HomeMy WebLinkAboutCOUNCIL MINUTES 1950-08-28 Page 125 MINUTES OF THE FOURTEENTH REGULAR MEETING • OF THE COUNCIL OF THE CITY OF LIVONIA AUGUST 28, 1950 The fourteenth regular meeting of the Council of the City of Livonia was held on August 28, 1950, at 33110 Five Mile Road, Livonia, Michigan The meeting was called to order at approximately 8:04 P M by the Vice President of the Council Wilson W Edgar, who presided over the meeting, Roll was called with the following result: Present--Wilson W Edgar, Raymond E Grimm, Harvey Jahn, Nettie Carey, William Taylor, and John Whitehead Absent--Harry S Wolfe The minutes of the thirteenth regular meeting of, the Council held on August 21, 1950, were read and approved The minutes of the second special meeting of the Council held on August 26, 1950, were read and approved. Mr John Creedon appeared before the Council in response to a request that he substantiate his bill in the amount of $150 00 Mr Creedon was informed by the Council that this hearing was granted to him in order that he might explain his bill to the Council and in order that the Council might pass on same Mr Creedon re- fused to substantiate or explain his bill and informed the Council the members thereof must make a search theirselves for substantiation The detailed questions asked of Mr. Creedon and his answered thereto were taken down by the Clerk and were placed on file for further reference On motion of Councilman John Whitehead, seconded by Councilman Raymond E Grimm and carried by the unanimous vote of all Councilmen named as present in the roll call of this meeting, it was: A 147 RESOLVED, that the matter of allowance or disallowance of the bill of John Creedon be taken under advisement Petition of Nick Mustatia and Mary Mustatia for approval of transfer of S D M liquor license was referred to the Police Chief for investigation and report. Mayor Jesse Ziegler explained to the Council the Civilian Defense Program Page 126 necessitated by the present war emergency and advised the Council that he had appointed Mr Dallas Hay, as a matter of emergency, and tentively to the position of Civilian Defense Director Councilman Nettie Carey introduced the following ordinance: NO. 15 AN ORDINANCE CREATING AN OFFICE OF CIVILIAN DEFENSE AND DEFINING ITS POWERS AND DUTIES THE CITY OF LIVONIA ORDAINS• Section 1 An Office of Civilian Defense for the City of Livonia is hereby created, and shall continue all during the present war emergency and until terminated by further action of the Council. The Office of Civilian Defense shall be under the direction and management of a Director of Civilian Defense, who shall be appointed by the Mayyor, and who shall hold office at the pleasure of the Mayor Section 2 The Office of Civilian Defense and the Director thereof are hereby given full power and authority to work in co-operation with the State and Federal governments and all other governmental agencies, to take all necessary measures and steps to devise and carry out a program of Civilian Defense, and do all things reasonably necessary to the fulfillment of such program. Section 3 The Office of Civilian Defense shall receive the full co- operation and support of all other departments and agencies of the City of Livonia Section 4 The Office of Civilian Defense and the Director thereof are hereby given emergency powers and authority to safeguard and protect public life, property, health, and welfare in the City of Livonia. The Office of Civilian Defense and the Director thereof shall have such other powers and duties as maybe provided by resolution of the Council and as maybe reasonably necessary to the performance of this ordinance. It shall be the duty of all persons to comply with all orders and regulations of the Office of Civilian Defense made pursuant to the provisions of this ordinance Any persons, firms, or corporations who shall violate or fail to comply with any of the provisions of this ordinance, or with any of the rules and regulations of the Office of Civilian Defense, or who shall interfere with any of the functions of said office, shall be guilty of a misdemeanor and on conviction, shall be punished by a fine not to exceed Five Hundred Dollars (;500 00), or by imprisonment for not more than Ninety(90) days, or by both fine and imprisonment in the discretion of the Court. Section 5 The compensation of the Director of Civilian Defense, together with the budget appropriation and expense allowances of the Office of Civilian Defense, shall be fixed by resolution of the Council Section 6 This ordinance is hereby declared to be an emergency ordinance and shall become effective upon the date of publication A roll call vote was taken with the following result: Page 127 YEAS. Wilson W Edgar, Raymond E Grimm, Harvey Jahn, Nettie