Seven Mile Road, Livonia, Michigan, and was called to order at approximately 8.00 P M by the President of the Council, Harry S Wolfe Roll was called with the following result: Present-- Harry S Wolfe, Wilson W. Edgar, Raymond E. Grimm, Harvey Jahn, Nettie Carey, William Taylor and John Whitehead. Absent-- None The minutes of the Sixty-Fourth Regular Meeting of the Council held on March 10, 1952, were read and approved Abstract of Bids on Contract No. 2 on the Water Supply System, as prepared by Herald Hamill, City Engineer, was received and placed on file By Councilman Jahn, seconded by Councilman Carey and unanimously adopted as follows, it was. lis �- 933 RESOLVED that, the time for receiving bids on Contracts No 3 and 4 of the Water Supply System having expired at 8:30 P M according to advertised notice, the City Clerk is hereby directed to open and read all bids received Bids were opened and read as follows: Contract No. 3 Contract No. 4 1 Morris Mickelsen Company $ 209,701 50 2. Page 713 I� 93Y RESOLVED, that the foregoing bids be and hereby are referred to the City Engineer for his study and recommendation, and that his report on such bids be considered together with his report on Contract No 2 Councilman Edgar made a report submitted by the Insurance Committee and the Civil Service Commission as a result of a joint session held on March 11, 1952, to discuss group insurance for city employees Statements were also made by Robert Keenman and Harold Hultquist, Robert Baumgartner and Sidney Dettloff as city employees, by Mr Schiffman, an insurance agent and by John Campbell, member of the Civil Service Commission By Councilman Jahn, seconded by Councilman Whitehead and unanimously adopted as follows, it was. /9- 6735 RESOLVED, that the joint reports submitted by the Insurance Committee and the Civil Service Commission be accepted and placed on file, that further action on this matter be referred to the Civil Service Commission, and that final disposition be made by the Council after receipt of the Civil Service Commission of its proposed schedule and plan of hospitalization and group insurance, in accordance with the joint report and such amendments as is deemed proper Mr. Askew, associate of Ralph R Calder, architect, appeared before the Council and discussed the plans for the new city hall and the proposed advertisement for bids The question of receiving separate bids for the mechanical work as well as the preparation for the site was carefully considered and statements on this subject were made by John Campbell and Herald Hamill. The matter of location of the building on the site was likewise considered Councilman Edgar made a motion that the following resolution be adopted: qj RESOLVED, that the city hall building be placed at the Southerly end of the mall on the ground plans of the Civic Center site as prepared by the architect. The foregoing motion was seconded by Councilman Whitehead and a roll call vote was taken with the following result: AYES Edgar and Whitehead. NAYS: Grimm, Carey, Taylor, Jahn, and Wolfe Page 714 A ten minute recess was called following which the meeting reconvened with all members of the Council present. By Councilman Taylor, seconded by Councilman Jahn and adopted as follows, it was: ,47--?-37 RESOLVED that, on recommendation of the architect, the new city hall be placed on the Civic Center site in such a position that the front building line will be approximately 310 feet South of the center line of Five Mile Road and the East building line approximately 125 to 175 feet from the East boundary of the Civic Center site The result of the roll call vote taken on the foregoing resolution was as follows: AYES• Grimm, Carey, Taylor, Jahn and Wolfe. NAYS• Edgar and Whitehead. By Councilman Grimm, seconded by Councilman Whitehead and unanimously adopted as follows, it was: 93, RESOLVED that, in requesting bids on the construction of the new city hall, separate bids be required on the mechanical work ILw and installations, including electrical, plumbing and heating work, and likewise a separate bid for site improvement; and that the architect, Ralph R. Calder, submit to the city a letter clarifying his contract as to the clerk of the works By Councilman Edgar, seconded by Councilman Jahn and unanimously adopted as follows, it was: 9:57 RESOLVED, that the proposed form of advertisement inviting bids for the construction of the new city hall, as prepared by Ralph R. Calder, architect, and bearing date of March 17, 1952, is hereby approved on the following conditions. 