MINUTES OF THE THREE HUNDRED FORTY-SEVENTH REGULAR MEETING
OF THE COUNCIL OF THE CITY OF LIVONIA
On November 6, 1961, the above meeting was held at 33001 Five Mile Road,
Livonia, Michigan, and was called to order by the President of the Council at ap-
proximately 8:56 P. M. Councilman Kleinert d elivered the invocation. Roll was
called with the following result: Present-- Sydney B. Bagnall, John T. Daugherty,
William N. Ponder, Rudolf R. Kleinert,Austin T. Grant, Jack Salvadore and James R.
McCann. Absent-- None.
By Councilman Ponder, seconded by Councilman Daugherty and unanimously
adopted, it was
#761-61 RESOLVED that, the minutes of the 316th regular meeting of the
Council of the City of Livonia held October 23, 1961, and the 68th special
meeting held November 1, 1961, are hereby approved.
By Councilman .alvadore, seconded by Councilman Daugherty, it was
#762-61 RESOLVED that, the following resolution, vetoed by the Mayor
on October 31, 1961, be and hereby is readopted:
RESOLVED that, Council resolution #655-61 adopted on September 25,
1961, requesting the Department of Law to prepare a certain ordinance,
is hereby rescinded and the Election Commission is requested to submit
an additional report of those precincts not in conformity with State law
as regards machine precincts.
The President relinquished the chair to the Vice President at 9:02 P. M., to speak
on the motion, and resumed the chair at 9:06 P. M.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Ponder, Grant, Salvadore, McCann, Daugherty and Bagnall.
NAYS: Kleinert.
The President declared the resolution adopted and the Mayor's veto over-ruled.
By Councilman Kleinert, seconded by Councilman Grant, it was
#763-61 RESOLVED that, the complete budget for the next fiscal year
commencing December 1, 1961, and ending November 30, 1962, as submitted
by the Mayor to the Council on September 15, 1961, pursuant to Section 3,
Chapter VII of the City Charter, and as revised by the Counci 1, be and
hereby is determined and adopted and appropriations made as provided by
the City Charter; that all proceedings on said budget be and hereby are
approved as being in full conformance with the City Charter, it appearing

that proper notice of public hearing thereon was duly published in The
LLivonia City-Post, the official newspaper of the City on October 25, 1961;
and provided further, that the City Clerk shall publish or cause to be
published this resolution together with a summary of the said budget as
adopted herein, together with the minutes of this meeting.
Councilman Daugherty called for a division of the question. After receiving an
opinion from the City Attorney, the Council President declared the request out of
order.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Ponder, Kleinert, Grant, Salvadore„ McCann and Bagnall.
NAYS: Daugherty.
The President declared the resolution adopted.

By Councilman Grant, seconded by Councilman Salvadore, it was
#764-61 RESOLVED that, in administering the 1961-62 City budget, the
particular attention of the Mayor and several department heads is directed
to the provisions for capital outlay, and to the summary of such provisions
dated November 6, 1961, entitled, uDetail of Capital Outlay, and expenditures
from this section of the budget shall be made only for those items specifi-
cally authorized therein and such expenditures shall in no case exceed the
specific appropriations provided therefor; any deviation as to the nature
of the item or amount of the expenditure shall require prior Council approval.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Ponder, Kleinert, Grant, Salvadore, McCann, Daugherty and Bagnall.
NAYS: None.
By Councilman Ponder, seconded by Councilman Grantl it was
#765-61 RESOLNIZ that, pursuant to Section 5, Chapter VII and Section 1
of Chapter VIII of the Charter of the City of Livonia, the Council does
hereby establish a tax levy of five (5) mills, i e., five-tenths (5/10)
of one (1) percentum of the State equalized assessed valuation of all real
and personal property subject to taxation in the City of Livonia for the
next fiscal year commencing December 1, 1961, and ending November 30, 1962,
and in addition to the above amount which is authorized to be levied for
general purposes by the Charter of the City of Livonia:
(a) The Council does hereby establish a tax levy of .09 mills, i. e.,
9/1000 of one (1) percentum of the State equalized assessed valuation
of all real and personal property subject to taxation in the City of
Livonia for the fiscal year set out above for the purpose of debt
retirement on a 1959 Fire Station Bond issue;
(b) The Council does hereby establish a tax levy of one (1) mill, i. e.,
1/10 of one (1) percentum of the State equalized assessed valuation
of all real and personal property subject tn taxation in the City of
Livonia for the fiscal year set out above, pursuant to the provisions
of Act 298 of the Public Acts of 1917, for the purpose of establish-
ing, operating, maintaining and administering the Municipal Garbage
Collection System and/or plant for the collection and disposal of
garbage and refuse in the City of Livonia; and in addition to the
amount authorized to be levied for general purposes;

(c) The Council does hereby establish a tax levy of .04 mills i. e.,
1/250th of one (1) percentum of the State equalized assessed valuation
Lof all real and personal property subject to taxation in the City of
Livonia for the fiscal year set out above for the purpose of debt
retirement on the 1960 Public Library Bond issue; and also in addition
to the above amount which is authorized to be levied for general
purposes;
(d) The Council does hereby establish a tax levy of .19 mills, i. e.„
19/1000 of one (1) percentum of the State equalized assessed valuation
of all real and personal property subject to taxation in the City of
Livonia for the fiscal year set out above for the purpose of debt
retirement on the 1954 Middle Rouge Interceptor Bond issue;
and provided further, that the Wayne County Bureau of Taxation, City
Assessor, City Treasurer and City Clerk are hereby authorized and directed
to do all things necessary or incidental to the full performance of this
resolution, and the City Clerk is requested to immediately transmit copies
of this resolution to each of the above offices.
A roll call vote was taken on the foregoing resolution with the following result:

By Councilman Kleinert, seconded by Councilman Grant and unanimously
adopted, it was
#766-61 RESOLVED that, Petition No.V-62 submitted by the City Planning
Commission under date of November 3, 19b1, to vacate the 86 foot street
known as Alois Avenue whichruns south from Schoolcraft Road between Lots
6 and 7 of Schoolcraft Manor Subdivision in the North 1/2 of Section 30,
is hereby referred to the City Planning Commission for action and recom-
mendation according to law and Ordinance No. 29.
The letter from the Mayor regarding the Livonia Hockey League was removed
from the agenda to a special meeting to be held dednesday, November 8, 1961.
The letter from the Mayor, accompanied by a report from the Engineering
Division, regarding the Plymouth Road Sanitary Sewer, Middlebelt to Farmington Road,
was removed from the agenda to the next study meeting.
By Councilman Kleinert, seconded by Councilman Daugherty, it was
#767-61 REsOLVED that, having considered the r_lcommendation of the
[mu Library Commission, dated November 2,1961, regarding bids received for
furnishing the Carl Sandburg Library, and havihg considered also in this
connection, the recommendation of Tarapata-Macvlahon Associates,Inc.,A.I.A.,
dated November 1, 1961, which recommendation is made a part of this resolu-

tion by this reference, the Council does hereby accept the adjusted bid
submitted by the C. A. Finsterwald Company, for supplying furniture for
the said library, in the amount of $2,757.74, and the Council also accepts
the bid of Townley Draperies in the amount of $299.00 for supplying draperies
for said library-, such bids having been in fact the lowest bids received
for the items listed in the aforementioned recommendation of the architect.

On motion of Councilman Kleinert, secorded by Councilman McCann and
unanimously adopted, this 347th regular meeting of the Council of the City of
