HomeMy WebLinkAboutCOUNCIL MINUTES 1955-08-15 SPECIAL Page 1991 LTHIRTY-FIRST SPECIAL MEETING OF THE COUNCIL OF THE CITY OF LIVONIA On August 15, 1955, the above meeting was held at 33001 Five Mile Road, Livonia, Michigan, and was called to order at approximately 8:11 P. M., by the President of the Council, John T. Daugherty. Councilman Kleinert delivered the invocation. Roll was called with the following result: Present-- John T. Daugherty, David L. Jones, Harry R. Killam, Rudolf R. Kleinert, John W. Whitehead and Wilson W. Edgar. Absent-- Nettie Carey. The following members of the Building Code Board of Appeals attended this meeting: Gustave Muth, James Orr, John Perkins and Ove Hanson. The City Clerk, Marie W. Clark, read a letter dated August 12, 1955 from Friedman, Meyers and Keys, attorneys for Slatkin Builders; letter dated August 21, 1955 from C. V. S. Building Company, letter dated August 11, 1955 to Howard Middle- wood, Acting Chief Building Inspector from the Mayor; and letter addressed to the Council dated August 12, 1955 from the Mayor. Councilman Whitehead was excused at 8:21 P.M. , and returned at 8:23 P.M. By Councilman Edgar, seconded by Councilman Whit ehead, it was #413-55 RESOLVED that, the Council does hereby uphold the decision of the Building Code Board of Appeals taken by such board at the regularly scheduled meeting held Thursday, August 11, 1955, pursuant to Section 104.14 of Ordinance No. 51, otherwise known as the Build- ing Code, wherein such Appeal Board determined that the Inspection Department shall issue 24 building permits to Slatkin Builders, Inc., and 31 building permits to C. V. S. Building Company. By Councilman Kleinert, seconded by Councilman Kill am, it was RESOLVED that, the foregoing resolution #413-55 be tabled pending a det :rmination in Circuit Court case. A roll call vote was taken on the foregoing resolution with the following result: imm AYES: Killam and Kleinert NAYS: Jones, Whitehead, Edgar and Daugherty. The President declared the resolution denied. Page 1992 A roll call vote was taken on resolution #413-55 with the following result: AYES: Jones, Killam, Whitehead, Edgar and Daugherty. NAYS: Kleinert. The President declared the resolution adopted. A recess was called at 9:51 P. M., after which the meeting resumed with all members present who were named as present in the original roll call of this meeting. The City Clerk, Marie W. Clark, read a letter dated August 8, 1955, ad- dressed to the Mayor from the Shelden Land Company. Mr. Bleakley appeared before the Council in regard to this matter. By Councilman Whitehead, seconded by Councilman Edgar, it was #414-55 RESOLVED that, careful consideration having been given to the request of Shelden Land Company dated August 9, 1955 for 28 building permits in Rosedale Gardens Subdivision No. 14, and having further noted the stipulation set forth in paragraphs two and three of the above request, the Council does hereby grant permission to the Shelden Land Company to make application for 28 building permits. A roll call vote was taken on the foregoing resolution with the following result: AYES: *Jones, Killam, Kleinert, Whitehead, Edgar and Daugherty. NAYS: None. *Councilman Jones abstained from voting, which under Ordinance No. 27, Section 19, is recorded as a yes vote. By Councilman Edgar, seconded by Councilman Whitehead and unanimously adopted, it was #415-55 RESOLVED that, the Inspection Departnent be and hereby is in- structed to issue building permits in accordance with the provisions of resolutions #413-55 and #414-55. By Councilman Kleinert, seconded by Councilman Jones and unanimously adopted, it was #416-55 RESOLVED that, the City Attorney be instructed to prepare an amendment to Ordinance No. 51 permitting the Council to waive certain Page 1993 conditions for issuance of building permits as now outlined by said Ordinance No. 51. The City Clerk, Marie W. Clark, read a letter dated August 15, 1955, from Mrs. Joseph Morelli, and letter dated August 9, 1955 from the City Attorney. By Councilman Edgar, seconded by Councilman Whitehead, it was #417-55 RESOLVED that, careful consideration having been given to the requests of Mrs. Joseph Morelli dated July 29, 1955 and August 15, 1955, for a permit to build a home on three acres of lard on Six Mile Road between Middlebelt and Merriman Roads, the Inspection Department be and hereby is instructed to issue such building permit to Mrs. Joseph Morelli in compliance with this resolution. A roll call vote was taken on the foregoing resolution with the following result: AYES: Jones, Killam, Whitehead, Edgar and Daugherty. NAYS: Kleinert. The President declared the resolution adopted. The City Clerk, Marie W. Clark, read a letter dated August 11, 1955 from iwo Harry Slatkin Builders, Inc., requesting building permits. By Councilman Kleinert, seconded by Councilman Jones and unanimously adopted, it was #418-55 RESOLVED that, the communication from Harry Slatkin Builders, Inc., dated August 11, 1955, be tabled to the meeting of August 22, 1955. On motion of Councilman Kleinert, seconded by Councilman Killam and unanimously adopted, this 31st special meeting of the City Council was duly ad- journed at 10:54 P.
