The meeting was called to order at approximately 8.08 P M by the President of the Council, Harry S Wolfe The roll was called with the following result: Present--Harry S Wolfe, Raymond E Grimm, Harvey Jahn, Nettie Carey, William Taylor, John Whitehead and Wilson W Edgar, absent--none Thelerk C read the minutes ofh t e fourth regular meetingof the e Council held on June 19, 1950 The President asked for corrections to these minutes but none were offered On motion duly made, seconded and unanimously carried, it was A-65 RESOLVED, that the minutes of the fourth regular meeting of the Council held on June 19, 1950, be and hereby are approved in all respects With the consent of all members of the Council, the regular order of business was suspended in order that the Council might hear the oral statement of Mr Phinney, C P A , who explained the need of the City for the services of an accountant The communication from the Liquor Control Commission as to appli- cation of L & J Ranch was brought up again for consideration On motion of John Whitehead, seconded by Wilson W Edgar and unanimously carried, it was A-66 RESOLVED, that the application of L & J Ranch for a new club license for 37910 Amrhian, Livonia, Michigan (mailing address Plymouth) be and hereby is approved Certain petitions for change of zoning classification were read IIIand considered On motion of Raymond E. Grimm, seconded by Wilson fro` Edgar and unanimously carried, it was Page 34 A-67 RESOLVED, that the petitions of Anne B Slapinskas, Bernice Lehn, Hans Hartmann and William F Rutenbar, be and hereby are referred to the City Planning Commission for hearing and recommendations according to law. Sample license cards obtained by John Thitehead from the Wayne County Board of Health were examined, andWilliam Brashear, City Attorney, and Councilman Wilson 17 Edgar were requested to prepare license card for Livonia. The City Clerk presented to the Council proposed plat of new subdivision to be known as "Thomas Elliot Subdivision" A ten-minute recess was called following which the meeting was again called to order On motion of John '^;'hitehead, seconded by Nettie Carey and unanimously carried, it was A-68 RESOLVED, that William W Brashear, the City Attorney, discuss with the representatives of the Wayne County Road Commissioner's Office the cost of improving the roads in the new "Thomas Elliot Subdivision" and that he prepare an agreement providing for a bond to protect the City in the event the Council approves the proposed plat of said subdivision A preliminary plat of a proposed subdivision to be known as Wilson Subdivision was submitted and considered On motion of Harvey Jahn, seconded by Raymond E Grimm and unanimously carried, it was A-69 RESOLVED, that temporary approval by the Council of the following proposed plat to be known as the Wilson Subdivision, otherwise described as the South 1/)4 of the North 1/2 of Section 35, Town 1 South, Range 9 East, City of Livonia, Wayne County, Michigan, be withheld until such time as the width of each lot is increased to 60 feet for each parcel of land, and said proposed plat re- submitted Mail from George Eberle, Servin L Flack and Elwood L. Zavitz, advising that they had filed application with the Liquor Control Commission for a Class "C" license was read and considered On motion of Wilson W. Edgar, seconded by Raymond E Grimm and unanimously carried, it was Page 35 A-70 RESOLVED, that the Clerk prepare a form letter to be sent to anyone requesting approval of Liquor License prior to action by the Liquor Control Commission Communication from Michigan Mutual Liability Company was read, considered and placed on file. On motion of Raymond E Grimm, seconded by Harvey Jahn and unanimously carried, it was A-71 RESOLVED, that the appointments by the Mayor of the following members of the City Planning Commission: Carson W Johnston - 11032 Cranston, Plymouth 3 year term George Bentley - 12414 Middlebelt Road, n 3 year term Dallas Hay - 30425 Seven Mile Rd , Farmington 3 year term Edward Conway - 11326 Hubbard Rd., Plymouth 2 year term Harold Bower - 29539 Six Mile Rd , Farmington 2 year term Walter Russell - 27460 Pickford, Farmington 2 year term Helen Byers - 11)1149 Cardwell, Garden City 1 year term Robert Maclntyre - 8937 Newberg Rd., Plymouth 1 year term Clarence Jahn - 33421 Five Mile Rd , Plymouth 1 year term be and hereby are