MINUTES OF THE THREE HUNDRED EIGHTY-EIGHTH REGULAR MEETING
OF THE COUNCIL OF THE CITY OF LIVONIA
On December 5, 1962, the above meeting was held at the City Hall, 33001
Five Mile Road, Livonia, Michigan, and was called to order by the President of the
Council at approximately 8:19 P. M. Councilman Kleinert delivered the invocation.
Roll was called with the following result: Present-- Sydney B. Bagnall, John T.
Daugherty, William E. Parks, Rudolf R. Kleinert, John F. Dooley, Edward H. McNamara
and James R. McCann. Absent-- None.
Elected and appointed City Officials also present: Marie W. Clark, City
Clerk; the Director of Public Works; the Police Chief, the Chief City Engineer; the
City Attorney; the first Assistant City Attorney; and the Budget Director.
By Councilman McCann, seconded by Councilman McNamara and unanimously
adopted, it was
#898-62 RESOLVED that, the minutes of the 387th regular meeting of the
Council of the City of Livonia, held on November 28, 1962, are hereby
approved.
The letter dated December 5, 1962, from the Mayor, regarding a program for
refunding outstanding water bonds, was received and placed on file.
The letter dated December 3, 1962, from the Director of Public Works
regarding accelerated public works applications, submitted pursuant to resolution
#862-62, was received and placed on file for the information of the Council.
By Councilman Daugherty, seconded by Councilman McNamara and unanimously
adopted, it was
#899-62 RESOLVED that, the Council of the City of Livonia does hereby
urge that all possible action be taken to expedite the release of all
remaining funds appropriated by the Congress for use in connection with
the recently enacted Accelerated Federal Public Works Program; this
resolution is adopted in view of the several applications for public
works projects which have been filed by the City of Livonia with the
Community Facilities Administration, all of which public works projects
are required in the interest of our community and for the welfare of its
citizens; further, the City Clerk is hereby requested to send copies of
this resolution to the President of the United States, Senators Patrick
V. McNamara and Philip A. Hart, and Congressman Martha W. Griffiths in
order that they might take whatever action is within their respective
powers toward accomplishing the release of such Federal funds.

By Councilman Dooley, seconded by Councilman McNamara and unanimously
adopted, it was
#900-62 RESOLVED that, the City Council of the City of Livonia does hereby
acknowledge receipt of the letter from the City Attorney, dated November 30,
1962, pertaining to the matter of the Dennis Corporation vs the City of
Livonia, a cause pending in the Wayne County Circuit Court, No. 627-519,
together with a copy of the Order of the Court entered in such cause on the
30th day of November, 1962; further, that this Council does hereby set the
12th day of December, 1962, at its regularly scheduled Council meeting, as
the time for re-examination of the application of the Dennis Corporation
in accordance with the Court's Order; further, that the City Clerk be and
is hereby instructed to advise the counsel for the plaintiff of the pro-
posed re-examination of the application pursuant to the Court Order which
requires such notice; and further, that the City Clerk cause a notice of
this re-examination to be published in the official publication of the City
of Livonia prior to the time of the hearing so that all people in the City
of Livonia may know that December 12th is the time that this Council will
take under consideration the re-examination of the Dennis Corporation's
application.
By Councilman Parks, seconded by Councilman Kleinert, it was
#901-62 RESOLVED that, having considered the report and recommendation
dated November 23, 1962, from the Chief City Engineer, approved by the
Director of Public Works, and it appearing that the contractor's declaration,
contractor's affidavit and waiver of lien have been received and filed in
the office of the City Clerk, and that all work has been completed in ac-
cordance with City standards, the Council does hereby authorize final
payment of the sum of $504.62 to Waterway Construction Company, 22226 West
Eight Mile Road, Southfield, Michigan, for the installation of a sanitary
sewer on Whitcomb Drive, pursuant to a contract dated December 11, 1961,
with the City, and the City Clerk is hereby requested to send a certified
copy of this resolution to the Board of County Road Commissioners of Wayne
County for its approval and for payment from surplus construction funds
remaining from the 1956 sanitary sewer bond issue.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Daugherty, Parks, Kleinert, Dooley, McNamara, McCann and Bagnall.
NAYS: None.
The letter dated November 21, 1962, from the Department of Law, submitted
pursuant to resolution #809-62, regarding the status of present court cases, was
received and placed on file for the information of the Council.
The letter dated November 23, 1962,from the Livonia Chamber of Commerce,
regarding its policy for accommodating new business in Livonia, was received and
placed on file for the information of the Council.

