HomeMy WebLinkAboutCOUNCIL MINUTES 1990-09-2426046 MINUTES OF THE ONE THOUSAND ONE HUNDRED AND EIGHTY FIFTH REGULAR MEETING OF THE COUNCIL OF THE CITY OF LIVONIA On September 24, 1990, the above meeting was held at the City Hall, 33000 Civic Center Drive, Livonia, Michigan and was called to order by the President of the Council at 8:00 P.M Councilman Bishop delivered the invocation. Roll was called with the following result Present: Laura Toy, Robert R Bishop, Gerald Taylor, Dale Jurcisin, Ron Ochala and Joan McCotter, Absent Fernon P. Feenstra (absent due to a death in the family). Elected and appointed officials present Robert F. Nash, City Clerk, Cathryn K. White, Assistant City Attorney, Robert D. Bennett, Mayor, John Nagy, Planning Director; Raul Galindo, City Engineer, James Andres, Chief Accountant, Karen Szmula, Director of Legislative Affairs; Ron Reinke, Superintendent of the Department of Parks and Recreation, Robert Beckley, Director of Public Works, Suzanne Wisler, Director of Community Resources, Michael Deller, City Librarian and John Fegan, Director of Building Inspection On a motion by Councilman Taylor, seconded by Councilman Jurcisin, and unanimously adopted, it was #864-90 RESOLVED, that the minutes of the 1,184th Regular Meeting of the Council of the City of Livonia, held September 12, 1990 are hereby approved. On a motion unanimously introduced, supported and adopted, it was #865-90 WHEREAS, The Athena Award Program was initiated in 1982 by the Lansing, Michigan Regional Chamber of Commerce to recognize, encourage and celebrate the achievements of women in business and the professions, and WHEREAS, Jeanne M. Hildebrandt has been selected by the Livonia Chamber of Commerce to be a recipient of the Athena Award for 1990, and 26047 WHEREAS, she is employed as General Manager for the Livonia Mall and has worked diligently to further the goals of professional women in many ways, including supporting her female employees and helping them to achieve promotion within the company, and WHEREAS, she is a past member of the Planning Commission of the City of Livonia and the Livonia Industrial Development Commission and has devoted countless hours to many professional, civic, educational and charitable organizations including the Livonia Chamber of Commerce, Madonna College, the Livonia Prayer Breakfast Committee, the Schoolcraft College Foundation Board, the Michigan Cancer Foundation and the Metro Area Shopping Center Managers Association, and WHEREAS, her professionalism, dedication to others and leadership abilities are appreciated by all who know her, NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council do hereby take this means to congratulate and commend JEANNE HILDEBRANDT for the honor which has been bestowed upon her On a motion by Councilman Ochala, seconded by Councilwoman Toy, A communication from Edward K. Miller, dated September 4, 1990 submitted on behalf of Old Rosedale Gardens Homeowners Association re the condition of Rosedale Park was received and placed on file for the information of the Council #866-90 RESOLVED, that having considered a letter from Mr Edward K Miller, 10005 Blackburn Avenue, Livonia, Michigan 48150, dated September 4, 1990, submitted on behalf of Old Rosedale Gardens Homeowners Association with regard to the condition of Rosedale Park, and having also considered the report and recommendation of the Superintendent of Parks and Recreation dated September 11, 1990, approved for submission by the Mayor in connection therewith, the Council does hereby refer this item to the Livonia City Council/Schools Liaison Committee for its report and recommendation on the question of the future use of the Whitman School park area #867-90 RESOLVED, that the City of Livonia, Michigan does hereby accept the terms of the Agreement as received from the Michigan Department of Natural Resources, and that the City of Livonia does hereby specifically agree, but not by way of limitation, as follows 1 To appropriate the sum of twenty-two thousand five hundred dollars ($22,500) to match the grant authorized by the DEPARTMENT and to appropriate such additional funds as shall be necessary to completed the project. 26048 2 To maintain satisfactory financial accounts, documents and records to make available to the DEPARTMENT for auditing at reasonal times 3. To construct the project and provide such funds, services and materials as may be necessary to satisfy the terms of said Agreement 4 To authorize Ronald R. Reinke, Superintendent of the Department of Parks and Recreation, to be the local Authorized Representative to sign documents in behalf of the City of Livonia, Michigan 5 To comply with any and all terms of said Agreement including all terms not specifically set forth in the foregoing portions of this Resolution #868-90 RESOLVED, that having considered the report and recommendation of the Superintendent of Parks and Recreation dated September 12, 1990, approved for submission by the Mayor, wherein it is recommended that the 1991 Memorial Day Parade be conducted on Saturday, May 25, 1991 according to the following schedule Ceremony at Park 9 00 A M Parade 10 30 A M and that the route be as follows Assembly at Bentley High School, Five Mile west to Farmington, Farmington south to Lyndon, Lyndon west to Ford Field, Parade will end at Ford Field the Council does