HomeMy WebLinkAboutCOUNCIL MINUTES 1963-03-25 ADJOURNED Page 5947 MINUTES OF THE ADJOURNED FOUR HUNDRED FIRST REGULAR MEETING OF THE COUNCIL OF THE CITY OF LIVONIA On March 25, 1963, the above meeting was held at the City Hall, 33001 Five Mile Road, Livonia, Michigan, and was called to order by the President of the Council at approximately 9:39 P. M. Roll was called with the following result: Present-- Sydney B. Bagnall, John T. Daugherty, Willimm E. Parks, Rudolf R. Kleinert, John F. Dooley, Edward H. McNamara and James R. McCann. Absent-- None, By Councilman Dooley, seconded by Councilman Daugherty, it was #190-63 RESOLVED that, having considered the recommendation dated March 20, 1963, from the Mayor, and the offer from Radner and Radner„ attorneys-at-law, dated March 15, 1963, the Council does hereby authorize the acquisition of the following property: Part of the Southeast 1/4 of Section 11, T. 1 S., R. 9 E., City of Livonia, Wayne County, Michigan, described as follows: Commencing at the South 1/4 corner of said Section 11; thence North 0 degrees 07 minutes 22 seconds 'lest 2400.95 feet along the North-South 1/4 line of said Section, to the point of beginning; thence North 0 degrees 07 minutes 22 seconds Nest 228.00 feet along said North-South line to the center of said Section; thence North 89 degrees 45 minutes 26 seconds East 654.09 feet, along the East-dest 1/4 line of said Section; thence South 0 degrees 15 minutes 06 seconds East 376.00 feet; thence North 77 degrees 30 minutes 12 seconds west 671.15 feet to the point of beginning, containing 4.537 acres and subject to the rights of the public for Curtis Road, excepting the east 30 feet thereof; - AND - The North 180 feet of the East 30 feet of the following described parcel of land, to-wit: Part of the Southeast 1/4 of Section 11, T. 1 S., R. 9 E., City of Livonia, Wayne County, Michigan, described as follows: Commencing at the South 1/4 corner of said Section 11; thence North 0 degrees 07 minutes 22 seconds West 2400.95 feet along the North-South 1/4 line of said Section, to the point of beginning; thence North 0 degrees 07 minutes 22 seconds west 228.00 feet along said North-South line to the center of said Section; thence North 89 degrees 45 minutes 26 seconds East 654.09 feet, along the East-west 1/4 line of said section; thence South 0 degrees 15 minutes 06 seconds East 376.00 feet; thence North 77 degrees 30 minutes 12 seconds West 671.15 feet to the point of beginning, containing 4.537 acres and subject to the rights of the public for Curtis Road; upon the terms and conditions set out in the aforesaid letter from Radner and Radner, attorneys-at-law, dated March 15, 1963, subjectohowever, to the following conditions: Page 5948 (1) that the Department of Law first determine the status of the title to such property and the existence, if any, of any recorded encumbrances against the same; that this authorization is conditioned upon the Department of Law affirmatively determining that no encumbrances of record exist on the land contract sellers interest including building and use restrictions, zoning ordinance, ordinances, easements for sewers and public utilities. (2) that the Department of Lew in consummating said purchase require any other restrictions which might be necessary to protect the interest of the City; and further, this authority is ccnditioned upon the Department of Law affirmatively determining that there is no restriction whatsoever prohibiting the use of this property for parks and recreation purposes; (3) that the vendor, consistent with its offer in the aforesaid letter dated March 15, 1963, simultaneously convey to the City of Livonia without any compensation, the North 180 feet of theEast 30 feet of the aforesaid parcel; and provided further, that for the purpr,ses of this resolution, the sum of $3,800.00 is hereby transferred from the Unallocated Account to the Park Site Acquisition Account of the Budget, and the Mayor and City Clerk are hereby authorized to do any and all things reasonably necessary or in- cidental to the full performance of this resolution. A roll call vote was taken on the foregoing resolution with the following result: AYES: McCann, Daugherty, Dooley, Kleinert, Parks, McNamara and Bagnall. NAYS: None. By Councilman Parks, seconded by Councilman McNamara and unanimously adopted, it was #191-63 RESOLVED that, the letter dated March 20, 1963, from the Mayor, regarding an offer from Mr. Henry Alper to sell to the City a parcel of land located in Section 19 of the City of Livonia, is hereby referred to the next study session of the Council after receiving a report from the Parks and Recreation Commission. By Councilman Kleinert, seconded by Councilman Daugherty, it was #192-63 RESOLVED that, having considered the communication dated March 19, 1963, from the Department of Law, submitted pursuant to resolution #594-62, regarding acceptance of Thorpe Drive as a public street, the Council does hereby authorize the acceptance of those properties described in the aforesaid letter, and for this purpose authorizes the City Clerk to record and thereafter file those deeds referred to in the aforesaid letter, and to do all other things neces- sary or incidental to the full performance of this resolution. A roll call vote was taken on the foregoing resolution with the following result: AYES: McCann, Daugherty, Dooley, Kleinert, Parks, McNamara and Bagnall. NAYS: None. Page 599 By Councilman Parks, seconded by Councilman McCann, it was #193-63 RESOLVED that, having considered the letter dated March 15, 1963, from the City Assessor, the Council does hereby transfer the sum of $2,000.00 from the Unallocated Fund to the Board of Review Salaries Account No. 1115-1, to cover salaries for clerical help for the extension of meetings by the Board of Review. A roll call vote was taken on the foregoing resolution with the following result: AYES: McCann, Daugherty, Dooley, Kleinert, Parks and McNamara. NAYS: Bagnall. The President declared the resolution adopted. By Councilman Daugherty, seconded by Councilman McNamara and unanimously adopted, it was #194-63 RESOLVED that, the Department of Law prepare and submit to the City Council all proper Charter amendments to those sections of the City Charter that are in conflict with applicable State statutes. By Councilman Dooley, seconded by Councilman McNamara and unanimously adopted, it was #195-63 RESOLVED that, the Council hereby accepts the dedication for street purposes of the Westerly thirty (30) feet of property owned by Mr. Gracent Eidt, as described in the letter dated March 20, 1963, from the Mayor, and in consideration of such dedication agrees to install 285 feet of fence along the new westerly line of the grantor's property. By Councilman Dooley, seconded by Councilman McNamara and unanimously adopted, it was #196-63 RESOLVED that, the letter dated March 19, 1963, from Municipal Judge Robert H. Lorion regarding authority of the Court Clerk to sign checks for and in behalf of the Municipal Judge, is hereby referred to the Department of Law for report and recommendation.
