HomeMy WebLinkAboutSYNOPSIS - 2010-08-09 nd SYNOPSIS OF THE MINUTES OF THE 1,662REGULAR MEETING LIVONIA CITY COUNCIL – AUGUST 9, 2010 Meeting was called to order at 8:00 p.m. Present: Laura Toy, Maureen Miller Brosnan, Conrad Schwartz, John Pastor, Brian Meakin, Joe Laura, and James McCann. Absent: None. st MAD #270-10 Resolution by Pastor and Laura, approving the minutes of the 1,661 FAT Regular Meeting of the Council held July 19, 2010. A roll call vote was taken on the foregoing resolution with the following result: AYES: Toy, Schwartz, Pastor, Meakin, Laura, and McCann. NAYS: None. PRESENT: Brosnan. th Toy congratulated Council Vice-President Joe Laura and wished him a Happy 60 Birthday which will be on Sunday, August 15, 2010. Meakin congratulated the Fairway Farms Swim Team for winning First Place in the swim meet at the recreation center; it’s been 12 years since they’ve won the First Place title. President McCann waved to his grandson Kaiden watching at home. President McCann announced there is new data for Item #9. Brosnan on behalf of the Council congratulated Don Knapp, City Attorney, and his wife, Kathy, on the birth of their twin daughters Mary Claire and Emily Anne who were born on July 29, 2010. AUDIENCE COMMUNICATION: Joe Neussendorfer, 11316 Merriman, said on Saturday, August 14, 2010, buglers across America will play Taps beginning at 7:00 p.m. to honor America’s greatest th generation who fought in World War II and to mark the 65 Anniversary of the end of World War II. Suzanne Yarbrough, 33428 Richland, a resident of Livonia for 13 years, said she wonders why Livonia is number four (4) on the list of worst roads in the State of Michigan. She named several streets within the City limits, many of which are County Roads that are in desperate need of repair. She stated that she and some of her family members have had suspension damage to their vehicles that, as implied by her, is a result of the poor condition of the roads. She said it’s disturbing to see new courthouses and sidewalks when nothing is being done to improve the roads within the City. nd SYNOPSIS OF THE MINUTES OF THE 1,662 REGULAR MEETING 2 LIVONIA CITY COUNCIL – August 9, 2010 President McCann noted that many of the roads she mentioned are either County or State Roads; Todd Zilincik, City Engineer, said issues with any of these roads should reported by calling the road repair hotline at 1-88-ROAD-CREW. The following items were received and filed: Communications from the Department of Law, dated July 14, 2010 and August 6, 2010, re: Christopher Maiberger and Ross Towing of Livonia v City of Livonia, et al, U.S. District Court, Eastern District of Michigan Case No. 2:09-cv-15000. Letter from Veolia Environmental Services, dated August 4, 2010, re: explanation of being disqualified from bid process. (CR 932-98) Communications from the Public Service Division, dated July 9, 2010 and July 20, 2010, re: summary of proposals received for solid waste/recycling services in the City. (CR 932-98) Booklet from Veolia Environmental Services, dated July 20, 2010, re: Corporate Overview and Capabilities. (CR 932-98) The following resolutions were offered by Pastor and Schwartz: #271-10 Approving the request of Stacie Pettit, 8937 Louisiana, to hold a block MAD party and close Louisiana between Oregon and Kentucky on Saturday, August 28, 2010 FAT Police from 12:00 p.m. to 10:00 p.m., with no rain date requested, subject to the approval of the Police Department. #272-10 Approving the request of Angela Chapman, 9135 Henry Ruff, to hold a MAD block party and close Olsen, between Henry Ruff and Hillcrest on Saturday, August 21, FAT 2010 from 3:00 p.m. to 10:00 p.m., with no rain date requested, subject to the approval Police of the Police Department. #273-10 Approving a request, submitted by Heather and Joe Swingle, waiving MAD FAT Section 8.32.070 (Noise Control) of the Livonia Code of Ordinances in connection with th Police their 4 annual gathering of family and friends on Saturday, August 21, 2010, to allow a OrdEnf live band to perform from 6:00 p.m. until 11:00 p.m at 12332 Camden. MAD #274-10 Approving a request, submitted by James Farr, waiving Section 8.32.070 FAT (Noise Control) of the Livonia Code of Ordinances in connection with his wedding on Police Saturday, August 14, 2010, to allow a DJ to perform from 3:00 p.m. until 11:00 p.m. at OrdEnf 33925 Wadsworth. #275-10 Approving a request, submitted by Marcus Stewart, waiving Section MAD 8.32.070 (Noise Control) of the Livonia Code of Ordinances in connection with his FAT wedding on Saturday, August 21, 2010, to allow a live band to perform from 6:00 p.m. Police until 10:00 p.m. at 17750 Fairfield. OrdEnf nd SYNOPSIS OF THE MINUTES OF THE 1,662 REGULAR MEETING 3 LIVONIA CITY COUNCIL – August 9, 2010 MAD #276-10 Approving the request, submitted by AZD Associates, on behalf of Livonia FAT Dermatology in connection with Petition 2010-06-08-01 for a proposal to construct a Planning medical office complex consisting of two separate buildings on property located on the Insp west side of Farmington Road, between Lyndon Avenue and Five Mile Road (14815 Eng and 14801 Farmington Road), in the Northeast ¼ of Section 21, subject to conditions. #277-10 Approving the