hereby concur in and approve of the aforesaid action, and the Livonia Police Department is hereby requested to do all things necessary to close the roads involved in this event and the Department of Parks and Recreation is hereby requested to provide advance notice to businesses along the parade route of this activity. #869-90 RESOLVED, that having considered a letter from the Senior Citizens Woodcarvers Club, dated August 28, 1990, requesting that the requirement of Transient Merchant's license be waived for exhibitors for the Senior Citizens Woodcarvers Show to be held on October 7, 1990, at the Civic Park Senior Center and also requesting permission to display two temporary signs at Five Mile and Farmington Roads, one on the lawn of the Senior Center, and one in the parking lot at the rear of the center, the Council does hereby concur in and approve of this request in the manner and form herein submitted 26049 #871-90 RESOLVED, that having considered a letter from Deborah L Zech, 29253 Lyndon, Livonia, MI 48154, dated September 12, 1990, as well as a petition submitted by certain homeowners of the Compton Village Subdivision with regard to sewage problems caused in the area by reason of heavy rainfall, the Council does hereby refer this item to the Engineering Division for a report and recommendation which should be based upon inspection of the area in question, further, the Council does hereby request that the Department of Public Works provide pumps in all critical areas of the City during times of heavy rains so as to thereby alleviate similar future problems, and the Council does hereby request that all homeowners in these areas disconnect the downspouts of the gutters on their homes from sanitary sewers and in this regard the Inspection Department is requested to submit a report and recommendation #872-90 RESOLVED, that having considered a letter from Deborah L Zech, 29253 Lyndon, Livonia, MI 48154, dated September 12, 1990, as well as a petition submitted by certain homeowners of the Compton Village Subdivision with regard to sewage problems caused in the area by reason of heavy rainfall, the Council does hereby request that the Mayor provide a response team to serve the needs of areas which experience such problems, which teams should include the services of the Director of Emergency Preparedness. #873-90 RESOLVED, that having considered a letter from Deborah L. Zech, 29253 Lyndon, Livonia, MI 48154, dated September 12, 1990, as well as a petition submitted by certain homeowners of the Compton Village Subdivision with regard to sewage problems caused in the area by reason of heavy rainfall, the Council does hereby request that the Finance Director submit a report and recommendation with regard to the number of claims which have been submitted with respect to this matter #874-90 RESOLVED, that having considered a letter from Deborah L Zech, 29253 Lyndon, Livonia, MI 48154, dated September 12, 26050 1990, as well as a petition submitted by certain homeowners of the Compton Village Subdivision with regard to sewage problems caused in the area by reason of heavy rainfall, the Council does hereby request that the City Assessor submit a report and recommendation with regard to whether or not tax relief may be afforded to homeowners suffering these problems #875-90 RESOLVED, that having considered a letter from the Director of Building Inspection, dated September 11, 1990, approved for submission by the Mayor wherein it is recommended that (1) Section 15 04 060 of the Livonia Code of Ordinances should be amended so as to adopt the "1990 National Electrical Code (NFPA-70-1990)" by reference and (2) Sections 15 08 050 through 15.08 260 should be amended so as to include the Technical Amendments to the 1990 Code, the Council does hereby refer this matter to the Department of Law for the preparation of the suggested ordinance amendments for submission to Council #876-90 RESOLVED, that having considered the report and recommendation of the Fire Chief dated September 7, 1990, approved by the Director of Finance and approved for submission by the Mayor, the Council does hereby authorize the sale of 1979 Plymouth Volare to be sold at auction in accordance with procedures previously authorized in this regard, as well as the disposal of a 1977 Plymouth Grand Fury to be used by the Livonia Fire Department for training purposes #877-90 RESOLVED, that having considered the report and recommendation of the Chief of Police dated August 31, 1990, which bears the signature of the Finance Director and is approved for submission by the Mayor, the Council does hereby accept the bid of SWS Security, 1300 Boyd Road, Street, MD 21154-1826, for supplying the Division of Police with a 360 degree tracking device for the price of $11,750 00, the same having been in fact the lowest bid received and meets all specifications #878-90 RESOLVED, that having considered the report and recommendation of the Director of Public Works and the City Librarian dated September 12, 1990, approved by the Director of Finance and approved for submission by the Mayor with regard to proposed Noble Library Roof Repairs and Building Improvement, the Council does hereby accept the following low bids which meet specifications and authorize the Mayor and City Clerk to execute construction contracts with the following contractors Contract Major