HomeMy WebLinkAboutWAIVER OF NOTICE 1952-06-24 Page 814 WAIVER OF NOTICE OF SPECIAL MEETING The undersigned, Harvey R Jahn, pursuant to Section 8 of Chapter IV of the Charter, does hereby waive notice of a special meeting of the Council of the City of Livonia to be held Tuesday, June 24, 1952, at 8:00 P M , at the City Hall, 33110 Five Mile Road, Livonia, Michigan DATED: June 24, 1952, at 7:00 P M Iv Harvey R ahn MINUTES OF THE SIXTEENTH SPECIAL MEETING OF THE COUNCIL OF THE CITY OF LIVONIA lim On June 24, 1952, above meeting was held at 33110 Five Mile Road, Livonia, Michigan, and was called to order at approximately 8:30 P M by the President of the Council, Harry S Wolfe Roll was called with the following result: Present-- Harry S Wolfe, Wilson W. Edgar, Raymond E. Grimm, John Whitehead, Nettie Carey and William Taylor. Absent-- Harvey Jahn The City Clerk presented the foregoing Waiver of Notice signed by Councilman Harvey Jahn. Communication from the Civil Service Commission dated June 24, 1952, was read as follows: "This Commission has learned with much regret of the death of our Patrolman Sidney Dethloff. Patrolman Dethloff became an employee of the City of Livonia on October 16, 1950, and his bi-weekly salary at the present time is $136 00 plus $13 60 premium pay Page 815 "Under the Workmen's Compensation Law of the State of Michigan, his widow and children are entitled to $26 00 a week for a period , Lor of 400 weeks or a graitotal of $10,400 00 This of course will have to be checked with our insurance carriers. "The Civil Service Commission also feels that his widow is entitled to his maximum sick leave pay under our sick leave policy which is 4 work weeks or a total base rate of $272 00 gross "Also his widow is entitled to his 2 weeks' vacation pay including premium which totals $149 60 "As you know, the group insurance plan for employees of the city has not as yet been resolved Inasmuch as the city has not had to pay premiums on such a plan for a considerable length of time, it is recommended that the sum of $4,000.00, the death benefit to which he would be entitled under our proposed group insurance plan, should be paid to his widow from city contingent funds "The above has been discussed in full with Mr. William Brashear who concurs with our suggestions and of course they are subject to legal opinion as to beneficiary. If the above suggestions are adopted, the widow will receive a total of $14,821.60 in direct benefits as a result of his employment from the City of Livonia which should leave little doubt that our employees are adequately protected All this of course is in addition to any private insurance he may have had " Councilman Grimm was excused from the meeting due to illness By Councilman Carey, seconded by Councilman Taylor and adopted as follows, it was. #99 RESOLVED that, pursuant to written recommendations of the Civil Service Commission dated June 24, 1952, it appearing that such commission together with the Insurance Committee of the Council had been engaged in formulating a comprehensive disability and group insurance plan for the employees of the City of Livonia and that such plan has been substantially completed in a manner approved by the Council, and it further appearing that such plan provides for the payment to an employee's widow, in the event of death of such employee, of a sum based on such employee's wage scale and that this sum for an employee earning $3536.00 a year would be $4,000 00, and it further appearing that such plan will be soon completed and given full effect, and it further appearing that Sidney Dethloff, a police officer of the City of Livonia, who was killed in the line of duty on June 23, 1952, and that at the time of his death he was earning $3536 00 a year, it is hereby determined that the widow of said Sidney Dethloff, Olive Dethloff, has a claim against the City of Livonia in the matter of insurance, which claim is founded in justice and supported by a moral obligation, that such claim is hereby allowed in the amount of $4,000 00; that the sum of $4,000.00 is hereby appropriated from the unallocated fund to the Police Department for payment of such claim, and that payment of such claim by the City Treasurer is hereby authorized and directed; provided, however, that allowance and payment of such claim shall be in addition to any other amount or amounts to which said widow is entitled under the Workmen's Compensation Law and existing Workmen's Page 816 Compensation Insurance; that such allowance is made and payment authorized on the condition that nothing contained in this resolution shall impair or affect the right of said widow to the compensation under the Workmen's Compensation Law, and that this resolution is adopted on condition that such compensation will not in any way be impaired or affected by any of the provisions of this resolution, or by the allowance or payment of such claim or by acceptance of such payment by said widow. A roll call vote was taken on the foregoing resolution with the following result: AYES. Edgar, Whitehead, Carey, Taylor and Wolfe NAYS: None. By Councilman Edgar, seconded by Councilman Whitehead and adopted as follows, it was. #100 RESOLVED, that the sum of $773 00 be appropriated from the unallocated fund to the Police Department for payment to Schrader Funeral Home for funeral expenses of Patrolman Sidney Dethloff, that the City Treasurer is hereby directed to make payment in said amount of $773 00 from the above appropriation; that hereafter the City of Livonia will pay an amount not in excess of $800 00 on the funeral expense of any employee of the City who shall be hereafter killed in the line of duty; provided, however, that the determination of whether or not an employee is actually killed while on duty shall be made by the City Council after such investigation as it may require lim A roll call vote was taken on the foregoing resolution with the following result. AYES: Edgar, Whitehead, Carey, Taylor and Wolfe NAYS: None By Councilman Taylor, seconded by Councilman Whitehead and unanimously adopted as follows, it was: #101 RESOLVED, that the request from Lola Davis Atteberry, transfer of ownership SDM License from Charles P Davis Estate, Lola Davis, Administratrix, 20330 Farmington Road, Livonia, Michigan, be and hereby is approved On motion of Councilman Taylor, seconded by Councilman Whitehead and unanimously passed, the meeting was adjourned at 9.50 P.
