By Councilman Dooley, seconded by Councilman McNamara and unanimously adopted, it was #318-65 RESOLVED that , the minutes of the 488th regular meeting of the Council of the City of Livonia held March 31 , I965 , are hereby approved. By Councilman Ventura, seconded by Councilman Allen, it was #319-65 RESOLVED that , having considered a letter dated April 7 , 1965 , from David L. Jones , Water and Sewer Commissioner , regarding the Industrial Road, the Council does hereby amend resolution #83- 64, adopted on January 29 , 1964, so as to delete the words "Contract Payment Reserve Funds of the Sewer Division" and substitute in lieu thereof , the following language "The City Treasurer is hereby author- ized to establish a separate bank account at National Bank of Detroit , to be known as ' Industrial Road Construction Fund - Series I of Livonia Sewerage Disposal System of the City of Livonia ' . Page 7106 By Councilman Dooley, seconded by Councilman McCann and unanimously adopted, it was im #320-65 RESOLVED that , having considered resolution #3-46-65 of the City Planning Commission transmitted in a communication dated March 22 , 1965 , regarding the service drive running parallel to Six Mile Road in Burton Hollow Subdivision in Section 16 , the Council does hereby concur in the recommendation of the City Planning Commission for the reasons therein stated and does hereby rename the said service drive "Hollow Drive" , and directs the Department of Public Works to take all necessary action to effectuate this resolution. By Councilman Ventura, seconded by Councilman McNamara, it was #321- 65 RESOLVED that , having considered a communication dated March 22 1965 , from the Water and Sewer Commissioner, approved by the Director of Public Works , concerning Invoice No . 816 (dated April 30 , 1958) , and the Ashcroft Drain between Inkster and Harrison Roads in the City of Livonia , Michigan (resolution #789- 56 and #467-64) , the Council does hereby amend the Master Drain Plan so as to provide that the Ashcroft Drain Enclosure be and hereby is made a part of Livonia Drain No. 1 , and requests that the said Ashcroft Drain be financed out of the Livonia Drain No . 1 bond issue, and the City Clerk is here- by requested to transmit a certified copy of this resolution to the Wayne County Drain Commissioner and the Livonia Drainage Board District No . 1 . im A roll call vote was taken on the foregoing resolution with the following result AYES Daugherty, Allen, Dooley, McNamara, McCann, Ventura and Kleinert . By Councilman Ventura, seconded by Councilman McNamara, it was #322-65 Resolved that , having considered a communication dated March 22 , 1965 , from the Water and Sewer Commissioner, approved by the Director of Public Works , concerning Invoice No. 816 (dated April 30 , 1958) , and the Ashcroft Drain between Inkster and Harrison Roads in the City of Livonia , Michigan (resolutions #789- 56 and #467-64) , the Council does hereby request the Drainage Board for the Livonia Drain District No . 1 , to approve the payment of $10 , 191 . 76 out of the construction fund surplus to the General Fund of the City of Livonia, Michigan, and the City Clerk is requested to transmit a certified copy of this resolution to the Wayne County Drain Commissioner and to the Livonia Drainage Board District No 1 . Page 7107 By Councilman Dooley, seconded by Councilman Ventura , it was #323-65 RESOLVED that , having considered a communicated dated March 5 , 1965 , from the Chief City Engineer, approved by the Director of Public Works , concerning Smokier-Rousseau Subdivision sidewalks , and the claim of Mrs . Clayton Roshirt , submitted pursuant to resolu- tion #168-65 , and having considered the claim of Mrs Roshirt and being fully advised therein, the Council does hereby authorize and and request the City Clerk and City Treasurer to credit Mrs . Clayton Roshirt , 36713 Richland, Livonia, Michigan, with an amount equal to the charge made against her property ($100 . 97) , for sidewalk construc- tion, it appearing that the construction of sidewalks in front of her property was not to be included in the program A roll call vote was taken on the foregoing resolution with the following result AYES. By Councilman Daugherty, seconded by Councilman Ventura and unanimously adopted, it was #324-65 RESOLVED that , the Law Department be and hereby is request- imp ed to prepare an amendment to Ordinance No . 446, Section 5 . 08 to eliminate the emergency provisions of said section of the subject ordinance. By Councilman McNamara, seconded by Councilman Ventura, it was #325-65 RESOLVED that , the Chief City Engineer having filed with the City Clerk a statement dated April 1 , 1965 , in conjunction with the Council ' s consideration of the revision of the assessment roll follow- ing a public hearing in connection with the proposed paving on Deering Avenue , 15- 1/ 2 feet in width, from Six Mile Road in a northerly direc- tion approximately 1900 lineal feet , to a point north of Bennett , in Section 12 , T . 