MINUTES OF THE FOUR HUNDRED FORTY-FIRST REGULAR MEETING
OF THE COUNCIL CF THE CITY OF LIVONIA
On February 26, 1964, the above meeting was held at the City Hall, 33001 Five
Mile Road, Livonia, Michigan, and was called to order by the President of the Council
at approximately 8:25 P. M. Councilman McNamara delivered the invocation. Roll was
called with the following result: Present-- Sydney B. Bagnall, John T. Daugherty,
Edward H. McNamara and James R. McCann. Absent-- William E. Parks, *Rudolf R. Kleinert
and *John F. Dooley.
Elected and appointed officials present: Marie W. Clark, City Clerk;
Juanita Hillas, Deputy City Clerk; Harry C. Tatigian, first Assistant City Attorney;
dilliam J. Strasser, Chief City Engineer; Robert A. Shaw, Director of Public works;
Victor C. Phillips, Budget Director; Thomas J. Griffiths, Jr., Chief Accountant;
Daniel R. Andrew, Industrial Coordinator; Carl Deaek, Superintendent, Operations
Division; Richard Sanderson, Chief Inspector; Edward Milligan, Chairman, Planning
Commission; David L. Jones, Water and Sewer Commissioner; and John T. Dufour, Super-
intendent, Parks and Recreation.
By Councilman McNamara, seconded by Councilman Daugherty and unanimously
adopted, it was
#162-6L1 RESOLVED that, the minutes of the 440th regular meeting of the
Council of the City of Livonia, held February 19, 1964, are hereby approved.
Marie W. Clark, City Clerk, informed the Council of a veto message from
the Mayor on the Ordinance amending Ordinance No. 60, containing Petition No. 1-613,
which was placed on the table f or consideration at a later time in the meeting.
Councilman McNamara introduced the following Ordinance:
AN ORDINANCE AMENDING THE INTRODUCTORY PARAGRAPH, SECTIONS
16, 33, 39, 40 AND 41 OF ORDINANCE NO. 372, AN ORDINANCE
ESTABLISHING ELECTION PRECINCTS WITHIN THE CITY C ' LIVONIA,
FIXING THE BOUNDARIES THEREOF, AND PROVIDING FOR THE PUBLI-
CATION AND POSTING OF NOTICE THEREOF, AND ADDING SECTIONS
42 AND 43 THEREOF.

THE CITY OF LIVONIA ORDAINS:
Section 1. The introductory paragraph of Ordinance No. 372 of the City of
Livonia, entitled "An Ordinance Establishing Election Precincts Within the City of
Livonia, Fixing the Boundaries Thereof, and Providing for the Publication and Posting
of Notice Thereof," is hereby amended to read as follows:
That the City of Livonia shall be divided into forty (40) election
precincts, numbered from one (1) to forty (40), and respectively consisting
of areas as described hereinafter.
Section 2. Section 16 of Ordinance No, 372 of the City of Livonia is hereby
amended to read as follows:
Section 16. That election precinct number sixteen shall consist of:
All that area of the City lying south of the center line of Seven Mile
Road and north of the center line of Curtis Avenue as established, and
north of the east and west quarter line of Section 11, between the center
line of Middlebelt Road on the east and the center line of Merriman Road
on the west; also that area lying south of the center line of Pembroke
Avenue and the imaginary extension thereof, and north of the center line
of Seven Mile Road, between the center line of Purlingbrook Avenue on the
east and an imaginary line extending northerly from the center line of
Merriman Road, along the westerly boundary of Section 2 on the west.
Section 3. Section 33 of Ordinance No. 372 of the City of Livonia is hereby
amended to read as follows:
Section 33. That election precinct number thirty-three shall consist
of: All that area of the City lying south of the center line of Five Mile
Road and north of the center line of Schoolcraft Road between the center
line of Levan Road on the east and the center line of Newburgh Road on the west.
Section 4. Section 39 of Ordinance No. 372 of the City of Livonia is hereby
amended to read as follows:
Section 39. That election precinct number thirty-nine shall consist of:
All that area of the City lying south of the center line of Curtis Avenue
as established, and south of the east and west quarter line of Section 11,
and north of the center line of Six Mile Road between the center line of
Middlebelt Road on the east and the center line of Merriman Road on the west.
Section 5. Section 40 of Ordinance No. 372 of the City of Livonia is hereby
amended to read as follows:
Section 40. That election precinct number forty shall consist of:
All that area of the City lying south of the center line of Five Mile Road
and north of the center line of Schoolcraft Road and west of the center
line of Newburgh Road.
Section 6. Section 41 of Ordinance No. 372 of the City of Livonia is hereby
amended to read as follows:
Section 41. That notice of the division of the City into the described
election precincts shall be published for two successive weeks in The

