On June 8, 1953, above meeting was held at 33001 Five Mile Road, Livonia, Michigan, and was called to order at approximately 8:02 P M by the President of the Council, Harry S. Wolfe. Roll was called with the following result: Present-- Harry S. Wolfe, Wilson W. Edgar, Harold Bower, John Whitehead, Nettie Carey and William Taylor. Absent-- Raymond E. Grimm. Minutes of the 95th regular meeting held on May 25, 1953, and adjourned to June 1, 1953, were read and approved. By Councilman Taylor, seconded by Councilman Bower and adopted as follows, it was: #522 RESOLVED, that on recommendation of James L. Hagen, Director of Public Safety, Final Certificate No 1174-2 dated June 5, 1953, issued by Nathaniel 0. Gould & Thomas W. Moss, Inc., architects, on contract for construction of addition to Police Department Building, is hereby approved; and payment of the sum of $863 20 to the contractor, __ as the balance owing on such contract, is hereby authorized A roll call vote was taken on the foregoing resolution with the following result: AYES: Edgar, Bower, Carey, Whitehead, Taylor and Wolfe. NAYS. None. By Councilman Carey, seconded by Councilman Whitehead and adopted as follows, it was. #523 RESOLVED, that the action of the special committee for approval of minor changes in the new City Hall, in ordering screens for the new City Hall from Thomas Brick & Tile Company at a price of $1875.00 is hereby approved; and the issuance of a purchase order by the City Clerk in conformance with this resolution is hereby authorized. Councilman Grimm arrived before the roll call vote on the above resolution and remained throughout this meeting. NAYS: None Page 1100 By Councilman Edgar, seconded by Councilman Bower and unanimously adopted as follows, it was. #524 RESOLVED, that the hour of 8:30 P M having arrived, all sealed bids received on One New Armco Multiplate Arch Culvert be opened by the City Clerk and read. Pursuant to the foregoing resolution, the City Clerk opened and read the following sealed bids: (1) Jensen Bridge & Supply Co. - price per lineal foot, $41.87 (2) Armco Drainage & Metal Products, Inc - price per lineal foot, $40.49 By Councilman Taylor, seconded by Councilman Grimm and unanimously adopted as follows, it was- #525 RESOLVED, that the foregoing bids be referred to the Director of Public Works for his report and recommendation. Ordinance No 67 introduced by Councilman Edgar at the meeting of the Council held on June 1, 1953, and entitled, "An Ordinance Amending Section 35 of the Zoning Map of the City of Livonia, and Amending Article 3 00 of the Zoning Ordinance, Ordinance No 60 of the City of Livonia, by Adding Thereto Section 3 14", was taken from the table and a roll call vote was conducted thereon with the following result: Page 1101 AYES: Edgar, Bower, Carey, Whitehead, Taylor, Grimm and Wolfe. NAYS. None. President Wolfe announced that the foregoing ordinance was duly adopted and will 111 become effective on the date of publication, June 26, 1953 By Councilman Whitehead, seconded by Councilman Grimm and adopted as follows, it was: #528 RESOLVED, that on recommendation of the Director of Public Works the bid of Armco Drainage & Metal Products, Inc in the amount of $40.49 per lineal foot for One New Armco Multiplate Arch Culvert is hereby accepted and the issuance of a purchase order by the City Clerk in con- formance with such bid is hereby authorized. Wiedman, Inc in the amount of $497.75 (over and above trade-in) for 1953 Ford Tudor Sedan is hereby accepted and the issuance of a purchase order by the City Clerk in conformance with such bid is hereby authorized. A roll call vote was taken on the foregoing resolution with the following result: AYES: Edgar, Bower, Carey, Whitehead, Taylor, Grimm and Wolfe NAYS: None. By Councilman Carey, seconded by Councilman Taylor and adopted as follows, it was: #531 RESOLVED that, further consideration having been given to the revised salary schedule approved on June 1, 1953, the Council feels that the salary of the Deputy City Treasurer should be fixed in the following amount: Deputy City Treasurer - First six months $140.00 $3,640.00 7 thru 12 months $144 00 $3,744.00 Over 12 months $148.00 $3,848.00, effective as of June 1, 1953; does hereby suggest to the Civil Service Commission that said schedule be amended to authorize the above stated salary; and, in anticipation of such amendment, does hereby appropriate from the Unallocated Fund the sum of $104.00 to the City Treasurer's Office for the purpose of paying the amount required by such amendment. A roll call vote was taken on the foregoing resolution with the following result: AYES- Edgar, Bower, Carey, Whitehead, Taylor, Grimm and Wolfe NAYS- None. By