1 S , R. 9 E . , City of Livonia, Wayne County, Michigan, said hearing having been held on March 1 , 1965 , after due notice as required by ordinance , and after having carefully considered the matter , the Council does hereby 1) accept and approve said statement of April 1 , 1965 , in all respects, 2) determine that the estimated cost of the improvement is $30 , 481 . 26, 3) determine that the cost of said improvement shall be paid for in part by special assessment on property benefited thereby and in part by the City at large , in proportions hereafter established, 4) that the proportion of the cost and expense of said improvement to be borne and paid by the City shall be $5 , 500 .00 for intersections , and 50% of the balance of the assessment in the amount of $12 , 490 . 63, and that the balance of said cost and expense of said public improve- Page 7108 ment amounting to $12, 490 . 63 shall be borne and paid by special assessments on all lands and premises in the special assessment district as herein established in proportion to the benefits to be derived therefrom, 5) determine that assessments made for such improvement may be paid in ten ( 10) annual installments together with interest thereon in the amount of four per cent (4%) per annum on unpaid balance, 6) designate the assessment district , describing the land and premises upon which special assessments shall be levied as follows A special assessment district located in the S. E. 1/4 of Section 12 , T. 1 S. , R. 9 E . , City of Livonia, Wayne County, Michigan, being more particularly described as follows Lots 10 through 29 , and lot 147 of Thomas F . O 'Connor ' s Parkview Acres Subdivision, a subdivision of the W. 1/2 of the S. E. 1/4 of Section 12 , T. 1 S . , R. 9 E . , City of Livonia, Wayne County , Michigan, as recorded in Liber 69 , Page 24 of the County Records . 7) that the City Assessor is hereby directed to prepare a new special assessment roll including all lots and parcels of land within the above district designated by the Council and to assess to each such lot or parcel of land such relative portions of the whole sum to be levied against all lands in the special assessment district as the special benefits to such lots or parcels of land bear to the total benefit of all land and also to enter upon such roll the amount which has been assessed to the City at large , all in accordance with the determina- tion of the City Council , 8) determine that this resolution is made in pursuance of the provi- sions of Ordinance No . 401 , Section 3. 10 , to amend the roll, and 9) that upon completion of said roll , the City Assessor shall attach thereto his required certificate and file said roll with the City Clerk who shall thereupon present the same to the City Council for consideration of confirming the roll . A roll call vote was taken on the foregoing resolution with the following result AYES Daugherty , Dooley , McNamara, McCann, Ventura and Kleinert . NAYS Allen. The President declared the resolution adopted . By Councilman Dooley, seconded by Councilman McCann and uanimously Ladopted, it was #326-65 RESOLVED that , having considered a copy of a communication dated March 16 , 1965 , to Quik Pik Food Stores , Inc . , from the Michigan Page 7109 Liquor Control Commission, regarding an application for an SDM license to be located at 20391 Middlebelt Road, Livonia, Michigan, L advising that said Commission at a meeting held March 8 , 1965 , ordered rescission of a prior approval due to no activity or con- struction of a facility since June 17 , 1963, and for the reason that there is now a church being erected within 500 feet of the pro- posed location , the Council does hereby rescind its resolution #388-63, approving said request for the reasons given by said Commis- sion, and the City Clerk is requested to forward a certified copy of this resolution to the Michigan Liquor Control Commission. By Councilman Dooley, seconded by Councilman Allen and unanimously adopted, it was #327-65 RESOLVED that , having considered a communication dated March 17 , 1965 , from the Planning Director, approved by the Mayor for submission, submitted pursuant to resolution #124-65 , the Council does hereby adopt the Lot Split Specifications set forth with said communication, and does hereby adopt the suggestion of the Planning Director that the Engineering Division also sign lot split petitions to certify that adequate utilities are available, and the Council does hereby request the Department of Law to prepare and sub- mit to the Council an ordinance providing for a $5 . 