HomeMy WebLinkAboutSYNOPSIS - 2009-06-10 th SYNOPSIS OF THE MINUTES OF THE 1,634REGULAR MEETING LIVONIA CITY COUNCIL – JUNE 10, 2009 ________________________________________________________________ Meeting was called to order at 8:00 p.m. Present: John Pastor, Joe Laura, Brian Meakin, Tom Robinson, and Terry Godfroid-Marecki. Absent: James McCann, and Laura Toy. MAD #242-09 Resolution by Meakin and Pastor, unanimously adopted, approving FAT rd the minutes of the 1,633 Regular Meeting of the Council held May 27, 2009, as submitted. MAD #243-09 Resolution by Meakin and Pastor, unanimously adopted, approving FAT the minutes of the 245th Special Meeting of the Council held June 6, 2009, as submitted. Pastor welcomed his son Ryan and his girlfriend Ashley back from their Intercultural Relations Internship with Spring Arbor University. Robinson wished his younger sister Janet Roberts a happy birthday. Council Vice President Godfroid-Marecki welcomed Karen Tessner back from surgery. She also stated how much she appreciated the work that Judy Priebe has done over the last six weeks. Laura presented a commendation from the Mayor’s office to J. Bonde, Founder and Director of Seedlings, Braille Books for Children, congratulating and th commending them on their 25 anniversary. Ms. Bonde stated how deeply honored she was to receive the award. She thanked the community for their support. Pastor presented a “Veteran of the Year” tribute to Joseph Girolamo (Major Joe). Wayne County Commissioner Joan Gebhardt also presented him with a plaque honoring him as “Veteran of the Year”. State Senator Glenn Anderson and State Representative John Walsh also presented him with a tribute, signed by the Governor, in honor of his service to our nation and being named “Veteran of the Year”. Mr. Girolamo thanked everyone for what they have done for him. He stated that he never thought he would be named “Veteran of the Year”. th Mark Garrison, 19318 St. Francis, 55 President of the Livonia Jaycees, announced the numerous awards they have won during their first quarter. He also spoke about the increased number of new members. As of June 10, 2009 there are 95 members. Their next convention is in Dearborn, the third weekend of August. th SYNOPSIS OF THE MINUTES OF THE 1,634REGULAR MEETING 2 LIVONIA CITY COUNCIL – June 10, 2009 Brandon Kritzman, 29601 St. Francis, Community Development Vice President of the Livonia Jaycees, gave an update on some of their upcoming events, and some of the projects they’ve recently accomplished. Pastor thanked Mark Garrison for bringing the Jaycees back in action and for giving back to the Community. He is a former Livonia Jaycee. AUDIENCE COMMUNICATION: Joe Neussendorfer, 11316 Merriman Road, commended the City of Livonia residents who maintain public rights-of-ways throughout the City of Livonia. th Mayor Jack Kirksey reviewed the 245 Special Meeting that was held on Saturday, June 6, 2009 regarding the resolution that was unanimously passed to support the automotive dealerships within the City. The Plymouth Road Development Authority encourages the Livonia citizens to write letters of support to the White House. The following items were received and filed: A communication from the Department of Finance dated May 27, 2009, re: forwarding various financial statements of the City of Livonia for the month ending April 30, 2009. A communication from the Engineering Division, dated June 3, 2009, re: the economic impact on the Water and Sewer Fund of limiting the consumption rate increase to 5.3%. (CR 214-09) A communication from the Engineering Division, received in the Office of the City Clerk on June 5, 2009, re: the water and sewer rate history, from 1999 to 2009. (CR 214-09) The following resolutions were offered by Pastor and Laura: MAD #244-09 Approving the request of Patricia Holcomb, 12387 Cavell, to close FAT Cavell between Grantland and Capitol, on Saturday, July 4, 2009 from 