HomeMy WebLinkAboutSYNOPSIS - 2012-01-11 th SYNOPSIS OF THE MINUTES OF THE 1,696 REGULAR MEETING LIVONIA CITY COUNCIL – JANUARY 11, 2012 Meeting was called to order at 8:00 p.m. Present: Thomas Robinson, Maureen Miller Brosnan, Brandon Kritzman, James McCann, Joe Laura, John Pastor, and Laura Toy. Absent: None. th #01-12 Resolution by Pastor and Brosnan, approving the minutes of the 1,695 MAD Regular Meeting of the Council held December 14, 2011. FAT A roll call vote was taken on the foregoing resolution: AYES: Brosnan, McCann, Laura, Pastor and Toy. NAYS: None. PRESENT: Robinson and Kritzman. Brosnan presented a tribute to Kayte Prush, a kindergartener at Cleveland Elementary, for the 100 letters she wrote to American soldiers serving oversees on behalf of the City of Livonia in honor of her grandfather. President Toy congratulated Chief of Police Curtis Caid and Deputy Chief of Police Ben McDermott on attaining their new positions. She also congratulated Brian Meakin on his appointment to the Civil Service Commission and thanked Ronald Campau for serving 32 years on the Civil Service Commission. AUDIENCE COMMUNICATION: Marguerite Gwizdala, 9870 Seltzer, expressed her concerns about Smart Meters. Donna Williams, 7451 Lafayette, Dearborn Heights, expressed her concerns regarding Smart Meters being installed on homes here in Livonia. Chaplain Dr. Charlene Helen Berry, 49615 Lyndon, Plymouth, expressed her concerns regarding Smart Meters. Pauline Holeton, 2392 Barclay, Shelby Township, distributed DVDs for Council’s viewing. She expressed her concerns regarding Smart Meters. Bernard Moshel, 32674 Myrna, said metal posts have been erected that encompass the athletic field at Rotary Park. John Holeton, 2392 Barclay, Shelby Township, said that four other cities/townships have adopted resolutions prohibiting Smart Meters since he last came before Livonia Council. President Toy announced there is new data on Item #13. th SYNOPSIS OF THE MINUTES OF THE 1,696 REGULAR MEETING 2 LIVONIA CITY COUNCIL – January 11, 2012 The following items were received and filed: Communication from the Office of the Mayor, dated January 5, 2012, re: forwarding the Annual Report for the Fiscal Year 2010-2011 which reflects activities of the Livonia City Departments, Commissions and Boards. Letter from the City Clerk, dated December 16, 2011, as well as the December 6, 2011 letter from the Livonia Board of Education, re: collection of Livonia Public School District taxes for the year 2012. Letter from the City Clerk dated December 16, 2011, as well as the December 13, 2011 letter from the Wayne County Regional Educational Service Agency (RESA), re: collection of the Wayne County Regional Educational Service Agency (RESA) taxes for the year 2012. A report and recommendation of the Committee of the Whole, dated January 11, 2012, listing the Chairpersons and members of the various Council Committees for years 2012-2013. (CR 498-05) The following resolutions were offered by McCann and Pastor: #02-12 Approving the request of Rino Soave, Infinity Construction Services, LLC, MAD FAT to waive the sidewalk requirement in front of two newly-constructed homes located at Eng 18239 Gill Road and 18249 Gill Road; FURTHER, reserving the right to require sidewalks at these locations in the event that additional sidewalks are installed in this area at some future date. MAD #03-12 Approving the request submitted by Xue Yan Wang, 23240 Brentwood FAT Drive, Brownstown, MI, 48183, for a Massage Apprentice Permit in accordance with Police Chapter 5.49 of the Livonia Code of Ordinances, as amended. OrdEnf MAD #04-12 Accepting the police communications equipment to be obtained under the FAT 2009 Urban Area Security Initiative (UASI) Grant in the total amount of $53,809.50, to Police be used to purchase equipment to enhance the City’s Intelligence Bureau Communications, with no matching funds required. MAD #05-12 Approving an Animal Sheltering Agreement between the City of Livonia FAT and the Michigan Humane Society, 30300 Telegraph Road, Suite 220, Bingham Farms, Michigan 48025, for the period December 1, 2011 to November 30, 2013, with boarding fees changed from a daily rate to $3,250.00 per month. MAD #06-12 Authorizing the Mayor and City Clerk, to execute an amended Frequency FAT Police Reconfiguration Agreement in connection with Livonia Public Safety Radio Rebanding. (CRS 407-10 and 302-11) th SYNOPSIS OF THE MINUTES OF THE 1,696 REGULAR MEETING 3 LIVONIA CITY COUNCIL – January 11, 2012 A roll call vote was taken on the foregoing resolutions: AYES: Robinson, Brosnan, Kritzman, McCann, Laura, Pastor and Toy. NAYS: None. #07-12 Resolution by Laura and McCann, unanimously adopted, designating MAD Brandon Kritzman to serve as Delegate of the City of Livonia to the Southeast Michigan FAT Council of Governments (SEMCOG) and designating Thomas Robinson as the alternate on a continuing basis or until further order of the Council by Council Resolution. (CR 498-05) MAD #08-12 Resolution by Brosnan and Laura, unanimously adopted, designating FAT Thomas Robinson to serve as Council representative on the Board of Directors of the Livonia Anniversary Committee (SPREE) on a continuing basis or until further order