Councilman Edgar, seconded by Councilman Bower and unanimously adopted as follows, it was: #532 RESOLVED, that the petition of Daniel W Wheeler, et al, for dedication of Thorpe Drive in Section 36, be referred to the Department of Public Works and the City Attorney for their report and recommendations. The City Clerk read a communication from the Traffic Commission dated May 27, 1953, recommending the purchase of stop signs and 25 mile per hour signs. The Chairman of the Commission, Mr Jack Hickox, appeared and explained this recommendation. By Councilman Taylor, seconded by Councilman Carey and unanimously adopted as follows, it was: Page 1103 #533 RESOLVED, that the communication from the Traffic Commission dated May 27, 1953, be referred to the Department of Public Works and that such department be requested to obtain bids for 250 stop signs and 200 25 mile per hour signs for submission to the Council. By Councilman Edgar, seconded by Councilman Taylor and unanimously adopted as follows, it was- #534 RESOLVED, that a special committee be appointed to make a report and recommendation as to signs to be erected at the entrances to the City of Livonia. President Wolfe thereupon appointed to such special committee, Councilmen Edgar, Bower and Taylor By Councilman Whitehead, seconded by Councilman Grimm and unanimously adopted as follows, it was: #535 RESOLVED, that the communication from the City Engineer to the Director of Public Works dated June 3, 1953, recommending a certain settlement in connection with the contracts of Hawk & Welch, Inc. and George Tripp for construction of Sewage Disposal System No 2, be referred to the City Attorney who is requested to prepare proper forms of release to be submitted to said contractors. A recess was then called, following which the meeting was resumed with each and every member of the Council present. Lester French, Director of Public Works, presented to the Council plans and specifications for construction of the Coventry Gardens Drain together with the following sealed bids for such construction- 6'f Pipe ErectingManholes (6001in. ft.) (2) (1) Sinacola Contracting Co $1,770.00 $100.00 (2) United Contracting Co. $1,800.00 $190.00 (3) Waterway Construction Co. $2,100.00 $200 00 (4) Rocco Ferrera Co. $1,950.00 $500.00 By Councilman Edgar, seconded by Councilman Taylor and adopted as follows, it was: #536 RESOLVED, that the Council having previously approved the purchase of 36" tile for installation in Coventry Gardens Subdivision at a cost of $4,526.00 and sealed bids for the construction of the drain in Coventry Gardens Subdivision having been received, the bid of Sinacola Contracting Co. in the amount of $1,870.00 is hereby accepted and the Mayor and City Clerk are authorized to affix their signatures on behalf of the City of Livonia to a contract in conformance with such bid, that said plans and specifications for the Coventry Gardens Drain are hereby approved; provided, however, that said sums of $1,870 00 and $4,526 00, together with an additional 10% for engineering fees and contingencies, shall be considered as the cost of said project to be financed by special assessment procedure as heretofore authorized by the Council and now in progress. NAYS: None By Councilman Bower, seconded by Councilman Whitehead and adopted as follows, it was: #537 RESOLVED that, the Council having heretofore authorized an extension of Contract No 1, Sewage Disposal System No. 4, with Thomas Sinacola, and it appearing that there has been a general price increase in the cost of material involved in such contract, on recommendation of the Director of Public Works and City Engineer under date of June 8, 1953, the following increase and unit prices for such material. 4850 lin. ft. - 24" @ 0 28 a foot - $1358.00 1000 lin ft - 18" @ 0.18 a foot - 180.00 300 lin. ft. Manhole @ 1.00 a foot - 300 00 are hereby approved and such contract is amended accordingly, and the Mayor and City Clerk are authorized to enter into a supplemental agreement in accordance with this resolution. A roll call vote was taken on the foregoing resolution with the following result: AYES: Edgar, Bower, Carey, Whitehead, Taylor, Grimm and Wolfe. NAYS. None. The report of the Justice Court and Violations Bureau for May, 1953, was received and placed on file By Councilman Whitehead, seconded by Councilman Carey and unanimously adopted as follows, it was: #538 RESOLVED, that the appointment by Mayor Jesse Ziegler of George Bentley, Dallas Hay and Paul Harsha as members of the City Planning Commission for a term of three years commencing June 9, 1953, is hereby approved. Mr. Peterson appeared before the Council in regards to the construction of sewers in