HomeMy WebLinkAboutPLANNING MINUTES 2011-06-28MINUTES OF THE 1,011TH PUBLIC HEARINGS AND REGULAR MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, June 28, 2011, the City Planning Commission of the City of Livonia held its 1,011° Public Hearings and Regular Meeting in the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan. Mr. Lee Morrow, Chairman, called the meeting to order at 7:00 p.m. Members present: Scott P. Bahr Ashley V. Krueger R. Lee Morrow Lynda L. Scheel Carol A. Smiley Gerald Taylor Ian Wilshaw Members absent: None Mr. Mark Taormina, Planning Director, and Ms. Margie Watson, Program Supervisor, were also present. Chairman Morrow informed the audience that if a petition on lonighfs agenda involves a rezoning request, this Commission makes a recommendation to the City Council who, in tum, will hold its own public hearing and make the final determination as to whether a pefifion is approved or denied. The Planning Commission holds the only public hearing on a request for preliminary plat and/or vacating petition. The Commission's recommendation is forwarded to the City Council for the final determination as to whether a plat is accepted or rejected. If a petition requesting a waiver of use or site plan approval is denied tonight, the petitioner has len days in which to appeal the decision, in writing, to the City Council. Resolutions adopted by the City Planning Commission become effective seven (7) days after the date of adoption. The Planning Commission and the professional staff have reviewed each of these pefifions upon their fling. The staff has furnished the Commission with both approving and denying resolutions, which the Commission may or may not use depending on the outcome of the proceedings tonight. ITEM #1 PETITION 2011-05-02-08 GET SKILLZ BASKETBALL Ms. Scheel, Secretary, announced the first item on the agenda, Pefifion 2011-05- 02-08 submitted by Al Abdelnour requesting waiver use approval pursuant to Section 16.11(f) of the City of Livonia Zoning Ordinance #543, as amended, to operate an indoor recreational facility (Get Skillz Basketball) at 13500 Wayne Road, located on the east side of Wayne Road between Industrial Road and Schoolcmff Road in the Northwest 1/4 of Section 28. June 28, 2011 25712 Mr. Taormina: This request involves property that is located in the Northwest 1/4 of Section 28. This is a square mile that is generally bounded by Plymouth Road to the south, Farmington Road along the east, and Schoolcraft Road and the 1-96 Expressway to the north. The property is on the east side of Wayne Road between Industrial Road and Schoolcraft Road. This site is approximately 0.68 acres in size. It has 100 feel of frontage on Wayne Road and an average depth of just under 300 feet. The zoning of the properly is M-1, Light Manufacturing. This would include not only this property but also the surrounding properties to the north, south, east and west. The property currently has a building on it. It is about a 10,430 square foot structure. Indoor recreational facilities and athletic training schools are allowed as a waiver use under Section 16.11(f) of the Zoning Ordinance. This is after a determination is made that because of their nature and unique characteristics, for example, the requirement for higher ceilings, that these uses would be compatible within an industrial setting, and also provided that all the parking, as well as ingress and egress to the facility, does not interfere with industrial traffic in the area. Such uses shall not include health and fitness clubs, swimming pools, bowling alleys, billiard parlors and poolrooms. The petition this evening is for the Get Skillz Basketball training facility. This would occupy the entire 10,400 square feet of the building. The front part of the building would be maintained as it currently exists, which includes the entrance, several office rooms, restrooms, and a lunchroom. The rear portion of the building, which constitutes the open shop area, would be transformed into a series of training basketball courts. They would run both the width and length of the building to provide for various training half -courts or full courts. They would provide training for students of all ages. This would include high school and college players. It is our understanding there would be about 9 or 10 students per training session. The facility would be open seven days a week, from the morning to the evening. However, we understand most of the sessions would be in the afternoon, at least during the school year. There would be one receptionist and three trainers. Parking is calculated on the basis of one space for each employee and sufficient off-street space for the safe and convenient loading and unloading of students. With the four employees, there would be a minimum need of four parking spaces. What is available on the site is a total of 20 parking spaces. The majority of the site's parking is located behind the building. There is an access drive along the south side of the building, which is shared with the adjoining business to the east, which is ABC Transportation Company. There are a few other spaces June 28, 2011 25713 located in front of the building. So there is a total of 20 packing spaces available. It is our understanding that the majority of the students are expected to be dropped off and then