M. Councilman Dooley delivered the invocation Roll was called with the following result. AYES. Dooley, McNamara, *Ventura, Pinto, Milligan and McCann NAYS: None *Councilman Ventura abstained from voting, which is recorded as a "Yes" vote under the provisions of Ordinance No 27, Section 19 The Vice President declared the resolution adopted By Councilman Ventura, seconded by Councilman Pinto and unanimously adopted, it was #855-65 RESOLVED that, having considered the report and recommendation dated September 1, 1965, from the City Clerk relative to designation of Page 7422 polling place for Precinct No 34, the Council does hereby designate the John F Kennedy Elementary School, located at 14201 Hubbard Road, in Section 17, as the polling place for Precinct No. 34. By Councilman Dooley, seconded by Councilman Milligan, it was #856-65 RESOLVED, That National Bank of Detroit, Detroit, Michigan, be and is hereby appointed Paying Agent for S256,000 City of Livonia, Wayne County, Michigan, Public Library Bonds (1965 Series), dated June 1, 1965, as more fully described on attached Exhibit A, BE IT FURTHER RESOLVED, That National Bank of Detroit shall be paid, as compensation for its services as Paying Agent, fees on the follow- ing basis For Payment of Interest Coupons - Each Interest Maturity $0 125 per coupon, subject to a minimum of $10 00 for each interest maturity date. * $5,000 denomination SO 05 per coupon * 81,000 denomination For Payment of Coupon Bonds at Each Maturity or Prior Redemption Date Si 50 per bond * S5,000 denomination. A roll call vote was taken on the foregoing resolution with the following result AYES: Dooley, McNamara, Ventura, Pinto, Milligan and McCann NAYS: None By Councilman McNamara, seconded oy Councilman Dooley and unanimously adopted, it was #857-65 RESOLVED that, the letter dated August 19, 1965, from the City Planner regarding the Municipal Parking Lot in Section 34, is hereby re- ferred to the next regular meeting of the Council, following the next study session By Councilman Ventura, seconded by Councilman Dooley, it was #858-65 RESOLVED that, having considered a communication dated August 25, 1965, from the Department of Law transmitting certain Grants of Easements, pursuant to Council resolution #564-65, obtained in conjunction with the Page 7423 construction of the Bell Creek Arm, Area 5b, of the Master Sanitary Sewer Project, which easements are described as follows : (1) An easement from William E Masterson and Kathleen H Masterson, dated May 15, 1965, and an easement from Arthur Hansen and Sine Hansen dated August 13, 1965, in Parcel 13a329a, such easement being described as a strip of land 20 0 feet wide, 10 0 feet on either side of a centerline beginning at a point on the east line of said parcel distant south 193 07 feet from the N. E. corner of said parcel and proceeding S 81° 16' 47" W 133 55 feet, thence N 85° 46' 15" W. 191.06 feet to a point of terminus on the west line of said parcel distant south 199 30 feet from the N. E. 1/4 of Section 26, T 1 S , R 9 E , City of Livonia, Wayne County, Michigan, as described as beginning at a point on the East 1/4 line of said Section 26, distant due south from the N. E. corner of Section 26, T 1 S , R 9 E , 1316 90 feet, proceeding thence S 89° 49' W , 776 51 feet, thence due North 130 0 feet to a curve, thence southeasterly 109 73 feet along the arc of a curve having a radius of 70 00 feet, an interior angle of 89° 49' 00", and lying southwesterly of the long chord of 98 84 feet, bearing S 45° 05' 30" E , thence N 89° 49' E , 706 51 feet to the east line of said Section 26, thence due South along said east line 60 00 feet to the point of beginning except the interest of the people in the easterly portion (Middlebelt Road) thereof, the Council does hereby accept same for and on behalf of the City of Livonia, and the City Clerk is requested to record such Quit Claim Deed with the Wayne County Register of Deeds office and to do all other things necessary and incidental to the full performance of this resolution By Councilman Pinto, seconded by Councilman Dooley, it was #861-65 RESOLVED that, having considered a communication dated August 19, 1965, from the Chief City Engineer, approved by the Director of Public Works, regarding action taken by the City Council on May 19, 1965, in its resolu- tion #516-65, in confirming Special Assessment Roll No 28 for the paving of Levan Road from Six Mile Road to Ladywood Avenue in Section 17, the Council does hereby amend and modify the last sentence set forth in paragraph 3 of resolution #516-65, to read as follows "The first installment shall be due and payable December 1, 1966, and subsequent installments on December 1st of succeeding years", this action being taken for the reason that the proposed improvement