MINUTES OF THE ONE THOUSAND ONE HUNDRED AND EIGHTY EIGHTH REGULAR MEETING
OF THE COUNCIL OF THE CITY OF LIVONIA
On November 7, 1990, the above meeting was held at the City Hall, 33000
Civic Center Drive, Livonia, Michigan and was called to order by the President
of the Council at 8 00 P M Councilman Ochala delivered the invocation
Roll was called with the following result Present Laura Toy, Robert,
R Bishop, Gerald Taylor, Dale Jurcisin, Ron Ochala and Joan McCotter, Absent
Fernon P Feenstra (representing the City at a meeting of the Michigan Municipal
League).
Elected and appointed officials present Robert F Nash, City Clerk,

On a motion by Councilman Bishop, seconded by Councilwoman Toy,
and unanimously adopted, it was

Meeting of the Council of the City of Livonia, held October
24, 1990 are hereby approved
On a motion by Councilman Taylor, seconded by Councilman Jurcisin,
and unanimously adopted, it was

On a motion by Councilman Bishop, seconded by Councilman Taylor,
#1009-90 RESOLVED, that having considered a request from M.A T.,
37815 Woodridge Drive, Suite 101, Westland, Michigan 48185,
for a license to operate a transportation service in the City
of Livonia to and from both Detroit Metropolitan and Detroit
City Airports, the Council does hereby refer this item to the
Police Department for its report and recommendation
#1010-90 RESOLVED, that having considered the report and
recommendation of the Superintendent of Public Service and
the Director of Public Works, dated October 3, 1990 approved
by the Finance Director and approved for submission by the
Mayor, the Council does hereby authorize the purchase from
Morton International, Inc , Morton Salt Division, 110 North
Wacker Drive, Chicago, Illinois 60606, of rock salt at the
unit price of $23 35 per ton for the period September 4, 1990
through September 3, 1991, under the State of Michigan Contract
Agreement No 7433, further, the Council does hereby determine
to authorize the said purchase without competitive bidding
inasmuch as the same is based upon the low State of Michigan
bid price, as well as for the additional reasons indicated
in the aforesaid communication, and such action is taken in
accordance with the provisions set forth in Section 3 04 150D5
of the Livonia Code of Ordinances, as amended
#1011-90 RESOLVED, that having considered the report and
recommendation of the Director of Building Inspection dated
October 4, 1990, which bears the signature of the Finance
Director and is approved for submission by the Mayor, the Council
does hereby authorize the demolition and removal of the structure
located at 19315 Lathers by J R Mathews, Inc , P 0 Box 52334,
Livonia, Michigan 48152 for the price of $3,850.00, the same
to be appropriated and expended from the Civic Improvement
- Unsafe Buildings Account (205-525-882-050) with the provision
that said account be reimbursed at such time as funds are
subsequently recovered from the owners of the above property
as provided for in Chapter 15 52 180 of the Livonia Code of
Ordinances, further, the Council does hereby authorize the
said item without competitive bidding in accordance with Section
3 04 150D5 of the Livonia Code of Ordinances, as amended

