HomeMy WebLinkAboutCOUNCIL MINUTES 1963-03-13 Page 5921 MINUTES OF THE FOUR HUNDREDTH R.JXIITTA.R MEETING OF THE COUNCIL OF THE CITY OF LIVONIA On March 13, 1963, the above meeting was held at the City Hall, 33001 Five Mile Road, Livonia, Michigan, and was called to order by the President of the Council at approximately 8:25 P. M. Councilman McNamara delivered the invocation. Roll was called with the following result: Present-- Sydney B. Bagnall, John T. Daugherty, William E. Parks, Rudolf R. Kleinert, John F. Dooley, Edward H. McNamara and James R. McCann. Absent-- None. Elected and appointed City officials also present: Marie W. Clark, City Clerk; Juanita Hillas, Deputy City Clerk; the City Attorney; the first Assistant City Attorney; the Director of Public Works; the Director of Public Safety; the Budget Director; the City Planner; and the Chief City Engineer. By Councilman Dooley, seconded by Councilman Daugherty and unanimously adopted, it was #161-63 RESOLVED that, the minutes of the 399th regular meeting of the Council of the City of Livonia held on March 6, 1963, are hereby approved. By Councilman Kleinert, seconded by Councilman Dooley and unanimously adopted, it was #162-63 RESOLVED that, acknowledging receipt of letters dated March 13, 1963, from the Civil Service Commission and received on said date, re- garding salary adjustments for the positions of Budget Director, Assistant City Attorney and Distribution Clerk; and the letter dated March 11, 1963, from the Mayor pertaining to salary adjustment for the position of Budget Director; wherein such communications make reference to various increments of salary ranges; and whereas, the complete position classification and pay plan outlining and explaining such increments and ranges has not been presented to the Council in complete form, the Council does hereby refer the aforesaid communications to the Finance Committee pending receipt of such complete report and recommendation. By Councilman Daugherty, seconded by Councilman McNamara and unanimously adopted, it was #163-63 RESOLVED that, the letter dated March 11, 1963, from the Mayor in reference to the Industrial Development Coordinator appointment, is hereby referred to the Committee of the Whole meeting, March 13, 1963. For Services in paying bonds at each maturity or call - $1.00 for each coupon bond for the first 100 pieces .50 for each coupon bond for the excess over 100 pieces. Plus out-of-pocOt expenses, such as postage, registered mail, surcharge, etc. BE IT FURTHER RESOLVED, That all cancelled bonds, coupons and statements of account may be forwarded to: City of Livonia 33001 Five Mile Road Livonia, Michigan Attention: Marie W. Clark, City Clerk Tel. No. Garfield 1-2000 A roll call vote was taken on the foregoing resolution with the following result: AYES: Dooley, McNamara, McCann, Daugherty, Parks, Kleinert and Bagnall. NAYS: None. Page 5923 By Councilman Daugherty, seconded by Councilman Parks and unanimously adopted, it was #165-63 RESOLVED that, having considered the letter from Mr. Harry R. Killam, 11081 Clements Circle West, Livonia, Michigan, the Council does hereby refer such letter to the Engineering Division for its report and recommendation. Councilman Daugherty introduced the following Ordinance: AN ORDINANCE VACATING PORTIONS OF STREET, ALLEY AND PUBLIC GROUND. THE CITY OF LIVONIA ORDAINS: Section 1. The report and recommendation of the City Planning Commission, dated January 8, 1963, on Petition No. V-71, for vacating a certain alley, is hereby accepted and adopted, and the Council does hereby approve all proceedings on said petition, it appearing that a public hearing thereon was duly held on November 27, 1962, as provided by law and that the proper notices of such hearing were given. Section 2. Pursuant to Ordinance No. 29 of the City of Livonia, entitled "An Ordinance Providing the Procedure for Vacating of Streets, Alleys and Public Ground," as amended by Ordinance No. 50, the following alley is hereby vacated: A portion of the alley described in Petition V-71, and being more particularly described as that alley twenty (20) feet in width running north and south between Haldane Avenue and Gable Avenue and adjoining Lots Nos. 99 through 113,inclusive, on the west, and adjoining Lots Nos. 21 through 50, inclusive, on the east, of the Westmore