HomeMy WebLinkAboutCOUNCIL MINUTES 1956-04-23 Page 2287 MINUTES OF THE ONE HUNDRED SIXTY-SEVENTH REGULAR MEETING OF' THE COUNCIL OF THE CITY OF LIVONIA On April 23, 1956, the above meeting was held at 33001 Five Mile Road, Livonia, Michigan, and was called to order at approximately 8:07 P.M., by the President of the Council, Austin T.Grant. Councilman Kleinert delivered the invocation. Roll was called with the following result: Present-- Austin T. Grant, Rudolf R. Kleinert, Sydney B.Bagnall, Frank OtNeill,David L. Jones, Peter A. Ventura and John T. Daugherty. Absent-- None. By Councilman Kleinert, seconded by Councilman O'Neill, it was #230-56 RESOLVED that, the minutes of the 166th regular meeting of the City Council held April 16, 1956, are approved as corrected. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Bagnall, O'Neill, Ventura, Daugherty and Grant. NAYS: Jones. s The President declared the resolution adopted. The City Clerk, Marie W. Clark, read a letter dated April 23, 1956 from the Mayor. By Councilman Kleinert, seconded by Councilman Ventura and unanimously adopted, it was #231-56 RESOLVED that, the recommendations contained in the letter from the Mayor dated April 23, 1956 be tabled to a meeting of the Committee of the Whole. The City Clerk, Marie W. Clark, read a letter dated April 23, 1956 from Ferry and Lyle, City Auditors. By Councilman Daugherty, seconded by Councilman Jones and unanimously adopted, it was #232-56 RESOLVED that, the letter dated April 23, 1956 from the City Auditor regarding transfer of Parks and Recreation Accounts to the Department of Public Works is hereby referred to the Finance Committee for report and recommendation to the Council. Page 2288 The City Clerk, Marie W. Clark, read a letter dated April 20, 1956 from the Election Commission. Councilman Kleinert introduced the following Ordinance: NO. AN ORDINANCE TO AMEND SECTIONS 3, 4, 5, 8, 9$ 11, 12, 14 AND 16 OF ORDINANCE NO. 117 OF THE CITY OF LIVONIA, ENTITLED "AN ORDINANCE ESTABLISHING ELECTION PRECINCTS WITHIN THE CITY OF LIVONIA, FIXING THE BOUNDARIES THEREOF, AND PROVIDING FOR THE PUBLICATION AN) POSTING OF NOTICE THEREOF." THE CITY OF LIVONIA ORDAINS: Section 1. Sections 3, 4, 5, 8, 9, 11, 12, 14 and 16 of Ordinance No. 117 of the City of L vonia, entitled "An Ordinance Establishing Election Precincts Within the City of Livonia, Fixing the Boundaries Thereof, and Providing for the Publication and Posting of Notice Thereof," are hereby amended to read as follows: Section 3. That election precinct number two shall include: All that area of City bounded on the North by the center of Schoolcraft Road, on the East by the center of Merriman Road, on the South by the center of West Chicago Road, and on the West by the center of Hubbard Road and an imaginary line extending North to the center of Schoolcraft Road. Section 4. That election precinct number three shall include: A11 that area of City lying West of the center of Hubbard Road and an imaginary line extending South to the center of Schoolcraft Road, between the center of Six Mile Road and the center of Schoolcraft Road. Section 5. That election precinct number fonrshall include: All that area lying between the center of Schoolcraft Road and the center of Plymouth Road, between the center of Farmington Road and the center of New- burgh Road; also that area lying West of the center of Newburgh Road, be- tween the center of Amrheiin Road and Schoolcraft Road; Also, including that area of City lying South of the center of Plymouth Road, between the center of Farmington Road and the center of Wayne Road. Section 8. That election precinct number seven shall..include: All that area of City lying East of the center of Middle Belt Road, be- tween the center of Six Mile Road and the center of Schoolcraft Road. Section 9. That election precinct number eight shall include: All that area of City lying East of the center of Middle Belt Road, between the center of Schoolcraft Road and the center of Plymouth Road; also that area of City bounded by the center lines of Plymouth Road, Harrison Avenue, West Chicago Road and Middle Belt Road. Section 11. That election precinct number ten shall include: Page 2289 All that area of City lying South of Schoolcraft Road, between the center of Henry Ruff