Work Activity Contractor Amount Asbestos Abatement Brand Industrial Services $ 55,830.00 12401 Universal Drive Taylor, Michigan 48180 26051 2 Roofing Improvement Gregory Industries, Limited $ 49,530 00 4645 Bree Road St Clair, Michigan 48079 3 Electrical Lighting Etna Electrical Co , Inc $ 27,186.00 improvement 29591 West Chicago Livonia, Michigan 48150 4. Acoustical Ceiling Michael & Solomon Contractors $ 7,813 00 Installation 31185 Schoolcraft Road Livonia, Michigan 48150 Sub -total $140,359 00 Further, the Council does hereby authorize the Director of Public Works to proceed with the additional elements necessary to complete this work, such action to be taken in accordance with the provisions of the Finance Ordinance and Law Securing a contractor to complete miscellaneous masonry as a result of roof modification at a cost not to exceed $5,000 00 $ 5,000 00 2 Completion of sheet metal work necessary to extend the air distribution system to the new ceiling Estimated cost not to exceed $5,000 00 $ 5,000 00 3 Hire a consultant to provide inspection, review of shop drawings, and review of progress estimates $ 13,743 48 4 Miscellaneous expenses including the renting of semi -trailers for book storage, general building cleanup after renovation, and costs incurred throughout the construction phase at a cost not to exceed $5,000 00 $ 5,000 00 Total cost of all items of work shown above $169,102.48 Further, the Council does hereby appropriate and authorize the expenditure of a sum not to exceed $161,202 48 from the Unexpended Fund Balance of the Library Fund for this purpose #879-90 RESOLVED, that having considered the report and recommendation of the Director of Community Resources, dated September 5, 1990, which bears the signature of the City Attorney and the Finance Director and is approved for submission by the Mayor, to which is attached a proposed amended agreement between the City of Livonia and Northwest Transport Company, 31376 Industrial Road, Livonia, Michigan 48150, to provide specialized transportation services for non -transferable wheelchair persons in Northwest Wayne County, and Farmington and Farmington Hills, and a proposed amendment agreement between the City Of Livonia and SMART for support Of this program* the Council does hereby authorize the Mayor and City Clerk to execute the said agreements in the manner and form herein described, subject to the approval as to form of the Department of Law 1800-90 RESOLVED, that having considered a letter Of application from ABC Cab, P 0. Box 653, Farmington, MI 48332° dated August 27, 1990» for a taxicab license to operate 15 Cabs to be located at 36977 Amrhein, Livonia, MI 48150° and having also considered a letter from Yellow & Red Cab Company, 31376 Industrial, Livonia, Ml 48150, dated September 14, 1990, in opposition thereto, the Council dO8S hereby refer this item to the Chief of Police for his report and recommendation #881-90 RESOLVED, that having considered a communication from the City Planning Commission, dated August 31° 1990, which sets forth its resolution 8-431-90 adopted On August 28, 1880, with regard to a request from Father George 3halhoub for an extension Of the approval of Petition 89-3-2-23 relative to D waiver use approval to JRJ Group, Inc., to construct an activities hall addition to St Mary's AntiOchidn Orthodox Church located on the east side of Merriman Road between 3j% and Seven Mile Roads in the Southwest 1/4 of Section 11, previously granted in Council Resolution 679-89 adopted on July 17* 1989, the Council does hereby concur in the recommendation Of the Planning Commission and grant the extension for a one-year period, subject to compliance with all Of the conditions set forth in Planning Commission resolution 6-140-89 and Council Resolution 679-89 #882-90 RESOLVED, that having considered the report and recommendation of the Assistant Planning Director, dated August 31, 1090, approved for submission by the Mayor, to which is attached d proposed Contract between the County of Wayne and the City of Livonia for the administration of CD8G funds by the County for the development of a homeless shelter project involving the renovation Of the commissary building located in the former Eloise complex in the City of Westland, the Council having previously authorized the use of $17,550 in CDBG funds for this purpose in accordance with Council Resolution 522-90, the Council does hereby authorize the Mayor and City Clerk for and on behalf of the City of Livonia to execute the said contract in the manner and form herein submitted #083~90 RESOLVED, that having considered a communication from the Planning Commission dated September 5, 7990° to which is attached the document titled "Capital Improvement Program, 1991-199611, the Council does hereby refer this item to the Capital Improvement Committee for its report and recommendation. 