Livonian Observer, the first publication to be within ten (10) days after
the adoption of said ordinance, and such notice shall be posted in two or
more public places in each of the said election precincts; and a like notice
shall be immediately transmitted by the City Clerk to the County Clerk.
Section 7. Ordinance No. 372 is hereby amended by adding Sections Nos. 142
and 43 thereto, which shall read as follows:
Section 42. Ordinances No. 117, No. 125, No. 183, No. 199 and all other
ordinances or parts of ordinances in conflict herewith are hereby repealed
only to the extent necessary to give this ordinance full force and effect.
Section 43. Should any portioh of this ordinance be held invalid for
any reason, such holding shall not be construed as affecting the validity
of any of the remaining portions of this ordinance.
The foregoing Ordinance was placed on the table for consideration at the next regular
meeting of the Council.
By Councilman McCann, seconded by Councilman McNamara, it was
#163-64 RESOLVED that, the sum of $34,000.00 is hereby transferred from
the Unallocated Fund to the Seven Mile Road Paving Account of the Budget
for the purpose of defraying the cost of the City's share of paving on
Seven Mile Road, east and west of Middlebelt Road.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: McNamara, McCann, Daugherty and Bagnall.
NAYS: None.
Councilman McCann introduced the following Ordinance:
AN ORDINANCE AMENDING SECTION 2L OF THE ZONING MAP CF THE
CITY CF LIVONIA AND AMENDING ARTICLE 3.00 (F THE ZONING
ORDINANCE, ORDINANCE NO. 60, AS AMENDED, OF THE CITY OF
LIVONIA, BY ADDING THERETO SECTION 3.371 (Petition Z-606)
THE CITY OF LIVONIA ORDAINS:
Section 1. The report and recommendation of the City Planning Commission
dated December 6, 1963, on Petition No. 1.-606, as amended, having been considered by
the Council, the Council hereby adopts said petition to amend the Zoning Ordinance and
the Zoning Map of the City of Livonia, and all proceedings heretofore conducted on
said petition are hereby approved.
Section 2. Article 3.00 of the toning Ordinance, Ordinance No. 60, as amended,
L of the City of 'Livonia, is hereby amended by adding thereto the following Sections
Section 3.374. Petition No. Z-606, as amended, submitted by Walter J.
Abraham is hereby granted and the zoning classification of the premises

hereinafter described is hereby changed from R-1-B to C-1 as requested in
said petition:
Lots 194 to 199, both inclusive Five-Elm Park Subdivision,
as recorded in Liber 55, Page 64, Wayne County Records, said
subdivision being a part of the N. W. 1/4 of the N. W. 1/4
of Section 24., T. 1 S., R. 9 E., City of Livonia, Wayne
County, Michigan;
and the Northwest 1/1i. of Section 24 of the Zoning Map is hereby amended to
conform to the change made in this section.
Section 3. The attached map designated "Amendment No of the toning
Map of the iT ty of Livonia," showing all ofthe amendments and changes made in the
foregoing Section 2 of this ordinance is hereby approved, established and made a
part hereof.
Section 4. All ordinances or parts of ordinances in conflict herewith are
hereby repealed only to the extent necessary to give this ordinance full force and
effect.
Section 5. Should any portion of this ordinance be held invalid for any
reason, such holding shall not be construed as affecting the validity of any of the
remaining portions of this ordinance.
The foregoing Ordinance was placed on the table for consideration at the next regular
meeting of the Council.
An Ordinance Amending Ordinance 449 known and cited as the "Building Code
Ordinance of the City of Livonia" as amended, by Adding Section 4.10 to Axticle IV
Thereof, introduced on February 19, 1964, by Councilman McNamara, was taken from the
table and a roll call vote conducted thereon;
Councilmen *Rudolf R. Kleinert and *John F. Dooley arrived at 8:55 P. M.
with the following result:
AYES: McNamara, McCann, Kleinert, *Dooley and Bagnall.
NAYS: Daugherty.
*Councilman Dooley abstained from voting which is recorded as a "Yes" vote under the
provisions of Ordinance No. 27, as amended, Section 19.
The president declared the foregoing Ordinance duly adopted and would become effective
on publication.