an area west of Stark Road and south of Plymouth Road, and this matter was referred to the City Engineer and the City Attorney By Councilman Taylor, seconded by Councilman Grimm and adopted as follows, it was. #539 RESOLVED that, pursuant to the request of the City Attorney, the sum of $908 88 be appropriated from the Capital Improvement Fund to �-- the Department of Law for the purchase of law books A roll call vote was taken on the foregoing resolution with the following result. NAYS: None Communication from Livonia Business and Professional Ments Association dated May 8, 1953, pertaining to the establishment of off street parking facilities was read and placed on file. City Attorney William Brashear presented a communication from the Board of Road Commissioners for the County of Wayne dated June 3, 1953, pertaining to water restrictions and explained the requirement of such board and the City of Detroit that the City of Livonia adopt sprinkling regulations, which requirement resulted not from any lack of mains in Livonia, but from the lack of water supply made available by the facilities of the City of Detroit. Councilman Grimm introduced the following ordinance. No 68 AN ORDINANCE REGULATING THE USE OF WATER DURING THE PERIOD COMMENCING JUNE 26, 1953, AND ENDING SEPTEMBER 6, 1953; AND PROVIDING A PENALTY FOR VIOLATION HEREOF THE CITY OF LIVONIA ORDAINS: Section 1. The City Council, having given careful consideration to the quantity of water available for distribution and use within the City of Livonia and having considered the requirement of the Board of Wayne County Road Commissioners that sprinkling regulations be adopted by the City of Livonia at least equivalent to those enforced in the City of Detroit, such requirement having been imposed by the City of Detroit on the users of water supplied by its own system including those surrounding municipalities which are supplied with water from such system by contract with the Board of Wayne County Road Commissioners; and it appearing that the City of Detroit has under construction certain facilities which when completed should avoid severe sprinkling regulations, but that such facilities will not be completed in time to alleviate the water shortage problem of the approaching summer season, does hereby determine that there now exists a condition of emergency within the City of Livonia because of the present inadequacy of water supply. Section 2. During the period commencing June 26, 1953, and ending September 6, 1953, and between the hours of 2.00 P. M. and 9:00 P. M. on each day of the week in said period, except Saturdays and Sundays, no person, firm or corporation shall use or consume water from the water supply system of the City of Livonia for the purpose of sprinkling or watering lawns, gardens, flowers, shrubbery and trees within the City of ..�. Livonia Page 1106 Section 3. During the period of time and hours set forth in Section 2 of this ordinance, mechanical refrigeration systems used for cooling purposes for human comfort, and using city water, no re-circulated, shall be limited to an average space temperature of not less than 80 degrees F , dry bulb, when the outside temperature is 90 degrees F. or above by official United States Weather Bureau determination; provided, however, that this shall not apply to hospitals or similar institutions. Section 4. Every person convicted of a violation of this ordinance shall be punished by a fine of not more than Five Hundred ($500 00) Dollars or by imprisonment of not more than ninety (90) days or by both such fine and imprisonment in the discretion of the Court. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 6. This ordinance is hereby declared necessary for the protection of the public health, safety and welfare and shall become effective immediately upon publication. A roll call vote was taken on the foregoing ordinance with the following result: AYES: Edgar, Bower, Carey, Whitehead, Taylor, Grimm and Wolfe. NAYS: None. 111 President Wolfe declared the above ordinance was duly adopted and will take effect on the date of publication on June 26, 1953 Electrical Inspector Stanley Markley appeared before the Council, presented the revised fee schedule adopted by the City of Detroit and effective as of July 1, 1953, and recommended that the City of Livonia adopt the same revised schedule so that the rates in Livonia will be the same as those in other communities operating under the Reciprocal Inspection Ordinance By Councilman Edgar, seconded by Councilman Taylor and unanimously adopted as follows, it was: #540 RESOLVED, that Resolution #A-970 adopted by the City Council at its 66th regular meeting held on March 24, 1952, is hereby amended