-1 industrial zone This is known as SARMOR Industrial Park which is located on west side of Industrial Road about one-third of a mile east of Merriman Road Approval to operate athletic training facilities in the M-1 zoning district falls under the provisions of Section 16 11(f) of the Zoning Ordinance where such uses can be allowed provided that all parking and ingress and egress to the facility is designed so as not to interfere with the industrial traffic in the area This property contains roughly 482 feet of frontage along Industrial Road, has an average depth of 592 feet and contains a total land area of roughly 6 5 acres The site is developed with a large multi-tenant industrial building that is about 110,880 square feet. There are two driveways off Industrial Road, one at the north end and one at the south end that provide access to the site It is a "U" shaped building with parking and access on all sides There are a total of 208 parking spaces available to the tenants within this facility Entirely surrounding the subject property is industrial zoning and industrial land uses In the lower right hand corner of the site plan, there is an area identified with red cross-hatch that denotes the space where 4 Star would be located This is about a 1,645 square foot unit in the southeasterly corner of the building The space itself would be divided into two areas As you walk in, there is the front office and entrance area and then a door leads to the back area which is identified on this plan as a gym That's the larger space and the area where the athletic training programs would be operated There are no exterior building modifications planned in connection with this proposal The strength training and conditioning facility as proposed would require one parking space for each employee plus sufficient off- street parking spaces for the safe and convenient loading and unloading of students Parking is shared by all of the tenants in this facility There are at least 20 parking spaces in close proximity of this unit. We don't anticipate any parking or access issues, mainly because of the number of persons that are going to be using this facility in relationship to the points of access or ingress/egress as well as parking We believe that the peak hours of operation for this business will not coincide with the peak hours of the operation for most of the industrial uses within this complex. I will let the petitioner, Mr Adamcheck, explain the reasons for that. A question that was asked at the Study Meeting regarding the percentage of SARMAR Industrial Park that is leased We did check our Costar listing on that, and we're showing that roughly 85 percent of the existing industrial complex is currently leased With that, Mr Chairman, I can read out the departmental correspondence Mr Morrow Please January 13, 2015 26694 Mr Taormina. There are five items of correspondence The first item is from the Engineering Division, dated December 22, 2014, which reads as follows "In accordance with your request, the Engineering Division has reviewed the above referenced planning petition We have no objections to the proposed site use at this time The proposed plan indicates that project will consist of renovating a portion of the interior of the building for an indoor training facility, which will not require Engineering Department permits The legal description provided with the petition appears to be correct and is acceptable to this office The existing parcel is assigned an address of#30932 Industrial Road with a range of#30932 to #30976 Industrial Road for the individual units within the building The address of #30958 Industrial Road does fall within the approved address range, and can be used for the proposed training facility if it is not currently being used by another tenant. The existing structure is currently serviced by public utilities, which are to remain in place Should changes to the existing utility leads be needed, the owner will need to submit plans to the Engineenng Department to determine if permits will be required " The letter is signed by David W Lear, P E , Assistant City Engineer The second letter is from the Livonia Fire & Rescue Division, dated December 22, 2014, which reads as follows "I have reviewed the petition for a waiver use approval to operate an indoor training facility on the property at the above referenced address and have noted the following (1) This proposal is a change of use for the address in question This requires that the location must conform to current NFPA 101 standards, 2012 edition, for New Assembly use (2) Chapter 12, New Assemblies, and Chapter 7, Means of Egress, must be conformed to which includes Emergency Exit Signs, Emergency Lighting, Exit Pathways, Occupant Load, and Extinguisher Requirements (3) Exterior