1 That such form be amended to provide for separate bids in accordance with the resolution previously prepared by the Council on this day; 2 That such approval shall not become effective until detailed plans and specifications in proper form have been duly submitted to the Council and approved by the Council, and 3 That such form be amended to show that such detailed plans and specifications, approved by the Council, are on file in the Office of the City Clerk Page 715 Director of Public Safety James Hagen, Fire Chief Calvin Roberts and Tom Moss, architect, appeared before the Council and discussed the plans for a proposed new fire hall President Wolfe, with the consent of all members, requested that they bring in a report as to what changes will be necessary in converting the present city hall into a fire hall and the estimated cost of such changes By Councilman Whitehead, seconded by Councilman Taylor and unanimously adopted as follows, it was: /2 9yo RESOLVED that, pursuant to recommendation of Carl J Wagonschutz, dated March 13, 1952, the City Treasurer pay to Shelden Land Company the sum of $74 17 to reimburse such company for that portion of the 1951 tax as is allotted to the Livonia Township School District, the entire tax having been erroneously assessed against the South 225 feet of Lot 1596 of Rosedale Gardens Subdivision No. 8 The result of the roll call vote taken on the foregoing resolution was as follows: AYES: Grimm, Carey, Taylor, Jahn, Edgar, Whitehead & Wolfe NAYS: None. By Councilman Jahn, seconded by Councilman Taylor and unanimously adopted as follows, it was: /9- 9.Y/ RESOLVED that, pursuant to recommendation of Herald Hamill, City Engineer, dated March 10, 1952, the City Treasurer pay and release to Buckland Development Company the sum of $4511 38 from the cash bond deposited by such company to guarantee proper installation of water mains on Grandon Avenue in Grandon Woods Subdivision; provided, however, that said Buckland Development Company shall approve such recommendation of Herald Hamill in writing prior to receiving the aforesaid payment. The result of the roll call vote taken on the foregoing resolution was as follows: AYES• Grimm, Carey, Taylor, Jahn, Edgar, Whitehead & Wolfe NAYS: None. Letter from K. K. Martin, dated March 12, 1952, was received and placed on file. By Councilman Jahn, seconded by Councilman Taylor and unanimously adopted as follows, it was: Page 716 9X2- RESOLVED that, pursuant to written recommendation of Hubbell, Roth & Clark, Inc , consulting engineers, dated March 6, 1952, and pursuant to recommendation of the Department of Public Works dated March 17, 1952, the sewers in Sections 2 and 3 of Sewage Disposal System No. 1, and that part of the sewers in Section 4 of said system, consisting of the 30" sewer on Plymouth Road extending from Hartel to Middlebelt and the 24" sewer on Hartel running Northerly 780 feet from Plymouth Road, be approved for the purpose of issuing permits for connections to said sewers; provided, however, that this approval applies only to said sewers for the aforesaid purpose, and does not constitute final approval of the contractors' surface restoration and cleanup, nor does this resolution constitute final approval of such sewers or of performance of the contracts pertaining thereto By Councilman Carey, seconded by Councilman Whitehead and unanimously adopted as follows, it was: 9 9 RESOLVED, that the application of William J Monahan for transfer of S D M license and of Roderick P. and Esther C McKay to add space on 1951 S D M license, be tabled until the Council receives a report and recommendation from the Police Department By Councilman Edgar, seconded by Councilman Taylor and unanimously adopted as follows, it was: /2 9 /RESOLVED, that the petition of Robert K Alexander, et al, for paving and drainage on Wadsworth Drive be referred to the Department of Public Works and City Engineer for their preliminary investigation and report. Letter from the City of Plymouth, dated March 13, 1952, was read and placed upon the minutes as follows: "I wish to take this opportunity to thank you and the Fire Department for the splendid cooperation given us on our recent fire at Allen Industries Inc "I called for assistance and received, with the greatest of success, the Fire Department's immediate response The splendid workmanship exemplifies a well manned and trained Fire Department of which your citizens should be very proud. "In case you should need our help at any time, we will be only too glad to assist. "Again I wish to thank you and the Fire Department for their help " Page 717 President Wolfe stated that, with the consent of all present, he would cause the foregoing letter to be acknowledged and a letter of appreciation sent to the City of Plymouth for its aid in connection with our recent fire at the Ford Tank Plant. By Councilman Jahn, seconded by Councilman Carey and unanimously adopted as follows, it was: 19-9`45 RESOLVED, that the Department of Public Works be commended for its capable work during the recent fire at the Ford Tank Plant, in conjunction with the Fire and Police Departments and that a letter of commendation be written consistent with this resolution. By Councilman Taylor, seconded by Cohncilman Carey and unanimously adopted as follows, it was. q 9/69 RESOLVED, that the letter from Tomorrows Homes, Inc , dated March 12, 1952, pertaining to drainage in Melody Manor Subdivision be referred to the Department of Public Works for its recommendation and report. Copy of letter from Jesse Ziegler, Mayor, dated March 4, 1952, appointing Howard Passmore to the Board of Review (taxes) was received and placed on file. By Councilman