confirmed and approved Councilman Harvey Jahn introduced the following Ordinance. NO. 7 AN ORDINANCF TO ESTABLISH DISTRICTS IN THE CITY OF LIVONIA; TO REGULATE THE USE OF LAND AND STRUCTURES THEREIN, TO REGULATE AND LIMIT THE HEIGHT, THE AREA, THE BULK AND LOCATION OF BUILDINGS• TO REGULATE AND RESTRICT THE LOCATION OF TRADES AND INDUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIC USES, TO REGULATE AND DETERMINE THE AREA OF YARDS, COURTS AND OTHER OPEN SPACES; TO REGULATE THE DENSITY OF POPULATION, TO PROVIDE FOR THE ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE; TO PROVIDE FOR A BOARD OF APPEALS, AND ITS POWERS AND DUTIES; TO PROVIDE A PENALTY FOR THE VIOLATION OF THE TERMS THEREOF, AND TO ADOPT THE ZONING ORDINANCE OF THE TOWNSHIP OF LIVONIA, AMENDMENTS THERETO AND ZONING MAP The City of Livonia Ordains: Section 1 This Ordinance shall be known and cited as the Zoning Ordinance of the City of Livonia The necessity, intent and purposes of this Ordinance is to promote the public health, safety, morals, convenience, comfort, prosperity and general welfare, and to recognize and carry out section 13 of Chapter X of the Charter by adopting the Zoning Ordinance of the Township of Livonia, with amendments, and a revised zoning map Page 36 III Section 2. The Zoning Ordinance of the Township of Livonia, adopted by the Township Board of Livonia Township on December 6, 1945, together with all amendments or changes in said Zoning Ordinance heretofore approved by said Township Board, is hereby made a part of this Ordinance and is hereby adopted and enacted by the City of Livonia Section 3. The attached map of the City of Livonia, showing the zoned districts and classifications set forth in said Zoning Ordinance of the Township of Livonia, as amended, and all changes and amendments as of May 23, 1950, is hereby approved and adopted Section 4 A Board of Appeals consisting of six members is hereby created pursuant to Act 207, Public Acts of Michigan, 1921, as amended, and is hereby vested with the powers and duties stated in said Act, as amended, together with such powers and duties set forth in said Zoning Ordinance of the Township of Livonia as are not in conflict with the provisions of said Act, as amended Section 5. The Council may, from time to time, on its own motion or on petition, amend this Ordinance or amend, supplement or change the regulations and boundaries of districts or zones, in the manner prescribed by Act No 207, Public Acts of Michigan, 1921, as amended, the Charter and this Ordinance. All proposed amendments to this Ordinance or changes in district boundaries or regulations, prior to adoption, shall be referred by the Council to the City Planning Commission, aich is hereby appointed the commission to perform the duties set forth in Section 4 of said Act No. 207, as amended. Whenever the III owners of fifty per cent (50%) or more of the frontage in any district or part thereof shall present to the Council a petition in writing duly signed and which shall have been acknowledged by each of said petitioners substantially in accordance with the provisions for the acknowledgment of deeds, requesting an amendment, supplement, change or repeal of the regulations prescribed for such district or part thereof, it shall be the duty of the Council to refer the petition to the City Planning Commission for hearing and recommendation and to vote upon said petition within ninety (90) days after the filing of the same by the petitioners with the Council The City Planning Commission shall make its recommendations to the Council on any such proposed amendments or changes within sixty (60) days from the time the same are submitted to the Commission The City Planning Commission is authorized to hold public hearings on all such proposed amendments or changes and to make rules of procedure governing same If any area is hereafter transferred to another district through a change in district boundaries made by an amendment as above provided, the provisions of this Ordinance relating to buildings or structures, or uses of buildings, structures or premises existing at the time of passage of this Ordinance shall apply to buildings or structures, or uses of buildings, structures or premises existing at the time of passage of such amendment in such transferred area Section 6 This Ordinance and the various parts, sections and