By Councilman McNamara, seconded by Councilman Dooley and unanimously
adopted, it was
#902-62 RESOLVED that, having considered the letter dated November 15,
1962, from the Greenwich Pointe Civic Association requesting the installa-
tion of street lights at certain intersections, the Council does hereby
refer the same to the Director of Public Safety for his report and recom-
mendation.
By Councilman McCann, seconded by Councilman McNamara and unanimously
adopted, it was
#903-62 RESOLVED that, having considered the letter dated November 28,
1962, from the Burton Hollow Civic Association regarding the installation
of street lights at certain intersections (with the reference therein to
a previous letter dated April 10, 1962, on the same subject), the Council
does hereby refer this matter to the Director of Public Safety for his
report and recommendation.
By Councilman McCann, seconded by Councilman Dooley, it was
#9014.62 RESOLVED that, having considered the report and recommendation
dated November 30, 1962, from the Superintendent of Operations Division,
approved by the Director of Public Works, the Council does hereby accept
the low bid of Morton Salt Company, 10335 Flora, Detroit 17, Michigan,
for supplying salt to the City of Livonia at a price of $6.90 per ton,
delivered.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Daugherty, Parks, Kleinert, Dooley, McNamara, McCann and Bagnall.
NAYS: None.
By Councilman Daugherty, seconded by Councilman McCann and unanimously
adopted, it was
#905.62 RESOLVED that, the bids for rock salt as received by the City
of Livonia and detailed in the letter dated November 30, 1962, from the
Director of Public Works to the City Council, are hereby referred to the
Anti-Trust Division of the Department of Justice in connection with bids
for this item from previous years.
By Councilman McNamara, seconded by Councilman Daugherty, it was
#906-62 RESOLVED that, having considered the report and recommendation
dated November 30, 1962, from the Superintendent of Operations Division,
approved by the Director of Public Works, the Council does hereby accept
the bids of Michigan Chemical (28% delivered and 38% spread), and Dow
Chemical (38% delivered) for supplying liquid calcium chloride to the City
of Livonia; further, the Council hereby requests that the Director of

Public Works order such material from the successful bidders in amounts
which are as equal as possible under prevailing circumstances.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Daugherty, Parks, Kleinert, Dooley, McNamara, McCann and Bagnall.
NAYS: None.
By Councilman Kleinert, seconded by Councilman McCann, it was
#907-62 RESOLVED that, having considered the report and recommendation
dated November 30, 1962, from the Superintendent of Operations Division,
approved by the Director of Public Works, the Council does hereby accept
the following respective bids for the items listed below:
(1) The low bid of the Michigan Concrete Company, 14445 Hamilton
Avenue, Detroit 3, Michigan, for all items (concrete Pipe) listed
in Group I of the bid specifications.
(2) The low bid of the Michigan Concrete Compary, supra, for supply-
ing the City of Livonia with the following particular items:
GROUP II - MANHOLES & CATCH BASINS:
ManHole Steps $ 1.25 each
Precast Inlets 2X2 with Dog House 12.00 each
Precast Bottoms for 2' Inlet 10.00 each
(3) The low bid of Michigan Concrete Co., supra, and Macomb-Oakland
Supply Company, 12300 North Inkster Road, Detroit 39, Michigan, for
supplying to the City of Livonia the following items, the City
reserving the privilege of purchasing from the supplier who can
furnish the material most promptly as same is needed:
Manhole Casting #1020 H $39.00 each
Catch Basin Castings #1260 27.00 each
Precast Catch Basins 3'X2'X6' 54.00 each
Catch Basins 36" x 6' 5!4.00 each
(4) The low bid of the Macomb-Oakland Supply Company, supra, for
supplying the City of Livonia with the following particular items:
Precast Man Holes )'X3'X7' $11.50/ft.
Precast Bottoms for 4' Manholes 16.00 each
Precast Bottoms for 3' Manholes 9.00 each
DeWitt Compound #10 or 10W .53/gal
(5) The low bid of the Macomb-Oakland Supply Co., supra, for all
items (vitrified pipe) listed in Group III of the bid specifications.
all of which is consistent with the aforesaid recommendation from the
Operations Division.

A roll call vote was taken on the foregoing resolution with the following results
AYES: Daugherty, Parks, Kleinert, Dooley, McNamara, McCann and Bagnall.
NAYS: None.
By Councilman Kleinert, seconded by Councilman McCann, it was
#908-62 RESOLVED that, having considered the report and recommendation
dated November 30, 1962, from the Superintendent of Operations Division,
approved by the Director of Public Works, the Council does hereby accept
the low bid of United Steel Fabricators, Inc., 333 Gasche Street, Wooster,
Ohio, for supplying the City with guard rail at 87 cents per foot and end
sections at $2.05 each, such having been the lowest bid for these items.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Daugherty, Parks, Kleinert, Dooley, McNamara, McCann and Bagnall.
NAYS: None.

approved by the Director of Public Works, the Council does hereby accept
the following bids for the items listed below:

supplying the City with the following particular items:

all of which is consistent with the aforesaid recommendation from the
Operations Division.
A roll call vote was taken on the foregoing resolution with the following result:

NAYS: None.
The resolution adopted by the Pontiac City Commission on November 13, 1962,
regarding the addition of fluoride to the water supply of that City, was received and
placed on file.

By Councilman McNamara, seconded by Councilman Parks, it was
#910-62 RESOLVED that, the action of this Council in reducing all
departmental budgets by 5% was done for the purpose of meeting committed
and anticipated capital expenditures not provided for in the proposed
1962-63 budget, these committed and anticipated capital items being
approximately $120,000; it is not the intent of the Council that essential
police or fire services be reduced; and if, in the judgment of the admin-
istration, this amount can be secured by larger reductions in other
departments, the Council will look upon such a recommendation most
favorably.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Daugherty, Parks, Kleinert, Dooley, McNamara, McCann and Bagnall.
NAYS: None.
On motion of Councilman Kleinert, seconded by Councilman McCann and
unanimously adopted, this 388th regular meeting of the Council of the City of
Livonia was duly adjourned at 8:56 P. M., December 5, 1962.
