HomeMy WebLinkAboutCOUNCIL MINUTES 1966-04-13 Page 7843 MINUTES OF THE FIVE HUNDRED THIRTY-FOURTH REGULAR MEETING OF THE COUNCIL OF THE CITY OF LIVONIA On April 13, 1966, the above meeting was held at the City Hall, 33001 Five Mile Road, Livonia, Michigan, and was called to order by the President of the Council at approximately 8:16 P. M. Councilman Kleinert delivered the invocation. Roll was called with the following result: Present--Peter A. Ventura, Rudolf R. Kleinert, *Edward H. McNamara, Robert F. Nash, Jack Salvadore, and Edward G. Milligan. Absent--James R. McCann. Elected and appointed officials present: Addison W. Bacon, City Clerk; Steve Polgar, City Attorney; Harry C. Tatigian, first Assistant City Attorney; Joel LaBo, Director of Public Safety; John Dufour, Superintendent of Parks and Recreation; Robert A. Shaw, Director of Public Works; Carl E. Demek, Superintendent of Operations; Richard Jones, Assistant Superintendent of Operations; William J. L Strasser, City Engineer; Don Hull, City Planner; David L. Jones, Water & Sewer Commissioner; Avram Rosenthal, Library Director; Victor C. Phillips, Budget Director; Thomas J. Griffiths, Jr. , Chief Accountant; Henry G. Sieferd, City Assessor; Ronald L. Nisun, Constable, and Joseph C. Keane, Constable. By Councilman Kleinert, seconded by Councilman Nash, and unanimously adopted, it was #371-66 RESOLVED, that the minutes of the 533rd regular meeting of the Council of the City of Livonia held on April 11, 1966, are hereby approved. By Councilman Kleinert, seconded by Councilman Salvadore, it was #372-66 RESOLVED, that having considered the three letters from the Mayor, each dated April 13, 1966, relative to the creation of Position of Assistant Development Coordinator, to the establishment of a temporary appointed full-time Recreational and Open-Space Co-ordinator, and the recommendation that the position of Director of Public Safety be placed on a full time basis, the Council does hereby acknowledge receipt of same and does refer these matters to the Committee of the Whole for their report and recommendations. iiimiA roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Salvadore, Nash, Milligan, and Ventura. Page 7844 By Councilman Milligan, seconded by Councilman Kleinert, it was #373-66 RESOLVED, that having considered a communication from the Chief City Engineer dated March 28, 1966, approved by the Director of Public Works, regarding the proper development of Newburgh Road in a manner so as to provide for the orderly installation of sanitary sewer lines, water mains and storm sewers, the Council does hereby request that the Board of Education for the Livonia School District dedicate the West 60 feet of Bureau of Taxation Parcel 17E1b2„ E2b, Hlb, H2 and Parcel 08H2a, H2b1 for this purpose without reservations or qualifica- tions. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Salvadore, Nash, Milligan, and Ventura. NAYS: None. By Councilman Kleinert, seconded by Councilman Salvadore, it was #374-66 RESOLVED, that having considered a communication dated March 31, 1966 from the Department of Law and the Grant of Easement attached thereto, submitted pursuant to council resolution #320-66, which grant is dated March 30, 1966 executed by Homer Lucht, also known as Homer Lute and Viola Lucht, his wife, also known as Viola Lute, conveying an easement in connection with the construction of the Newburgh Road Water Trans- mission Main as follows: The east 10 feet of the west 60 feet of that part of the S. W. 1/4 of Section 5, T. 1 S. , R. 9 E. , City of Livonia, Wayne County, Michigan, described as beginning at a point on the West line of said section distant North 1092.75 feet from the S. W. corner of Section 5 and proceeding thence East, 262.45 feet; thence North, 186.0 feet; thence West, 262.45 ft; thence south 186.0 feet to the point of beginning. (Parcel 05C2) the Council does hereby accept for and in behalf of the City of Livonia the aforesaid Grant of Easement and the City Clerk is hereby requested to have the same recorded with the Wayne County Register of Deeds Office and to do all other things necessary or incidental to the full perform- ance of this resolution. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Salvadore, Nash, Milligan, and Ventura. NAYS: None. By Councilman Milligan, seconded by Councilman Kleinert, it was #375-66 RESOLVED, that having considered a communication dated April 7, 1966 from the Department of Law and the Grant of Easement dated April 5, 1966 attached thereto, submitted pursuant to council resolution No. 243-66, executed by William S. Lute and Mary Rose Lute, his wife, conveying to the City of Livonia an easement in connection with the Page 7845 construction of the Newburgh Road Water Transmission Main, as follows: The East 10 feet of the West 60 feet of the following described parcel: That part of the S. W. 1/4 of Section 5, T. 1 S. , R. 9 E. , City of Livonia described as beginning at a point on the W. line of said section distant north, 925.40 feet from the S. W. corner of Section 5 and proceeding thence north along said W. line, 166.39 feet; thence N. 89° 06' E, 261.80 feet; thence south 166.39 feet; thence S. 89° 06' W, 261.80 feet to the point of beginning. the Council does hereby accept for and in behalf of the City of Livonia the aforesaid Grant of Easement and the City Clerk is hereby requested to have the same recorded with the Wayne County Register of Deeds Office and to do all other things necessary or incidental to the full perform- ance of this resolution. By Councilman Kleinert, seconded by Councilman Nash, it was #376-66 RESOLVED, that having considered a communication dated March 30, 1966 from the Department of Law and the two Grants of Easements attached thereto, submitted pursuant to council resolution No. 243-66, which grants convey to the City of Livonia easements in connection with the construction of the Newburgh Road Water Transmission Main and more particularly de- scribed as follows: Grant of Easement dated March 25, 1966 executed by Marion