request, submitted by ANK Enterprises, Inc., in connection MAD with Petition 2010-06-08-02 for a proposal to remodel the exterior of the commercial FAT Planning center (Mid-Five Shopping Center) on property located on the southwest corner of Five Insp Mile Road and Middlebelt (29441-29583 Five Mile Road), in the Northeast ¼ of Section Eng 23, subject to conditions. #278-10 Approving the request, submitted by the City of Livonia Engineering MAD FAT Division, authorizing an increase in the scope of work and additional appropriations for Eng the 2010 Sidewalk Replacement Program to include repairs necessitated from work performed by Consumers Energy, with reimbursement to the City of $100,000.00. (Contract 10-G). (CR 113-10) A roll call vote was taken on the foregoing resolutions with the following result: AYES: Toy, Brosnan, Schwartz, Pastor, Meakin, Laura, and McCann. NAYS: None. UNFINISHED BUSINESS #279-10 Resolution by Meakin and Pastor, unanimously adopted, authorizing the MAD City of Livonia Administration to enter into negotiations regarding a proposed solid FAT waste/recycling contract with Waste Management of Michigan, Inc., 48797 Alpha Drive, Insp Suite 150, Wixom, MI 48393, for solid waste collection, disposal, recycling and related OrdEnf services for the City of Livonia for a five-year term, commencing December 1, 2010 through November 30, 2015, and to thereafter submit a proposed contract in this regard to Council for its consideration. (CR 426-07, CR 378-04 and CR 452-00) (CR 932-98) MAD #280-10 Resolution by Toy and Meakin, unanimously adopted, approving a FAT request, submitted by Karen Ritchey, waiving Section 8.32.070 (Noise Control) of the Police Livonia Code of Ordinances in connection with a birthday party on Saturday, August 14, OrdEnf 2010, to allow a live band to perform from 7:00 p.m. until 10:00 p.m. at 20111 Parker. #281-10 Resolution by Toy and Meakin, authorizing the Livonia Housing MAD Commission to acquire three (3) foreclosed properties located at 16425 Rougeway, FAT 14200 Beatrice and 28115 Clements Circle S, for the total of $66,700.01, which Housing includes closing costs, through the Neighborhood Stabilization Program. A roll call vote was taken on the foregoing resolution with the following result: AYES: Toy, Brosnan, Schwartz, Pastor, Meakin, and McCann. NAYS: Laura. nd SYNOPSIS OF THE MINUTES OF THE 1,662 REGULAR MEETING 4 LIVONIA CITY COUNCIL – August 9, 2010 Knapp left the podium at 8:31 p.m. to avoid the appearance of a conflict of interest regarding the next item. Cathryn White, Chief Assistant City Attorney, was present on behalf of the Law Department for the next item. #282-10 Resolution by Pastor and Brosnan, unanimously adopted, approving an MAD application for Industrial Facilities Exemption Certificate, submitted by Robert Sakuta, FAT President, Delta Research Corp., for the purchase of various machinery and equipment Planning Assessr for their facility located at 32791 Capitol, Livonia, MI 48150. (Industrial Development Overlay District No. 80) for twelve (12) years. Knapp returned to the podium at 8:32 p.m. NEW BUSINESS #283-10 Resolution by Toy and Brosnan, unanimously adopted, approving the MAD FAT request of Marcella Vance, 15901 Auburndale, to hold a block party and close Police Auburndale between Five Mile and Myrna on Sunday, August 22, 2010 from 2:00 p.m. to 10:00 p.m., with no rain date requested, subject to the approval of the Police Department. #284-10 Resolution by Brosnan and Toy, unanimously adopted, accepting a cash MAD FAT donation in the amount of $1,500.00 from Target Community Relations, for use by the Police Police Crime Prevention, in connection with this year’s National Night Out event. MAD #285-10 Resolution by Toy and Brosnan, unanimously adopted, accepting a Grant FAT of Easement from Sandra Gnida, for an easement in connection with the development Eng of a public sidewalk constructed at 31270 Pickford Avenue in the Northwest ¼ of Assessr Section 11. #286-10 Resolution by Meakin and Brosnan, unanimously adopted, accepting a MAD Grant of Easement from George W. and Ann Bradley, for an easement in connection FAT with the development of a new storm sewer constructed at 36457 Ann Arbor Trail in the Eng Southwest ¼ of Section 32. Assessr #287-10 Resolution by Brosnan and Toy, unanimously adopted, accepting a Grant MAD of Easement from Thomas Wozniak, for an easement in connection with the FAT development of a public sidewalk constructed at 31222 Pickford Avenue in the Eng Assessr Northwest ¼ of Section 11. MAD #288-10 Resolution by Toy and Meakin, unanimously adopted, accepting a Grant FAT of Easement from Leo Soave, for an easement in connection with the development of a Eng new sanitary sewer constructed at Wooded Creek Subdivision in the Northwest ¼ of Assessr Section 13. nd SYNOPSIS OF THE MINUTES OF THE 1,662 REGULAR MEETING 5 LIVONIA CITY COUNCIL – August 9, 2010 AUDIENCE COMMUNICATION: Joe Neussendorfer, 11316 Merriman, commended Terry Marecki, City Clerk, for the good job she and her staff did on the State Primary Election held on August 3, 2010. nd By Pastor and Schwartz, unanimously adopted, adjourning this 1,662 Regular Meeting of the Council of the City of Livonia at 8:38 p.m. on August 9, 2010.
