HomeMy WebLinkAboutSYNOPSIS - 2009-10-07 nd SYNOPSIS OF THE MINUTES OF THE 1,642 REGULAR MEETING LIVONIA CITY COUNCIL – OCTOBER 7, 2009 Meeting was called to order at 8:00 p.m. Present: Brian Meakin, Tom Robinson, James McCann, Terry Godfroid-Marecki, John Pastor, Joe Laura, and Laura Toy. Absent: None. MAD #397-09 Resolution by Pastor and Robinson approving the minutes of the FAT st 1,641 Regular Meeting of the Council held September 23, 2009. A roll call vote was taken on the foregoing resolution: AYES: Meakin, Robinson, Godfroid-Marecki, Pastor, Laura and Toy NAYS: None. PRESENT: McCann. th John Pastor announced his 4 annual coat, hat, gloves and food drive on Friday, October 30, 2009 from 5:30 p.m. until 8:00 p.m. at the Knights of Columbus on Farmington Road. President Toy announced the Michigan Public Service Commission will hold a meeting and forum at the Civic Park Senior Center on Monday, October 12, 2009 from 12:30 p.m. until 2:30 p.m. to assist customers with questions on utility costs and payment issues. President Toy announced two communications students from the University of Michigan in the audience tonight taking photos – Kyle Glovak and Lauren Valia. President Toy requested a moment of silence for former first lady Bette Moelke. She passed away on September 27, 2009. President Toy announced new data on items #7 and #10. President Toy announced an “X” item to be discussed at the end of tonight’s meeting re: a request to schedule a Closed Committee of the Whole Meeting to discuss pending litigation and attorney/client privileged communications with respect to Jennifer Wandzel v City of Livonia. AUDIENCE COMMUNICATION: George Boller, 36270 Hammer Lane, spoke about the number of car break-ins in his neighborhood. He also mentioned the hazardous waste date printed in the Livonia Fall Newsletter was incorrect. He also spoke about the traffic and construction going on at Newburg between Six and Seven Mile Roads. nd SYNOPSIS OF THE MINUTES OF THE 1,642 REGULAR MEETING 2 LIVONIA CITY COUNCIL – OCTOBER 7, 2009 Roy Stewart, 15438 Golfview Drive, spoke about the pole barn being put up at Idyll Wyld Golf Course. Christopher Martin, 12275 Inkster Road, spoke about his purchase of vacant foreclosed homes. The following items were received and filed: A communication from the Department of Finance dated September 16, 2009, re: forwarding the Quarterly Investment Report for the City of Livonia as of August 31, 2009. A communication from the Department of Law dated September 30, 2009, re: revised Lease Agreement for the City-owned building located at 33233 Five Mile Road utilized by the Livonia Chamber of Commerce. (CR 542-03) A communication from the Housing Director, dated September 29, 2009, re: forwarding a revised notification letter to be mailed to residents within 300’ of proposed home acquisitions. The following resolutions were offered by Laura and Pastor: #398-09 Approving the request of Renee M. Vargo to waive Section MAD FAT 8.32.070 (Noise Control) of the Livonia Code of Ordinances, as amended, Ord Enf between the hours of 7:00 p.m. and 9:30 p.m. to allow a live band to perform in Police connection with a party scheduled for Saturday, October 10, 2009 at 38141 Lancaster. #399-09 Concurring in and approving the recommendation of the Civil MAD FAT Service Commission regarding the changes in the City’s compensation plan Civ Serv regarding overtime compensation for non-represented employees. MAD #400-09 Approving the purchase of 300 buckets of Pulsar Briquettes from FAT B & B Pools and Spas, 29440 Six Mile Road, Livonia, MI 48152, for a price of Parks/Rec $105.00 per bucket for a total price of $31,500.00 for use at the Community Recreation Center, Botsford, Clements Circle and Shelden Pools, with the understanding that such price per bucket will remain in place through November 30, 2010; FURTHER, authorizing an expenditure in the amount of $31,500.00 from budgeted funds; FURTHER, authorizing the said purchase without competitive bidding. #401-09 Accepting the lowest unit price bid meeting all specifications of MAD FAT Patterson Tree Service, 5400 Washington Road, Carsonville, MI 48419, for completing all work