clauses thereof are hereby declared to be severable If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid, it is hereby provided that the remainder of this Ordinance shall not be affected thereby III Section 7 Every person, whether as principal, agent, servant, employee or otherwise, including the owners of any building, structure or premises or part thereof where any violation of this Ordinance shall exist or shall be Page 37 created, who shall violate or refuse to comply with or resist the enforce- ment of any of the provisions of this Ordinance shall be guilty of a mis- demeanor and upon conviction thereof shall be punished by a fine not exceeding Five Hundred Dollars ($500 00), or by imprisonment for a term not exceeding ninety (90) days, or by both such fine and imprisonment within the discretion of the Court, and sucherson shall be deemed p eme guilty of separate offenses for each day during any portion of which the violation or failure, neglect or refusal to comply with any of the provisions of this Ordinance is committed, continued or permitted Section 8 The Council is hereby given all such powers and duties of the Township Board as are stated in said Zoning Ordinance of Livonia Township Section 9 Ordinance No 2, entitled, "An Ordinance Adopting Zoning Ordinances of the Township of Livonia, Amendments Thereto and Zoning Map," Section 18 of said Zoning Ordinance of Livonia Township and another Ordinances or parts of Ordinances inconsistent or in conflict herewith are hereby repealed Section 10 This Ordinance is hereby declared to be an emergency Ordinance and shall become effective on publication July 7, 1950 A roll call vote was taken with the following result: YES--Harry S Wolfe, Raymond E Grimm, Harvey Jahn, Wilson W Edgar Nettie Carey, William Taylor and John Whitehead NO---None The President declared the above Ordinance passed and effective as of the date of publication, July 7, 1950 On motion of John Whitehead, seconded by Nettie Carey and unanimously carried, it was A-72 RESOLVED, that the salary of Mrs Muriel Barnes be increased from Sixty and no/100 Dollars ($60 00) to One Hundred Dollars (10O 00) a month Mr Burns made a statement on the proposed electrical code On motion of Wilson W Edgar, seconded by William Taylor and unanimously carried, it was A-73 RESOLVED that the next regular meeting of the Council be held July 7, 1950 at 8.00 P M instead of Monday, July 3, 1950 Page 38 I E Bills were then presented and considered On motion of Harvey Jahn, seconded by William Taylor and unanimously carried, it was A-74 RT;SOLVED, that the following bills be paid by the City Treasurer: The Detroit Edison Company--City Hall lights $5 42; The Detroit Edison Company--Rosedale Street lighting service--$11L0 65. McKee Oil Burner Service--Fire Hall #2, Oil burner transformer-I25 75, The Plymouth Mail--Printing-- $181 50, Pursell's Office Supplies—Typewriter table--$10 35- Michigan Bell Telephone Company--Livonia Exchange--$31 10• Callaghan & Company--Mccuillin Volumes 11 and 12--$25 00, Harry's Shell Service--Gas & Oil--$13 55; Hayes Service-- Gasoline--$17 )47; Clarita Print Shop--Printing--$78.00; Gregory Mayor & Thom Co.--office supplies & election supplies-- $99 14; J C Goss Company--office furniture--$8 00 On motion of Harvey Jahn, seconded by Wilson W. Edgar and unanimously carried, it was A-75 PESOLVED, that the agreement, dated May 25, 1950, between the Board of Wayne County Road Commission of the County of Wayne, and the City of Livonia providing for the maintenance of certain designated roads and streets within the said City of Livonia by the ii`ayne County Road Commission, be and the same I is hereby approved and the signing thereof by the Mayor of the City of Livonia, and the City Clerk, be and hereby is authorized On motion of Wilson W Edgar seconded by Raymond E Grimm and unanimously carried, it was A-76 RESOLVED, that the salary of the City Attorney of the City of Livonia be and hereby is fixed in the amount of Twelve Thousand Five Hundred ($12,500 00) Dollars per annum, payable in monthly installments, said salary being retroactive as of May 31, 1950 It was moved by Raymond E Grimm, seconded by Harvey Jahn and unanimously carried that the meeting be adjourned Time of adjournment being 12:25 A M , June 27, 1950 MaNClark, City Clerk ,i,,,,,,6/III ATTESTED' 1 // ilirWai II 4 AAS Harry S ^'olfe,i•resident
