MINUTES OF THE ADJOURNED ONE HUUDRLD THIRTY-EIGHTH REGULAR
MEETING OF THE COUNCIL OF THE CITY OF LIVONIA
On March 21, 1955, the above meeting was held at 33001 Five Mile Road,
Livonia, Michigan, and was called to order at avproximately 8:05 P. M., by the
President of the Council, John T. Daugherty. Councilman Kleinert delivered the
invocation. Roll was called with the following result: Present-- John T. Daugherty,
David L. Jones, Harry R. Killam, Rudolf R. Kleinert, John Whitehead, Nettie Carey
and Wilson W. Edgar. Absent-- None. Marie W. Clark, City Clerk was absent from
this meeting.
The Deputy City Clerk read a letter from the City Planning Commission
dated February 25, 1955 as to Petition No. Z-82, also letters from Wayne County
Department of Health dated September 28, 1954; the Wayne County Drain Commissioner
dated November 24, 1954; the Mayor dated December 3, 1954 and the Livonia Public
ime Schools dated December 15, 1954.
By Councilman Kleinert, seconded by Councilman Jones and unanimously
adopted, it was
#147-55 RESOLVED, that the report and recommendation of the City Planning
Commission dated February 25, 1955 as to Petition No. Z-82 for change of
zoning classification in the Southwest 1/4 of Section 16 is approved; and
such petition is hereby denied.
The Deputy Clerk read a letter dated February 25, 1955 from the City Plan-
ning Commission as to Petition No. Z-85.
By Councilman Kleinert, seconded by Councilman Whitehead and unanimously
adopted, it was
#148-55 RESOLVED, that the report and recommendation of the City Planning
Commission dated February 25, 1955 as to Petition No. Z-85 for change of
zoning classification in the Southeast 1/4 of Section 33 is approved; and
such petition is hereby denied.
The Deputy Clerk read a letter from the City Planning Commission dated
March 10, 1955 as to Petition No. Z-88.

By Councilman Kleinert, seconded ray Councilman Whitehead, it was
#149-55 RESOLVED, that the report and recommendation of the City Planning
Commission dated March 10, 1955 as to Petition No. Z-88 of Mrs. Juanita
Lumley, et al, for change of zoning classification in the Southeast 1/4 of
Section 33 from RUFB to R-1-A is hereby a,proved, and the City Attorney is
directed to prepare an amendment to Zoning Ordinance No. 60 in accordance
with this resolution.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Killam, Kleinert, Whitehead, Carey and Edgar.
NAYS: Jones and Daugherty.
The President declared the resolution adopted.
The Deputy Clerk read a letter from the City Planning Commission dated
March 10, 1955 as to Petition No. Z-90, proposed Laurel Glen Subdivision.
By Councilman Kleinert, seconded by Councilman Carey and unanimously
adopted, it was
L #150-55 RESOLVED, that the report and recommendation of the City Planning
Commission dated March 10, 1955 as to Petition No. Z-90 of James Taylor
and Roger H. Blackwood, Fred Blackwood Company, for change of zoning classi-
fication in the Southwest 1/4 of Section 9 from AG-B to RUFA is hereby ap-
proved; and the City Attorney is directed to prepare an amendment to Zoning
Ordinance No. 60 in accordance with this resolution.
The Deputy Clerk read a letter dated March 21, 1955 from Harry C. Kent,
attorney for Leonard el1°. Mr. Nat Gursten, attorney, appeared before the Council
in this matter.
By Councilman Jones, seconded by Councilman Killam, it was
#151-55 RESOLVED, that the vacation and leave pay for former Sergeant
Leonard Wallo of the Livonia Police Department be referred to a joint
meeting of the Livonia Civil Service Commission and Mr. Nat Gursten,
attorney for Mr, Wallo.
A roll call vote wa- taken on the foregoing resolution with the following result:
AS: Jones, Killam, Whitehead, Carey, Edgar and Daugherty.
NAYS: Kleinert.
The President declared the resolution adopted.
The Deputy Clerk read a letter dated February 24, 1955 from the Silkworth

Oil Company, Inc., reouesting permission to tie into the sanitary sewer on Joy Road.
By Councilman Kleinert, seconded by Councilman Carey and unanimously
adopted, it was
#152-55 RESOLVED, that the matter of sewer facilities for Silkworth
Oil Company be tabled to the next regular meeting of the Council, March
28, 1955, pending a report from the Mayor.
The Deputy Clerk read a letter from the Mayor dated March 4, 1955, letter
to the Mayor from the inspection Department dated March 4, 1955 regarding a permit
for construction of proposed West Chicago .woad Reservoir.
By Councilman Jones, seconded by Jouncilnian Carey and unanimously adopted,
it was
#153-55 RESOLVED, that the letter from the Mayor dated March 4, 1955 re-
garding the 'gest Chicago Road heservoir be tabled pending a report from the
City Planning Commission.
The Deputy Clerk read a letter dated March 8, 1255 from the Mayor to Mr.
James C. Belcher, regarding appointment to the Electrical Board of Examiners, which
was received and placed on file.
The Deputy Clerk read the report of the Justice Court and Violations
Bureau for the month o± February, 1955, which was received and placed on file.
The Deputy Clerk read a letter dated March 9, 1955 from William Remaley
requesting car allowance.
By Councilman Kleinert, seconded by Councilman Jones, it was
#154-55 RESOLVED, that a car allowance of $25.00 per month be and hereby
is authorized for members of the Board of Water Commissioners, retroactive
to date of appointment, and that such expenses be charged to the appropriate
Water Department Budget Account.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Jones, Killam, Kleinert, Carey, Edgar and Daugherty.
NAYS: Whitehead.