Carey, William Taylor and John Whitehead; NAYS: None The Vice President declared the ordinance adopted and effective as of the date of publication Communication from the Civil. Service Commission was read in which it was suggested that an additional Ten Cents an hour be allowed to the Special Police Officer acting as supervisor in the Traffic Division Councilman Harvey Jahn made a motion that the following resolution be adopted: A I'M RESOLVED, that the Council, on the recommendation of the Civil Service Commission, does hereby grant an additional Ten Cents an hour as an increase to the compensation of the Special Police Officer acting as supervisor in the Race Track Traffic Division and that this increase be effective as of August 7, 1950 The above motion was seconded by Councilman William Taylor and a roll call vote was taken with the following result: 1 YEAS: Wilson W Edgar, Raymond E Grimm, Harvey Jahn, Nettie Carey, William Taylor and John Whitehead; NAYS. None The Vice President declared the foregoing resolution passed. The City Auditor, Herbert L Ferry, made a recommendation to the Council as to procedure for approving bills and defining "duly certified vouchers" as used in the Charter On motion of Councilman Harvey Jahn, seconded by Councilman John Whitehead and carried by the affirmative vote of all of the Councilmen named as pre- sent in the roll call of this meeting, it was: A-171 F.ESOLVED, that the City Attorney, William Brashear, be instructed to prepare an ordinance setting forth the procedure on certifying bills and payment, and that the City Auditor, Herbert L2 Ferry assist in the pre- paration r! of this ordinance. Lester French, Director of Public Works submitted a report prepared by the City Engineer in relation to the proposed Plat of Rosedale Gardens No 9 Subdivision. Mr Al Roth, Consulting Engineer for Sheldon Land Company made a statement as to such report. Councilman Harvey Jahn made a motion that the following resolution be adopted: Page 128 q 0,9- RESOLVED, that the report and recommendations of Harold F Hamill, City Engineer, as set forth in his communication addressed to Lester French, dated August 28, 1950, and pertaining to improvements in Rosedale Gardens Subdivision No. 9 be and hereby is accepted and approved in all respects; that, upon compliance by the subdivider, Sheldon Land Company, with such recommendations and on deposit by said subdivider of a cash bond with the City of Livonia in the amount of $190,672 00, conditioned on the making of all of the improvements specified in said report and recommendations of Harold F Hamill, the proposed Plat of Rosedale Gardens No 9 Subdivision, together with the plans prepared by Hubbel, Roth, & Clark, of sewer and water extensions, and of street easements, grades and paving, and of side- walks, be and hereby are approved; provided, however, that such bond shall be in substantially the same form as was required by the City of Livonia in relation to the Thomas Elliot Subdivision and as make approved by the City Attorney, William Brashear. The above motion was seconded by Councilman John Whitehead and a roll call vote was taken with the following result: YEAS: Wilson W Edgar, Raymond E Grimm, Harvey Jahn, Nettie Carey, William Taylor, and John Whitehead; NAYS: None The Vice President declared the foregoing resolution passed A recess was then called, following which the meeting was resumed with all Councilmen present as named in the roll call at the opening of this meeting. Councilman Wilson W Edgar submitted his report on progress made in obtain- ing a main Post Office On motion of Councilman William Taylor, seconded by Councilman Harvey Jahn, and unanimously carried by the affirmative vote of all Councilmen named as present in the roll call of this meeting, it was: fl-03 RESOLVED, that the City Attorney, William Brashear be instructed to go to Washington, D C. for the purpose of advocating a main Post Office for the City of Livonia, and that the expense of such trip be paid by the City Councilman Wilson W Edgar next reported on developments in the preparation of plans for enlarging the present City Hall On motion of Councilman Harvey Jahn, seconded by Councilman William Taylor and carried by the affirmative vote of all Councilmen named as present at the roll call of this meeting, it was. Page 129 p--/v/ RESOLVED, that a Detroit telephone line be procured for the 111 City Hall; that a Detroit telephone also be procured for the Police Department; that a Livonia pay station be installed in the City Hall and that the City Clerk take all action necessary to the full performance of this resolution Communication from Glenn W Vannoy and James E Vannoy was read On motion duly made, seconded and unanimously carried, it was: n-05 RESOLVED, that the City Clerk ascertain