Sub- division of part of the West 1/2 of the Southwest i/4 of Section 3,T. 1 S., R. 9 E., City of Livonia, Wayne County, Michigan, as recorded in Liber 48, Page 82, Wayne County Records; provided, however, that there be and hereby is reserved a public easement for public utilities for the full width of the alley herein vacated. Section 3. All ordinances or portions of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect. Section 4. Should any portion of this ordinance be held invalid for any reason, such holding shall not be construed as affecting the validity of the remain- ing portions of this ordinance. The foregoing Ordinance was placed on the table for consideration at the next regular meeting of the Council. Section 3. All ordinances or portions of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect. Section Li. Pursuant to Ordinance No. 29 of the City of Livonia, entitled "An Ordinance Providing the Procedure for Vacating of Streets, Alleys and Public Ground," as amended by Ordinance No. 50, the following public easements are hereby vacated: A public walkway easement described in Petition No. V-73, and being more particularly described as that public walk- way easement, ten (10) feet in width, adjacent to Lots Nos. 25 and 26, of Meadowview Subdivision, a part of the West 1/2 of Section 21, T. 1 S., R. 9 E., City of Livonia, Wayne County, Michigan, as recorded in Liber 84, Page 63, Wayne County Records; provided, however, that there be and hereby is reserved an easement for public utilities and surface drainage across the east six (6) feet of the walkway easement herein vacated; and A public walkway easement described in Petition No. V-73, and being more particularly described as that public walk- way easement, ten (10) feet in width, adjacent to Lots Nos. 50 and 51, of Meadowview Subdivision, a part of the East 1/2 of Section 20 and part of the West 1/2 of Section 21, T. 1 S., R. 9 E., City of Livonia,Wayne County, Michigan, as recorded in Liber 84, Page 63, Wayne County Records; provided, however, that there be and there hereby is reserved an easement for public utilities the full width of the walkway easement herein vacated; and A public walkway easement described in Petition No.V-73, and being more particular described as that public walkway easement, ten (10) feet in width, adjacent to Lots Nos. 65 and 66, of Meadowview Subdivision No. 2, of part of the East 1/2 of Section 20, T. 1 S., R. 9 E., City of Livonia, Wayne County, Michigan, as recorded in Liber 8L, Page 70, Wayne County Records; provided, however, that there be and hereby is reserved an easement for public utilities the full width of the walkway easement herein vacated. Section 3. All ordinances or portions of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect. Section 4. The foregoing Ordinance was placed on the table for consideration at the next regular meeting of the Council. The letter dated February 15, 1963, from the office of the Wayne County Drain Commissioner, regarding a resolution from the Belleville City Council, was received and placed on file for the information of the Council. Page 5926 By Councilman Dooley, seconded by Councilman Parks and unanimously adopted, it was #166-63 RESOLVED that, the letter dated January 3, 1963, and received on February 27, 1963, from the Michigan Association of Osteopathic Physicians and Surgeons, Inc., regarding the development of a community swimming pool in the City of Livonia be and hereby is referred to the Superintendent of Parks and Recreation for his report and recommendation. By Councilman Daugherty, seconded by Councilman Kleinert and unanimously adopted, it was #167-63 RESOLVED that, having considered the communication dated Janu- ary 4, 1963, from the Michigan Liquor Control Commission, and the recom- mendation dated March )4, 1963, from the Director of Public Safety, the Council does hereby approve of the request from Burton Hollow Drug and Pharmacy, Incorporated, for a new SDM license to be located at 17230 Farmington Road, Livonia, Michigan, and the City Clerk is requested to forward a certified copy of this resolution to the Michigan Liquor Control Commission. On motion of Councilman Kleinert, seconded by Councilman Daugherty and unanimously adopted, this 400th regular meeting of the Council of the City of Livonia was duly adjourned at 8:56 P.