picked up after the session. All the regular parking spaces are 10 feel by 20 feet. They are not proposing any exterior changes to the building other than signage. They would be permitted either one ground sign not to exceed 30 square feel in area or one wall sign not to exceed 30 square feel in area. Mr. Morrow: Is there any correspondence? Mr. Taormina: There are four items of correspondence. The first item is from the Engineering Division, dated June 28, 2011, which reads as follows: "In accordance with your request, the Engineering Division has reviewed the above -referenced petition. The legal description provided is connect. The address is confirmed to be 13500 Wayne Road for this building." The letter is signed by Kevin G. Roney, P.E., Assistant City Engineer. The second letter is from the Livonia Fire & Rescue Division, dated June 3, 2011, which reads as follows: "This office has reviewed the site plan submitted in connection with a request for waiver use approval to operate an indoor recreational facility on property located at the above referenced address. 1 have no objections to this proposal with the following stipulation: The Building and the Occupancy must comply with NFPA 101, Chapter 12, 2009 Edition." The letter is signed by Earl W. Fesler, Fire Marshal. The third letter is from the Division of Police, dated June 7, 2011, which reads as follows: 7 have reviewed the plans in connection with the petition. There are a few issues 1 want to address. First, the parking lot is very small. There are only 3 parking spaces in the front (west) lot, which includes one handicapped space. There are approximately 14 to 15 spaces in the rear (east) lot if the foliage is cleared. There are no parallel parking spots available on either side of the building. Wayne Road is posted no parking on both sides of the street as well (TCORCO 71-5 effective 06/16/1971). My concem is with the issue of overflow parking if and when this establishment hosts parties, games, tournaments, etc. ABC Cab company is immediately to the south of this address, and uses most of their parallel parking spots on the north side of their buflding/property, as well as their rear (east) lot. Currently, when 1 visited this site, ABC was actually using most of their parking spaces, as well as the parking spaces behind this proposed site. In closing, 1 believe this site is going to have issues with parking. And when it does, the employees, players, and visitors will have no other choice but to park in neighboring lots and inevitably on Wayne Road, which is not allowed." The letter is signed by John Gibbs, June 28, 2011 25714 Sergeant, Traffic Bureau. The fourth letter is from the Inspection Department, dated June 28, 2011, which reads as follows: "Pursuant to your request, the above -referenced petition has been reviewed. The following is noted. (1) This petition is change of use and would require that the building meet all current Michigan Building Codes including the Michigan Barrier Free Code. This will be addressed further at the time of our plan review if this project moves forward. (2) The driveway approach is in disrepair and will require replacement (3) The petitioner has not provided an occupant load for this space. The number of restroom fixtures and drinking fountain requirements will be addressed at the time of our plan review if this project moves forward. This Department has no further objections to this petition." The letter is signed by Jerome Hanna, Assistant Director of Inspection. That is the extent of the correspondence. Mr. Morrow: Thank you, Mr. Taormina. Are there any questions for the staff? Mr. Taylor: Through the Chair to Mark Taormina. Mark, I was out there again today. Is the driveway wide enough to have parallel parking on the south side of the building? I have the same concerns with parking there. Mr. Taormina: I looked at that exact thing today. If there is a need for additional parking, it is likely that people would park in a parallel fashion along the south side of the building. Across the aisleway is angled parking, and I believe there is adequate space to allow this. For that reason, I think it should work. They could probably stripe some parallel spaces. Mr. Taylor: I thought they could angle park in there. Mr. Taormina: Yes, I think it would work. Mr. Taylor: Thank you. Mr. Morrow: Will the petitioner please come forward? We'll need your name and address for the record. Al Abdelnour, 15406 Levan Road, Livonia, Michigan 48154. Mr. Morrow: I understand you're a dentist. Dr. Abdelnour: Yes, I am. Mr. Morrow: Shall we call you doctor? June 28, 2011 25715 Dr. Abdelnour: You can call me Al. That's fine. My office is down the street here in Livonia. Mr. Morrow: Would you like to add anything to what Mark has presented here, and then we'll probably have some questions for you. Dr. Abdelnour: It seems like parking is the major concern for this facility. Again, I was there today. I saw all the cabs in the back of the building. We have not signed the lease as of yet, but I assure you that within the lease, we're going to make sure that the ABC Cab Company cannot park in our parking lot. Those 20 spots are going to be for Gel Skillz Basketball, assuming that we gel approved. Again, I was going to address the parallel parking along the side of the building. You guys already brought it up. Il