Linen Supply Co , Inc., 3800 18th Street, Detroit, Michigan
48208, for supplying the Public Service Division employees
with rental uniforms and cleaning service at the unit prices
quoted in its bid of October 3, 1988 ($215 95) for the period
through November 30, 1991, further, the Council does hereby
authorize the said item without competitive bidding in accordance
with Section 3.04.14OD5 of the Livonia Code of Ordinances, as
amended
A communication from the Director of Finance, dated October 23, 1990
re Chapter 20 Drains was received and placed on file for the information of the
Council
#1013-90 RESOLVED, that having considered the report and
recommendation of the City Engineer, dated October 17, 1990,
which bears the signature of the Finance Director and is approved
for submission by the Mayor, with regard to the traffic signal
modernization on Plymouth Road at Harrison, the Council does
hereby agree to and approve of the City of Livonia participating
in the actual cost of modernization and maintenance of the
said traffic signal control device to the extent of 50%, the
total estimated cost of such modernization being in the amount
of $28,857 00, and the City's estimated cost of participation
being in the amount of $14,428 00, further, the estimated annual
cost for maintenance is $960 00 with the City's estimated cost
of participation being $480.00, and further, the Council does
hereby appropriate and authorize the expenditure of a sum not
to exceed $14,908 00 from Michigan Transportation Funds (Major
Road Account) for this purpose, and the Mayor and City Clerk
are hereby authorized, for and on behalf of the City of Livonia,
to execute the proposed cost agreement submitted in this regard,
and the City Clerk is hereby requested to forward a certified
copy of this resolution, together with the signed cost agreement,
to the Michigan Department of Transportation
#1014-90 RESOLVED, that having considered the report and
recommendation of the Planning Director dated October 24, 1990
and approved for submission by the Mayor, with regard to a
proposed land exchange of property located on the north side
of Ann Arbor Trail between Newburgh Road and Horton Avenue,
the Council does hereby refer this item to the Committee of
the Whole for its report and recommendation
#1015-90 RESOLVED, that having considered a communication
from the Department of Law, dated October 10, 1990, approved
by the Director of Finance and approved for submission by the
Mayor, the Council does hereby authorize the disposal of expired
bonds and/or coupons by means of cremation as provided for
in P A. 1962, No 56, as amended (MCLA 129 121 et seq ), and
does hereby direct the said cremation shall be done in the

presence of the Finance Director (or his representative) and
the Fire Chief (or his representative) and the City Clerk (or
his representative), and such individuals and the appropriate
officer of the paying agent are hereby authorized to execute
the necessary certificate of cremation and to do all things
necessary or incidental to the full performance of this
resolution.
A communication from the City Clerk, dated October 23, 1990 re
Clarenceville School District Tax Levy Rates - December, 1990 was received and
placed on file for the information of the Council
#1016-90 RESOLVED, the Council does hereby request that the
Streets, Roads and Plats Committee submit its report and
recommendation on the question of vehicular parking on public
right-of-way adjacent to the travelled portion of major
thoroughfares.
#1017-90 WHEREAS, pursuant to the direction of the City Council
in its resolution 887-90, adopted on September 24, 1990, and
in accordance with Section 3 08 140 of the Livonia Code of
Ordinances, as amended, the City Assessor of the City of Livonia
has prepared, reported and certified to the Council under date
of October 10, 1990 an assessment roll dated October 10, 1990
for a proposed street lighting improvement consisting of the
installation of 100 watt high pressure sodium lights with
colonial post tops with underground wiring in Caliburn Estates
Subdivision No 1 located in the Northwest 1/4 of Section 8,
City of Livonia, Wayne County, Michigan, containing the special
assessments to be assessed and levied, respectively, in the
proposed special assessment district heretofore established
for the construction and operation of the proposed improvement
in said district as designated in Council Resolution 887-90,
THEREFORE, BE IT RESOLVED, that the said roll is hereby accepted
by the City Council, that it is hereby ordered to be filed
in the office of the City Clerk for public examination, that
the City Clerk be and hereby is directed to give notice as
required by the provisions of Section 3 08 110 of the Livonia
Code of Ordinances, as amended, to wit that the assessment
roll has been made and filed in the office of the City Clerk
for public examination and that the City Council of the City
of Livonia will meet in the City Hall, 33000 Civic Center Drive,
Livonia, Michigan, on Monday, December 17, 1990 at 7 30 p.m
to review the said Special Assessment Roll at which time and
place opportunity will be given to all interested persons to
be heard,
IT IS FURTHER RESOLVED, that the City Clerk be and hereby is
directed to publish a notice of said public hearing at least

once in the official newspaper of the City of Livonia which
is published and circulated generally in and throughout the
said City, at least ten (10) days prior to the aforesaid date
of December 17, 1990, the City Clerk is also directed to give
notice of said hearing by sending written notice thereof by
first class mail to each and every property owner in the proposed
assessment district as their respective names and addresses
appear on the most current assessment roll in the City Assessor's
office.

