HomeMy WebLinkAboutCOUNCIL MINUTES 1964-01-22 Page 6405 MINUTES OF THE FOUR HUNDRED THIRTY-SEVENTH REGULAR MEETING OF THE COUNCIL OF THE CITY OF LIVONIA On January 22, 1964, the above meeting was held at the City Hall, 33001 Five Mile Road, Livonia, Michigan, and was called to order by the President of the Council at approximately 8:12 P. M. Councilman Dooley delivered the invocation. Roll was called with the following result: Present-- Sydney B. Bagnall, John T. Daugherty, William E. Parks, Rudolf R. Kleinert, John F. Dooley and Edward H. McNamara. Absent-- *James R. McCann. Elected and appointed officials present: Juanita Hillas, Deputy City Clerk; Alan Walt, City Attorney; Milton I. Firestone, Assistant City Attorney; Thomas J. Griffiths, Jr., Chief Accountant; David R. McCullough, City Planner; Victor C. Phillips, Budget Director; Daniel R. Andrews, Industrial Coordinator; Milton R.Holley, City Assessor; William J. Strasser, Chief City Engineer; Robert A. Shaw, Director of Public Works; and David L. Jones, Water and Sewer Commissioner. By Councilman McNamara, seconded by Councilman Dooley and unanimously adopted, it was #50-64 RESOLVED that, the minutes of the 436th regular meeting of the Council of the City of Livonia held January 15, 1964, are hereby approved. The Deputy City Clerk informed the Council of a veto message from the Mayor on resolution #30-64, Petition Z-610, adopted by the Council on January 15, 1963; which was laid on the table for consideration at a later time in the meeting. The letter dated January 14, 1964, from the Department of Law, transmitting an opinion of the Court on the Ledan vs City of Livonia court case, submitted pur- suant to resolution #4-64, was received and filed for the information of the Council. The letter dated January 10, 1964, from the Director of Public Works, con- cerning a Buckingham Village Drainage problem of William Palmer, 14249 Deering, was received aid filed for the information of the Council. An Ordinance Amending Section 30 of the Zoning Map of the City of Livonia Page 6406 and Amending Article 3.00 of the Zoning Ordinance, Ordinance No. 60, as amended, of the City of Livonia, by Adding Thereto Section 3.372 (Petition 1-621), introduced on January 15, 1964, by Councilman Dooley, was taken from the table and a roll call vote conducted thereon with the following result: AYES; Dooley, McNamara, Daugherty, Parks, Kleinert and Bagnall. NAYS: None. The President declared the foregoing Ordinance duly adopted and would become effective on publication. By Councilman Parks, seconded by Councilman McNamara and unanimously adopted, it was #51-64 RESOLVED that, pursuant to Section 6 of Chapter VIII of the Charter of the City of Livonia, the Board of Review (Tax Assessments) shall convene for its first session on the following dates: FIRST SF..SION: Tuesday - March 3, 1964 - FOR BOARD OF REVIEW ONLY (this meeting of Tuesday, March 3, 1964 is a closed meeting for Board of Review only, to examine the 1964 assessment rolls.) (Public Sessions) Wednesday - March 4, 1964 - 9 A. M. - 12 Noon 1:00 P.M. - 4:00 P.M. Thursday - March 5, 1964 2:00 P.M. - 8:00 P.M. Friday - March 6, 1964 - 9 A. M. - 12 Noon 1:00 P.M. - 4:00 P.M. Saturday - March 7, 1964 - 9 A. M. - 3 P. M. and that such Board shall convene for its second session on: SECOND SESSION: (Public Sessions) Monday - March 9, 1964 - 9 A. M. - 12 Noon 1:00 P.I. - 4:00 P.M. at the Livonia City Hall, 33001 Five Mile Road, Livonia, Michigan; and such additional meetings as may be necessary, for the purpose of reviewing the Assessment Roll forte year 1964, and hearing any taxpayers deeming themselves aggrieved by the assessment; the place of the Board of Review meetings will be the Council conference room located in the City Hall, and the Director of Public Works is requested to erect a suitable partition dividing the Council secretary's work area from the balance of the conference room. Page 6407 By Councilman Parks, seconded by Councilman Kleinert, it was RESOLVED that, having considered the request dated January 6, 1964, of the City Assessor, approved by the Mayor, and having considered the recommendation of the Mayor in a letter dated January 22, 1964, the Council does hereby appropriate the sum of $3,100 to be transferred to Account No. 140-1 of the Assessor's Budget from the Unallocated Fund; and does hereby transfer the sum of $750 to said