The President announced that the letter from Marie W. Clark, City Clerk,

as to the petition regarding the Dog Shelter would be received and placed on file.
By Councilman Kleinert, seconded by Councilman Whitehead and unanimously
adopted, it w'.s resolved that
#155-55 WHEREAS, within the City of Livonia, Michigan, there are many
residents who are members of the UM-CIO, and
WHEREAS, these Livonia UAW--CIO members have helped to democrati-
cally elect delegates to represent them at the 15th Annual UAW-CI0 Con-
stitutional Convention, and
WHEREAS, certain of the elected convention delegates are residents
of our City,
NOlg, THEREFORE, SE IT RESOLVED, that this City Council of Livonia,
Michigan does hereby extend official greetings, and best wishes for a suc-
cessful convention, to the officers delegates and guests at the 15th UAW-CIO
Annual Convention, and
RE IT FUR rHER RESOLVED, that a copy of this resolution be forwarded
to the Secretary-Treasurer of the UAW CIO for presentation at that Con-
vention.
The Deputy Clerk read letter dated March 17, 1955 from the Fire Department
requesting approval of capital expenditure.
By Councilman Whitehead, seconded by Councilman Carey and unanimously
adopted, it was
#156-55 RESOLVET that the request of the Fire Department dated March 17,
1955 for capital expenditures in the following amounts:
Requisition No. 3111 0120.00 Acct. No. 70E

be and hereby is approved.
The Deputy Clerk read a letter dated March 21, 1955 from the Department of
Public Works regarding bids for City Dump salvage.
By Councilman Kleinert, seconded by Councilman Killam and unanimously
adopted, it was
#157-55 RESOLVED, that on recommendation of the Department of Public
Works dated March 21, 1955, the bid of Joseph Szalay dated March 1, 1955
in the amount of 038.50 per month, $462.00 per year, for salvage rights
of the Livonia Dump is hereby approved, and the Mayor and the City Clerk
are authorized to enter into a contract with said Joseph Szalay, 17816
Palmer, Melvindale, Michigan, for this purpose.
The Deputy Clerk read letters dated March 17, 1955 from the City Planning
Commission; from the City Attorney dated February 22, 1955; from Herald Hamill
dated November 20, 1954, and from the Mayor dated November 29, 1954.

By Councilman Kleinert, seconded by Councilman Jones and unanimously
Imoadopted, it was
#158-55 RESOLVED, that the City Planning Commission, having given final
approval to the Plat of Bell Creek Farms Subdivision No. 2 under date of
March 17, 1955; and it further appearing that the City Engineer, under
date of November 20, 1954, certified that all improvements have been in-
stalled and likewise did approve the final plat of said subdivision; and
it further appearing that the City Council did give tentative approval of
said subdivision under date of September 8, 1952, and that all requirements
as set forth have been fulfilled, the Council does hereby approve said
final plat of Bell Creek Farms Subdivision No. 2, and the City Clerk is
hereby authorized to affix her signature to said plat in accordance with
this resolution.
Pursuant to a resolution adopted by the Council March 14, 1955, Council-
man Edgar gave the following report:
"As official representative of the Council with permission to appear
before the Liquor Control Commission, I met with the Commission at a
public hearing in Lincoln Park last Thursday afternoon. I might state
that, at that hearing the Liquor Control Commission reversed its
original. decision and granted the license to Mr. Joseph Richards. At
imm the conclusion of the hearing, I contacted Mr. Frank Blackford, the
chairman, Mr. Kenneth Daniels and Mr. Walter Nowak, the enforcement
officer and asked if I would have permission to see the letters written
in protest to the granting of this license. I informed them that we
had a letter from the Liquor Control Commission stating that their en-
tire file on the Richards case was available for inspection. I showed
them my official letter and it was Mr. Nowak's contention that I could
not see the letters. I appealed to Mr. Blackford arra Mr. Daniels and
I was told that if I wanted to see the letters, I should see the Chief
of Police in Livonia, for all they had were copies. They informed me
that the letters were solicited by the Chief of Police of Livonia. I
heard it stated at the hearing that there were seven letters of protest,
one from an unauthorized agent of the Ford Motor Company, one from the
developer of a subdivision in that area and one from the Board of Edu-
cation. It stated that this letter was written at the request of the
Chief of Police. Therefore, I would like to report that I was not per-
mitted to see the letters in the COrrnnission files, that they are in the
possession of our Chief of Police and inasmuch as I would like to see
the letters, I think the entire Council is entitled to see them. I
would like to ask the Commissioner of Public Safety if we could see
these letters in the possession of the Police Department ."
Thereupon, Councilman lhitehea.d commended Mr. Edgar on his report and
asked that such be made a matter of record in the minutes.
A recess was called at 9:55 P. M., after which the m=eting resumed with

all members present who were named as present in the original roll call of this
meeting.
Chief of Police George Harmon presented to the Council the lett rs
mentioned above, which letters were received and placed on file.
On motion of Councilman Kleinert, seconded by Council man Jones and
unanimously adopted, this adjourned 138th regular meeting of the City Council
was duly adjourned at 10:25 P. M. , March 21, 1955.