26053 #884-90 RESOLVED, that having considered the report and recommendation Of the Department of Law and the Planning Director dated August 74, /990" submitted pursuant to Council Resolution 578-90 with regard to the maintenance and conveyance of the northwest corner of Farmington Road and Seven Mile Road to the City Of Livonia by Schostak Brothers and Company (which has not been accomplished), the Council does hereby refer this item to the C0mitteS of the Whole for its report and recommendation. #885-90 RESOLVED, that having considered a communication from the Department of Law, dated September 7, 1990, approved by the Finance Director and approved for submission by the Mayor, with respect to the sale of property located at 9234 Newburgh Road, the legal description of which is The Northerly 84.80 feet Of Lot 475, "Supervisor's Livonia Plat No, 12» of part of Section 32, Town l South, Range 9 East, Livonia Township /now City Of Livonia), Wayne County, Michigan Recorded in Liber 68 of Plats, on Page 05, Wayne County Records, reserving and excepting therefrom the West 27 feet thereof for Newburgh Road right-of-way. the Council does hSy9hv authorize the sale of this property to American Legion Post 32° Myron H. Beals, 9318 Newburgh Road, Livonia, Michigan 48150, from the City of Livonia for the price Of $15,000 00 Cash, which sale is conditioned upon the purchaser providing any title work as may be required for this transaction, the action herein being taken in order to best serve the interests of the community, and the Mayor and City Clerk are hereby authorized, for and on behalf Of the City of Livonia, to execute a quit claim deed and Such other documents as may be necessary Or incidental to fulfill the purpose of this resolution, and the Department of Law is hereby requested to prepare and place in proper form such legal documents as may be necessary to consummate this transaction, and the proceeds from such Sale shall be credited to the 7 9 Million Dollar General Obligation Road Improvement Bond Issue. �ff- 11%11 #886-90 WHEREAS, pursuant to due and proper notice published and mailed to all property owners in Special Assessment District No. 347, more particularly described in Council Resolution 616-90 adopted on June 25, 1990, as required by the provisions of the City Charter and Title 3, Chapter 8 of the Livonia Code of Ordinances, as amended, the City Council has duly met and reviewed the special assessments levied in the special assessment roll prepared by the City Assessor to cover the district in which street lighting is to be installed, such roll having been prepared on the basis of street lighting being installed in Arbor Park View Subdivision in the Southeast 1/4 of Section 33, in said Special Assessment District No. 347, NOW, THEREFORE, BE IT RESOLVED, that the said Council does hereby determine to install street lighting consisting of the installation of 100 watt high pressure sodium lights on davitt poles and underground wiring in Arbor Park View Subdivision located in the Southeast 1/4 of Section 33, and that the assessments set forth in said Special Assessment District No 347 Roll are fair and equitable and based upon benefits derived in said district, in accordance with the plans of the City Engineer and resolutions of the City Council, said Special Assessment Roll No. 347 based on installation of 100 watt high pressure sodium lights on davitt poles and underground wiring is hereby approved and confirmed in all respects, pursuant to the provisions of Section 3 08 130 of the Livonia Code of Ordinances, as amended, the City Clerk shall endorse the date of confirmation on the Assessment Roll, and the assessment roll shall then be immediately transmitted to the City Treasurer who shall take such further action as set forth in Title 3, Chapter 8 of the Livonia Code of Ordinances, as amended, and the City Clerk is hereby authorized to transmit the proper street lighting order to the Detroit Edison Company on forms provided by them for this purpose #887-90 RESOLVED, that the City Engineer having filed with the City Clerk a statement dated July 17, 1990 on all matters required by Sections 3.08.060 and 3.08 140 of the Livonia Code of Ordinances, as amended, and a first public hearing having been held thereon on September 19, 1990, after due notice as required by Section 3 08.070 of said Code, and careful consideration having been given to all such matters, the Council does hereby, pursuant to Section 3 08.080 of said Code accept and approve said statement in all respects, (2) determine to make the improvement consisting of the installation of 100 watt high pressure sodium street lighting system on colonial post tops with underground wiring in Caliburn Estates Subdivision No. 1 located in the Northwest 1/4 of Section 8, City of Livonia, Wayne County, Michigan, as described in said statement, 26055 and to defray the cost of such improvement by special assessment upon the property especially benefited in proportion to the benefits derived or to be derived, (3) approve the plans and specifications for said improvement as set forth in said statement dated July 17, 1990, (4) determine that the cost of such improvement shall be paid by special assessment upon the property especially benefited; (5) determine that the assessment made for such improvement shall be paid in annual installments, according to said statement, (6) designate the assessment district, describing the land and premises upon which special assessments shall be levied as follows A Special Assessment District in the N W 1/4 of Section 8, T.lS., R.K., City of Livonia, Wayne County, Michigan, described as containing the property shown on the Special Assessment Plan and the Special Assessment Roll. (7) direct the City Assessor to prepare a special assessment roll in accordance with the Council's determination on said