Account No. 140-1 from Account No. 145-1 of the Board of Review Budget, it appearing that such funds are required for five temporary clerks, the payment of services of Wayne County personnel, and temporary increase in salary to the City Assessor from $100 per month to $400 per month for the period from February 1, 1964 through April 13, 1964, and thereafter is hereby fixed at $100 per month; and the City Clerk and City Treasurer are hereby authorized to do all other things necessary or incidental to the full performance of this resolution; all prior resolutions are hereby rescinded only to the extent that they are in conflict herewith. By Councilman Daugherty, seconded by Councilman Dooley, it was #52-64 RESOLVED that, the request dated January 6, 1964, from the City Assessor for funds is hereby tabled to the next regular meeting of the Council. A roll call vote was taken on the foregoing resolution with the following result: AYES: Dooley, McNamara, Daugherty and Bagnall. NAYS: Parks and Kleinert. The President declared the resolution adopted. By Councilman McNamara, seconded by Councilman Dooley, it was #53-64 RESOLVED that, the sum of $400.00 is appropriated from the Un- allocated Fund to the Department of Assessment to obtain the services of Wayne County personnel in checking tax rolls of the City of Livonia. A roll call vote was taken on the foregoing resolution with the following result: AYES: Dooley, McNamara, Daugherty, Parks, Kleinert and Bagnall. NAYS: None. By Councilman Kleinert, seconded by Councilman Parks, it was #54-64 RESOLVED that, having considered the letter dated January 9, 1964, from Mrs.Olson Hensley, 11531 Cavell, Livonia, Michigan, concerning urban renewal, the Council takes this means to advise Mrs. Hensley that by its action in declining to hire an urban renewal director (resolution #945-63) it has found no present requirement for urban renewal; and the City Clerk is requested to transmit a copy of this resolution to Mrs. Olson Hensley. *Councilman James R. NAYS: None, By Councilman Dooley, seconded by Councilman Kleinert and unanimously adopted, it was #55-614 RESOLVED that, having considered resolution WS 594 12/63 of the Water and Sewer Board, concerning Open Storm Drain policy, submitted in a letter dated January 7, 1964, by the Chairman of said board, approved for submission by the Mayor, the Council does hereby refer the same to the Water and Sewer Committee of the Council for its report and recommendation. The copy of the letter to Civil Service Commission from an employee of the Water Department was received and filed for the information of the Council. By Councilman Daugherty, seconded by Councilman McCann and unanimously adopted, it was #56-64 RESOLVED that, the Civil Service Commission is heray recuested to advise the City Council as to the disposition relative to the area of political activity only, as related to the section of the Charter dealing with this specific area, as contained in the letter dated January 9, 1964, from Judith Beaton. The letter dated January 7, 1964, from Norman Raupp, 15790 Middlebelt Road, Livonia, concerning property taxes was received and filed for the information of the Council. The resolution from the Township of Sumpter regarding the late President John F. Kennedy, was received and filed for the information of the Council. The copy of notice to property owners from the Engineering Division regard- ing sanitary sewers in Golden Ridge Subdivision was withdrawn from the agenda. The report of the Municipal Court for the month of December, 1963, was received and filed for the information of the Council. By Councilman Kleinert, seconded by Councilman Parks and unanimously adopted, it was #57-64 RESOLVED that, having considered the letter dated January 17, 1964, from the Michigan Liquor Control Commission, the Council takes this means Page 6409 to inform the Michigan Liquor Control Commission that it did previously approve, above all others, of a request from Walter J. Mahalak and Doris M. Mahalak, 9952 Bassett Avenue, Livonia, Michigan, for a new full year Class C license (see resolutions #886-61, adopted December 4, 1961; #876-62 adopted November 21, 1962; #622-63 adopted August 7, 1963, and #929-63 adopted December 4, 1963), and takes this means to inform the Michigan Liquor Control Commission that the property located at 30423 Plymouth Road, Livonia, Michigan, in lieu of