HomeMy WebLinkAboutSYNOPSIS - 2009-08-10 th SYNOPSIS OF THE MINUTES OF THE 1,638REGULAR MEETING LIVONIA CITY COUNCIL – AUGUST 10, 2009 Meeting was called to order at 8:01 p.m. Present: Jim McCann, Terry Godfroid-Marecki, John Pastor, Joe Laura, Brian Meakin, Tom Robinson, and Laura Toy. Absent: None. MAD #314-09 Resolution by Pastor and Robinson approving the minutes of the FAT 1,637th Regular Meeting of the Council held July 20, 2009, as submitted. A roll call vote was taken on the foregoing resolution: AYES: McCann, Pastor, Laura, Meakin, Robinson, and Toy. NAYS: None. PRESENT: Godfroid-Marecki. th Godfroid-Marecki wished Joe Laura a happy birthday. His birthday is August 15. She also wished her grandson, Aleksander, a happy birthday. He will be turning one (1) on August 15, 2009. Meakin thanked Evelyn Goudreau, Community Resources – Cable TV, on the work that she did on their first televised Council Meeting with AT&T. He also stated that now his wife would be able to watch him on television. AUDIENCE COMMUNICATION: None. The following items were received and filed: A communication from the Department of Finance, dated June 27, 2009, re: forwarding various financial statements of the City for the month ending June 30, 2009. A communication from the Division of Police, dated July 23, 2009, re: report on recent larceny from auto and motor vehicle thefts. A communication from the Livonia Housing Commission dated July 8, 2009, re: the audit report for fiscal year ending December 31, 2008, excluding Silver Village, Newburgh Village, the CDBG Program, and single family City-owned properties. A communication from the Board of Trustees, Livonia Employees Retirement System, dated June 30, 2009, re: Livonia Employees Retirement System Annual Actuarial Valuation Report of Defined Benefit (DB) plan as of November 30, 2008. A communication from the Board of Trustees, Livonia Employees Retirement System, dated June 30, 2009, re: 401(a) Defined Contribution Plan Annual Report for 2008. A communication from the Director of Human Resources, received in the Office of the City Clerk, on July 27, 2009, re: the comparison handout titled “Deferred Compensation Survey 2009.” (CR 537-08)(CR 331-08) The following resolutions were offered by Pastor and Laura: #315-09 Approving the request of Donna Nowicki, 33003 Middleboro, to MAD FAT close Middleboro, between Westmore and Mayfield, on Saturday, August 15, Police 2009, from 2:00 p.m. until 10:00 p.m., for the purpose of conducting a block party, subject to the approval of the Police Department. MAD #316-09 Approving the request of Ashley Beck, 651 Irvin, Plymouth, MI FAT Ord enf 48170, for a Massage Apprentice Permit in accordance with Chapter 5.49 of the Police Livonia Code of Ordinances, as amended. #317-09 Referring the issue of Public Safety Employee furlough days to the MAD FAT Public Safety, Education and Recreation Committee for its report and Police recommendation. #318-09 Approving the purchase of updated forensic software and computer MAD FAT equipment for the detective bureau AVID video enhancement system from Police Dynamic Technologies, d/b/a Ocean Systems, 4016 Blackburn Lane, Burtonsville, MD 20866, in the total amount of $18,703.00; FURTHER, authorizing an expenditure in an amount not to exceed $18,703.00 from Account No. 265-334-987-000 (Adjudicated Forfeiture Fund); FURTHER, authorizing the purchase without competitive bidding, in accordance with Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended. MAD #319-09 Approving the request to adjust the admission income limits for FAT Newburgh Village, Silver Village and City-owned homes to reflect Detroit Housing metropolitan area median income figures. #320-09 Approving the change of the assumed annual rate of investment MAD return, for the Employees Retirement System Annual Actuarial Valuation Report FAT Civ Service of Defined Benefit (DB) plan, from eight and one-quarter percent (8.25%) to eight percent (8%) and the assumed wage increase assumption rate from four and three-quarter percent (4.75%) to four percent (4%) effective December 1, 2009. #321-09 Approving