#1019-90 RESOLVED, that having considered a communication
dated October 23, 1990 from Anthony J. Brooks which, in
accordance with the provisions of Section 19.08 of Ordinance
543, as amended, the Zoning Ordinance, takes an appeal from
a determination made on October 16, 1990 by the City Planning
Commission in its resolution 10-475-90 with regard to the
satellite disc antenna on property located at 14545 Richfield
in Section 19, the Council does hereby designate Monday, December
17, 1990 at 7:30 P.M as the date and time for conducting
a public hearing with regard to this matter, such hearing to
be held at the City Hall, 33000 Civic Center Drive, Livonia,
Michigan; and the City Clerk is hereby requested to do all
things necessary in order to give proper notice in writing,
as well as by the publication of a notice in the City's official
newspaper of such hearing and the date and place thereof, in
compliance with the requirements set forth in Ordinance No.
543, as amended, the Zoning Ordinance of the City of Livonia.
#1020-90 RESOLVED, that having considered a communication
dated October 24, 1990 from Marc E. Thomas, attorney, submitted
on behalf of Ronald Wisnewski which, in accordance with the
provisions of Section 19 08 of Ordinance 543, as amended, the
Zoning Ordinance, takes an appeal from a determination made
on October 16, 1990 by the City Planning Commission in its
resolution 10-476-90 with regard to the satellite disc antenna,
on property located at 9497 Patton in Section 31, the Council
does hereby designate Monday, December 17, 1990 at 7 30 P.M
as the date and time for conducting a public hearing with regard
to this matter, such hearing to be held at the City Hall , 33000
Civic Center Drive, Livonia, Michigan, and the City Clerk is
hereby requested to do all things necessary in order to give
proper notice in writing, as well as by the publication of
a notice in the City's official newspaper of such hearing and
the date and place thereof, in compliance with the requirements
set forth in Ordinance No 543, as amended, the Zoning Ordinance
of the City of Livonia.
#1021-90 RESOLVED, that in accordance with the provisions
set forth in Section 4 of Act 207 of the Public Acts of Michigan
of 1921, as amended, the City Zoning Act (MSA 5.2934, MCLA
125.584), as well as Article XXIII of Ordinance 543, as amended,
the Zoning Ordinance of the City of Livonia, the Council does
hereby determine that a public hearing will take place before
the City Council of the City of Livonia on Wednesday, January
9, 1991 at 7 30 P M. at the City Hall, 33000 Civic Center
Drive, Livonia, Michigan with respect to the following item
Petition 90-4-1-11, submitted by the City Planning
Commission for a change of zoning of property located
south of Five Mile Road between Bainbridge Avenue and
Henry Ruff Road, in the Northwest 1/4 of Section 23 from
M-1 and RUFA to ML and R-1, the City Planning Commission

in its resolution 10-473-90 having recommended to the
City Council that that portion of the petition proposing
a zoning change from M-1 to ML be approved, and the balance
of the petition for a zoning change from RUFA to R-1
be tabled;
FURTHER, THE City Clerk is hereby requested to, no less than
fifteen (15) days prior to the aforesaid date of said public
hearing, cause to have a statement indicating the (a) nature
of the proposed amendment to the Zoning Ordinance, and/or (b)
location of the proposed change of zoning as set forth above,
first to be published in the official newspaper of the City
or a newspaper of general circulation in the City of Livonia
as well as to, not less than fifteen (15) days prior to said
public hearing, cause to have notice to be given by registered
mail to each public utility company and to each railroad company
owning or operating any public utility or railroad within the
districts or zones affected, and further, the City Clerk is
requested to do all other things necessary or incidental to
the full performance of this resolution
#1022-90 RESOLVED, that in accordance with the provisions
set forth in Section 4 of Act 207 of the Public Acts of Michigan
of 1921, as amended, the City Zoning Act (MSA 5.2934, MCLA
125.584), as well as Article XXIII of Ordinance 543, as amended,
the Zoning Ordinance of the City of Livonia, the Council does
hereby determine that a public hearing will take place before
the City Council of the City of Livonia on Monday, December
17, 1990 at 7 30 P M. at the City Hall, 33000 Civic Center
Drive, Livonia, Michigan with respect to the following item
Petition 90-8-1-22, submitted by Charles Tangora for
the Italian Club of Livonia and Dan Arnold for a change
of zoning of property located on the north side of Five
Mile Road, east of the 1-275 Freeway in the Southwest
1/4 of Section 18 from RE to C-2, the City Planning
Commission in its resolution 10-465-90 having recommended
to the City Council that Petition 90-8-1-22 be denied,
FURTHER, THE City Clerk is hereby requested to, no less than
fifteen (15) days prior to the aforesaid date of said public
hearing, cause to have a statement indicating the (a) nature
of the proposed amendment to the Zoning Ordinance, and/or (b)
location of the proposed change of zoning as set forth above,
first to be published in the official newspaper of the City
or a newspaper of general circulation in the City of Livonia