whether or not the Livonia Township Board approved an application of Glenn W Vannoy and James E Vannoy for Class C license in 1942. Councilman Harvey Jahn made a motion that the following resolution be adopted: A /7(, RESOLVED, that during the month of September, 1950, the regular meeting of the Council shall take place on the following dates: September 14, September 21, and September 28 at 8:00 P. M. on each date. The above motion was seconded by Councilman John Whitehead and a roll call vote was taken with the following result: YEAS. Wilson W. Edgar, Raymond E Grimm, Harvey Jahn, Nettie Carey, William Taylor, and John Whitehead; NAYS: None. The Vice President declared the foregoing resolution passed. Councilman Nettie Carey introduced the following ordinance. NO 16 AN ORDINANCE REGULATING THE INSTALLATION AND MAINTENANCE OF R1 CTRIC WIRING, ELECTRIC DEVICES AND ELECTRIC MATERIAL; AND PROVIDING FOR PERMITS, INSPECTIONS AND LICENSES WITH RESPECT THERETO AND A PENALTY FOR VIOLATION THEREOF. THE CITY OF LIVONIA ORDAINS: Section 1 0 Electrical Inspection 1 1 The Bureau of Inspection, hereinafter called the Inspection Authority, shall have and hereby is given jurisdiction, subject to review as hereinafter pro- vided, over the inspection of all electrical installations, including changes, re- pairs and additions thereto within the City of Livonia The Chief Inspector shall appoint an Electrical Inspector who shall inspect all electrical installations and report to the Inspection Authority The Electrical Inspector may be engaged by contract to handle inspections in consideration for such percentage of the inspection Page 130 fees as maybe fixed by resolution of the council, in which event he shall not be subject to Civil Service; otherwise he shall be subject to Civil Service. This jurisdiction shall apply to the installation of wiring devices, apparatus and equip— ment for connection to electricity supply systems having voltages over 30 volts, except as provided in Section 4. Section 2.0 Fees for Permits and Inspections 2 1 No permit for the installation, alteration or maintenance of electric wiring, electric devices or electric material shall be issued until a fee of Two Dollars ($2 00) together with the inspection fees herein provided, have been paid into the City Treasury 2 2 The following fees shall be charged for inspection of electrical installations, devices, apparatus and equipment in the City of Livonia: (a) Incandescent Light Wiring One Circuit or less $2 50 Each additional circuit 25 If additional circuits are installed after the original permit has been filed, the maximum fee will prevail (b) Incandescent Light Fixtures First fifty sockets or less 2.00 Each additional 25 sockets or fraction thereof 1 00 (c) Combined Wiring and Fixtures When inspected on one trip, one circuit or less and 50 sockets or less 3.50 Each additional circuit 25 16 (d) Electric Ranges or `Tater Heating A single electric range or water heater 2 50 Each additional range or water heater 50 When range or heater may be inspected on the same trip with wiring or fixture inspections, for each range or water heater 50 (e) Electric Signs 50 lamp or 500 V.A. or less 2 50 Each additional 20 lamp or 200 V A or fraction thereof .25 Page 131 (f) Motors and Generators 111 For the installation of a single motor or generator 1 H P. or less $1.00 Greater than 1 H P up to 10 H P. inclusive 2 00 Greater than 10 H P up to 20 H P inclusive 3 00 Greater than 20 H P up to 30 H P inclusive 4 00 Over 30 H.P. 5.00 When more than one machine is to be installed on the same premises by the same party, and may be inspected at the same time, a charge shall be made for the largest machine according to the above schedule plus 50¢ for each additional unit When several motors of less than 1/4 H.P. are 411, properly connected to the same circuit, the fee charged shall be based upon the number of such circuits as for wiring of incandescent lighting (g) Meter Permits For temporary service only 1.00 Fixture permit fee includes meter permit for permanent service only (h) Furnace 'Tiring For the installation of one furnace and/or temperature control equipment with motor up to and including 1 H P. 2 00 Where motor size exceeds 1 H P , charge is 16 for power See Item (f) Where there is no motor connected with the above installation 1 00 For two or more furnaces and/or temperature control equipment in the same building, the above fees apply plus 50¢ for each additional Where permit covers a combination of wiring circuits and furnace equipment, add one-half of the above fee to the regular charge for circuit wiring (i) Miscellaneous When additional inspections are made necessary by reason of the inspector being called prema- turely, or due to noncompliance with the rules, an additional