an actuarial transfer of funds, proportionately from the MAD FAT General and Police Valuation Divisions to the Fire Valuation Division, in order to Civ Service th SYNOPSIS OF THE MINUTES OF THE 1,638REGULAR MEETING 3 LIVONIA CITY COUNCIL – August 10, 2009 eliminate the need for a City contribution to the Fire Division effective December 1, 2009; FURTHER, approving the transfer from the reserve for employer contributions the sum of $527,578.00 from the General Employees Division, and $546,866.00 from the Police Division (total amount of Inter-Division Actuarial Report transfer $1,074,444.00) to be credited to the Fire Division effective December 1, 2009. #322-09 Approving the change of the assumed annual rate of investment MAD return for the Retiree Health and Disability Benefits Plan and Trust (VEBA) from FAT Civ Service eight and one-quarter percent (8.25%) to eight percent (8%) and the assumed wage increase assumption rate from four and three-quarter percent (4.75%) to four percent (4%) effective December 1, 2009. NAYS: None. #323-09 Resolution by McCann and Meakin, unanimously adopted, referring MAD FAT the subject of conducting an employee survey regarding the level of satisfaction Civ Service with current deferred compensation providers, and whether there should be additional providers available, to the administration for its report and recommendation. #324-09 Resolution by Godfroid-Marecki and Laura, unanimously adopted, MAD FAT referring the issue of Council to close or terminate 457 Plans to the Department Civ Service of Law for its report and recommendation. MAD #325-09 Resolution by Laura and Meakin, unanimously adopted, referring FAT the subject of adopting the proposed policy regarding prohibiting the utilization of City fuel in connection with personal use of City vehicles to the Committee of the Whole for its report and recommendation. #326-09 Resolution by McCann and Godfroid-Marecki, unanimously MAD FAT adopted, determining to take no further action with regard to the subject of Police forfeiture funds and their use. (CR 176-06) McCann gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTIONS 040, 070 AND 090 OF TITLE 2, CHAPTER 36 (COMMISSION ON AGING) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Meakin gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTIONS 020, 030, 040, AND 120 OF TITLE 2, CHAPTER 44 (COMMISSION ON CHILDREN AND th SYNOPSIS OF THE MINUTES OF THE 1,638REGULAR MEETING 4 LIVONIA CITY COUNCIL – August 10, 2009 YOUTH) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Godfroid-Marecki gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTIONS 050 AND 080 OF TITLE 2, CHAPTER 56 (HISTORIC PRESERVATION COMMISSION) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. MAD #327-09 Resolution by Meakin and Pastor, unanimously adopted, approving FAT the recommended action with respect to the compensation of City Board and Commission members. #328-09 Resolution by Robinson and Godfroid-Marecki, amending Council MAD FAT Resolution No. 557-06, to modify a condition of waiver use approval, in Planning connection with Petition 2006-08-02-21, on behalf of Dr. Chahal, A-Quality Care Ord Enforce Veterinary Hospital, amending condition eight (8) to permit boarding of household pets with a maximum of seven (7) dogs and eight (8) cats. A roll call vote was taken on the foregoing resolution: AYES: McCann, Godfroid-Marecki, Pastor, Laura, Meakin, Robinson, and Toy. NAYS: None. #329-09 Resolution by Robinson and Godfroid-Marecki, amending Council MAD FAT Resolution No. 557-06, to modify a condition of waiver use approval, in Planning connection with Petition 2006-08-02-21, on behalf of Dr. Chahal, A-Quality Care Ord Enforce Veterinary Hospital, in order to remove and replace condition eight (8), to waive the requirement for an overnight attendant set forth in Section 11.03(b)(2) of Zoning Ordinance No. 543, as amended. th SYNOPSIS OF THE MINUTES OF THE 1,638REGULAR MEETING 6 LIVONIA CITY COUNCIL – August 10, 2009 A roll call vote was taken on the foregoing resolution: AYES: Godfroid-Marecki, Pastor, Laura, Meakin, and Robinson. NAYS: McCann and Toy. #330-09 Resolution by Pastor and Meakin, authorizing the City’s statutory MAD FAT Right of First Refusal and payment to the County for the statutory minimum bid Housing relating to the tax foreclosed properties located at 19010 Westmore, in the Inspection Planning amount of $12,980.66, 36682 Pinetree, in the amount of $7,734.49, and 33680 Orangelawn, in the amount of $6,018.77 upon payment to the City of those amounts from Community Development Block Grant (CDBG) funds. A roll call vote was taken on the foregoing resolution: AYES: McCann, Godfroid-Marecki, Pastor, Meakin, Robinson, and Toy. NAYS: Laura. #331-09 Resolution by Pastor and Meakin, authorizing the Livonia Housing MAD FAT Commission to acquire the Federal Housing Administration – HUD foreclosed Housing property located at 11180 Haller, for the purchase price of $1.00, plus applicable Inspection Planning closing costs not to exceed $5,000.00, from the Community Development Block Grant (CDBG) funds. A roll call vote was taken on the foregoing resolution: AYES: McCann, Godfroid-Marecki, Pastor, Meakin, Robinson, and Toy. NAYS: Laura. MAD #332-09 Resolution by Pastor and Robinson, determining that from August FAT 2009 to October 2010 the Housing Director shall notify all residents, residing on Housing Inspection the same block or adjacent to, of bank foreclosed property that such property is Planning being acquired by the City. A roll call vote was taken on the foregoing resolution: AYES: McCann, Pastor, Laura, Meakin, Robinson, and Toy. NAYS: Godfroid-Marecki. MAD #333-09 Resolution by Pastor and Laura, approving Petition 2009-04-06-02 FAT to prepare an amendment to Section 18.50A and 18.50H of Article XVIII of Inspection Planning Ordinance No. 543 to allow for a five (5) second text change duration on variable electronic message signs. (CR 209-09) A roll call vote was taken on the foregoing resolution: AYES: McCann, Pastor, Laura, Meakin, Robinson, and Toy. NAYS: Godfroid-Marecki. #334-09 Resolution by Robinson and Pastor, unanimously adopted, MAD accepting a cash donation in the amount of $1,000.00 from Target Community FAT Police th SYNOPSIS OF THE MINUTES OF THE 1,638REGULAR MEETING 7 LIVONIA CITY COUNCIL – August 10, 2009 Relations, for use by the Police Crime Prevention, in connection with this year’s National Night Out event. MAD #335-09 Resolution by Pastor and Laura, unanimously adopted, accepting FAT various gifts and cash donations, in the amount of $52,886.00 from various Library contributors for use by the Livonia Public Library for purposes designated by the donors. MAD #336-09 Resolution by Meakin and Pastor, unanimously adopted, concurring FAT Police in the recommendation of the Civil Service Commission approving the Livonia Civ Service Lieutenants and Sergeants Association Contract Agreement for the period December 1, 2006 through November 30, 2012. (CR 293-09) #337-09 Resolution by Meakin and Pastor, unanimously adopted, referring MAD FAT the proposed salary and fringe benefit adjustments for the Police Command Staff Police for the period December 1, 2006 through November 30, 2012, to the Civ Service Administration for its report and recommendation; FURTHER, that this matter should remain in the Closed Committee of the Whole pending receipt of the requested report. (CR 297-09) MAD #338-09 Resolution by Robinson and McCann, unanimously adopted, FAT referring the proposed amendment to Zoning Ordinance No. 543, as amended, to Planning the Planning Commission for the holding of a Public Hearing in accordance with provisions of law and City Ordinance, to further clarify and strengthen the language to Section 3.08 of Article III, District Regulations. #339-09 Resolution by Godfroid-Marecki and Laura, unanimously adopted, MAD FAT referring the subject of an update on various Economic Development matters, Planning since the resignation of the Economic Development Director, to the Economic Development, Community Outreach and Strategic Planning Committee for its report and recommendation; FURTHER, referring this matter to the Administration for its report and recommendation.