#1023-90 RESOLVED, that in accordance with the provisions
set forth in Section 4 of Act 207 of the Public Acts of Michigan

the Zoning Ordinance of the City of Livonia, the Council does
hereby determine that a public hearing will take place before
the City Council of the City of Livonia on Wednesday, January
9, 1991 at 7:30 P.M. at the City Hall, 33000 Civic Center
Drive, Livonia, Michigan with respect to the following item:
(1 ) Petition 90-9-1-23, submitted by Jerry Brady for
A DelGuidice for a change of zoning of property
located on the northeast corner of Bretton and
Middlebelt in the Southwest 1/4 of Section 1 from
OS to C-1, the City Planning Commission in its
resolution 10-466-90 having recommended to the City
Council that Petition 90-9-1-23 be denied,
(2) Petition 90-8-6-6, submitted by the City Planning
Commission to determine whether to amend Section
10.03 of Zoning Ordinance 543 so as to provide for
the addition of Carry -Out Restaurants and Limited
Service Restaurants as waiver uses in the C-1 zoning
District, the City Planning Commission in its
resolution 10-470-90 having recommended to the City
Council that Petition 90-8-6-6 be denied,
(3) Petition 90-8-6-5, submitted by the City Planning
Commission to determine whether to amend Section
3 01 of Zoning Ordinance 543 so as to change the
name of the PS district to OS and to list the three
new zoning districts, NP, Nature Preserves, R -C,
Condominium Residential, and R -8C, High Rise
Condominium Residential, the City Planning Commission
in its resolution 10-469-90 having recommended to
the City Council that Petition 90-8-6-5 be approved,
(4) Petition 90-9-6-8, submitted by the City Planning
Commission to determine whether to amend various
sections of Zoning Ordinance 543 so as to insert
the zoning designation of OS in place of PS and to
add reference to NP, R -C and R -8C where applicable,
the City Planning Commission in its resolution 10-471-
90 having recommended to the City Council that Petition
90-9-6-8 be approved,
FURTHER, THE City Clerk is hereby requested to, no less than
fifteen (15) days prior to the aforesaid date of said public

On a motion by Councilman Jurcisin, seconded by Councilman Bishop,
and unanimously adopted, it was
#1024-90 RESOLVED, that having considered the report and
recommendation of the Capital Improvement Committee dated October
29, 1990, and submitted pursuant to Council Resolution 1107-89
with regard to the proposed 120 unit senior citizen housing
development on certain City -owned land located on the west
side of Newburgh Road between Amrhein Road and Plymouth Road,
and having also considered a report and recommendation from
the Housing Director dated October 22, 1990, approved for
submission by the Mayor to which is attached a letter from
Camborne Construction Engineering, Inc. dated October 26, 1990,
and having also considered the report and recommendation of
the Housing Director dated October 30, 1990, approved for
submission by the Mayor, to which is attached the amended budget
for "Newburgh Village" which is as follows

