HomeMy WebLinkAboutCOUNCIL MINUTES 1965-06-09 Page 7256 MINUTES OF THE FOUR HUNDRED NINETY-EIGHTH REGULAR MEETING OF THE COUNCIL OF THE CITY OF LIVONIA On June 9, 1965, the above meeting was held at the City Hall, 33001 Five Mile Road, Livonia, Michigan, and was called to order by the President of the Council at approximately 8 16 P. M. Councilman Allen delivered the invocation. Roll was called with the following result. Present--Rudolf R Kleinert, Charles J Pinto, Daniel C. Allen, John F Dooley, Edward H. McNamara and James R McCann Absent-- Peter A. Ventura Elected and appointed officials present Addison W Bacon, City Clerk, Steve Polgar, City Attorney, Milton Firestone, Assistant City Attorney, Robert A Shaw, Director of Public Works, William J. Strasser, Chief City Engineer, John Dufour, Superintendent of Parks and Recreation, Carl Demek, Superintendent, Operations Division, Don Hull, City Planner, Daniel R Andrew, Industrial Coordinator, David L Jones, Water and Sewer Commissioner, and Robert Nash, Zoning Board of Appeals By Councilman Dooley, seconded by Councilman Allen and unanimously adopted, it was #569-65 RESOLVED that, the minutes of the 497th regular meeting of the Council of the City of Livonia, held on June 2, 1965, are hereby approved The President announced receipt of a veto message, dated June 8, 1965, from the Mayor on the Ordinance amending Ordinance No 60, containing Petition Z-657, which was set aside for action at an adjourned session of this meeting By Councilman Dooley, seconded by Councilman Pinto and unanimously adopted, it was #570-65 RESOLVED that, having received a letter dated June 9, 1965, from the Mayor relative to Merriman Road, and having taken note particularly of the last paragraph in said letter which reads- "The assistance of the Council in any way to expedite the acquisition of the needed right-of-way is imperative if Merriman Road is to be completed through Eight Mile Road this year", this Council does hereby request the Mayor to advise the Council specif- ically that which he would like the Council to do in the way of giving assistance Page 7257 By Councilman Allen, seconded by Councilman McNamara, it was #571-65 RESOLVED that, having considered the report of the Finance Committee, and the communication dated January 4, 1965, from the Director of Public Safety, approved by the Budget Director, the Council does hereby concur with the recommendation of the Civil Service Commission, dated August 27, 1964, for a Clerk-Stenographer I in the Police Department, with the provision that a new employee could be hired at Step 2 A roll call vote was taken on the foregoing resolution with the following result: AYES Allen, Dooley, McNamara, McCann, Pinto and Kleinert NAYS• None By Councilman McNamara, seconded by Councilman McCann and unanimously adopted, it was #572-65 RESOLVED that, the proposed House Moving Ordinance is hereby referred to The Detroit Edison Company, Consumers Power Company and the Michigan Bell Telephone Company for review prior to adoption. Councilman Dooley introduced the following Ordinance: AN ORDINANCE AMENDING SECTION 12 OF ORDINANCE NO. 216, AS AMENDED, OF THE CITY OF LIVONIA, KNOWN AS THE "FINANCIAL ORDINANCE". The foregoing Ordinance, when adopted, is on file in the office of the City Clerk and is the same as if word for word repeated herein The above Ordinance was placed on the table for consideration at the next regular meeting of the Council By Councilman McNamara, seconded by Councilman Dooley, it was #573-65 RESOLVED that, having considered a communication dated May 24, 1965, from the Department of Law transmitting a contract for the employ- ment of Ralls-Hamill-Becker, Architects, 15223 Farmington Road, Livonia, for the purpose of performing architectural services in connection with the new main Fire Station and Headquarters Building to be constructed in the Livonia Civic Center on Farmington Road, which contract has been ap- proved by the Director of Public Works, Director of Public Safety, Chief City Engineer, and the Fire Chief, and as to form by the Department of Law, the Council does hereby authorize the Mayor and City Clerk to execute the aforesaid contract as submitted for the purpose of employing the aforesaid