10:00 POLICE a.m. to 10:00 p.m., for the purpose of conducting a block party, subject to the approval of the Police Department. MAD #245-09 Approving the request of Stacie Pettit, 8937 Louisiana, to close FAT Louisiana between Oregon and Kentucky, on Saturday, August 29, 2009 from POLICE 11:00 a.m. to 10:00 p.m., for the purpose of conducting a block party, subject to the approval of the Police Department. MAD #246-09 Approving the request of Andrea Kolhoff, Devon-Aire Civic FAT Association, 9903 Flamingo, to close Sunset between Richland and Robert and POLICE Robert between Sunset and Flamingo, on Saturday, August 8, 2009 from 10:00 th SYNOPSIS OF THE MINUTES OF THE 1,634REGULAR MEETING 3 LIVONIA CITY COUNCIL – June 10, 2009 a.m. to 6:00 p.m., for the purpose of conducting a block party, with a rain date of Sunday, August 9, 2009, subject to the approval of the Police Department. #247-09 Approving the request of Nicole Bush, 14641 Susanna, to close MAD Susanna between Ross and Donald, on Saturday, July 11, 2009, from 1:00 p.m. FAT POLICE to 10:00 p.m., for the purpose of conducting a block party, with a rain date of Sunday, July 12, 2009, subject to the approval of the Police Department. #248-09 Approving the request of Fred E. Sackllah, Festival Chairperson, MAD The Basilica of St. Mary Antiochian Orthodox Church, to place three (3) 4’ x 4’ FAT signs on St. Mary’s property and at Bryant Park, no earlier than Wednesday, ORD ENF June 17, 2009 and removed no later than Monday, July 20, 2009, for their Second Annual Sahara Fest scheduled for Thursday, July 16, 2009 thru Sunday, July 19, 2009, at Bryant Park located at 18000 Merriman Road. #249-09 Approving the request of Fred E. Sackllah, Festival Chairperson, MAD FAT The Basilica of St. Mary Antiochian Orthodox Church, to waive Section 8.32.070 ORD ENF (Noise Control) of the Livonia Code of Ordinances, between the hours of 10:00 POLICE a.m. and 10:00 p.m., except on Sunday ending at 9:00 p.m., in connection with their Second Annual Sahara Fest scheduled for Thursday, July 16, 2009 through Sunday, July 19, 2009, at Bryant Park located at 18000 Merriman Road. MAD #250-09 Authorizing the purchase of 100% of the City’s requirement of rock FAT salt used for ice control from the Detroit Salt Company, 12841 Sanders Street, Detroit, MI 48217, utilizing consortium bid pricing of $41.77 per ton, for an estimated total amount of $229,735.00 for the period of August 1, 2009 through June 30, 2010; FURTHER, authorizing an expenditure in an amount not to exceed $229,735.00 from budgeted funds in Account No. 101-463-784-000 (Snow Removal Supplies); FURTHER, authorizing the purchase without competitive bidding in accordance with Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended. #251-09 Authorizing the release to Leo Soave Building, Inc., 20592 MAD FAT Chestnut Circle, Livonia, MI 48152, the proprietor of Livonia Manor Site ENG Condominiums, located in the SE ¼ of Section 3, of the Financial Assurances previously deposited re: Sidewalk Bond ($5,000.00 all cash) and Monuments and Markers ($670.00 all cash), as all improvements have been satisfactorily installed. A roll call vote was taken on the foregoing resolutions: AYES: Pastor, Laura, Meakin, Robinson, and Godfroid-Marecki. NAYS: None. #254-09 Resolution by Meakin and Pastor, unanimously adopted, MAD FAT discharging the Committee of the Whole from further consideration of the INSP proposed Water Service Contract between the City of Livonia and the City of WATER Detroit. (CR-155-09) #255-09 Resolution by Meakin and Pastor, unanimously adopted, approving MAD the Water Service Contract between the City of Livonia and the City of Detroit for FAT INSP a term of thirty (30) years with the option of renewing for ten (10) years. WATER Pastor gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 040 OF TITLE 13, CHAPTER 08 (WATER SERVICE RATES AND REVENUES) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Pastor