An Ordinance Amending Ordinance No. 63 known and cited as the Heating Code
Lof the City of Livonia, by Adding Section 11.29 to Article IV and Section 9.26 to
Article IX Thereof, introduced on February 19, 1964, by Councilman Dooley was taken
from the table and a roll call vote conducted thereon with the following result:
AYES: McNamara, McCann, Daugherty, Kleinert, Dooley and Bagnall.
NAYS: None.
The President declared the foregoing Ordinance duly adopted and would become effective
on publication.
An Ordinance Amending Section 1.3 of Article I of Ordinance No. 11116, the
Street Ordinance of the City of Livonia, introduced on February 19, 19611, by- Council-
man

man McNamara, was taken from the table and a roll call vote conducted thereon with
the following result:
AYES: McNamara, McCann, Daugherty, Kleinert, Dooley and Bagnall.
LNAYS: Norje.
The President declared the foregoing Ordinance duly adopted and would become effective
on publication.
The letter dated February 21, 1964, from L. E.Schmidt, Superintendent of
Clarenceville Public Schools, regarding the construction of a pedestrian bridge to
service Botsford School, was received and placed on file for the information of the
Council.
By Councilman Daugherty, seconded by Councilman Kleinert, it was
#1611-611 RESOLVED that, having considered the report and recommendation
dated February 10, 1961 , from the Fire Chief, approved by the Director of
Public Safety, Budget Director and the Mayor, the Council does hereby
accept the bid cf Bi-Lateral Fire Hose Company, 20 North Wacker, Chicago 6,
Illinois, for supplying the City with 1,000 feet of 2-1/2" Fire Hose and
300 feet of 1-1/2" Fire Hose for the price of $2,060.00, such having been
in fact the lowest bid received for this item.
A roll call vote was taken on the foregoing resolution with the following results
AYES: McNamara, McCann, Daugherty, Kleinert, Dooley and Bagnall.
NAYS: None.

By Councilman Daugherty, seconded by Councilman McNamara, it was
#165-64 RESOLVED that, having considered the report and recommendation
dated February 22, 1964, from the Superintendent of Operations, approved
by the Director of Public Works and Budget Director, the Council does
hereby accept the bid of Rudoni Excavating Company, Inc., 2150 Howard Street,
Lincoln Park, Michigan, for supplying the City with the rental of a Lorain
50K back hoe shovel, with operator, at $13.50 per hour, for work in con-
nection with the Doris Avenue Sewer project, such having been in fact the
lowest bid received for this item.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: McNamara, McCann, Daugherty, Kleinert, Dooley and Bagnall.
NAYS: None.
Councilman Daugherty was excused at 9:19 P. M.
By Councilman Kleinert, seconded by Councilman McNamara, it was
#166-64 RESOLVED that, having considered the report and recommendation
dated February 22, 1964, from the Superintendent of Operations, approved
by the Director of Public Works and Budget Director, the Council does hereby
accept the bid of Forest Dodge, Inc., 34955 Plymouth Road, Livonia, Michigan,
for supplying the City with one Dodge Model D-600 two ton chassis with
Perfection box for the Sewer Division for the price of $3,782.04, less
trade-in allowance of $75.00, or $3,707.04, such having been in fact the
lowest bid received for this item.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: McNamara, McCann, Kleinert, Dooley and Bagnall.
NAYS: None.
Councilman Daugherty returned at 9:21 P. M.
By Councilman McNamara, seconded by Councilman Dooley and unanimously
adopted, it was
#167-64 RESOLVED that, the Council having considered the letter dated
February 10, 1964, from the Michigan Liquor Control Commission, regarding
the application from Gerald J. Tartoni and Sylvia A.Tartoni, 11411 Garden,
Livonia, for a new full year Tavern license to be located at 28790 Plymouth
Road, Livonia, Michigan, the Council does hereby refer the same to the
Committee of the Whole.
The report of the Municipal Court for the month of January, 1964, was
received and filed for the information of the Council.
By Councilman McNamara, seconded by Councilman Dooley, it was

#168-6L1. RESOLVED that, having considered a letter dated February 211, 1964,
from the Mayor, with regard to the Livonia Irish American Society and its
need for assistance in the decoration of its float in the St. Patrick's Day
Parade to be held in Detroit this year, the Council does hereby determine
to appropriate a sum not to exceed $200.00 from the Public Relations Account
No. 102-22, for this purpose, and the City Clerk and City Treasurer are re-
quested to do all things necessary or pertinent to the full performance of
this resolution.
A roll call vote was taken on the foregoing resolution with the following results
AYES: McNamara, McCann, Daugherty, Kleinert, Dooley and Bagnall.
NAYS: None.
By Councilman McNamara, seconded by Councilman McCann, it was
#169-64. RESOLVED that, having considered the report and recommendation
dated February 21, 1964, from the Superintendent of Operations, approved
by the Director of Public Works and Budget Director, the Council does
hereby accept the bid of Miller Equipment Company, 32910 Plymouth Road,
Livonia, Michigan, for supplying the City with one Asplundh 12" Model EX
Brush Chipper for the price of $2,987.00, such having been in fact the
lowest bid received for this item.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: McNamara, McCann, Dooley, Kleinert, Daugherty and Bagnall.
NAYS: None.
The following resolution was unanimously introduced, supported, and
adopted:
#170-64 RESOLVED that, we, the members of this Council of the City of
Livonia, on this 26th day of February, 1961 , do hereby take this occasion
at the 41st regular meeting of the Council, to express appreciation for
the services rendered to this Honorable Body, as well as to the people of
the City of Livonia, by Mr. David R. McCullough, the City Planner; this
Council does further commend Mr. McCullough for the dedicated effort he
has put forth as the City Planner with this community, and does further
express to Mr. McCullough its sincere wishes for a successful and satisfy-
ing career in the future.
The President relinquished the chair to Councilman McCann at 9:34 P. M.,
and was excused. The President returned at 9:39 P. M., and resumed the chair at
9:42 P. M.