recommendation of the Capital Improvement Committee dated October
29, 1990, and submitted pursuant to Council Resolution 1107-89
with regard to the proposed 120 unit senior citizen housing
development on certain City -owned land located on the west side
of Newburgh Road between Amrhein Road and Plymouth Road, and
having also considered a report and recommendation from the
Housing Director dated October 22, 1990, approved for submission
by the Mayor to which is attached a letter from Camborne
Construction Engineering, Inc dated October 26, 1990, the Council
does hereby take this means to indicate that it approves Building
Elevation Plan B
On a motion by Councilman Jurcisin, seconded by Councilman Bishop,
and unanimously adopted, it was

recommendation of the Capital Improvement Committee dated October
29, 1990, and submitted pursuant to Council Resolution 1107-89
with regard to the proposed 120 unit senior citizen housing
development on certain City -owned land located on the west side
of Newburgh Road between Amrhein Road and Plymouth Road, and
having also considered a report and recommendation from the
Housing Director dated October 22, 1990, approved for submission
by the Mayor to which is attached a letter from Camborne
Construction Engineering, Inc. dated October 26, 1990, the Council
does hereby take this means to indicate that the name of the
project is hereby designated and shall henceforth be "Newburgh
Village "
On a motion by Councilman Jurcisin, seconded by Councilman Bishop,
and unanimously adopted, it was
#1027-90 RESOLVED, that having considered the report and
recommendation of the Capital Improvement Committee dated October
29, 1990, and submitted pursuant to Council Resolution 952-86
in connection with a communication from the Mayor dated September
16, 1986 and a communication from the Cable Television Commission
dated September 29, 1986, approved for submission by the Mayor,
with regard to proposals received for professional design services
for a comprehensive program for Civic Center signage, the Council
does hereby refer this item to the Mayor for a report and
recommendation insofar as funding sources are concerned, as
well as for the preparation of specifications and thereafter
the taking of competitive bids in order to implement this project
On a motion by Councilman Jurcisin, seconded by Councilman Taylor,
and unanimously adopted, it was
#1028-90 RESOLVED, that having considered the report and
recommendation of the Capital Improvement Committee dated October
29, 1990 and submitted pursuant to Council Resolution 116-89,
and having also considered a letter from Mayor Bennett dated
October 29, 1990, where it is recommended that the name of
Bicentennial Park be changed to Edward H. McNamara -Bicentennial
Park, the Council does hereby concur in this recommendation
and requests that the Department of Law prepare an amendment
to paragraph 39 of Section 12.16.010 in order to implement the
action taken herein.

CODE) OF TITLE 15 OF THE LIVONIA CODE OF
ORDINANCES, AS AMENDED
A roll call vote was taken on the foregoing Ordinance with the following result
AYES. Ochala, Toy, Bishop, Taylor, Jurcisin and McCotter.
NAYS: None
The President declared the foregoing Ordinance duly adopted, and would become
effective on publication.

AN ORDINANCE AMENDING SECTION 2 OF THE
ZONING MAP OF THE CITY OF LIVONIA AND
AMENDING ARTICLE III OF ORDINANCE NO.
543, AS AMENDED, KNOWN AND CITED AS "THE
CITY OF LIVONIA ZONING ORDINANCE" BY ADDING
SECTION 3 THERETO. (Petition 90-3-1-8)
The foregoing Ordinance, when adopted, is filed in the Journal of Ordinances
in the office of the City Clerk and is the same as if word for word repeated
herein The above Ordinance was placed on the table for consideration at the
next regular meeting
On a motion by Councilman Taylor, seconded by Councilwoman Toy,
and unanimously adopted, it was I
L#1029-90 RESOLVED, that having considered a letter from the
principal of Clarenceville Middle School dated October 15, 1990,
wherein a request is submitted for a waiver of fees on permits
for a carnival which is to take place at the Clarenceville Middle
School on April 18, 19, 20 and 21, 1991, and which also requests
police protection, trash pick-up and a city dumpster, the Council
does hereby refer this item to the Mayor for his report and
recommendation.

so as to permit consideration of several items that do not appear

and unanimously adopted, it was
#1033-90 RESOLVED, that the Council does hereby amend and revise
Council Resolution 989-90, adopted on October 24, 1990, so as
to have the same read as follows
RESOLVED, that pursuant to Section 5, Chapter VII
and Section 1 of Chapter VIII of the Charter of the City of
Livonia, the Council does hereby establish a tax levy of 4.66
mills, of the State equalized assessed valuation of all real
and personal property subject to taxation in the City of Livonia
for the next fiscal year commencing December 1, 1990, and ending