seems like there is plenty of room to add a few more spaces if we need it. But with the 20 spots, we feel we have plenty of parking for the 10, 12 or even 15 students that we have training with us, along with the four employees. I also talked to the owner of the building north of us today. He had some concerns about us parking during the day and blocking his parking lot. I assured him on the phone that we would make sure that we would not park in his parking lot. He told me he closed at 3:30 in the afternoon. We start basically at 4:00 p.m. and move on to the evening. I have to talk with him some more, but he said wasn't a concern even if we needed overflow parking at night in his parking lot. I don't think we're going to need that, but we're trying to have a good relationship with the neighbors on either side. Mr. Morrow: Thank you. There will probably be a few more questions. I'm going to go to the Commission. Mr. Taylor: Again, on the parking, how can you ensure though that ... did you say the person to the north, the owner to the north? Dr. Abdelnour: Yes. I spoke with him on the phone today. Mr. Taylor: You say your business doesn't start until 4:00 p.m.? Dr. Abdelnour: Well, during the school year, most of the kids are in school until 4:00 p.m. So we train during the school year basically from September through June, would be pretty much from 4:00 p.m. through the evening. Mr. Taylor: I understand that, but what about during the summer? June 28, 2011 25716 Dr. Abdelnour: During the summer, we would have some earlier hours. Three or four months in the summer we would definitely train at all hours of the day. Mr. Taylor: That's what I'm thinking. Knowing most parents, a lot of them will drop their kids off, but a lot of them will stay and watch the practice. Dr. Abdelnour: Absolutely. Mr. Taylor: When you do that, I'm afraid you're going to lose parking. That's what worries me. Dr. Abdelnour: If we have four trainers training three kids, or even three trainers training three kids, we're talking 12 students an hour. We schedule them. These are by appointment only. We can coordinate it. Basically, if you have 12 high school kids and we're worried about all 12 kids driving there and parking, we can coordinate the hours where we have four high school students at one time, along with some younger students training on other courts because most of the parents will drop their children off and leave and come back and pick them up. Even if we train 12 kids an hour, even 14 kids an hour, and everybody parked there, plus our four employees, that's 18 spots. We have 20 parking spots. Parking should not be a concern at any time of the day. Mr. Taylor: Is the owner of the building here? Dr. Abdelnour: He is not. We requested that he come to the meeting as we spoke before, but we don't have a deal in place at this point because we didn't want to sign the lease until we were sure that we were going to gel this waiver of use. So he decided that he didn't want to show up. Mr. Taylor: I understand that you haven't signed the lease yet, but it's just unfortunate that in order to approve you, we have to ask the owner of the building to cut down weeds that are four and five feet high in the back along the fence. It seems like maybe he could keep his building up a little better. The driveway obviously needs to be repaved and restriped where the parking is. Dr. Abdelnour: I assure you, before we sign the lease, we're going to make sure all those issues are ... Mr. Taylor: Its kind of a gamble going in there. It's too bad that we have to use you in order to put pressure on the owner of the building to June 28, 2011 25717 keep his building up. Its an industrial zone. I understand that, but still, weeds four or five feet high all around the back of the fence is not the way to keep a building. Dr. Abdelnour: I agree 100 percent. We want to make sure that this is as cosmetically pleasing as possible for all of our clients. So we are going to make sure that the building is completely maintained. Mr. Taylor: If I were you, I think I would have him do something. Chances are you're going to be approved by this Board, but you sfill have to go to the Council. I would have those weeds cul down and all those cars out of there so that when somebody comes from the Council, and they will come and take a look at that site and say, well, geez, they're sfill using it for ABC parking. How is he going to change it that quick, and how do we know he's going to change ilthalquick? Justa suggestion loyou. Dr. Abdelnour: Absolutely. I will relay that message to the owner, but also, if we do sign this lease and we do gel approval, its in our best interest to make sure ... and we're going to have that in the lease. We're going to make sure that nobody other than Gel Skillz patrons and Gel Skillz employees will be parking in our lot. That's crucial to our own business. My partners and I are not going to go into a business with ABC cabs parked in the back of our parking lot. We're going to make sure that, one, it's in our lease, and if we have to have them removed, we will have them removed. As far as the cosmetic appearance of the building, I'm very big into cosmetic appearance. I really believe that we're going to keep that building in tiptop shape so the City of Livonia will be happy with it. Mr. Taylor: I think its a