lighting and proper walkways are required to be ADA compliant. Providing that all details in regards to New Assembly Occupancy are followed and inspected prior to tenant use, this department has no objections to this petition " The letter is signed by Daniel Lee, Fire Marshal The third letter is from the Division of Police, dated December 18, 2014, which reads as follows "I have reviewed the plans in connection with the petition I have no objections to the proposal " The letter is signed by Joseph Boitos, Sergeant, Traffic Bureau The fourth letter is from the Inspection Department, dated December 29, 2014, which reads as follows "Pursuant to your request, the above-referenced petition has been reviewed The following is noted (1) The parking lot shall be repaired and restriped as necessary Parking spaces shall be 10' wide, 20' deep and January 13, 2015 26695 double striped (2) This petition is a change of use and would require that the building meet all current Michigan Building Codes including the Michigan Barrier Free Code This will be addressed further at the time of our plan review if this project moves forward This Department has no further objections to this petition " The letter is signed by Jerome Hanna, Assistant Director of Inspection And lastly we have an email, dated January 20, 2015, that was submitted to the Planning Department from Donald Kleinknecht, a Livonia resident, which reads as follows "Mr Adamcheck served our country and he seems to be dedicated to his new venture If he has the proper licenses and insurance to operate a strength and conditioning business along with complying with all the building and parking codes, he should be given a waiver" That is the extent of the correspondence Mr Morrow. Are there any questions of the Planning Director? Mr Morrow. Very fine You heard the Planning Director Is there anything you would like to add or detract from what you've heard so far? Mr Adamcheck: No, sir Requesting a permit to work on getting people in shape and healthy in the City of Livonia I was born and raised in Livonia, went to the Army, came back, now looking to help continue Livonia's growth I like what I've seen in that Middlebelt/96 corridor and would like to be a part of that. Mr Morrow We will see if the Commissioners have any questions of you Any questions for the petitioner? Ms Smiley. Good evening Who is your target group? Mr Adamcheck: Yes, ma'am Our demographic is athletics, high school level athletes and also general population from about 15 to 45 I do train some athletes that are 55 to 65 years old also Our strength and conditioning is Olympic weightlifting and barbell isometric plyometric weights We do not utilize machines Ms Smiley. Thank you Mr Wilshaw Mr Adamcheck, how many customers do you expect to have at any given time using your facility? January 13, 2015 26696 Mr Adamcheck: Yes, sir My classes are capped so that way I can maintain positive control of the athletes as opposed to just babysitting Our classes will never exceed 15 people, and most classes I would average between 6 to 8 individuals Mr Wilshaw How many employees will you have besides yourself? Mr Adamcheck: Myself Mr Wilshaw Okay Hours of operation? Mr Adamcheck: Hours of operation are a 6 00 a m class and the gym is open with me in the facility watching over the whole time until 8 00 p m most days of the week. On the weekends, we're open for two three-hour bursts So we go from 9 00 a.m to 1 00 p m on Saturday and then 11 00 a m to 3 00 p m on Sunday Mr Wilshaw It sounds like what you're offering is a very specialized training environment where instead of going to say an LA Fitness or somewhere there is a bunch of machines and people can freely use them, they're coming there to get special training, very small group, personalized and make sure that the person is doing all the things that you want them to do to get to the stages of development that you want them to get to Right? Mr Adamcheck: Yes, sir Mr Wilshaw Okay It sounds very good As a Livonia resident, I'm glad that you want to open in this community I'm glad that you're wanting to continue to stay in this community and support it, and I think it sounds like a good plan Mr Adamcheck: Thank you very much Mr Morrow. Thank you, Mr Wilshaw Anyone else? Are you currently in business somewhere and are moving or will this be a brand new operation? Mr Adamcheck: This will be a brand new operation Mr Morrow. Okay Ms Smiley. How did you learn how to do this? Mr Adamcheck: When I went into the Army, I got injured and as part of my recuperation and recovery process for my shoulder injury, learning to lift properly with very light objects was part of it. That just kind of snowballed into actually learning it, and then teaching how to teach others, into just really getting involved in