architectural firm, and BE IT FURTHER RESOLVED that, the sum of $1, 162 50 is hereby authorized and advanced from the General Funds for the purpose of making the payment to the aforesaid architectural firm in accordance with the schedule of payments set forth in Article 8 of the aforesaid contract, which Page 7258 amount shall be reimbursed to the General Funds from the proceeds of a $500,000.00 general obligation bond issue previously approved by the electorate of the City of Livonia, at the election held on November 3, 1964, under the provisions of Act 279 of the Public Acts of Michigan of 1909, as amended, and the Mayor and City Clerk and City Treasurer are hereby authorized to do all things necessary to the full performance of this resolution. A roll call vote was taken on the foregoing resolution with the following result• AYES: Allen, Dooley, McNamara, McCann, Pinto and Kleinert NAYS• None. By Councilman Dooley, seconded by Councilman McNamara, it was #574-65 RESOLVED that, pursuant to the report and recommendation dated May 28, 1965, from the Chief City Engineer, approved by the Director of Public Works, the Council does hereby amend Item No 8 of resolution #72-65, adopted on January 27, 1965, so as to reduce the General Improvement Bond for remaining improvements in Idyle Hills Estates Subdivision No 2 to $3,000.00 cash to cover the cost of remaining improvements in said sub- division, and the Sidewalk Bond shall remain the same, and the financial assurances now on deposit with the City, if any, shall be reduced accord- ingly, and the City Clerk and City Treasurer are hereby authorized to do all things necessary or incidental to the full performance of this resolution A roll call vote was taken on the foregoing resolution with the following result AYES Allen, Dooley, McNamara, McCann, Pinto and Kleinert NAYS: None The communication dated May 26, 1965, from the Department of Law regarding the City of Livonia vs Morton Salt Company, et al, was received and filed By Councilman McNamara, seconded by Councilman McCann and unanimously adopted, it was #575-65 RESOLVED that, the report dated May 21, 1965, from the Bureau of Inspection regarding the complaint of Jettia M. Merrick regarding motor- cycle sales and service at 9601 Inkster Road, is hereby referred back to the Chief Inspector for a report as to whether the nuisance has been abated and why it has taken a year for this report Councilman Dooley introduced the following Ordinance AN ORDINANCE VACATING PORTIONS OF STREET, ALLEY AND PUBLIC GROUND (Pet V-82) The foregoing Ordinance, when adopted, is on file in the office of the City Clerk and is the same as if word for word repeated herein. NAYS: None The President declared the above Ordinance duly adopted and would become effective on publication Councilman McCann introduced the following Ordinance AN ORDINANCE AMENDING SECTION 22 OF THE ZONING MAP OF THE CITY OF LIVONIA AND AMENDING ARTICLE 3 00 OF THE ZONING ORDINANCE NO. 60, AS AMENDED, OF THE CITY OF LIVONIA BY ADDING THERETO SECTION (Pet Z-636) The foregoing Ordinance, when adopted, is on file in the office of the City Clerk and is the same as if word for word repeated herein. Box 810, Grand Prarie, Texas, for supplying the City with sign blanks as set forth in the tabulation attached to said report and recommendation for the price of $1,614.20, such having been in fact the lowest total bid received for these items A roll call vote was taken on the foregoing resolution with the following result- AYES: Allen, Dooley, McNamara, McCann, Pinto and Kleinert NAYS: None By Councilman Allen, seconded by Councilman McNamara, it was #578-65 RESOLVED that, having considered the report and recommendation dated May 26, 1965, from the Superintendent of Operations, approved by the Budget Director and Director of Public Works, the Council does hereby accept the bid of Sun Oil Company, 3884 Holbrook Avenue, Hamtramck, 12, Michigan, for supplying the City with heating and diesel fuel oil for a period of one year from July 1, 1965 through June 10, 1966, at the follow- ing prices No. 1 Oil at $0 1169 per gallon, and No 2 Oil at $0.1069 per gallon for heating, and No. 2 Oil at $0 1069 per gallon for diesel operated equipment, such having been in fact