00 filing fee in connection with all petitions for lot split or division. L By Councilman Dooley, seconded by Councilman Allen, it was #328-65 RESOLVED that , having considered the letter dated April 5 , 1965 , from William N Ponder, attorney, and having also reconsidered the report and recommendation dated June 5 , 1964 , from the City Plan- ning Commission in regard to Petition No . Z- 635 of Casimir C. Gawron for change of zoning in the Northeast 1/ 4 of Section 31 from C- 1 to R-3, the Council does hereby rescind its resolution #571-64, adopted on July 1 , 1964 , and such petition is hereby denied A roll call vote was taken on the foregoing resolution with the following result AYES Daugherty, Dooley, McNamara, Allen and Kleinert . NAYS McCann and Ventura. The President declared the resolution adopted . By Councilman McCann, seconded by Councilman Allen and unanimously adopted, it was #329- 65 RESOLVED that , having considered a communication dated im March 23, 1965 , from the Board of County Road Commissioners of Wayne County , submitted pursuant to resolution #809-64, which requested consideration of initiating steps for widening and improving Five Mile Road from Inkster Road to Eckles Road in the City of Livonia , Page 7110 The Council does hereby acknowledge receipt of said communication and takes the same under advisement for consideration by the Council, im and BE IT FURTHER RESOLVED that , the Council does hereby request the said Board of County Road Commissioners to advise the Council of the basis upon which the Commission is requesting 40% payment by the City of Livonia instead of participation in accordance with prior percentages , and the City Clerk is hereby requested to transmit a copy of this resolution to the said Board, 7th floor, City-County Building, Detroit 26 , Michigan, to the attention of Mr. Oscar M. Gunderson By Councilman McCann, seconded by Councilman Dooley and unanimously adopted, it was #330-65 RESOLVED that , having considered a communication dated March 23, 1965 , from the Board of County Road Commissioners of Wayne County, submitted pursuant to resolution #809-64, which requested consideration of initiating steps for widening and improving Five Mile Road from Inkster Road to Eckles Road in the City of Livonia, Wayne County, Michigan, the Council does hereby refer to the Budget Director and the Chief City Engineer the question of the feasibility of financing said paving and the Chief City Engineer is requested to prepare recommendations for a major road study for the City of Livonia. By Councilman Allen, seconded by Councilman McNamara and unanimously adopted, it was Page 7125 #359-65 RESOLVED that , the Council having adopted resolution #298-65 , at its regular meeting held on March 24, 1965 , requir- imeing the Chief City Engineer to ascertain the assessed valuation of all property affected by the proposed paving of the North 1/2 of Lyndon Avenue between Harrison and Garden Avenues in Section 24, City of Livonia , Wayne County, Michigan, the number of parcels which show tax delinquencies , the number of parcels owned by public author- ities , the number of parcels which are vacant , and to prepare and cause to be prepared, plans and specifications therefor, and an esti- mate for the cost thereof, and to file the same with the City Clerk together with his recommendation as to what proportion of the cost should be paid by special assessment and what part , if any, should be a general obligation of the City, the number of installments in which assessments may be paid and the lands which should be includ- ed in the proposed special assessment district, and it appearing to the Council that all of such information, estimate, plans and speci- fications and recommendations have been properly filed by the Chief City Engineer with the City Clerk under date of March 30 , 1965 , and that there has been a full compliance with all of the provisions of Section 3. 03 of Ordinance No 401 , as amended, entitled "An Ordinance to Provide for the Making of Public Improvements , Defraying the Expense Thereof by Special Assessment and a Special Assessment Procedure" , the Council does hereby set Monday, May 10 , 1965 , at 8 00 p . m. , as the date and time for a public hearing on the necessity for such pro- posed improvement , which public hearing shall be held before the Council in the City Hall , 33001 Five Mile Road , Livonia, Michigan , pursuant to Section 3. 04 of said Ordinance No 401 , as amended , and the City Clerk is hereby authorized to give notice and publication of such hearing as is required by Section 3 .04 of said ordinance By Councilman Ventura, seconded by Councilman Dooley and unanimously adopted, it was #360-65 RESOLVED that , having considered the letter dated March 8 , 1965 , from the Michigan Liquor Control Commission, and the report and recommendation of the Director of Public Safety dated April 5 , 1965 , in connection therewith, the Council does hereby approve of the request from Great Scott Supermarkets , Inc. , for transfer of ownership of 1964-65 SDM licensed business located at 29475 West Seven Mile Road, Livonia, Michigan, from Tony ' s Inc. By Councilman McNamara, seconded by Councilman Ventura, it was #361-65 RESOLVED that , having considered the letter dated March 3 , 1965 , from the Michigan Liquor Control Commission, and the report and recommendation dated March 30 , 1965 , from the Director of Public Safety in connection therewith, the Council does hereby approve of the request from Frank Hanna, Jr. , and Shawky Mousa for transfer of ownership of 1964-65 SDD and SDM licensed business located at 28225 Five Mile Road, Livonia, Michigan, from Gerald R.