required in connection with the City’s 2009 Tree and Stump Removal Program for an estimated total cost not to exceed $87,629.00; FURTHER, authorizing an expenditure in the amount of $87,629.00 from nd SYNOPSIS OF THE MINUTES OF THE 1,642 REGULAR MEETING 3 LIVONIA CITY COUNCIL – OCTOBER 7, 2009 budgeted funds; FURTHER, authorizing the Director of Public Works to approve minor adjustments in the work as necessary. #402-09 Accepting the lowest unit price bid of Greg Davis Landscape MAD FAT Services, Inc., 471 Renaud Road, Grosse Pointe Woods, MI 48236, for completing all work required in connection with the City’s 2009 Street Tree Planting Program for the estimated total cost of $56,677.00, based upon the estimate of units involved; FURTHER, authorizing expenditures not to exceed $150.000.00 from budgeted funds; FURTHER, accepting the second lowest bidder, R.C. Turtle Refinishing Co., 2475 S. Hickory Ridge Trail, Milford, MI 48380, for an amount not to exceed $150,000.00, in the event the low bidder is unable to supply certain species of trees; FURTHER, authorizing the Director of Public Works to approve minor adjustments in the work as necessary. MAD #403-09 Approving a one (1) year extension of the existing contract with FAT Brendel’s Septic Tank Service, LLC, 9481 Highland Road, White Lake, MI 48386, Eng for providing portable toilet service for the City’s 2010 season at the unit prices bid in their proposal, dated February 5, 2007, for the estimated total cost of $29,975.00; FURTHER, authorizing an expenditure not to exceed $29,975.00 from budgeted funds; FURTHER, authorizing without competitive bidding. #404-09 Approving the lease agreement between the City of Livonia and the MAD Livonia Chamber of Commerce for property located at 33233 Five Mile Road, FAT Econ Dev Livonia, Michigan 48154, to continue to be used as a Livonia Welcome Center Planning and Chamber of Commerce Offices for the period beginning November 1, 2009 through October 31, 2012. A roll call vote was taken on the foregoing resolutions: AYES: Meakin, Robinson, McCann, Godfroid-Marecki, Pastor, Laura and Toy. NAYS: None. Godfroid-Marecki gave SECOND READING to the following Ordinance: AN ORDINANCE ADDING CHAPTER 51 (VACANT AND ABANDONED STRUCTURES) TO TITLE 15 OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. (CR 379-09) A roll call vote was taken on the foregoing Ordinance: AYES: Meakin, Robinson, McCann, Godfroid-Marecki, Pastor, Laura and Toy. NAYS: None. Godfroid-Marecki gave SECOND READING to the following Ordinance: nd SYNOPSIS OF THE MINUTES OF THE 1,642 REGULAR MEETING 4 LIVONIA CITY COUNCIL – OCTOBER 7, 2009 AN ORDINANCE AMENDING SECTION 040 OF TITLE 15, CHAPTER 52 (DANGEROUS BUILDINGS AND STRUCTURES) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. (CR 379-09) A roll call vote was taken on the foregoing Ordinance: AYES: Meakin, Robinson, McCann, Godfroid-Marecki, Pastor, Laura and Toy. NAYS: None. #405-09 Resolution by Pastor and Godfroid-Marecki, authorizing the Livonia MAD Housing Commission to acquire four (4) Fannie Mae foreclosed properties FAT Insp located at 15813 Deering, 18981 Melvin, 18231 Middlebelt and 28614 Seven Housing Mile, for the total purchase price of $158,990.00, plus applicable closing costs in an amount not to exceed $7,000.00 each; FURTHER, authorizing a sum not to exceed $186,990.00 from funds available through the Neighborhood Stabilization Program (NSP) for this purpose. A roll call vote was taken on the foregoing resolution: AYES: Meakin, McCann, Godfroid-Marecki, Pastor and Toy. NAYS: Robinson and Laura. #406-09 Resolution by McCann and Laura, unanimously adopted, MAD FAT suspending the rules for procedure as outlined in CR 574-82 in order to permit consideration of items that do not appear on the agenda. #407-09 Resolution by McCann and Pastor directing that a Closed MAD Committee of the Whole meeting be held to discuss litigation matters and FAT attorney/client privileged communications in connection with pending litigation, Jennifer Wandzel v City of Livonia. A roll call vote was taken on the foregoing resolution: AYES: Meakin, Robinson, McCann, Godfroid-Marecki, Pastor, Laura and Toy. NAYS: None.