Road (and an imaginary line extending North to the center of Schoolcraft Road) and the center of Middle Belt Road. Section 12. That election precinct number eleven shall include: All that area of City lying South of the c enter of Schoolcraft Road, be- tween the center of Henry Ruff Road (and an imaginary line extending North to the center line of Schoolcraft Road) and the center of Merriman Road. Section.]4. That election precinct number thirteen shall include: All that area of City lying South of the center of Schoolcraft Road, be- tween the center of Columbia (as extended) and Hubbard Roads (and an im- aginary line extending North to the center of Schoolcraft Road) and the center of Farmington Road. Section 16. That election precinct number fifteen shall include: All that area of City bounded on the North by the center of Six Mile Road, on the East by the center of Middle Belt Road, on the South by the center of Schoolcraft Road, and on the West by the center of Hubbard Road, as ex- tended by an imaginary line South to Schoolcraft Road. Section 2. That notice of the division of the City into the described election precincts shall be published for two successive weeks in The Livonian, the first publication to be within ten (10) days after the adoption of said ordinance, and such notice shall be posted in two or more public places in each of the said election precincts; and a like m tLce shall be immediately transmitted by the City Clerk to the County Clerk. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect. Section 4. Should any portion of this ordinance be held invalid for any reason, such holding shall not be construed as affecting the validity of any of the remaining portions of this ordinance. Section 5. This ordinance is hereby declared to be immediately necessary for the preservation of public safety and welfare, and shall become effective im- mediately upon publication. A roll cel vote was taken on the foregoing ordinance with the following result: AYES: Kleinert, Bagnall, O'Neill, Jones, Ventura, Daugherty and Grant. NAYS: None. The President declared the foregoing Ordinance duly adopted and would become effective on date of publication, May 3, 1956. By Councilman Kleinert, seconded by Councilman Jones, it was Page 2290 #233-56 RESOLVED that, pursuant to Charter Amendments #3 and #14, adopted by the electorate on February 20, 1956, appropriations from the Unallocated Fund to salary accounts are hereby approved as follows: Salary Account, Mayor $2,181.69 ►� n City Treasurer 2,310.00 A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Bagnall, O'Neill, Jones, Ventura, Daugherty ani Grant. NAYS: None. By Councilman Kleinert, seconded by Councilman Bagnall, it was #231 -56 RESOLVED that, the amount of $500.00 is hereby transferred from the Unallocated Fund to Election Commission Account #EC 70. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Bagnall, O'Neill, Jones,Ventura, Daugherty and Grant. NAYS: None. By Councilman Ventura, seconded by Councilman O'Neill, it was #235-56 RESOLVED that, the City Attorney is hereby instructed to con- sider the question of responsibility in connection with complaints re- garding the installation of the new sewer, as to whether the City or the County shall provide the inspectors to see that this work is carried out, and on other matters of information pertaining to the restoring of property along the right of way of the new sewers, for report to the Council. A roll call vote was taken on the foregoing resolution with the following result: AYES: Bagnall, O'Neill, Jones, Ventura, Daugherty and Grant. NAYS: Kleinert. The President declared the resolution adopted. The City Clerk, Marie W. Clark, read a letter dated April 23, 1956 from the Director of Public Works and City Engineer regarding requests for sewer extensions. By Councilman B*gnall, seconded by Councilman Daugherty and unanimously adopted, it was #236-56 RESOLVED that, the matter of funds for additional sewers be referred to the Wayne County Road Commission with the query as to the amount of available funds for this purpose, together with a complete progress report on present sewer construction to date. Page 2291 By Councilman Bagnall, seconded by Councilman Daugherty, it was #237-56 RESOLVED that, the matter of the Council agenda be referred to the Committee of the Whole for further discussion. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Bagnall, Jones, Daugherty and Grant. NAYS: O'Neill and Ventura. The President declared the resolution adopted. By Councilman Daugherty, seconded by Councilman Bagnall and unanimously adopted, it was #238-56 RESOLVED that, the recommendation from the Director of Public Works and City Engineer, dated April 23, 1956, be tabled pending the report from the Wayne County Road Commission in reference to the sewer. An Ordinance entitled, "An Ordinance to Amend Section 1 and 3 of Ordinance No. 5 of the City of Livonia, entitled 'An Ordinance Creating a Bureau of Inspection, and Defining its Powers and Duties'," introduced by Councilman Daugherty April 16, 1956, was taken from the table and a roll call vote conducted thereon with the following result: AYES: Kleinert, Bagnall, O'Neill, Jones, Ventura, Daugherty and Grant. NAYS: None. The ?resident declared the Ordinance duly adopted and would become effective on date of publication, May 3, 1956. An Ordinance entitled, "An Ordinance Vacating Portions of Certain Streets, Alley, and Public Ground", introduced April 16, 1956, by Councilman Kleinert, was taken from the table and a roll call vote conducted thereon with the following result: AYES: Kleinert, Bagnall, O'Neill, Jones, Ventura, Daugherty and Grant. NAYS: None. The President declared the ordinance adopted and would become effective on date of publication, May 3, 1956. By Councilman Ventura, seconded by Councilman Daugherty, it Was Page 2292 #239-56 RESOLVED that, the roll call vote on the Ordinance Amending Ordinance No. 60, introduced by Councilman Jones on April 16, 1956, is hereby tabled until the next regular meeting of the Council. A roll call vote was taken on the foregoing resolution with the following result: AYES: Bagnall, O'Neill, Jones, Ventura, Daugherty and Grant. NAYS: Kleinert. The President declared the resolution adopted. At the requests of the petitioners, the letters from Unity Construction Company and Temple, Brown, Temple and. Williams were withdrawn until the meeting of April 30, 1956. Marie W. Clark, City Clerk, read a letter dated April 16, 1956 from the City Assessor regarding installation of sidewalks on Five Mile Road. By Councilman Kleinert, seconded by Councilman O'Neill, it was #2l.0-56 RESOLVEp that WHEREAS, pursuant to the direction of the Council, the City Assessor of said City of Livonia, has prepared and reported to the Council the assessment roll covering and containing the Special Assess- ment assessed and levied, respectively, in proposed Special Assessment District No. 6, as heretofore established for the construction of proposed sidewalks in said district as designated in resolution heretofore adopted by the Council; THEREFORE, BE IT RESOLVED, that the said roll be accepted by the City Council and that it be filed in the office of the City Clerk for pub- lic examination and that the City Clerk be and hereby is directed to give notice pursuant to the provisions of Ordinance No. 31, of the City, as amended by Ordinances No. 46, 65 and 73; that the Assessment Roll has been made and filed in the office of the City Clerk for public exa dnation, and that the City Council of the City of Livonia will meet in the Municipal Building in said City at 8:30 o'clock P. M., on Thursday, May 17, 1956, to review the said Special Assessment Roll, at which time and place op- portunity will be given to all persons interested to be heard; IT IS FURTHER RESOLVED, that the City Clerk give notice of said hearing by causing a copy of this resolution to be published once in The Livonian, a newspaper published and circulated in said City, at least ten. (10) days prior to the date of May 17, 1956, and that the City Clerk also give notice of said hearing by sending written notice thereof to each property owner subject to special assessment by reason of said improvements; the addresses of said property owners to be taken from the latest tax assess- ment roll in the City Assessor's office. A roll call vote was taken on the foregoing resolution with the following result: Page 2293 AYES: Kleinert, Bagnall, c1'Nei 1, Jones, Ventura, Daugherty and Grant. NAYS: None. A recess was called at 9:48 P. M., after which the