will not be completed during the year 1965, and the City Clerk and City Treasurer are hereby requested to do all things necessary or incidental to the full performance of this resolution A roll call vote was taken on the foregoing resolution with the following result AYES Dooley, McNamara, Ventura, Pinto, Milligan and McCann NAYS* None By Councilman Ventura, seconded by Councilman Dooley, it was #862-65 RESOLVED that, having considered a communication dated August 25, 1965, from the Chief City Engineer, approved by the Director of Public Works and the Acting Director of Public Works, and approved by the Water and Sewer Commissioner by the Acting Commissioner, regarding the construction of a sanitary sewer line along Shadyside Street north of Seven Mile Road for a distance of approximagely 1600 feet, in connection with the Farmington Road Sanitary Sewer Project, Area 5c, the Council does hereby request the Depart- ment of Law and the Engineering Division to obtain construction easements Page 7426 from the property owners located on the east side of Shadyside Street in this area, which will enable the construction of the said sewer, for a total sum not to exceed S500 00, and for this purpose, the Council does hereby authorize the expenditure of the aforesaid amount from the Sewer Division Easement Account, such sum to be reimbursed from the proceeds of the sale of Series III Sanitary Sewer Bonds, and the City Clerk and City Treasurer are hereby requested to do all things necessary or incidental to the full performance of this resolution A roll call vote was taken on the foregoing resolution with the following result. AYES Dooley, McNamara, Ventura, Pinto, Milligan and McCann NAYSNone By Councilman McNamara, seconded by Councilman Pinto, it was #863-65 RESOLVED that, having considered a communication dated August 24, 1965, from the Chief City Engineer, approved by the Acting Director of Public Works and Acting Water and Sewer Commissioner, regarding the acquisition of easements for the construction of the Bell Creek Sanitary Sewer through the Bell Creek Valley between Merriman and Hubbard Roads in Area 5b, the Council does hereby authorize the Department of Law and Engineering Division to obtain easements from the following parcels by the owners of same in the amounts as indicated. Page 7427 By Councilman McNamara, seconded by Councilman Pinto, it was #864-65 RESOLVED that, having considered a communication dated August 25, 1965, from the Chief City Engineer, approved by the Acting Director of Public Works, and it appearing from the aforementioned communication that the neces- sary affidavit, waivers of lien and guaranty have been filed, the Council does hereby authorize the final payment in the amount of S225 00 to Mole Construction Company, Inc , 22850 Ecorse Road, Taylor, Michigan, which sum represents the balance due on a contract between that company and the City of Livonia, dated December 16, 1964, for the construction of a sanitary sewer extension in Section 2 (pursuant to resolutions #627-64 and #1022-64), and the City Clerk and City Treasurer are hereby authorized to do all things necessary to the full performance of this resolution A roll call vote was taken on the foregoing resolution with the following result: AYES: Dooley, McNamara, Ventura, Pinto, Milligan and McCann NAYS None By Councilman Ventura, seconded. by Councilman Pinto, it was #865-65 RESOLVED that, having considered a communication dated August 25, 1965, from the Director of Public Safety, approved by the Budget Director, regarding a course commencing on September 13, 1965, for police officers assigned to School Safety Education conducted at the Michigan State University, East Lansing, Michigan, the Council does hereby authorize the transfer of the sum of 5100.00 from the Detective Bureau Training Account #183-28 to the Traffic Bureau Training Accourt #187-28, for the purpose of providing sufficient funds in order to cover the expenses involved in having Corporal Archie Hewett of the Livonia Police Department attend this course. A roll call vote was taken on the foregoing resolution with the following result: AYES : Dooley, McNamara, Ventura, Pinto, Milligan and McCann NAYS : None By Councilman McNamara, seconded by Councilman Ventura and unanimously adopted, it was #866-65 RESOLVED that, having considered the petition received by the City Clerk on August 25, 1965, from Joan R Pearson, 19504 Weyher, Livonia, Michigan, and in accordance with the provisions of Act 73 of the Public Acts of 1959, as amended, the Council does hereby approve of dividing Lot 22 of Iris Gardens Subdivision of part of the S. W. 1/4 of Section 1, T 1 S , R 9 E , City of Livonia, Wayne County, Michigan, into two parcels one of whicn is to be used .for the purpose of providing a