great thing that you're doing facility -wise. I think you should take a look at all of these things I suggested. Thank you, Mr. Chairman. Dr. Abdelnour: Absolutely. Ms. Smiley: Do you have a landscape plan or some thoughts for the landscaping? Dr. Abdelnour: Yes. It's a very small frontage. I don't know the exact dimensions of the grass in the front, but its probably 20 by 20. It looks like there's a dead tree in front. We're going to remove that and we talked about planting maybe some nice hew hedges, little boxwoods, and plant some flowers and just keep it looking very nice. We don't want to gel real elaborate in the June 28, 2011 25718 industrial area because I think it would stand out, but we definitely want the building to be very pleasant to look at, especially for our clients. Ms. Smiley: Okay. What about the lighting in that area? Dr. Abdelnour: I was there today. I went in the back. There are no lights in the back, but we are planning on placing the large, I think they're even called gorilla lights. They're very large lights that light up in the entire back area so we will have a very lit parking lot, whether it be on the front and the side. We want to make sure that our clients can walk comfortably without walking in the dark because of a lot of business will be done at night. Ms. Smiley: For their good health and safety. Dr. Abdelnour: Absolutely. We will have plenty of light. Ms. Smiley: Okay. Thank you, Mr. Chair. Mr. Wilshaw: I didn't see any dumpsler for trash on the plan. Are you going to handle trash just internally and dispose of it yourself, or how are you going to manage it? Dr. Abdelnour: To be honest, I never even thought of that. I don't think we're going to be generating too much trash. It might be some sport drinks. I dont know. Do they pick up in the street in that area? Can we put out large garbage cans? I don't know what they do in that area there. Mr. Wilshaw: I'm not sure. I believe most of the businesses have dumpslers to manage their own trash. Dr. Abdelnour: That's very simple. I have an account with Republic Waste for my dental office in Livonia. I can have a dumpster put on there in a day so that's not an issue. We can definitely do that. Mr. Wilshaw: The only thing you have to think about then if you're going to have a dumpsler is obviously location because it's possible it will take up one of your parking spaces, which apparently are so valuable to you right now. Dr. Abdelnour: If it is a concern, then I guess I could remove the trash myself. I could place it in a dumpsler at my office. My partner also owns a facility just around the comer in the industrial area. We could have it placed there. I don't see a lot of trash being stimulated from this building because we're really going to go paperless June 28, 2011 25719 with computers as far as check in and check out. The only thing I see is from the bathrooms and sport drinks. Bottles. Most of them are recyclable I think. Mr. Wilshaw: Can you tell me a little bit more about your business? Obviously, you're going to be doing some training, one-on-one, or one on just a few training. I think you had mentioned during our study meeting possibly some tournaments and other things like that going on at your business. Can you explain how that's going to work? Dr. Abdelnour: To be honest, I don't know. Right now we are a training facility and we train by appointment one-on-one. Where this grows into, where we maybe host a small ... again, it's going to be one large, full NBA basketball court. So if we do host a tournament, you're talking about just two teams playing at a time. It can't be a very large tournament. If we do host these tournaments, I talked at the study meeting as far as parking, we may be able to provide transportation from either my facility or my partners facility directly to Gel Skillz to alleviate any parking issues. My partner's building is on Farmington Road just south of SchoolcraR, and mine is at Five and Levan, which is really around the corner. Mr. W Ishaw: Okay. Are you planning on having any other sports represented there besides basketball? Dr. Abdelnour: Not at this point. I've had inquiries by a friend of mine who was asking possibly could he do some golf training indoors in the winter. He would just put up a net and he could train on one of the courts. We weren't opposed to that. Also, possibly, maybe some volleyball training because it goes hand and hand on the basketball court. We're not opposed to doing other things, but it would be very limited out of this facility. I would say maybe indoor golf and possibly some volleyball. Mr. W Ishaw: Okay. The reason I asked that, and I'm glad that you mentioned volleyball, is I did look around at some of the other types of businesses that are similar to this in the area and I talked to some friends that have done one-on-one training at these types of facilities in basketball, and they said it's not uncommon for these types of facilities to use that facility has a volleyball court or do some other tournaments and activities there to supplement the business because training alone oftentimes isn't enough for some of these larger facilities. June 28, 2011 25720 Dr. Abdelnour: Right. That's why we were being real careful about the size of this facility. We have a clientele base already built in because my partner is already training. We