Jahn, seconded by Councilman Whitehead and unanimously adopted as follows, it was: 94/7 RESOLVED, that the appointment by the Mayor of Howard Passmore as a member of the Board of Review (taxes) is hereby approved and confirmed. By Councilman Taylor, seconded by Councilman Jahn and unanimously adopted as follows, it was: 9W7 RESOLVED, that copies be made of a letter from the Wayne County Drain Commissioner dated March 6, 1952, addressed to Herald Hamill and pertaining to the request of General Motors Corporation for relocation of the Livonia and Shaw Drains; that one of such copies be sent to General Motors Corporation and that another copy be placed on file in the Office of the City Clerk Ordinance No. 51 entitled, "An Ordinance Regulating the Erection, Construction, Enlargement, Alteration, Repair, Moving, Demolition, Conversion, Page 718 Occupancy, Equipment, Height, Area, Location and Maintenance of all Buildings and Structures in the City of Livonia; and Providing for Issuance of Permits, Collection of Fees, Making of Rules and Establishment of Fire Limits; Providing for the Repeal of Prior Ordinances; and Providing Penalties for Violation H ereof", which was intro- duced by Councilman Grimm at the 64th regular meeting of the Council held on March 10, 1952, was removed from the table and a roll call vote was conducted with the following result: AYES. Grimm, Carey, Taylor, Jahn, Edgar, Whitehead & Wolfe. NAYS: None. The President declared the foregoing ordinance adopted azd effective as of the date of publication, March 28, 1952. By Councilman Edgar, seconded by Councilman Carey and unanimously adopted as follows, it was• g 9'9 RESOLVED that, pursuant to recommendation of James L. Hagen, Director of Public Safety, the sum of $894 00 be transferred within the Police Department budget from the General Salaries Fund to the Office Clerical Salary Account. The result of the roll call vote taken on the foregoing resolution was as follows: AYES. Grimm, Carey, Taylor, Jahn, Edgar, Whitehead & Wolfe. NAYS• None. Councilman Jahn introduced the following ordinance. NO 52 AN ORDINANCE PROVIDING FOR THE LICENSING AND REGISTRATION OF ELECTRICAL CONTRACTORS AND THE LICENSING OF JOURNEYMAN ELECTRICIANS IN THE CITY OF LIVONIA; PROVIDING A RECIPROCAL ARRANGEMENT FOR THE RECOGNITION OF EXAMINATION AND LICENSES ISSUED BY OTHER MUNICIPALITIES IN THE STATE OF MICHIGAN VOLUNTARILY COOPERATING IN THE ENFORCEMENT OF THIS ORDINANCE; PROVIDING A PENALTY FOR VIOLATION HEREOF; AND REPEALING ALL OTHER ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH. THE CITY OF LIVONIA ORDAINS: Page 719 Section 1 Title This ordinance shall be known and cited as the "Electrical Licensing Ordinance of the City of Livonia " Section 2 Purpose The purpose of this ordinance is to promote and r.. protect the public health, safety and welfare Section 3 Construction. This ordinance shall be liberally construed in such manner as to best effectuate its purpose Section 4. Enabling Authority This ordinance is adopted pursuant to Section 1 of Chapter II and Section 11 of Chapter IX of the Charter of the City of Livonia. Section 5 License for Electrical Work It shall be unlawful for any person, firm or corporation to engage as an independent contractor in the installation, alteration, maintenance or repair of electrical wiring, equipment, apparatus or fixtures for light, heat or power purposes where the electromotive force exceeds 30 volts in or about buildings and/or structures located in the City of Livonia without first having procured a license. Section 6 Journeyman's License It shall be unlawful for any person to engage in the occupation or trade of Journeyman Electrician in the installation, alteration, maintenance or repair of electrical wiring, equipment, apparatus or fixtures for light, heat, power or medical purposes where the electromotive force exceeds 30 volts in or about buildings and/or structures within the City of Livonia without having first taken the examination and obtained a license as herein provided This provision shall not apply to helpers and apprentices, provided such work as they may do is performed under the direction and supervision of licensed Journeyman i•• Electricians who shall be on the premises at all times when such helpers or apprentices are performing such work on the premises Section 7. Qualifications. Persons making application must be 21 years of age or over and must have a license as a Journeyman Electrician and pass a suitable examination. Minimum qualifications for examinations for Journeyman Electricians shall be four (4) years of practical experience Time spent in trade school attendance shall be credited as apprentice experience. Four (4) years in technical school and one (1) year practical experience shall also qualify for examination Persons, firms or corporations applying for contractor's license must have at least one (1) member of the firm with the above qualifications and experience or may have one (1) or more men employed with the above qualifications and experience Section 8 Board of Examiners A Board of Examiners is hereby constituted consisting