the lowest bid received for these items. A roll call vote was taken on the foregoing resolution with the following result. AYES: Allen, Dooley, McNamara, McCann, Pinto and Kleinert NAYS: None By Councilman McNamara, seconded by Councilman Dooley, it was #579-65 RESOLVED that, having considered the report and recommendation dated May 27, 1965, from the Superintendent of Operations, approved by the Budget Director and Director of Public Works, the Council does hereby accept the following bids for supplying the City with Readymix Concrete for a period of one year from July 1, 1965, through June 30, 1966, at the Page 7262 following respective prices (1) Allied Concrete, Inc , 33840 Farmington Road, Livonia, for 6 bag mix at $15.00 per cubic yard, and 5 bag mix at $14.00 per cubic yard, (2) Fendt Builders Supply, Inc. , 22005 Gill Road, Farmington, Michigan, for 4 bag mix at $12.50 per cubic yard, such having been in fact the lowest bids received for these items A roll call vote was taken on the foregoing resolution with the following result AYES: Allen, Dooley, McNamara, McCann, Pinto and Kleinert NAYS: None By Councilman McNamara, seconded by Councilman Allen and unanimously adopted, it was #580-65 RESOLVED that, the letter dated May 27, 1965, from the Chief City Engineer regarding Wayne County Drain Commissioner's Miscellaneous Charges, is hereby tabled pending a meeting with a representative of the Drain Commissioner at the study meeting on June 23, 1965. By Councilman McNamara, seconded by Councilman McCann and unanimously adopted, it was #581-65 RESOLVED that, having considered the recommendation dated May 25, 1965, from the Director of Public Safety for a field camera and kit for the Identification Bureau of the Division of Police, the Council does hereby table this matter to the next study meeting, June 23, 1965, pending a further report from the Director of Public Safety The letter dated June 1, 1965, from the Water Resources Commission, re- garding the Detroit River-Lake Erie Conference, was received and filed By Councilman McNamara, seconded by Councilman Allen and unanimously adopted, it was #582-65 RESOLVED that, the Council expresses its appreciation and the appreciation of the citizens of the City of Livonia to Ford Motor Company for its contribution to the cost of supplying fuel for the torches dis- played by the City, said contribution being one over and above the con- tribution made by the Ford Motor Company and through its plants. NAYS: *Allen. *Councilman Allen stated he is voting against this matter because the low bid has not been accepted and because he doesn't believe the specifications went out properly The President declared the resolution adopted. The following preamble and resolution were offered by Councilman Dooley and supported by Councilman Allen: #585-65 WHEREAS, the City Council of the City of Livonia, County of Wayne, Michigan, intends to authorize special assessment bonds for the purpose of defraying the cost of acquiring and constructing street improvements in the City of Livonia, AND WHEREAS notice of intent to issue bonds must be published at least thirty (30) days before adoption of a resolution authorizing the issuance of the same in order to comply with the requirements of Section 5(g) of Act 279, Public Acts of Michigan, 1909, as amended, NOW, THEREFORE, BE IT RESOLVED THAT: 1. The City Clerk is hereby authorized and directed to publish a notice of intent to issue bonds in the Livonia Observer of Livonia, Michigan, a newspaper of general circulation in the City of Livonia 2. Said notice of intent so published shall be in substantially the following form: NOTICE OF INTENT TO ISSUE BONDS PLEASE TAKE NOTICE that the City Council of the City of Livonia intends to adopt a resolution authorizing the issuance of special assessment bonds of the City in the amount of not to exceed Two Hundred Twenty Thousand ($220,000.00) Dollars, for the purpose of defraying the cost of acquiring and constructing street improvements. Said special assessment bonds, in addition to special assessments, shall pledge the full faith and credit of the City. This Notice is given pursuant to the requirements of Section 5(g) of Act 279, Public Acts of Michigan, 1909, as amended.