just need a facility so we're not bouncing around. He's bouncing around from Catholic Central through different areas where he's training. We already have a clientele built in. We kind of know what the revenue stream is and we're looking strictly to do basketball at this point. Again, volleyball in some down time would be a great buffer for some additional income. Al this point, we're not looking at that. We're looking at growing this basketball training and strictly just doing basketball right now. Again, we're not opposed to doing a little bit of volleyball or even subletting a little bit for some golf training in the evenings in the winter. Mr. Wilshaw: Okay. Thank you. I do share the concerns of some of the other Commissioners about your parking but I also recognize that you're a successful business person already in the City and you seem to have the business sense to understand how to deal with shortfalls like your parking. I'm hoping that you're very successful and that the parking is not going to become an issue for you. Thank you very much. Mr. Bahr: You're talking about having 12 kids in there at a time. Right? Dr. Abdelnour: Yes. Mr. Bahr: So say in an hour when you've got 12 kids leaving, 12 kids coming, can you talk a little bit about the traffic flow there and how that's going to be handled? I understand the parking, you have a plan for handling that, but there's not a whole lot of room to maneuver there with 12 cars coming in and 12 cars coming out. Dr. Abdelnour: What we can do is, we can stagger our training 15 minutes. We thought about all of these issues because, again, we don't want to just gel approved by the Board and then have all these issues. We have to reconcile these issues for ourselves. We can actually stagger appointments. So if we have a 1:00 to 2:00 training, the next session may be from 2:15 to 3:15 and then next one 3:30 to 4:30 and so on. So we have a 15 minute lag time between training sessions so there is no parking issue and there's no traffic flow issue. Mr. Bahr: Okay. Thanks. Ms. Krueger: I just have a quick question about the landscaping. How do you plan to maintain that? Are there in -ground sprinklers? June 28, 2011 25721 Dr. Abdelnour: There are no in -ground sprinklers there. Depending on the size of the landscaping, we would discuss with the landlord if maybe he could put one in as part of the lease, or if we have to do it ourselves. We're going to do whatever it takes so we don't have dead bushes in front. I have very elaborate landscaping at my dental office, and we try to keep everything nice. I have a landscaping staff that comes and takes care of it. We're going to make sure that we don't have dead bushes and dead trees. Ms. Krueger: Okay. Very good. Thank you. Mr. Morrow: Any other questions? One comment that I wanted to make was, did you hear the letter from the Inspection Department which kind of goes to Mr. Taylor's comment about the owner of the building when it talks about the Michigan Codes including the Michigan Barrier Free Code. Then it goes on to talk about the disrepair and replacement of the driveway approach, and "The petitioner has not provided an occupant load for this space. The number of restroom fixtures and drinking fountain requirements will be addressed at the time of our plan review if this project moves forward" That letter is particularly important for you to note as well as your landlord because I'm assuming that these are expenses he will probably have to incur as it becomes a permanent part of the facility. Dr. Abdelnour: That's what we're going to have to discuss. Who do we need to speak to beforehand to address this issue? Mr. Morrow: Our Inspection Department would give you guidance. Dr. Abdelnour: That would be Jerome Hanna? Mr. Morrow: Yes. Jerome Hanna or perhaps one of the other assistants. Dr. Abdelnour: Okay. Mr. Morrow: But your landlord should be made aware of it. Dr. Abdelnour: Definitely. I tried to gel a hold of Jerome Hanna this week, but I think he's out of the office until Monday. I'll try to get a hold of him next week so that we can find out all these issues. The last thing we want to do is sign a lease with a lot of unknowns. We want to make sure that we understand everything we need to do. June 28, 2011 25722 Mr. Morrow: Yeah, because he said if it moves forward, it will be addressed at plan review. Well, that's not the time to bring it up, after your project has been approved by the City. Dr. Abdelnour: Right. I appreciate that. Thank you. Mr. Morrow: And just another comment. It sounds to me like you have a lot of flexibility to address the concerns we have relative to parking. Dr. Abdelnour: I think we do. Mr. Morrow: We wish you every success in the world, but by the same token, as part of the Planning and City Council, we want to make sure we don't create any kind of a traffic concern, or a parking concern might be a better way to address it. Dr. Abdelnour: I understand that fully. Mr. Morrow: Is there anything else? I'm going to go to the audience to see if there is anyone that wishes to speak for or against the granting of this petition? Seeing no one coming forward, a motion would be in order. On a motion by Wilshaw, seconded by Taylor, and unanimously adopted, it was #06-36-2011 RESOLVED, that pursuant to a Public Hearing having been held by the City Planning