statements as prepared by the City Engineer dated July 17, 1990, and (8) that upon completion of said roll, the City Assessor shall attach thereto the certificate required by the provisions of Section 3 08 100 of the Livonia Code of Ordinances, as amended, and file the same with the City Clerk, who thereupon is directed to present the same to the City Council prior to the holding of the second public hearing thereon pursuant to Title 3, Chapter 8 of the Livonia Code of Ordinances. #888-90 RESOLVED, that the City Engineer having filed with the City Clerk a statement dated July 18, 1990 on all matters required by Sections 3.08 060 and 3.08 140 of the Livonia Code of Ordinances, as amended, and a first public hearing having been held thereon on September 19, 1990, after due notice as required by Section 3 08.070 of said Code, and careful consideration having been given to all such matters, the Council does hereby, pursuant to Section 3 08 080 of said Code (1) accept and approve said statement in all respects, 26056 (2) determine to make the improvement consisting of the installation of 100 watt high pressure sodium street lighting system on colonial post tops with underground wiring in Caliburn Manor Subdivision No I located in the Northeast 1/4 of Section 7, City of Livonia, Wayne County, Michigan, as described in said statement; and to defray the cost of such improvement by special assessment upon the property especially benefited in proportion to the benefits derived or to be derived; (3) approve the plans and specifications for said improvement as set forth in said statement dated July 18, 1990$ (4) determine that the cost of such improvement shall be paid by special assessment upon the property especially benefited; (5) determine that the assessment made for such improvement shall be paid in annual installments, according to said statement, (6) designate the assessment district, describing the land and premises upon which special assessments shall be levied as follows: A Special Assessment District in the N E 1/4 of Section 7, T.lS., R.9E , City of Livonia, Wayne County, Michigan, described as containing the property shown on the Special Assessment Plan and the Special Assessment Roll. (7) direct the City Assessor to prepare a special assessment roll in accordance with the Council's determination on said statements as prepared by the City Engineer dated July 18, 1990, and (8) that upon completion of said roll, the City Assessor shall attach thereto the certificate required by the provisions of Section 3.08.100 of the Livonia Code of Ordinances, as amended, and file the same with the City Clerk, who thereupon is directed to present the same to the City Council prior to the holding of the second public hearing thereon pursuant to Title 3, Chapter 8 of the Livonia Code of Ordinances #889-90 RESOLVED, that having considered a communication from the City Planning Commission dated July 31, 1990, which sets forth its resolution 7-404-90 adopted on July 17, 1990, with regard to Petition 90-6-6-4 submitted pursuant to Council Resolution 85-90 to determine whether or not to amend Zoning Ordinance 543 so as to provide for the regulation of restaurant 26057 uses as waiver uses when located in department stores, supermarkets, or other developments (in lieu of allowing such uses as accessory uses), and the Council having conducted a Public Hearing with regard to this matter on September 19, 1990, pursuant to Council Resolution 742-90, the Council does hereby refer this item to the Planning Department for the purpose of developing alternative amendatory language which shall thereafter be submitted to the Legislative Committee for its report and recommendation. #890-90 WHEREAS, pursuant to due and proper notice published and mailed to all property owners in Special Assessment District No. 348, more particularly described in Council Resolution 584-90 adopted on June 13, 1990, as required by the provisions of the City Charter and Title 3, Chapter 8 of the Livonia Code of Ordinances, as amended, the City Council has duly met and reviewed the special assessments levied in the special assessment roll prepared by the City Assessor to cover the district in which street lighting is to be installed, such roll having been prepared on the basis of street lighting being installed in Gill Orchards Subdivision in the Southeast 1/4 of Section 4, in said Special Assessment District No. 348, NOW, THEREFORE, BE IT RESOLVED, that the said Council does hereby determine to install street lighting consisting of the installation of 100 watt high pressure sodium lights with colonial post tops and underground wiring in the Gill Orchards Subdivision located in the Southeast 1/4 of Section 4, and that the assessments set forth in said Special Assessment District No 348 Roll are fair and equitable and based upon benefits derived in said district, in accordance with the plans of the City Engineer and resolutions of the City Council, said Special Assessment Roll No 348 based on installation of 100 watt high pressure sodium lights with colonial post tops and underground wiring is hereby approved and confirmed in all respects, pursuant to the provisions of Section 3 08.130 of the Livonia Code of Ordinances, as amended, the City Clerk shall endorse the date of confirmation on the Assessment Roll, and the assessment roll shall then be
