Councilwoman McCotter delivered the invocation. Roll was called with the following result Present Robert E. Nash, City Clerk, Harry Tatigian, City Attorney, John Nagy, Planning Director, Raul Galindo, City Engineer, Marilyn Kazmer, Director of Legislative Affairs, and John J Fegan, Director of Building Inspection. lir On a motion by Councilman Taylor, seconded by Councilman Bishop, and unanimously adopted, it was #1141-87 RESOLVED, that the minutes of the 1 ,116th Regular Meeting of the Council of the City of Livonia, held November 23, 1987 are hereby approved On a motion unanimously introduced, supported and adopted, it was #1142-87 WHEREAS, Schoolcraft College has consistently fielded superb athletic teams, winning many regional , state and national awards in both men' s and women's sports, and WHEREAS, Dr Marvin Gans has guided the College' s efforts in maintaining athletic excellence in and outside the classroom as the College's Director of Athletics for the past twenty-three years, and WHEREAS, Marvin Gans, this year, leaves the position as Director of Athletics and of championship teams, and in a fitting departure to him we recognize the College' s National Junior College Athletic Association Soccer Champions, and imwWHEREAS, Schoolcraft College' s National Championship Socce- Team compiled a record of 15-2-3, and 23790 WHEREAS, Schoolcraft College' s Soccer Team defeated the #1 ranked Nassau, New York Community College team for the National Title with a 4-0 shutout, and WHEREAS, The Schoolcraft College Soccer Team, with Coach Nick O'Shea and Assistant Coach Lisa Griffin took their team which was injured and shorthanded to the national title, and the City of Livonia hereby acknowledges, congratulates and commends Marvin Gans, Nick O'Shea and Assistant Coach Lisa Griffin and team members Suzanne Abdilla Mary Hussey, Co-Captain Shari Acitelli Lisa Hysko Jennifer Belhart Jamie Kubacki Kelly Churchill , Co-Captain Kathryn Long Jennifer Flowers Laurie McLachlan Maureen Frampus Cheryl Saunders Kristi Green Shelly Tutor Kelly Holzwart Amy Weber Jennifer Huegli , Co-Captain NOW, THEREFORE, BE IT RESOLVED that for their outstanding efforts in representing the College and the community with dignity and honor, the City Council wishes to applaud the success of the aforementioned individuals A communication from the Director of Finance, dated November 24, 1987, forwarding various financial statements of the City of Livonia for the month ending October 31 , 1987 was received and placed on file for the information of the Council . Middlebelt, the Council does hereby refer this item to the Engineering Department for its report and recommendation. #1144-87 RESOLVED, that having considered a letter from Thomas J McGillis, 43541 Galway, Northville, Michigan 48167, dated November 16, 1987, wherein the request is submitted for permission to conduct a St. Patricks Day parade in Livonia, on March 12, 1988, the Council does hereby request that the Parks and Recreation Commission and the Chief of Police submit their respective reports and recommendations, and the Council does 23791 iim further refer this subject to the Committee of the Whole for further consideration #1145-87 RESOLVED, that having considered a letter from United Homes, Inc. , dated November 17, 1987, wherein an offer in the amount of $5,000 00 is submitted for the purchase of the South 82 5 feet of Lot 96 of the Garden Farms Subdivision, which parcel is located on Inkster Road, South of Seven Mile Road, the Council does hereby refer this item to the Department of Law for its report and recommendation 11146-87 RESOLVED, that having considered a letter from Dean R Iler, 15950 Norwich, and George A Bisel , 36039 Six Mile Road, dated September 11 , 1987 , wherein it is suggested that permanent video records be kept of all future regular and study session meetings of the City Council , and that they be archived in the new Civic Center Library, the Council does hereby refer this item to the Legislative Committee for its report and recommendation #1147-87 RESOLVED, that having considered the report and recommendation of the Superintendent of Parks and Recreation, dated November 17, 1987, approved by the Finance Director, and approved for submission by the Mayor Pro Tem, the Council does imp hereby accept the low bids which meet specifications as set forth in the attached tabulation for athletic equipment for 1988 #1148-87 RESOLVED, that having considered the report and recommendation of the Superintendent of Parks and Recreation, dated November 17, 1987, approved by the Finance Director, and approved for submission by the Mayor Pro Tem, wherein it is recommended that the City