charge of $1 50 per trip will be made For the inspection of electrical apparatus Page 132 for which no fee is herein provided and for the inspection of temporary installations for decora- tive, advertising and theatrical purposes, a fee of $3.00 per hour, or fraction thereof, shall be charged 2 3 Argy permit issued under the provisions of this ordinancemay be cancelled by the Bureau of Inspection on written request from the holder of such permit, but only in the event such written request is made within one year from the date of issuance of the permit and prior to any inspection or other action under the permit, including any exercise of privileges granted by the permit In the event any permit is cancelled on request of a holder thereof, as above provided, there shall be no refund of the permit fee or any part thereof, but the City Treasurer shall make a refund of 75% of all inspec- tion fees paid in connection with such unused permit 4600 Section 3 0 Right of Access to Buildings 3.1 The Electrical Inspector and/or his deputy shall have the right during reasonable hours to enter any building in the discharge of his official duties or for the purpose of making any inspection or test of the installation of electric wiring, electric devices and/or electric material contained therein and shall have the authority to cause the turning off of all electric supply and cut or disconnect, in cases of emergency, any wire where such electrical currents are dangerous to life or property or may interfere with the work of the Fire Department Section 4.0 Permits 4.1 No alterations or additions shall be made in the existing wiring of any building, nor shall any building be wired for the placingaf any elec- tric lights, motors, heating devices, or any apparatus requiring the use of electrical current at a potential over 30 volts, nor shall any alterations be 1110 made in the wiring in any building after inspection, without first notifying the Bureau of Inspection and securing a permit therefor Applications for such permit, describing such work, shall be made by the person, firm or cor- poration installing same and permit when issued shall be to such applicant 4.2 This section shall not apply to maintenance and repairs on the premises of a person, firm or corporation regularly employing qualified electricians for that purpose, nor such minor repair work as repairing flush and snap switches, replacing fuses, changing lamp sockets and receptacles, taping bare joints or repairing drop cords 11 3 All permits issued under the provisions of this ordinance shall terminate on the expiration of one year from the date of issuance unless exercised within such period of time. Section 5.0 Inspection Ile 5.1 Upon the completion of the wiring of any building, it shall be the duty of the person, firm or corporation installing the same to notify the Bureau of Inspection, who shall notify the Electrical Inspector to inspect the installation as soon as possible, and if it is found to be fully in compliance Page 133 with this ordinance and does not constitute a hazard to life and property, he shall issue to such person, firm or corporation for delivery to the owner a certificate of inspection authorizing connection to the electrical service and the turning on of the current All wires which are to be hidden from view shall be inspected before concealment and arty person, firm or corporation in- stalling such wires shall notify the Bureau of Inspection, giving sufficient time in which to make the required inspection before such wires are concealed. Section 6 0 Re-Inspection 6 1 The Electrical Inspector may make periodically a thorough re- inspection of the installation in buildings of all electric wiring, electric devices and electric material now installed or that may hereafter be installed, within the City of Livonia and when the installation of any such wiring, devices and/or material is found to be in a dangerous or unsafe condition, the person, firm or corporation owning, using or operating the same shall be notified and shall make the necessary repairs or changes requiring to place such wiring, devices and material in a safe condition and have such work com- pleted within fifteen days, or any longer period specified by the electrical inspector in said notice. The Electrical Inspector is hereby empowered to disconnect or order the discontinuance of electrical service to such wiring, devices and/or material so found to be defectively installed until the instal- lation of such wiring, devices and material has been made safe as directed by the Electrical Inspector. ILO Section 7.0 Construction Requirements 7 1 No certificate of inspection shall be issued unless the electri- cal installation is in strict conformity with the provisions of this ordinance, the statutes