November 30, 1991, and in addition to the above amount which
is authorized to be levied for general purposes by the Charter
of the City of Livonia
(a) The Council does hereby establish a tax levy
of 9006 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above, pursuant to Section
1 of Chapter VIII of the Charter of the City of Livonia, for
the purpose of providing additional revenues for police protection
and law enforcement personnel, equipment, supplies and facilities
of the City of Livonia, in addition to the amount authorized
to be levied for general municipal purposes,
(b) The Council does hereby establish a tax levy
of 1 3756 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above, pursuant to Section
1 of Chapter VIII of the Charter of the City of Livonia, for
the purpose of providing additional revenues for fire, police
and snow removal personnel, equipment, supplies and facilities
of the City of Livonia, in addition to the amount authorized
to be levied for general municipal purposes,
(c) The Council does hereby establish a tax levy,
of .9006 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above, pursuant to Section
1 of Chapter VIII of the Charter of the City of Livonia, for
the purpose of providing additional revenues for Library services,
supplies and facilities of the City of Livonia, in addition
to the amount authorized to be levied for general municipal
purposes,
(d) The Council does hereby establish a tax levy
of 0184 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above, pursuant to the
provisions of Act 379 of the Public Acts of 1925, for the purpose
of advertising, exploiting and making known the industrial and
commercial advantages of the City of Livonia and to establish
projects for the purpose of encouraging immigration to, and
increasing the trade, business and industries of the City of
Livonia, in addition to the amount which is authorized to be
levied for general municipal purposes,
(e) The Council does hereby establish a tax levy
of 1 8846 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above, pursuant to the
provisions of the Public Acts of 1917, for the purpose of
establishing, operating, maintaining and administering the

Municipal Garbage Collection System and/or plant for the
collection and disposal of garbage and refuse in the City of
Livonia, in addition to the amount which is authorized to be
levied for general municipal purposes,
(f) The Council does hereby establish a tax levy
of .0569 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above for the purpose
of debt retirement on the 1959, 1965 and 1968 Fire Station Bond
Issue, in addition to the amount which is authorized to be levied
for general municipal purposes,
(g) The Council does hereby establish a tax levy
of .1250 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above for the purpose
of debt retirement on the Park; and Recreational Facilities Bond
Issue, Series I and Series II, in addition to the amount which
is authorized to be levied for general municipal purposes,
(h) The Council does hereby establish a tax levy
of 3764 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above for the purpose
of debt retirement on the 1978 Street Improvement Bonds, Series
I, Series II and Series III, in addition to the amount which
is authorized to be levied for general municipal purposes,
(i) The Council does hereby establish a tax levy
of 0663 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above for the purpose
of debt retirement on the 1990 Street Improvement Bond, Series
I, in addition to the amount which is authorized to be levied
for general municipal purposes,
(j) The Council does hereby establish a tax levy
of .375 mills, of the State equalized assessed valuation of
all real and personal property subject to taxation in the City
of Livonia for the fiscal year set out above for the purpose
of defraying City expenses and liabilities for the collection
and disposal activities required for curbside recycling and
yard waste composting programs, in addition to the amount which
is authorized to be levied for general municipal purposes,
and provided further, that the Wayne County Bureau of Taxation,
City Assessor, City Treasurer and City Clerk are hereby authorized
and directed to do all things necessary or incidental to the
full performance of this resolution, and the City Clerk is hereby
requested to immediately transmit copies of this resolution
to each of the above offices

Annual Budget, as revised by reason of the adoption of the Charter
Amendment for recycling and composting at the election conducted
on November 6, 1990, and the balance of Council Resolution 988-90,
adopted on October 24, 1990, which previously approved the Annual
Budget for the fiscal year commencing December 1, 1990 and ending
November 30, 1991, is hereby incorporated by reference and is
to continue in full force and effect, except as revised herein.