to read as follows: 'RESOLVED, that pursuant to Section 5.04 of Ordinance No. 1111 51, known as the Building Code of the City of Livonia, the following supplementary schedule: Page 1107 SCHEDULE (B) Supplementary Schedule of Fees For Electrical Permits and Inspections WIRING For a complete installation of circuits involving receptacle or lighting outlets, appliances; lighting fixtures, gas-tube lighting; shop inspection of electric apparatus; heating, re- frigerating or ventilating equipment; alterations, changes or repairs. Page 1109 When a combination electrical installation is to be made for heat, light and/or power involving more than a single motor, rectifier, heating unit, circuit or wiring and/or fixtures within the same premises at the same time for the same party, a charge shall be made for the largest single unit in accordance with the above schedule, and for each additional unit a charge as follows. $ 50 per circuit of wiring for incandescent lighting, $1.00 for heating or power, and $1.00 for each 25 lamps or tubes or fraction thereof on fixtures. When a minimum fee for a combination installation does not exceed $3 25, the minimum will be charged to the first circuit or wiring. In similar cases involving fixtures with heaters and/or power, the minimum fee shall be charged to the heater or power installation. Page 1111 By Councilman Bower, seconded by Councilman Taylor and unanimously adopted as follows, it was: #541 RESOLVED, that the Council of the City of Livonia having heretofore, on December 8, 1952, approved the up-grading of the tavern license of Carl Haray at 34115 Plymouth Road, Livonia, Michigan, to a Class C License, and having heretofore, on May 11, 1953, approved the request of Carl Haray to add as a partner, Walter A. Misener on the existing 1952 Tavern SDM License at 34115 Plymouth Road, Livonia, Michigan, does hereby approve the up-grading of said tavern license of Carl Haray and Walter A. Misener to a Class C at 34115 Plymouth Road, Livonia, Michigan. By Councilman Bower, seconded by Councilman Whitehead and adopted as follows, it was: #542 RESOLVED that, the Council having previously directed the City Engineer to prepare tentative plans for the construction of Sewage Disposal System No. 3 of the City of Livonia, to serve an area approximately bounded on the North by Puritan Avenue, on the West by Farmington Road, on the South by Schoolcraft Road and on the East by Inkster Road, with its trunk along Lyndon Avenue, and such tentative plans having been completed by the City Engineer and approved by the Council, and the Council having carefully considered means of financing such construction and having decided that the best method of financing is by special assessment procedure under the provisions of Ordinance No 31 of the City of Livonia entitled, "An Ordinance to Provide for the Making of Public Improvements, Defraying the %gu Expense Thereof by Special Assessment and a Special Assessment Procedure", before determining to make such improvement, the Council does hereby require the City Engineer to ascertain the assessed valuation of all property affected by the proposed improvement, the number of parcels which show tax delinquencies, the number of parcels owned by public authorities, the number of parcels which are vacant and to prepare, or cause to be prepared, plans and specifications therefor and an estimate of the cost thereof and to file the same with the City Clerk, together with his recommendation as to what proportion of the cost should be paid by special assessment and what part, if any, should be a general obligation of the City, the number of install- ments in which assessments may be paid and the lands which should be included in the proposed special assessment district; that such plans, specifications, estimate and report be completed and filed with the City Clerk prior to June 29, 1953; and that all other steps be taken to commence and carry forward special assessment procedure in accordance with the provisions of said Ordinance No 31 A roll call vote was taken on the foregoing resolution with the following result: AYES: Edgar, Bower, Carey, Whitehead, Taylor, Grimm and Wolfe NAYS: None. Councilman Edgar as Chairman of the special committee on Street Lighting reported that he has conferred with representatives of The Detroit Edison Company; that the Edison Company advises him that some schools in Livonia already have street Page 1112 lights and are paying for the same; that the Edison Company recommends that the 111 matter of street lights in the vicinity of schools be considered as a school problem rather than a city function at this time; and that the committee recommends concurrence in such view.