of the Electrical Inspector of the City of Livonia and two other persons who shall be appointed by the Mayor for such terms as shall be designated at the time of appointment At least one of the members of said Boards shall be a licensed Electrical Contractor and shall have had ten (10) years or more experience in electrical work. This Board shall examine all applicants for either Contractor's or Journeyman Electrician's licenses. Applicants failing to pass will not be eligible for re-examination in any reciprocating municipality for a period of thirty (30) days. All applicants for licenses shall designate their legal address as the location of their residence in the case of Journeyman Electricians, and their legal address as the principal place of business in the case of Electrical Contractors All Electrical Contractors and Journeyman Electricians having their legal address within the corporate limits of the City of Livonia shall secure their license from the City Clerk Page 720 Section 9. Meetings of the Board. The Board shall prepare the application blanks, prescribe the examination and meet at least once a month, or on call of the Chairman, to hold examinations Due notice shall be given applicants of the date of examination Section 10. Application for Examination. All applications for said examination shall be in writing. The examination shall consist of an oral or written examination as the Examining Board shall determine, and such other practical tests in examination at the discretion of the Examining Board. Stenographic notes shall be taken of all oral examinations. Section 11. License Fees The fee for an Electrical Contractor's license shall be $25 00 per year. The fee for a Journeyman Electrician's license shall be $1.00 per year. Licenses shall expire one year from the date of issuance, and shall be renewed upon application by the licensee, together with the payment of the required fee. After March 1st, all licenses not renewed shall be considered cancelled and may not be renewed except upon approval by the Examining Board Electrical Contractors' licenses and Journeyman Electricians' licenses shall be issued by the City Clerk upon recommendation of the Examining Board. Licenses issued under this ordinance shall be nontransferable and shall be displayed when requested. Electrical Contractors licensed under the terms of this ordinance shall not secure permits for work to be done by any person not employed by said Electrical Contractor and licenses may be revoked for violation of this rule. Section 12 Registration Fees The City of Livonia shall permit Electrical Contractors lawfully licensed by other municipalities of the State of Michigan to install, alter or repair electrical wiring, equipment, apparatus or fixtures for light, heat or power purposes within the corporate limits of the City of Livonia, upon t"" payment of a One Dollar ($1 00) registration fee provided that such municipalities reciprocate in recognizing Electrical Contractors who are duly licensed under the pro- visions of this ordinance by granting them the same privilege and charging the same uniform license and registration fees, and, provided further, that the licensing ordinances are substantially equal to the requirements of this ordinance. Journeyman Electricians duly licensed by any municipality cooperating in the reciprocal arrangement shall be permitted to work in the City of Livonia without the payment of a registration fee; provided, however, that any Journeyman Electrician doing work within the City of Livonia, and holding a license shall register with the Bureau of Inspection Section 13. Requirement as to Licenses Issued by Other Municipalities No license shall be recognizedty the City of Livonia unless such licenses are issued by a cooperating municipality having an Examining Board No Electrical Contractors' licenses of applicants who maintain their principal place of business in a municipality which fails to approve, by affirmative action of its legislative body, the reciprocal and mutually interchangeable licensing arrangement covered by this ordinance, shall be recognized for the purpose of registration by the City of Livonia. Section 14 Bond Required of Non-Resident Contractors Corporations applying for Electrical Contractors' licenses, whose principal place of business is not in the State of Michigan, may obtain such license from the City Clerk upon approval by the Examining Board and the payment of the prescribed fee; provided, that the applicant shall file a duly executed bond in the penal sum of One Thousand Dollars ($1,000.00) running to the City of Livonia conditioned for the faithful performance and observance of the ordinance and rules and regulations made and approved as hereinafter provided Page 721 controlling the installation of electrical wiring and equipment. Such bond shall be a surety bond from a recognized and approved surety company authorized to transact business in the State of Michigan. Section 15 Suspension or Revocation of Licenses Any Electrical Contractor's or Journeyman Electrician's license may, after a hearing, be suspended or