of the Council by Council Resolution. (CR 498-05) #09-12 Resolution by Laura and McCann, unanimously adopted, designating the MAD Director of Finance, Michael T. Slater, as the official and voting representative of the FAT City of Livonia MMRMA (Michigan Municipal Risk Management Authority) and designating John Pastor as the alternate on a continuing basis or until further order of the Council by Council Resolution. (CR 498-05) #10-12 Resolution by Brosnan and Robinson, unanimously adopted, designating MAD FAT Joe Laura to serve as the official and voting representative of the Board of Trustees of the Livonia Employees Retirement System on a continuing basis or until further order of the Council by Council Resolution. (CR 498-05) #11-12 Resolution by Brosnan and Laura, unanimously adopted, designating MAD FAT James McCann to serve on the Hearts of Livonia Board on a continuing basis or until further order of the Council by Council Resolution. (CR 498-05) Brosnan gave SECOND READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 23 OF THE ZONING MAP OF THE CITY OF LIVONIA AND AMENDING ARTICLE III OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS "THE CITY OF LIVONIA ZONING ORDINANCE" BY ADDING SECTION 3.____ THERETO. (Petition 2011-07-01-03) A roll call vote was taken on the foregoing Ordinance: AYES: Robinson, Brosnan, Kritzman, McCann, Laura, Pastor and Toy. NAYS: None. Pastor gave SECOND READING to the following Ordinance: th SYNOPSIS OF THE MINUTES OF THE 1,696 REGULAR MEETING 4 LIVONIA CITY COUNCIL – January 11, 2012 AN ORDINANCE AMENDING CHAPTER 32 (PROPERTY MAINTENANCE CODE) OF TITLE 15 OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. A roll call vote was taken on the foregoing Ordinance: AYES: Robinson, Brosnan, Kritzman, McCann, Laura, Pastor and Toy. NAYS: None. Pastor gave SECOND READING to the following Ordinance: AN ORDINANCE AMENDING SUBSECTION (a) OF SECTION 26.04 OF ARTICLE XXVI (PERMITTED USES) OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS "THE CITY OF LIVONIA ZONING ORDINANCE." (Petition 2011-10-06-01) A roll call vote was taken on the foregoing Ordinance: AYES: Robinson, Brosnan, Kritzman, McCann, Laura, Pastor and Toy. NAYS: None. #12-12 Resolution by McCann and Pastor, unanimously adopted, approving the MAD proposed Amendment to the Livonia Code of Ordinances, as amended, adding Section FAT 190 to Title 15, Chapter 36 (Grading and Soil Erosion Control), Flood Prevention, to Planning OrdEnf incorporate new regulations required by the Federal Emergency Management Agency Eng (FEMA). McCann gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 190 OF TITLE 15, CHAPTER 36 (GRADING AND SOIL EROSION CONTROL) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED, ADRESSING FLOODPLAIN MANAGEMENT. McCann invoked the EMERGENCY CLAUSE and gave SECOND READING to the foregoing Ordinance, and a roll call vote was taken: A roll call vote was taken on the foregoing Ordinance: AYES: Robinson, Brosnan, Kritzman, McCann, Laura, Pastor and Toy. NAYS: None. MAD #13-12 Resolution by Robinson and Laura, unanimously adopted, referring the FAT subject matter of flood prevention and the related Ordinance to the Infrastructure and Planning Community Transit Committee for its report and recommendation. OrdEnf Eng th SYNOPSIS OF THE MINUTES OF THE 1,696 REGULAR MEETING 5 LIVONIA CITY COUNCIL – January 11, 2012 MAD #14-12 Resolution by Brosnan and Robinson, unanimously adopted, approving a FAT request, submitted by Daihui Yang, 23240 Brentwood Drive, Brownstown, MI 48183, for Police a Massage Apprentice Permit in accordance with Chapter 5.49 of the Livonia Code of OrdEnf Ordinances, as amended. MAD #15-12 Resolution by Brosnan and Laura, unanimously adopted, approving a FAT request, submitted by Noel E. Carter, 25953 Dartmouth, Inkster, MI 48141, for a Police Massage Apprentice Permit in accordance with Chapter 5.49 of the Livonia Code of OrdEnf Ordinances, as amended. AUDIENCE COMMUNICATION: Marguerite Gwizdala, 9870 Seltzer, offered some information for anyone interested in obtaining their own device for measuring radiation levels in their homes. John Holeton, 2392 Barclay, Shelby Township, expressed his displeasure in the reluctance from some of the Councilmembers to allow people their allotted time at the end of the Council Meeting to speak again. He was also displeased to hear a Councilmember say Council was not going to do anything with regard to Smart Meters. Laura stated he did not appreciate the personal attacks against the Council and asked the Chair to poll the Council. MAD #16-12 Resolution by McCann and Laura, determining to restrict Ms. Pauline FAT Holeton from addressing the Council a second time on the same subject matter. Police A roll call vote was taken on the foregoing resolution: AYES: Robinson, Kritzman, McCann, Laura, and Pastor. NAYS: Brosnan and Toy. MAD #17-12 Resolution by Robinson and Brosnan, unanimously adopted, referring the FAT subject matter of Smart Meters to the Infrastructure and Community Transit Committee for its report and recommendation. th By Pastor and Kritzman, unanimously adopted, adjourning this 1,696 Regular Meeting of the Council of the City of Livonia at 9:22 p.m. on January 11, 2012.
