HomeMy WebLinkAboutSYNOPSIS - 2009-07-20 th SYNOPSIS OF THE MINUTES OF THE 1,637REGULAR MEETING LIVONIA CITY COUNCIL – JULY 20, 2009 Meeting was called to order at 8:04 p.m. Present: Tom Robinson, James McCann, Joe Laura, John Pastor, Brian Meakin and Laura Toy. Absent: Terry Godfroid-Marecki MAD #298-09 Resolution by Laura and Pastor, unanimously adopted, approving FAT the minutes of the 1,636th Regular Meeting of the Council held July 8, 2009, as submitted. President Toy announced that the Youth Commission is partnering with the Goodfellows to assist low income Livonia families with school supplies. Donated th school supplies can be dropped off on the 5 floor at City Hall, Community Resources Department. School supplies in demand are backpacks, scissors, pencils, pencil sharpeners, rulers, and individual erasers. They will be accepting donations up until the end of August. Checks can be made payable to the City of Livonia Youth Commission. Call 734-466-2540 with any questions. President Toy announced that Bentley High School Concert Choir Homecoming Celebration will be held on Saturday, November 29, 2009. Meakin congratulated Dan West, President of the Livonia Chamber, his Staff, and the Community for an outstanding golf outing today. They sold out 124 golfers at Whispering Willows. This event takes care of the administration cost for the chamber. President Toy announced there would be an “X” item discussed at the end of tonight’s meeting regarding a proposed salary and fringe benefit adjustment for the classification of Fire Chief for the period December 1, 2008 through November 30, 2012. AUDIENCE COMMUNICATION: Tim Gerigk, 30200 Seven Mile, was present to request that the Noise Ordinance be waived for a DJ to perform at his backyard wedding reception on Saturday, August 1, 2009, from 6:30 p.m. until 11:30 p.m. #299-09 Resolution by Laura and McCann, unanimously adopted, approving MAD FAT the request of Tim Gerigk, 30200 Seven Mile, to waive the City’s Noise Ord Enf Ordinance for a DJ to perform on Saturday, August 1, 2009, from 6:30 p.m. until Police 11:30 p.m., at 30200 Seven Mile Road, in connection with a backyard wedding reception. th SYNOPSIS OF THE MINUTES OF THE 1,637REGULAR MEETING 2 LIVONIA CITY COUNCIL – July 20, 2009 Mayor Kirksey announced the passing of Albert M. Margolin, owner of Livonia Hardware. His family Dan and Larry will continue the business. th Mayor Kirksey announced that his 56 wedding anniversary was last Saturday. He stated that his daughter Amy’s birthday falls on their wedding anniversary. The following items were received and filed: A communication from the Office of the City Clerk, dated July 1, 2009, re: tax rate for the Clarenceville School District for the year 2009. A communication from the Office of the City Clerk, dated July 2, 2009, re: tax rate for Livonia Public Schools for the 2009-10 school year. A communication received in the City Council Office on July 15, 2009, titled “Electronic Sign Zoning Information” and “Digital Display Sign Codes.” (Petition 2009-04-06-02) A communication from Council Vice President Terry A. Godfroid-Marecki, dated July 17, 2009, requesting Agenda #13, Petition 2009-04-06-02, be rescheduled to the next Regular Meeting. The following resolutions were offered by Meakin and Pastor: MAD #300-09 Approving the request of Denise Justice, 32449 Washington, to FAT Police close Washington, between Hubbard and Indiana, on Saturday, August 1 2009, from 12:00 p.m. until 10:00 p.m., for the purpose of conducting a block party, with a rain date of Saturday, August 22, 2009, subject to the approval of the Police Department. #301-09 Approving the request of Dawn Nowicki, 30905 Orangelawn, to MAD close Orangelawn between Denne and Sunset, on Saturday, August 29 2009, FAT Police from 3:00 p.m. until 10:00 p.m., for the purpose of conducting a block party, subject to the approval of the Police Department. #302-09 Approving the request of Andy Magar, 17515 Doris, to close Sunset MAD FAT between Bobrich and Jeanine on Saturday, September 12, 2009, from 2:00 p.m. Police until 10:00 p.m., for the purpose of conducting a block party, with a rain date of Sunday, September 13, 2009, subject to the approval of the Police Department. #303-09 Approving the request of Patty Schaldenbrand to waive the MAD sidewalk requirement in front of her newly-constructed home located at 11810 FAT Eng Alois; FURTHER, reserving the right to require sidewalks at this location in the event that additional sidewalks are installed in this area at some future date. #304-09 Approving a change order to Contract 09-A in the amount of MAD FAT $698,115.57 payable to Hayball Transport, Inc., 12550 Farmington Road, Eng th SYNOPSIS OF THE MINUTES OF THE 1,637REGULAR MEETING 3 LIVONIA CITY COUNCIL – July 20, 2009 Livonia, MI 48150, for reconstruction of Victor Parkway from Seven Mile Road North to Pembroke Ave., and the reconstruction of Hees Ave. from Nevada Ave. East to Nebraska Ave., in connection with the 2009 Road Program Project previously authorized in Council Resolution 147-09; FURTHER, approving a change order to the existing contract with Orchard, Hiltz & McCliment, Inc., in the amount of $34,590.78 payable to Orchard, Hiltz & McCliment, Inc., 34000 Plymouth Road, Livonia, MI 48150, for additional construction engineering for the Hees Avenue segment, in connection with the 2008-2010 Road Repair Program previously authorized in Council Resolution 506-07; FURTHER, appropriating and authorizing an expenditure of a sum not to exceed $732,706.35 from unexpended fund balance of the Road, Sidewalk and Tree Fund (204) for this purpose. #305-09 Referring to the Parks and Recreation Commission for their report MAD and recommendation regarding the possible installation of a bicycle or recreation FAT trail along Hubbard Road between the Recreation Center and Rotary Park. Meakin gave a SECOND READING to the following Ordinance: AN ORDINANCE ADDING CHAPTER 40 (PROHIBITION ON USE OF GROUNDWATER) TO TITLE 13 OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. A roll call vote was taken on the foregoing Ordinance: AYES: Robinson, McCann, Laura, Pastor, Meakin and Toy. NAYS: None. McCann gave a SECOND READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 19.06 OF ARTICLE XIX OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS “THE CITY OF LIVONIA ZONING ORDINANCE.” (Petition 2009-03-06-01) A roll call vote was taken on the foregoing Ordinance: AYES: Robinson, McCann, Laura, Pastor, Meakin and Toy. NAYS: None. Pastor gave a SECOND READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 23.06 OF ARTICLE XXIII OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED th SYNOPSIS OF THE MINUTES OF THE 1,637REGULAR MEETING 4 LIVONIA CITY COUNCIL – July 20, 2009 AS “THE CITY OF LIVONIA ZONING ORDINANCE” (Petition 2009- 03-06-01) A roll call vote was taken on the foregoing Ordinance: AYES: Robinson, McCann, Laura, Pastor, Meakin and Toy. NAYS: None. #306-09 Resolution by McCann and Laura, unanimously adopted, approving MAD FAT the request of Mariah A. Colella, 6620 Academy, Brighton, MI 48116, for a Ord Enf Massage Therapist Permit in accordance with Chapter 5.49 of the Livonia Code Police of Ordinances, as amended, conditioned upon the applicant obtaining National Certification within six (6) months from the date of this approval. #307-09 Resolution by Meakin and Robinson, unanimously adopted, MAD approving Petition 2009-04-02-07, submitted by BJKL d/b/a Valvoline Instant Oil FAT Change, requesting waiver use approval for limited U-Haul truck rental in Planning Insp conjunction with an existing oil change facility on property located at 32850 Eng Plymouth Road, on the north side of Plymouth Road between Farmington Road Ord Enf and Mayfield Avenue, in the SW ¼ of Section 27, which property is zoned C-2, and subject to conditions. MAD #308-09 Resolution by Meakin and Robinson approving Petition 2009-04- FAT 02-07, submitted by BJKL d/b/a Valvoline Instant Oil Change, requesting waiver Planning Insp use approval to allow vehicles to be parked at a minimum distance of ten (10) Eng feet from the Plymouth Road and Mayfield Ave. rights-of-way lines, on property Ord Enf located at 32850 Plymouth Road, on the north side of Plymouth Road between Farmington Road and Mayfield Avenue, in the SW ¼ of Section 27, which property is zoned C-2. A roll call vote was taken on the foregoing resolution: AYES: Robinson, McCann, Laura, Pastor, Meakin and Toy. NAYS: None. MAD #309-09 Resolution by Meakin and Laura approving Petition 2009-04-02-07, FAT Planning submitted by BJKL d/b/a Valvoline Instant Oil Change, requesting waiver use Insp approval to enable the subject use to operate on a parcel that is 0.39 acre in Eng Ord Enf area, on property located at 32850 Plymouth Road, on the north side of Plymouth Road between Farmington Road and Mayfield Avenue, in the SW ¼ of Section 27, which property is zoned C-2. At the direction of the Chair, Petition No. 2009-04-06-02, submitted by the City Planning Commission, has been moved to the next Regular Meeting. th SYNOPSIS OF THE MINUTES OF THE 1,637REGULAR MEETING 5 LIVONIA CITY COUNCIL – July 20, 2009 #310-09 Resolution by Pastor and Meakin, unanimously adopted, approving MAD the request of Linda Saenz, to waive the City’s Noise Ordinance to allow a DJ to FAT Ord Enf perform on Saturday, August 1, 2009, from 2:00 p.m. until 10:00 p.m., at 30285 Police Seven Mile, in connection with an outdoor graduation party. #311-09 Resolution by Laura and Pastor, unanimously adopted, approving MAD the request of Mr. and Mrs. Joseph Swingle, to waive the City’s Noise Ordinance FAT for a live band to perform on Saturday, August 8, 2009, from 7:00 p.m. until 11:00 Ord Enf rd Police p.m., at 12332 Camden, in connection with their 3 annual gathering of friends. #312-09 Resolution by Pastor and Robinson, unanimously adopted, MAD suspending the rules for procedure as outlined in Council Resolution No. 574-82 FAT in order to permit consideration of items that do not appear on the agenda. #313-09 Resolution by Meakin and Robinson scheduling a Closed MAD Committee of the Whole Meeting to discuss proposed salary and fringe benefit FAT adjustments for the classification of Fire Chief for the period December 1, 2008 through November 30, 2012.