invoked the EMERGENCY CLAUSE and gave SECOND READING to the foregoing Ordinance and a roll call vote was taken: AYES: Pastor, Laura, Meakin, and Robinson. NAYS: Godfroid-Marecki. Pastor gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 050 OF TITLE 13, CHAPTER 28 (INDUSTRIAL WASTE SURCHARGE) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Pastor invoked the EMERGENCY CLAUSE and gave SECOND READING to the foregoing Ordinance and a roll call vote was taken: AYES: Pastor, Laura, Meakin, and Robinson. NAYS: Godfroid-Marecki. Pastor gave FIRST READING to the following Ordinance: AN ORDINANCE ADDING SECTION 17.09 TO ARTICLE XVII OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS “THE CITY OF LIVONIA ZONING ORDINANCE”. Meakin gave FIRST READING to the following Ordinance: AN ORDINANCE ADDING SECTION 250 TO TITLE 3, CHAPTER 04 (FINANCIAL PROCEDURES) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Meakin invoked the EMERGENCY CLAUSE and gave SECOND READING to the foregoing Ordinance and a roll call vote was taken: AYES: Pastor, Meakin, Robinson, and Godfroid-Marecki. NAYS: Laura. #256-09 Resolution by Meakin and Laura, unanimously adopted, approving MAD FAT a Special Assessment on referenced properties whose owners have not paid ASSESSOR charges connected with the 2008 Sidewalk Program, Contract 08-G, Single Lot Assessments; FURTHER, authorizing three (3) installment payments at 6% interest where assessments exceed $400.00, and the property owner has requested such installments; FURTHER, requesting the City Treasurer to give notice of the amounts determined to persons that are chargeable. (CR 127-09 and CR 182-08) th SYNOPSIS OF THE MINUTES OF THE 1,634REGULAR MEETING 6 LIVONIA CITY COUNCIL – June 10, 2009 #257-09 Resolution by Pastor and Robinson, unanimously adopted, MAD FAT approving the Findings and Order of the Hearing Officer regarding the demolition INSP of the property located at 33680 Orangelawn, in accordance with the provision PLAN set forth in section 15.52.150 of the Livonia Code of Ordinances as amended; ENG POLICE FURTHER, the Director of Inspection is authorized to do all things necessary to accomplish the demolition on or after July 18, 2009, in accordance with provisions of City Ordinance and Law, the cost of which is to be paid by the owner(s) of the property, in accordance with section 15.52.180 of the Livonia Code of Ordinances. MAD #258-09 Resolution by Laura and Pastor unanimously adopted, referring to FAT the Committee of the Whole for its report and recommendation with respect to prohibit utilizing City fuel in connection with personal use of City vehicles. #259-09 Resolution by Robinson and Pastor, unanimously adopted, MAD discharging the Committee of the Whole from further consideration of Council FAT Resolution 164-09 relating to the issue of placing City logos on City owned vehicles. MAD #260-09 Resolution by Robinson and Laura, unanimously adopted, referring FAT to the Law Department for preparation of a policy or ordinance that requires City logos to be placed on all City owned vehicles with the exception of the Mayor, th 16 District Court Judges, and police vehicles utilized for undercover or surveillance purposes. AUDIENCE COMMUNICATION: None. Laura commended Godfroid-Marecki on the way she operated tonight’s difficult meeting. He also commended Pastor for his hard work on tonight’s meeting and how much he appreciated his efforts. He said it showed the value of his experiences and his leadership. He also said that Pastor is truly an asset to the Council and to the City. Robinson agreed with Laura’s comments and said go Wings! Godfroid-Marecki congratulated Kevin and Beth Priddy and their family on the rd birth of their 3 child, James. He had severe surgery and is doing well. Pastor thanked everyone for their comments. He appreciates the vote of confidence. He looks forward to working together on other issues.