of the State of Michigan, the rules and regulations of the Michigan Public Service Commission under the authority of such statutes, and the rules and regulations established as provided in this ordinance, nor shall such certi- ficate be issued unless said installation is in conformity with approved methods of construction for safety to persons and property Section 8 0 Approved Materials 8 1 It shall be unlawful to install or use any electrical device, apparatus or equipment designed for attachment to, or installation on any electrical circuit or system for heat, light or power that is not of good design and construction and safe and adequate for its intended use. The Electrical Inspector shall have power to disapprove the use or installation of devices not fulfilling these requirements Devices, apparatus and equip- ment approved by such generally recognized authorities as United States Bureau of Standards, Electrical Testing Laboratories of New York, m Under- writers Laboratories shall be held to have the approval of the Electrical Inspector unless explicitly disapproved by said Authority for reasons of faulty design and poor construction involving danger to persons and/or property 8.2 It shall be the duty of the Electrical Inspector from time to time to inspect devices, apparatus and equipment offered to the public for use in installation to see that such items conform to the above requirements. Page 131 Section 9 0 Adoption of National Electrical Code 9 1 The latest edition of the National Electric Code, and all subsequent editions thereof, as approved by the American Standards Association, is hereby adopted by the City of Livonia and by this reference is made a part of this ordinance just as if it were word for word repeated herein. 9 2 The purpose of said National Electrical Code is the practical safeguarding of persons and of buildings and their contents, from electrical hazards arising from the use of electricity for light, heat, power, radio, signalling and for other purposes 9.3 Said National Electrical Code shall be published by providing to the public in the office of the City Clerk not less than fifty (50) printed copies in book form available for inspection by and distribution to the public at all times. The charge for such book shall be $Q.25, each. Any amendment to or revisions of such adopted code may be published in the same manner. A complete copy of said code shall be available for public use and inspection at the office of the City Clerk and publication of this ordinance shall constitute notice to such effect 9 4 All electrical installations, materials, devices, apparatus and equipment, unless otherwise provided herein, shall be in strict conformance with the provisions of said National Electrical Code. Section 10.0 Record and Review 10 1 The Bureau of Inspection shall keep complete records of all permits issued and inspections made and other official work performed under the provisions of this ordinance 10 2 When the Electrical Inspector condemns all or part of any electrical installation, the owner may within five (5) days after receiving written notice from the Electrical Inspector, file a petition in writing for review of said action of the Electrical Inspector with the Board of Examiners, upon receipt of which the said Board of Examiners shall at once proceed to determine whether said electrical installation complies with this ordinance, and within three (3) days shall make a decision in accordance with its findings. Section 11 0 License For Electrical Work. 11 1 It shall be unlawful for arty person, firm or corporation to engage as an independent contractor in the installation, alteration, main— tenance or repair of electrical wiring, equipment, apparatus or fixtures for light, heat or power purposes where the electromotive force exceeds 30 volts in or about buildings and/or structures located within the City of Livonia without first having procured a license. Persons making application must be twenty—one (21) years of age or over and must have a license as a Journeyman electrician and pass a suitable _ examination Persons, firms or corporations applying for Contractor's License must have at least one member of the firm with the above qualifica— tions and experience or may have one or more men employed with the above qualifications and experience Page 135 A Board of Examiners is hereby constituted consisting of the Electrical Inspector of the City of Livonia and two other persons who shall, be appointed by the Mayor for such terms as shall be designated at the time of appointment At least one of the members of said Board shall be a licensed Electrical Contractor and shall have had ten(10) years or more experience in electrical work. This Board shall examine all applicants for either Contractor's