Park Site located in the area of Bridge and St Francis be cleared and grubbed, and that downed trees be removed, the Council does hereby refer this item to the Department of Public Works for handling and implementation in accordance with the aforesaid recommendation #1149-87 WHEREAS, the City of Livonia, Michigan, (herein called the "Local Governing Body") acting by and through the Livonia Housing Commission (herein called the "Local Authority"), and the United States of America (herein called the "Government") as of the 7th day of December, 1987, entered into a certain Annual Contributions Contract to assist in the development of certain low-rent housing, identified therein as Project No MICH. 55-1 and 55-2, and WHEREAS, the Local Authority and the Government desire to modify the terms of said Annual Contributions Contract, BE IT RESOLVED BY THE LOCAL AUTHORITY AS FOLLOWS• 23792 The Local Authority shall enter into an amendatory agreement with the Government, modifying the terms of the Annual Contributions Contract, and the Tem, the Council does hereby accept the bid of Tennyson Car & Truck Rental , 32570 Plymouth Road, Livonia, Michigan 48150, for leasing 9 surveillance vehicles to the Division of Police for a one (1 ) year period, for a total price in the amount of $40,788 00, the same having been in fact the lowest bid received and meets all specifications #1151-87 RESOLVED, that having considered the communication from the Planning Director, dated November 17, 1987, to which is attached a landscape plan submitted in behalf of the Wonderland Mall in connection with the Sign Permit Application conditionally 166 approved in Council Resolution 1038-87, for a ground sign to be located at 29901 Plymouth Road, the Council does hereby approve the said landscape plan and authorize the issuance of the sign permit application #1152-87 RESOLVED, that having considered a communication dated September 28, 1987, from the Department of Law transmitting for Council acceptance a Grant of Easement, more particularly described as Grant of Easement dated September 16, 1987, executed by James P Harms and Patricia L. Harms, his wife, for A twenty (20) foot wide easement for open ditch and storm drainage, being a part of Lot 26, Fitzgerald Gardens Subdivision, as recorded in Liber 68, Page 95, Wayne County Records, said subdivision being a part of the S.W. 1/4 of Section 5, T.1S , R 9E , Livonia Township (now City of Livonia), Wayne County, Michigan the centerline of said 20 ft wide easement beginning at a point located N. 89°14'30" W 106.5 ft. and N 00°23' 50" E. 10 00 ft from the S E corner of said Lot 26, thence along said centerline N 89°14' 30" W 21 00 ft. , thence N 20°06' 51 " W 64 21 ft to the point of ending of said 20 ft. wide easement said point of ending located N 89°14' 30" W. 150 0 ft. from the N E corner of said Lot 26 and said easement lying entirely within said Lot 26 23793 the Council does hereby for and in behalf of the City of Livonia accept the aforesaid Grant of Easement and the City Clerk is hereby requested to have the same recorded in the office of the Register of Deeds and to do all other things necessary or incidental to fulfill the purpose of this resolution #1153-87 RESOLVED, that having considered Petition 87-9-3-9 submitted by James P. Harms, 30923 W Warren, #29-S, Westland, Michigan 48185, dated September 14, 1987, wherein a request is submitted to vacate a 10 ft drainage easement across Lot 26, Fitzgerald Gardens Subdivision, the Council does hereby refer this item to the City Planning Commission for action and recommendation in accordance with provisions of law and City Ordinance. #1154-87 RESOLVED, that having considered the communication from the City Planning Commission, dated November 17, 1987, which transmits its Resolution 10-254-87, adopted on October 27, 1987, with regard to a revised site plan submitted in connection with Petition 85-3-8-3, which was a proposal to construct a four story office building on the south side of Six Mile Road between 1-275 and Haggerty in Section 18, pursuant to the provisions set forth in Section 18.47 of Ordinance 543, as amended, the Council does hereby concur in the recommendation of the Planning Commission and the revised site plan is hereby approved and granted, such approval to be based upon the same conditions as those set forth in the aforesaid recommendation of the Planning Commission #1155-87 RESOLVED, that having considered a communication from the City Planning Commission dated November 4, 1987 , which transmits its Resolution 10-251-87 adopted on October 27 , 1987, with regard to the proposed preliminary plat of Regency Circle Subdivision to be located on the north side of Joy Road between Hix and Pere Avenue in the Southwest 1/4 of Section 31 , City of Livonia, Wayne County, Michigan, and it appearing that tentative approval was given by the City Planning Commission, after due notice and a public hearing on October 27, 1987 , the City Council does hereby approve of the said preliminary plat subject to the receipt of the report and recommendation by the City Engineer relative to the development plans and specifications for the improvements therein, and the financial assurances guaranteeing the satisfactory installation of such improvements. 