J. Franjac and Grace M. Franjac, his wife, conveying an easement being more particularly described as follows: Beginning at a point on the south line of Eight Mile Road (120 feet wide) distant S 0° 00' 50" E, 60.0 feet and N 89° 45' 30" E, 90.94 feet from the N. W. corner of Section 5, T. 1 S., R. 9 E , City of Ligonia, Wayne County, Michigan and proceeding thence N 89 45' 30" E, 45.0 feet along said south line of Eight Mile Road; thence S 44° 45' 30" W, 70.39 feet; thence N 5° 14' 10" E, 50.00 feet to the point of beginning, said easement being a part of the following described parcel: That part of the N. W. 1/4 of Section 5, T. 1 S. , R. 9 E. , City of Livonia, Wayne County, Michigan, described as beginning at a point on the W. section line distant S 0° 00' 50" E, 60 ft. from th8 N. W. corner of Section 5 and proceeding thence S 0 00' 50" E along said line, 226.94 ft; thence S 58° 52' 20" E, 159.e ft; thence N 72° 53' 30" E, 146.98 ft; thence S 88 17' 30" E, 113.32 ft; thence N 0° 00' 50" W, 271 ft; thence S 89° 45' 30" W along the S. line of Eight Mile Road, 390 feet to the point of beginning. Page 7846 Grant of Easement dated March 29, 1966 from Charles Lute, a single man, conveying the east 10 feet of the west 60 feet of the following described parcel: The west 75 acres of the S. W. 1/4 of Section 5, T. 1 S. , R. 9 E. , City of Livonia, Wayne County, Michigan, except the north 186.0 ft. of the south 1278.75 ft. of the west 262.45 ft. thereof; also except the south 478.50 ft. of the west 455.17 ft. thereof ; also except that part thereof described as beginning at a point on the W. line of said section distant north, 925.40 feet from the S. W. corner of Sec. 5 and proceeding thence north along said line, 166.39 ft. ; thence N 89° 06' E. , 261.80 ft. ; thence south, 166.39 ft. ; thence S. 89° 06' W. , 261.80 ft. to the point of beginning; also except that part thereof described as beginning at a point on the E. and W. 1/4 section line distant S. 89° 39' 50" E., 511.63 ft. from the W. l/4 corner of Sec. 5 and proceeding thence S 89° 39' 50" E., along said line, 742.26 ft. thence S. 0° 25' 35" W. , 1474.06 ft. ; thence N. 89° 12' 45" W. , 738.25 ft. ; thence N. , 0° 16' 10" E, 1468.24 ft to the point of beginning. the Council does hereby accept for and in behalf of the City of Livonia the aforesaid Grants of Easements and the City Clerk is hereby requested to have the same recorded with the Wayne County Register of Deeds Office and to do all other things necessary or incidental to the full perform- ance of this resolution. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Salvadore, Nash, Milligan, and Ventura. NAYS: None. By Councilman Salvadore, seconded by Councilman Kleinert, it was #377-66 RESOLVED, that having considered a letter from the Chief City Engineer dated April 1, 1966, approved by the Mayor, Director of Public Works and Budget Director, which requests funds sufficient to provide a desk and chair for an additional Clerk-Typist I employed in the office of the Engineering Division, the Council does hereby approve and concur in the said request and the sum of $248.68 is hereby transferred from Engineering Division Account No. 256-1 to Engineering Division Account No. 255-70 for this purpose. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Salvadore, Nash, Milligan, and Ventura. NAYS: None. The communication from the Mayor dated March 30, 1966, regarding a meet- ing to discuss the I-96 location, was received and filed for the information of the Council. The communication from Robert F. Nash, dated April 8, 1966, which submits his resignation from the Zoning Board of Appeals, was received and filed. Page 7847 *Councilman McNamara arrived at 8:33 P. M. By Councilman Milligan, seconded by Councilman Nash, it was #378-66 RESOLVED, that having considered certain alternate proposals which were submitted at a meeting conducted on April 12, 1966 by the Michigan State Highway Department to the City of Livonia as well as officials of the Schoolcraft College regarding the route location of the north/south segment of the I-96 Freeway where the same is proposed to traverse the City of Livonia, the Council does hereby take this means to advise the State Highway Department that the City of Livonia prefers and would approve the location of the same as set forth in the proposed alternate route #3, which location would be along the City's westerly limits i.e. Haggerty Road, and which route would be developed in an urban highway treatment, the estimated cost of which would be in the amount of $12,800,000.00 for this approximately three mile segment, and which sum compares favorably with the proposed construction of the said I-96 Freeway for a three mile stretch from Southfield Road to the westerly limits of the City of Detroit which is estimated to cost in excess of 37-1/2 million dollars; and further, the Council does hereby state that it is its understanding that the proposed construction of the I-96 highway along the Haggerty Road route would be in a manner so as to provide at least a distance of 143 feet from the edge of the right-of-way to the nearest building presently constructed on the campus of Schoolcraft College, the Administration Building, and that the said building would be in excess of 260 feet from the freeway construction itself, provided, however, that such approval is contingent upon the State Highway Department supplying the necessary funds for the widening and improvement of Plymouth Road in a manner satisfactory to the City of Livonia; and further, the Council hereby requests that certified copies of this resolution be transmitted by the City Clerk to the Mich- igan State Highway Department and to the Board of Trustees of School- craft College. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, McNamara, Salvadore, Nash, Milligan, and Ventura. NAYS: None. On motion of Councilman McNamara, seconded by Councilman Nash, and unani- mously adopted, this 534th Regular Meeting of the Council of the City of Livonia was duly adjourned at 8:47 P. M.