or Journeyman Electrician's licenses Applicants failing to pass will not be eligible for re-examination in any reciprocating municipality for a period of thirty (30) days. All applicants for licenses shall designate their legal address as the location of their residence in the case of Journeyman Electricians, and their legal address as the principal place of business in the case of Electrical Cortractors. All Electrical Contractors and Journeyman Electricians having their legal address within the corporate limits of the City of Livonia shall secure their license from the City Clerk The Board shall prepare the application blanks, prescribe the exami- nation and meet at least once a month, or on call of the Chairman, to hold examinations Due notice shall be given applicants of the date of examination. 11 2 It shall be unlawful for a.ri person to engage in the occupation or trade of Journeyman Electrician in the installation, alteration, maintenance or repair of electrical wiring, equipment, apparatus or 'ixtures for light, heat, power or medical p oses where the electromotive force exceeds 30 volts in or about buildings and/or structures within the City of Livonia without having first taken the examination and obtained a license as herein provided. This provision shall not apply to helpers and apprentices, provided such work as they may do is performed under the direction and supervision of licensed Journeyman Electricians who shall be on the premises at all times when such helpers or apprentices are performing such work on the premises. All applications for said examination shall be in writing The examination shall consist of an oral or written examination as the Examin- ing Board shall determine, and such other practical tests in examination at the discretion of the Examining Board. Stenographic notes shall be taken of all oral examinations. Minimum qualifications for examinations for Journeyman Electricians shall be four (Li) years of practical experience Time spent in trade school attendance shall be credited as apprentice experience Four (4) years in technical school and one (1) year practical experience shall also qualify for examination 11 3 The fee for an Electrical Contractor's license shall be $25 00 per year The fee for a Journeyman Electrician's license shall be $2.00 per year. Licenses shall expire one year from date of issuance, and shall be renewed upon application by the licensee, together with the payment of the required fee After March 1st, all licenses not renewed shall be considered cancelled and may not be renewed except upon approval by the Examining Board. Electrical Contractors' licenses and Journeyman Electri- cians' licenses shall be issued by the City Clerk upon recommendation of the Examining Board Licenses issued under this ordinance shall be non-trans- ferable and shall be displayed when requested. Electrical Contractors licensed under the terms of this ordinance shall not secure permits for work to be done by any person not employed by said Electrical Contractor, Page 136 and license maybe revoked for violation of this rule No license shall be recognized by the City of Livonia unless such licenses are issued by a cooperating municipality having an Examining Board. The City of Livonia shall permit Electrical Contractors lawfully licensed by other municipalities of the State of Michigan to install, alter or repair electrical wiring, equipment, apparatus or fixtures for light, heat or power purposes within the corporate limits of the City of Livonia, upon payment of a One Dollar ($1 00) registration fee, provided that such munici- palities reciprocate in recognizing Electrical Contractors who are duly licensed under the provisions of this ordinance by granting them the same privilege and charging the same uniform license and registration fees; and, provided further, that the licensing ordinances are substantially equal to the requirements of this ordinance. Journeyman Electricians duly licensed by any municipality cooperating in the reciprocal arrangement shall be per- mitted to work in the City of Livonia without the payment of a registration fee; provided, however, that apy Journeyman Electrician doing work within the City of Livonia, and holding a license from a cooperating municiaplity, shall register with the Bureau of Inspection. No Electrical Contractors' licenses of applicants who maintain their principal place of business in a municipality which fails to approve, by affirmative action of its legislative body, the reciprocal and mutually interchangeable licensing arrangements covered by this ordinance, shall be recognized for the purpose of registration by the City of Livonia Corporations applying for Electrical Contractors' licenses, whose principal place of business is not in the State