pedestrian walk- way in the Clarenceville School District, the legal descriptions of such parcels to be as follows : Parcel 1 The north 6 feet of Lot 22 of Iris Gardens Subdivision of part of the S. W. 1/4 of Section 1, T 1 S. , R. 9 E , City of Livonia, Wayne County, Michigan; as shown on the map attached to the aforesaid petition, which is made a part hereof by this reference, and the City Clerk is hereby requested to cause a certified copy of this resolution to be recorded in the office of the Wayne County Register of Deeds By Councilman McNamara, seconded by Councilman Pinto and unanimously adopted, it was #867-65 RESOLVED that, having considered the petition received by the City Clerk on August 31, 1965, from Charles Vanzile, 29104 St Martins, Livonia, Michigan, and in accordance with the provisions of Act 73 of the Public Acts of 1959, as amended, the Council does hereby approve of divid- ing Lot 435 of Supervisor's Livonia Plat No 7 of part of the S . W. 1/4 of Section 1, T 1 S , R. 9 B , City of Livonia, Wayne County, Michigan, into four parcels, the legal descriptions of which shall read as follows: Parcel 1 The north 90 feet of the east 140 feet of Lot 435 of Supervisor's Livonia Plat No 7 of part of the S. W. 1/4 of Section 1, T 1 S , R. 9 E , City of Livonia, Wayne County, Michigan, as shown on the map attached to the aforesaid petition which is made a part hereof by this reference, and the City Clerk is hereby requested to cause a certified copy of this resolution to be recorded in the office of the Wayne County Register of Deeds By Councilman Dooley, seconded by Councilman Pinto and unanimously adopted, it was #868-65 RESOLVED that, Pctition No 65-8-3-2, submitted by Nicholas Ortopan, 39381 Schoolcraft, Livonia, Michigan, under date of August 26, 1965, for the vacation of an unused portion of old Schoolcraft Road which lies on the south side of tax item 19J2 in the Southwest 1/4 of Section 19, City of Livonia, Wayne County, Michigan, is hereby referred to the City Planning Commission for action and recommendation according to law and Ordinance No 29, as amended By Councilman Ventura, seconded by Councilman Milligan and unanimously adopted, it was Page 7429 #869-65 RESOLVED that, having considered a communication dated August 31, 1965, from the City Planning Commission which transmits resolution #8-138-65 adopted on August 24, 1965, with regard to Petition 65-8-2-1, as submitted by the Wayne Out-County Teachers Credit Union, 15116 Beech Daly Road, Detroit, Michigan, requesting permission to construct a credit union office as a waiver use on property zoned PS and located on the west side of Middle- belt Road between Minton and Westfield in the Southeast 1/1+ of Section 35, the Council does hereby designate Monday, September 27, 1965, at 730 P. M. , as the time and date for conducting a public hearing with regard to this matter, and the City Clerk is hereby requested to do all things necessary in order to give proper notice in writing as well as by the publication of a notice in the City's official newspaper of such hearing and the date and place thereof, in compliance with the requirements set forth in Ordinance No. 543, the Zoning Ordinance of the City of Livonia, such hearing to be held at the City Hall, 33001 Five Mile Road, Livonia, Michigan By Councilman Dooley, seconded by Councilman McNamara, it was #870-65 RESOLVED that, having considered the report and recommendation dated September 8, 1965, from the Chief City Engineer, approved by the Director of Public Works, the Council does hereby accept the unit price bid of Colwell Contracting Company, 17674 Olympia, Detroit 40, Michigan, for installing sidewalks at various locations tnroughout the City of Livonia for the estimated cost of S3,601 02, based on the Engineering Division estimate of units of work involved, subject to a final payment based on the actual units of work as constructed in accordance with the unit prices accepted herein, said estimated cost and unit prices having been, in fact, the lowest bid received for this work, and the sum of $3,601 02 is hereby advanced from the General Funds, the same to be in part reimbursed from the proceeds of special assessments established for this purpose, and the Mayor and City Clerk are hereby authorized to execute a contract for and on behalf of the City of Livonia with the aforesaid bidder and to do all other things necessary or incidental to the full performance of this resolution A roll call vote was taken on the foregoing resolution with the following result' AYESDooley, McNamara, Ventura, Pinto, Milligan and McCann NAYS None On motion of Councilman Ventura, seconded by Councilman McNamara and unanimously adopted, this 506th regular meeting of the Council of the City of Livonia was duly adjourned at 9:02 P.