Commission on June 28, 2011, on Petition 2011-05-02-08 submitted by Al Abdelnour requesting waiver use approval pursuant to Section 16.11(f) of the City of Livonia Zoning Ordinance #543, as amended, to operate an indoor recreational facility (Gel Skillz Basketball) at 13500 Wayne Road, located on the east side of Wayne Road between Industrial Road and Schoolcmft Road in the Northwest 1/4 of Section 28, which property is zoned M-1, the Planning Commission does hereby recommend to the City Council that Petition 2011-05-02-08 be approved subject to the following conditions: 1. That the Site Plan received by the Planning Commission on May 31, 2011, is hereby approved and shall be adhered to; 2. That the site's landscaping shall be restored to the satisfaction of the Planning Director and thereafter permanently maintained in a healthy condition; June 28, 2011 25723 3. That only conforming signage is approved with this petition, any additional signage shall be submitted for review and approval of the Zoning Board of Appeals; 4. That the issues that are contained in the letter from the Inspection Department, dated June 28, 2011, shall be resolved to the satisfaction of the Inspection Department; and 5. That the specific plan referenced in this approving resolution shall be submitted to the Inspection Department at the time of application for the Certificate of Occupancy. Subject to the preceding conditions, this petition is approved for the following reasons: 1. That the proposed use is in compliance with all of the special and general waiver use standards and requirements as set forth in Sections 16.11 and 19.06 of the Zoning Ordinance #543; 2. That the subject properly has the capacity to accommodate the proposed use; and 3. That the proposed use is compatible to and in harmony with the surrounding uses in the area. FURTHER RESOLVED, that notice of the above hearing was given in accordance with the provisions of Section 19.05 of Zoning Ordinance #543, as amended. Mr. Morrow: Is there any discussion? Mr. Wilshaw: I'm going to add one additional condition that the issues that are contained in the letter from the Inspection Department, dated June 28, 2011, shall be resolved to the satisfaction of the Inspection Department prior to issuance of a Certificate of Occupancy. Those are the issues that you just referred to, Mr. Chair, the banner free space, driveway approach repair and restroom fixtures and dunking fountains. Mr. Morrow, Chairman, declared the motion is carded and the foregoing resolution adopted. It will go on to City Council with an approving resolution. Mr. Taylor: The petitioner has asked for a seven day waiver, and I would make that resolution to go to the Council. June 28, 2011 25724 On a motion by Taylor, seconded by Smiley, and unanimously approved, it was #06-37-2011 RESOLVED, that the City Planning Commission does hereby determine to waive the provisions of Section 10 of Article VI of the Planning Commission Rules of Procedure, regarding the effective dale of a resolution after the seven-day period from the dale of adoption by the Planning Commission, in connection with Petition 2011-05-02-08 submitted by At Abdelnour requesting waiver use approval pursuant to Section 16.11(f) of the City of Livonia Zoning Ordinance #543, as amended, to operate an indoor recreational facility (Gel Skillz Basketball) at 13500 Wayne Road, located on the east side of Wayne Road between Industrial Road and Schoolcraft Road in the Northwest 1/4 of Section 28. Mr. Morrow, Chairman, declared the motion is carried and the foregoing resolution adopted. It will go on to City Council with an approving resolution. We wish you every success. Dr. Abdelnour: Thank you very much. We appreciate everything ITEM #2 MOTION TO HOLD A PUBLIC HEARING REZONING Ms. Scheel, Secretary, announced the next on the agenda, a motion to hold a Public Hearing pursuant to Section 23.01(b) of the City of Livonia Zoning Ordinance #543, as amended, to determine whether or not to rezone vacant City -owned property adjacent to the existing Newburgh Village senior citizen housing community, located on the west side of Newburgh Road between Plymouth Road and Grantland Avenue in the Southeast 1/4 of Section 30, from RU to R-9. Mr. Morrow: This is a motion to hold a public hearing. It was brought forth by the Planning Commission at the request of the Livonia Housing Commission. I will ask for a motion approving it. On a motion by Scheel, seconded by Krueger, and unanimously adopted, it was #06-38-2011 RESOLVED, that the City Planning Commission, at the request of the Livonia Housing Commission, and pursuant to Section 23.01(b) of the City of Livonia Zoning Ordinance #543, as amended, does hereby establish and order that a public hearing be held to determine whether or not to rezone vacant City - owned property adjacent to the existing Newburgh Village June 28, 2011 25725 senior citizen housing community, located on the west side of Newburgh Road between Plymouth Road and Grentand Avenue in the Southeast 1/4 of Section 30, from RUF (Ruml Urban Farm) to R-9 (Housing for the Elderly). FURTHER RESOLVED, that notice of such hearing shall be given in accordance with the provisions of Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, and that thereafter there shall be a report and recommendation submitted to the City Council.