11156-87 RESOLVED, that having considered the report and recommendation of the City Engineer, dated November 12, 1987, and approved for submission by the Mayor Pro Tem in connection with the development of Greenwood Pets & Plants at 28980 Joy Road, the Council does hereby determine as follows' 1 . To advise the Wayne County Public Service Division (Permit Section) of the City' s willingness to accept jurisdiction 23794 and maintenance of a 4-inch storm sewer (approximately 25 1 f ) connection to an existing 12" storm sewer within the Joy Road Right-of-Way in connection with the development of Greenwood Pets 8 Plants, located on the north side of Joy Road in the Southwest 1/4 of Section 36, (the owners are to reimburse the City for any such maintenance that may become necessary) , and 2. To authorize the City Engineer to execute a Wayne County permit on behalf of the City of Livonia in connection with the above storm sewer construction #1157-87 RESOLVED, that having considered the report and recommendation of the City Engineer, dated November 17, 1987, approved for submission by the Mayor Pro Tem, with regard to the Kentucky Fried Chicken development at 13485 Farmington Road, the Council does hereby determine as follows 1 . To advise the Wayne County Public Service Division (Permit Section) of the City's willingness to accept jurisdiction and maintenance of a 15-inch storm sewer (approximately 25 1 .f. ) connection to an existing 36" storm sewer within the Farmington Road Right-of-Way in connection with the development of Kentucky Fried Chicken, located on the west side of Farmington Road in the Northeast 1/4 of Section 28 (the owners are to reimburse the City for any such maintenance that may become necessary) ; and 2 To authorize the City Engineer to execute a Wayne County permit on behalf of the City of Livonia in connection with the above storm sewer construction #1158-87 RESOLVED, that having considered a communication from the City Engineer dated November 13, 1987, approved for submission by the Mayor Pro Tem, recommending that the City dedicate a 20 ft. wide easement for storm sewer purposes across Helman Parksite in the Southwest 1/4 of Section 9, City of Livonia, Wayne County, Michigan, the Council does hereby determine to dedicate and establish for storm sewer purposes only the following described easement: A 20 foot wide storm sewer easement described as the South 20 ft of the West 360 ft of the following parcel of land The West 3/4 of the S.W. 1/4 of Section 9, T.1S ,R 9E. , City of Livonia, Wayne County, Michigan except the South 1210 ft. thereof, also except that part beginning at the W. 1/4 corner of Section 9, thence S 1435 ft. ,thence N. 89°47'45" E. 910 ft , thence N. 9°53' 30" W 294 11 ft , thence N. 10°21 '40" E. 275.30 ft , thence N 10°17'20" W. 171 .99 ft. , thence N 25°50'32" W. 183.19 ft , thence N. 2°25' 50" E 165.13 ft. , thence N. 23795 7°15'20" E 166.25 ft , thence N 33°31 '40" E 195 22 ft. , thence N. 43 ft. , thence N 89°48' 10" W 915 ft. to the point of beginning, also except the North 43 ft of the East 1075 ft. thereof. and the Council does further request that the Wayne County Bureau of Taxation record such easement dedication on all maps issued by that office, and further the City Clerk is hereby requested to have a certified copy of this resolution recorded in the Wayne County Register of Deeds Office #1159-87 RESOLVED, that the Council does hereby request that the City Engineer submit a report and recommendation with respect to the filling of the flood plain along the creek located adjacent to Lots 3 - 8 of the Hidden Creek Subdivision in the Southwest 1/4 of Section 9 A communication from the Regional Manager of MetroVision of Livonia, Inc. , dated November 13, 1987 forwarding the MetroVision Fourth Annual Report was received and placed on file for the information of the Council #11601-87 RESOLVED, that the Council does hereby request that the Cable Television Commission submit its report and recommendation on the current status of the implementation, if any, of the recommendations set forth