revoked by the Examining Board having issued such license upon evidence presented that false statements have been made upon application for license or upon evidence presented that the person, firm or corporation holding such license willfully or by reason of incompetence repeatedly violates any rules and regulations relating to the inspection, maintenance, alteration or repair of electrical wiring, devices, appliances or equipment. Section 16. Rules and Regulations. The Board of Examiners is hereby empowered and it shall be their duty to make such rules and regulations concerning electrical work in the City of Livonia as may be required to properly provide for the situation therein The rules and regulations so made shall be effective upon approval by the City Council. Section 17 Penalty Any person, firm or corporation who shall violate or fail to comply with any of the provisions of this ordinance, or of the rules and regulations made pursuant hereto, shall be guilty of a misdemeanor and on conviction shall be punished by a fine not to exceed Five Hundred Dollars ($500.00) or by imprisonment of not more than ninety (90) days, or by both such fine and imprisonment in the discretion of the Court Section 18 Repeal. Ordinance No. 16 of the City of Livonia entitled, "An Ordinance Regulating the Installation and Maintenance of Electric Wiring, Electric Devices and Electric Material; and Providing for Permits, Inspections and Licenses with Respect Thereto and a Penalty for Violation Thereof", as amended, and all other ordinances or parts of ordinances in conflict or inconsistent with this ordinance are hereby repealed Section 19. Severability. In the event any portion of this ordinance is held invalid for any reason, such holding shall not affect the validity of the remaining portion of this ordinance Section 20 Effective Date. This ordinance is hereby declared to be an emergency ordinance necessary for the protection of the public health and welfare, and shall take effect immediately on publication, as provided by the Charter. A roll call vote was taken on the foregoing ordinance with the following result: AYES• Grimm, Carey, Taylor, Jahn, Edgar, Whitehead and Wolfe NAYS: None President Wolfe declared the foregoing ordinance adopted and effective as of the date of publication, March 28, 1952 Councilman Taylor introduced the following ordinance: Page 722 NO. 53 AN ORDINANCE PROVIDING FOR THE REGISTRATION OF MASTER PLUMBERS AND JOURNEYMAN PLUMBERS; AND PROVIDING A PENALTY FOR VIOLATION HEREOF THE CITY OF LIVONIA ORDAINS: Section 1 Registration of Plumbers All plumbers licensed under Act No 266, Public Acts of Michigan, 1929, as amended, residing in or doing work in the City of Livonia are hereby required to register with the Bureau of Inspection. The registration of such plumbers shall be made on or before the 1st day of April of each year and shall be made only upon presentation of the State Plumbing License for the current year. Section 2 Registration Fees For the service of such registration under this ordinance, a fee of $1 00 shall be paid by each master plumber and a fee of 50* by each journeyman plumber Registration shall be granted immediately upon presentation of State license and payment of registration fee to the City Treasurer Section 3. Compliance with Local Ordinances and Regulations. All master plumbers andjpurneyman plumbers performing work or making installations within the City of Livonia shall fully comply with the Building Code of the City of Livonia, together with all other ordinances of the City of Livonia and all of the rules and regulations of the Bureau of Inspection The Bureau of Inspection shall report to the State Plumbing Board any persistent or wilful violation of such ordinances, rules and regulations, and any incompetence of a licenJed plumber Section 4. Penalty. Any person, firm or corporation who shall violate or fail to comply with any of the provisions of this ordinance, or who shall fail to register as required in this ordinance, shall be guilty of a misdemeanor, and on conviction, shall be punished by a fine not to exceed Five Hundred Dollars ($500.00), or by imprisonment for not more than ninety (90) days, or by both such fine and imprisonment in the discretion of the Court Section 5 Repeal Ordinance No 17 of the City of Livonia entitled, "An Ordinance Regulating the Installation and Maintenance of Plumbing and Drainage, and of Materials Used in Plumbing and Drainage; and Providing for Permits, Inspections and Licenses with Respect Thereto and a Penalty for Violation Thereof," as amended, together with all other ordinances and parts of ordinances in conflict or inconsistent with this ordinance are hereby repealed Section 6 Severability In the event any portion of this ordinance is held invalid for any reason, such holding shall not affect the validity of the remaining portion of this ordinance Section 7. Effective Date. This ordinance is hereby declared to be an emergency ordinance necessary for the protection of the public health and welfare, and shall take effect immediately on publication, as provided by the Charter.