the property located at 30411 Plymouth Road, Livonia, Michigan, is presently zoned C-2 and may be used under existing zoning regulations for any commercial use including the operation of a Class C licensed business, and the Council having previously approved such request takes this means of re-stating its policy with respect to any Class C license, the Council believing that it is not the responsibility of the local legislative body to approve of specific locations and the suitability of the same for the operation of Class C licenses, but that it is properly and legally the responsibility of the Michigan Liquor Control Commission to determine the suitability of particular premises for such use. By Councilman Parks, seconded by Councilman McNamara, it was #58-64 RESOLVED that, having considered the veto of resolution #30-64, adopted on January 15, 1964, the Council does hereby readopt said resolu- tion the same as if it were word for word repeated herein. A roll call vote was taken on the foregoing resolution with the following results AYES: McNamara, McCann, Daugherty, Parks, Kleinert and Bagnall. NAYS: Dooley. The President declared the resolution adopted and the veto over-ruled. By Councilman Daugherty, seconded by Councilman Dooley and unanimously adopted, it was #59-64 RESOLVED that, regular meetings of the Council for the month of February, will be held on Wednesdays, February 12th, 19th and 26th, 1964, at 8:00 o'clock P. M. On motion of Councilman Dooley, seconded by Councilman Daugherty and unanimously adopted, this 437th regular meeting of the Council of the City of Livonia was duly adjourned at 9:13 P. COUNCIL OF THE CITY OF LIVONIA Pursuant to the provisions of Section 8, Chapter IV of the City Charter, the above meeting was held on January 27, 1964, at the City Hall, 33001 Five Mile Road, Livonia, Michigan, and was called to order by the President of the Council at approximately 8:09 P. M. Roll was called with the following result: Present-- Sydney B. Bagnall, John T. Daugherty, Will—am E. Parks, Rudolf R. Kleinert, John F. Dooley, Edward H. McNamara and James R. McCann. Absent-- None. By Councilman McCann, seconded by Councilman Parks, it was #60-64 RESOLVED that, having considered the request of the City Assessor, dated January 6, 1964, approved by the Mayor, and having considered the recommendations of the Mayor in a letter dated January 22, 1964, the Council does hereby appropriate the sum of $1,487.00 to be transferred to Account No. 140-1 of the Assessor's Budget from the Unallocated Fund, and does hereby transfer the sum of $750.00 to said Account No. 140-1 from Account No. 145-1 of the Board of Review Budget, it appearing that such funds are required for five (5) temporary clerks, and temporary increase in the salary to the City Assessor from $100 per month to $460 for each of the months of February and March and $280 through April 13, 1964, and there- after is hereby fixed at $100.00 per month; and the City Clerk and City Treasurer are hereby authorized to do all other things necessary or in- cidental to the full performance of this resolution; all prior resolutions are hereby rescinded only to the extent that they are in conflict herewith. A roll call vote was taken on the foregoing resolution with the following result: AYES: McCann, McNamara, Dooley, Kleinert, Parks, Daugherty and Bagnall. NAYS: None. By Councilman Dooley, seconded by Councilman McNamara, it was #61-64 RESOLVED that, having considered the report and recommendation dated November 22, 1963, from the Chief City Engineer, approved by the Director of Public Works,concerning a public sidewalk along the north side of W. Chicago Road in front of Bureau of Taxation Parcel C2b, be- tween Middlebelt and the Emerson Junior High School property in the City of Livonia, and for the reasons therein stated, the Council does hereby require the respective owners of lots and premises herein referred to to construct, rebuild or repair sidewalks in front of, adjacent to and abutting such lots and premises; and the City Clerk is hereby requested to do all things necessary to carry out the provisions of this resolution which is made pursuant to Ordinance No. 446, Article V, Section 5.5. On motion of Councilman Dooley, seconded by Councilman McNamara and unanimously adopted, this 83rd special meeting of the Council of the City of Livonia was duly adjourned at 8:35 P.