in the Cable Television System Franchise Compliance Audit dated April , 1986, prepared by Carl Pilnik, Telecommunications Management Corporation #1161-87 RESOLVED, that having considered the communication from the Cable Television Commission dated November 9, 1987, which transmits its Resolution 96-87 , wherein it is recommended that Metrovision be authorized to purchase the CATV equipment for municipal and community access at the main library and the City Hall , in an amount not to exceed $73,406 00, as set forth in the attachment, the Council does hereby concur in and approve of such action. #1162-87 RESOLVED, that having considered a communication from the Department of Law, dated November 17, 1987, submitted pursuant to Council Resolution 453-87, in which Creative Investments offer to purchase vacant property at 17471 Louise and 17551 Louise, and a letter of May 19, 1987, in which United Homes, Inc. , offer to purchase this same property, the Council does hereby determine to take no further action with regard to these requests. #1163-87 RESOLVED, that having considered a communication from the Department of Law, dated November 17, 1987, submitted pursuant to Council Resolution 453-87 in connection with a letter from Creative Investments, 25621 Rutledge Crossing, Farmington Hills, 23796 Michigan 48018, wherein an offer of $5,700 is submitted for the purchase of certain City-owned property located at the southeast corner of Five Mile Road and Henry Ruff Road, being Tax Item 46-089-01-001-000, and having also considered a letter from United Homes, Inc , dated May 19, 1987, wherein an offer of $6,050 00 is submitted, the Council does hereby refer this item to the Finance Director for the preparation of specifications and thereafter the taking of competitive bids for the disposition of this property in accordance with the provisions of the Finance Ordinance, to thereafter be submitted to the Council for its consideration #1164-87 WHEREAS, the City of Livonia finds that there is an urgent necessity for Newburgh Road to be widened and improved between Joy Road, its southern City limit, and Edward Hines Drive, in Sections 31 and 32 in the City of Livonia, Wayne County, Michigan, and WHEREAS, the Council finds that it is necessary to widen and alter Newburgh Road in this area in order to facilitate the flow of traffic and to alleviate traffic congestion as a matter of public safety and convenience and to promote the public welfare generally; and WHEREAS, the Council further finds that the acquisition of certain rights-of-way, as further described hereinafter, is indispensable to the necessary widening, paving, altering and improvement of Newburgh Road, and WHEREAS, the City Engineer has recommended that Newburgh Road be widened and altered so as to provide a one hundred twenty (120) foot right-of-way, similar to existing roads which are located throughout the City, and has presented plans which have been approved by this Council , and WHEREAS, the aforesaid improvement is to be financed from part of the proceeds of the 7.9 Million Dollar General Obligation Road Improvement Bond Issue approved by the electorate of the City in 1977; and WHEREAS, Newburgh Road between Joy Road and Edward Hines Drive in Livonia is a City road under the jurisdiction and control of the City of Livonia and is incorporated in the Master Plan of the City of Livonia as part of the Master Thoroughfare Plan, having been incorporated in said Master Thoroughfare Plan by a resolution of the City Planning Commission adopted on April 19, 1951 ; NOW, THEREFORE, BE IT RESOLVED that this Council for the City of Livonia, Wayne County, Michigan, hereby declares that the acquisition of certain rights-of-way, as hereinafter described, is necessary for the widening, paving, altering and improvement 23797 of Newburgh Road which is necessary as a public improvement for the use and benefit of the public, for the purposes of its incorporation, for a public purpose within the scope of its power, and that good faith offers to purchase said rights-of-way have been made to all known property owners, and BE IT FURTHER RESOLVED, that this Council does hereby declare that it determines it necessary to take the fee to private property upon just compensation to be paid therefor for such improvement, the said properties necessary for the required rights-of-way and the just compensation for same being as follows (1 ) Land in the City of Livonia, Wayne County, Michigan, being a part of the Northeast quarter of Section 31 , T 1 S , R 9 E. , more particularly described as Lots 2 and 3, Horton' s Newburgh Subdivision, as recorded in Liber 37 of Plats, page 67, Wayne County Records.