meeting resumed with all members present who were named as present in the original roll call of this meeting. The City Clerk, Marie W. Clark, read a letter dated April 17, 1956 from the Civil Service Commission regarding certain excluded classifications for over- time pay. By Councilman Daugherty, seconded by Councilman Kleinert, it was RESOLVED that, the recommendations of Civil Service Commission be referred to a meeting of the Committee of the Whole. By Councilman Ventura, seconded by Councilman Bagnall, it was #211-56 RESOLVED that, the recommendations of Civil Service Commission dated April 17, 1956 regarding excluded classifications and sick leave be tabled indefinnitely. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Bagnall, O'Neill, Ventura, Daugherty and Grant. NAYS: Jones. The President declared the resolution adopted. Marie W. Clark, City Clerk, read a letter from the Parks and Recreation Commission dated April 19, 1956, regarding the purchase of park property in Section 35. By Councilman Ventura, seconded by Councilman Bagnall, it was #242-56 RESOLVED that, the Mayor and City Clerk are requested to enter into negotiations with Henry S. Alper for a land contract on the purchase of a park site in Section 35, as further set forth in the letter from the Parks and Recreation Commission dated April 19, 1956, and that the results of such negotiations shall be presented to the City Council prior to final determination. Clark, read a letter from the Civil Service Com- l. mission dated April 18, 1956, requesting an appropriation of $250.00. By Councilman Jones, seconded by Councilman Ventura, it was #213-56 RESOLVED that, the request of the Civil Service Commission for an appropriation of $250.00 to Budget Account No. 8, Publishing, is ap- proved and such sum is hereby transferred from the Unallocated Fund for this purpose. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Bagnall, O'Neill, Jones, Ventura, Daugherty and Grant. NAYS: None. Marie W. Clark, City Clerk, read a letter dated April 19, 1956, from the Superintendent of Public Works regarding additional personnel. By Councilman Kleinert, seconded by Councilman Daugherty and unanimously adopted, it was #244-56 RESOLVED that, the request of the Superintendent of Public Works dated April 19, 1956 for additional personnel be and hereby is approved. The City Clerk read a letter from Mr. Herman Band, dated March 16, 1956, relative to certain improvements in Botsford Park Subdivision. By Councilman Daugherty, seconded by Councilman O'Neill and unanimously adopted, it was #245-56 RESOLVED that, the petition of Herman Band dated March 16, 1956, relative to certaih improvements in Botsford Park Subdivision is hereby referred to the City Engineer for report and recommendation to the Council. The City Clerk, Marie W. Clark, read a letter dated April 12, 1956 from Harold Sivertson, requesting extension of sewer on Inkster Road. By Councilman O'Neil, seconded by Councilman Ventura and unanimously adopted, it was #216-56 RESOLVED that, the request of Harold A. Sivertson dated April 12, 1956, for extension of sewer from Inkster Road to Lot 143 on Whitcomb Drive is hereby referred to the City Engineer for report and recommendation. The City Clerk read a letter dated April 13, 1956 from Rose Hill Builders Page 2295 regarding the paving of Deering Avenue. By Councilman Daugherty, seconded by Councilman Bagnall, it was #2!i7-56 RESOLVED that, the letter dated April 13, 1956 from Rose Hill Builders regarding the paving of Deering Avenue is hereby referred to the City Engineer for report to the Council. A roll call vote was taken on the foregoing resolution with the following result: AYES: Bagnall, O'Neill, Jones, Ventura, Daughe rby and Grant. NAYS: Kleinert. The President declared the resolution adopted. By Councilman Bagnall, seconded by Councilman Daugherty and unanimously adopted, it was #218-56 RESOLVED that, the letters from the City Planning Commission, tabled from the meeting of April 16, 1956, are hereby referred to the Committee of the Whole meeting to be held Thursday,April 26, 1956. On motion of Councilman Daugherty, seconded by Councilman O'Neill and unanimously adopted, this 167th regular meeting of the City Council was duly ad- journed at 10:55 P. M., April 23, 1956. MW.