#171-6/1. RESOLVED that, the Planning Commission is hereby authorized to
engage the services of a planning consultant at the cost of $18.00 per
hour, and the Budget Director is requested to recommend a specific sum to
be allocated for that purpose and from what funds, in order that the City
Planning Commission may not be hampered in carrying out the duties charged
to them.
A roll call vote was taken on the foregoing resolution with the following results
AYES: McNamara, McCanns Dooley, Kleinert, Daugherty and Bagnall.
NAYS: None.
By Councilman Daugherty, seconded by Councilman Dooley and unanimously
adopted, it was
#172-611. RESOLVED that, the City Council does hereby invite the Civil
Service Commission and the Youth Commission to consider and submit the
respective recommendations relative to the practicability of the proposed
Youth Employment Director being incorporated as an added employee in the
personnel department of the City and responsible to the Civil Service
personnel director, but to be responsible for the Youth Employment Service
Program in addition to other work assignment within the personnel department.
Councilman Daugherty reintroduced the following Ordinance:
AN ORDINANCE AMENDING SECTION 13 OF THE ZONING MAP CF THE
CITY OF LIVONIA AND AMENDING ARTICLE 3.00 OF THE ZONING
ORDINANCE, ORDINANCE NO. 60, AS AMENDED, OF THE CITY CF
LIVONIA, BY ADDING THERETO SECTION 3.375 (Petition Z-613)
vetoed by the Mayor.
A roll call vote was taken on the foregoing Ordinance with the following result:
AYES: McNamara, McCann, Daigherty, Kleinert, Dooley and Bagnall.
NAYS: None.
The President declared the foregoing Ordinance readopted and the Mayor's veto over-
ruled.
On motion of Councilman Kleinert, seconded by Councilman Dooley and
unanimously adopted, this 1414.1st regular meeting of the Council of the City of
Livonia was duly adjourned at 10:16 P. M., February 26, 1964.

MINUTES OF THE EIGHTY-FIFTH SPECIAL MEETING OF THE
COUNCIL OF THE CITY OF LIVONIA
Pursuant to the provisions of Section 8, Chapter IV of the City Charter,
the above meeting was held on February 28, 1964, at the City Hall, 33001 Five Mile
Roads Livonia, Michigan, and was called to order by the President of the Council at
approximately 7:06 P. M. Roll was called with the following result: Present--
Sydney B. Bagnall, Rudolf R. Kleinert, William E. narks, James R. McCann, Edward H.
McNamara and John F. Dooley. Absent-- John T. Daugherty.
By Councilman Kleinert, seconded by Councilman Parks, it was
#173-64 RESOLVED that, having considered the letter dated February 28,1964,
from the Chief City Engineer, as approved by the Director of Public Works,
and the letter dated February 28, 1964, from the Industrial Coordinator,
regarding the relocation of a portion of the Patter Drain south of School-
craft Road and west of Levan Road in Section 29, the Council does hereby
determine that the relocation of said drain is in the best interests and
welfare of the City of Livonia, and does further resolve as follows:
(a) That such relocation is to be performed in accordance with a
sketch attached to the aforesaid letter of the Chief City
Engineer;
(b) That the Chief City Engineer is requested to prepare plans,
specifications and make any surveys that may be necessary in
connection with this proposed relocation;
(c) That the Department of Public Works obtain a permit from the
Wayne County Drain Commissioner in order to perform said re-
location, the Commissioner having jurisdiction of said drain;
(d) That the Department of Public Works is authorized to advertise
and receive bids for the construction thereof upon receipt of
executed release of right of way instruments from the parties
and owners in interest of the property wherein said drain is to
be relocated; and
(e) That said relocation is to be made at an estimated cost not to
exceed $5,000.00, to be borne by the City.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Kleinert, Parks, McCann, McNamara, Dooley and Bagnall.
NAYS: None.

unanimously adopted, this 85th Special Meeting of the Council of the City of Livonia
was duly adjourned at approximately 7:15 P. M., February 28, 1964.