the Olympic lifting community Ms Smiley' Okay Thank you January 13, 2015 26697 Mr Taylor How did you happen to come upon this building? I think it's a good use for industrial When we have workout areas and things like that, they have high ceilings But how did you happen to come upon this one? Mr Adamcheck: I've been working the crossfit community for awhile where we utilize industrial parkways most of the time Due to their high ceilings, we're able to do more things with them So I kind of grew up in that environment. So I wanted it for myself The industrial building just has a different feel for fitness and it's more of a come in, do your work, be serious about it and leave environment, as opposed to a come have pizza and tootsie rolls while you work out type of environment. It's just more serious Mr Taylor Thank you Good luck. Mr Adamcheck: Thank you Mr Morrow Does the Commission have any more questions? If not, is there anybody in the audience that wishes to speak for or against the granting of this petition? Seeing no one coming forward, I will close the public hearing and ask for a motion Mr Bahr I too think this is a great use for this property, and I'll bring forth an approving resolution On a motion by Bahr, seconded by Wilshaw, and unanimously adopted, it was #01-01-2015 RESOLVED, that pursuant to a Public Hearing having been held by the City Planning Commission on January 13, 2015, on Petition 2014-12-02-15 submitted by Matthew Adamcheck requesting waiver use approval pursuant to Section 16 11(f) of the City of Livonia Zoning Ordinance #543, as amended, to operate an indoor training facility (4 Star Strength & Conditioning) at 30958 Industrial Road, located on the west side of Industrial Road between the CSX railroad right-of-way and Schoolcraft Road in the Northwest 1/4 of Section 26, which property is zoned M-1, the Planning Commission does hereby recommend to the City Council that Petition 2014-12-02-15 be approved subject to the following conditions 1 That the issues as outlined in the correspondence dated December 22, 2014, from the Fire Marshal, including those relating to the requirement that the proposed space must conform to current NFPA 101 standards, shall be resolved to the satisfaction of the Fire Department; 2 That the issues as outlined in the correspondence dated December 29, 2014, from the Assistant Director of January 13, 2015 26698 Inspection, including those relating to the requirement that the building meet all current Michigan Building Codes including the Michigan Barrier Free Code, shall be resolved to the satisfaction of the Inspection Department; 3 That adequate lighting be provided in the parking areas and walkways as determined by the Inspection Department; and 4 That only conforming signage is approved with this petition, and any additional signage shall be separately submitted for review and approval by the Zoning Board of Appeals Subject to the preceding conditions, this petition is approved for the following reasons 1 That the proposed use is in compliance with all of the special and general waiver use standards and requirements as set forth in Sections 16 11 and 19 06 of the Zoning Ordinance #543, 2 That the subject property has the capacity to accommodate the proposed use, and 3 That the proposed use is compatible to and in harmony with the surrounding uses in the area FURTHER RESOLVED, that notice of the above hearing was given in accordance with the provisions of Section 19 05 of Zoning Ordinance #543, as amended Mr Morrow, Chairman, declared the motion is carried and the foregoing resolution adopted It will go on to City Council with an approving resolution They will contact you relative to the meeting they will have on this With that, good luck and thank you for bringing your business to Livonia Mr Adamcheck: Thank you very much all of you for your time January 13, 2015 26699 ITEM #2 APPROVAL OF MINUTES 1,065th Public Hearings and Regular Meeting Ms. Smiley, Secretary, announced the next item on the agenda, Approval of the Minutes of the 1,065th Public Hearings and Regular Meeting held on December 16, 2014 On a motion by McIntyre, seconded by Smiley, and unanimously adopted, it was #01-02-2015 RESOLVED, that the Minutes of 1,065th Public Hearings and Regular Meeting held by the Planning Commission on December 16, 2014, are hereby approved A roll call vote on the foregoing resolution resulted in the following AYES McIntyre, Smiley, Bahr, Wilshaw, Taylor, Morrow NAYS None ABSENT None ABSTAIN None Mr Morrow, Chairman, declared the motion is carried and the foregoing resolution adopted On a motion duly made, seconded and unanimously adopted, the 1,066th Public Hearings and Regular Meeting held on January 13, 2015, was adjourned at 7 17 pm CITY PLANNING COMMISSION ' i t ta_..ea . r Carol A.