of Michigan, may obtain such license from the City Clerk upon approval by the Examining Board and the payment of the prescribed fee; provided, that the applicant shall file a duly executed bond in the penal sum of One Thousand Dollars ($1,000 00) running to the City of Livonia conditioned for the faithful performance and observance of the ordinance and rules and regulations made and approved as hereinafter provided controlling the installation of electrical wiring and equipment. Such bond shall be a surety bond from a recognized and approved surety company authorized to transact business in the State of Michigan Any Electrical Contractor's or Journeyman Electrician's license may, after a hearing, be suspended or revoked by the Examining Board having issued such license upon evidence presented that false statements have been made upon application for license or upon evidence presented that the person, firm or corporation holding such license willfully or by reason of incompe- tence repeatedly violates any rules and regulations relating to the inspec- tion, maintenance, alteration or repair of electrical wiring, devices, appliances or equipment. 11.4 The Board of examiners is hereby empowered and it shall be their duty to make such rules and regulations concerning electrical work in the City of Livonia as may be required to properly provide for the situation therein The rules and regulations so made shall be effective upon approval by the City Council Section 12 0 Exemptions. 12.1 The provisions of this ordinance shall not apply to the following: 9 Page 137 111 (a) The installing of radio receiving sets and equipment, except the installation of convenience outlets for power supply (b) Apparatus and equipment installed by or for any public utility operating under jurisdiction of the Michigan Public Service Commission and used primarily for the generation or distribu- tion of electric current or for signal or communication pur- poses Section 13 0 Use of Funds. 13 1 All fees paid into the City Treasury for permits, licenses and inspections under the provisions of this ordinance shall become a part of the general fund of the City, and such part thereof as may be necessary shall be used to pay the expenses of the regulation and inspections herein authorized Section 114 0 Penalty 11.E 1 Any person, firm or corporation who shall violate or fail to comply with any of the provisions of this ordinance, or who shall injure or destroy any property or notice of the Bureau of Inspection, or who shall interfere with any of the work of said Bureau, shall be guilty of a mis- demeanor, and on conviction, shall be punished by a fine not to exceed Five Hundred Dollars ($500 00), or by imprisonment for not more than ninety (90) li; days, or by both such fine and imprisonment in the discretion of the Court. Section 15 0 Repeal. 15 1 Section 12 02, entitled, "Electric Wiring," of Article XII of the Building Code of the Township of Livonia, together with all parts of said Code which are inconsistent or in conflict with this ordinance, are hereby repealed 15.2 All ordinances or parts of ordinances in conflict or inconsistent with this ordinance are hereby repealed Section 16 0 Liability. 16 1 This ordinance shall not be construed to relieve from or lessen the responsibility or liability of any party owning, operating, controlling or installing any electric wiring, electric devices and/or electric material for damages to person or property caused by any defect therein nor shall the City of Livonia, or any of its subdivisions or agents, be held as assuming any such liability by reason of the inspection authorized herein, or certificate of inspection issued as herein provided. Section 17 0 Severability 17 1 In the event any portion of this ordinance is held invalid for any reason, such holding shall not affect the validity of the remaining por- tion of this ordinance Page 138 Section 18 0 Effective Date 18 1 This ordinance is hereby declared to be an emergency ordinance necessary for the protection of the public health and welfare, and shall take effect immediately on publication, as provided by the Charter A roll call vote was taken on the foregoing ordinance with the following result YEAS: Wilson W Edgar, Raymond E Grimm, Harvey Jahn, Nettie Carey, William Taylor and John Whitehead, NAYS: None The Vice President then declared the foregoing ordinance adopted and effective as of the date of publication On motion of Councilman William Taylor, seconded by Councilman Harvey Jahn and carried by the affirmative vote of all Councilmen named as present in the roll call of this meeting, it was - P-07 RESOLVED, that the Director of Public Works have all City vehicles and equipment lettered and numbered as follows: "City of Livonia, Department of Public Works."
