HomeMy WebLinkAboutSYNOPSIS - 2012-04-04 nd SYNOPSIS OF THE MINUTES OF THE 1,702 REGULAR MEETING LIVONIA CITY COUNCIL – APRIL 4, 2012 Meeting was called to order at 8:00 p.m. Present: Maureen Miller Brosnan, Brandon Kritzman, James McCann, Joe Laura, John Pastor, Thomas Robinson, and Laura Toy. Absent: None. #141-12 Resolution by Pastor and Brosnan, unanimously adopted, approving the MAD st FAT minutes of the 1,701 Regular Meeting of the Council held March 21, 2012. A roll call vote was taken on the foregoing resolution: AYES: Brosnan, Kritzman, Laura, Pastor, Robinson, and Toy. NAYS: None. PRESENT: McCann. Brosnan commended the Save Our Youth Task Force for their report presented at their Summit that was held in the City Auditorium last week. Robinson announced the Seedlings Braille Books for Children will be having an Open House on Thursday, May 17, 2012 from 5:00 – 7:00 p.m. at their office in the Metro-Plex Office Complex located at 14151 Farmington Road, Livonia, MI 48154; he encouraged the public to attend. President Toy asked for a moment of silence for Dawn Powell, a former classmate from Bentley High School, who passed away and will be dearly missed. President Toy announced there is new data on Items #16 and #26. AUDIENCE COMMUNICATION: John Grzebik, 11301 Hubbell, announced there will be another community forum on the potential bond for the schools to be held on April 16, 2012 from 3:30 – 5:00 p.m. at Stevenson High School. He also announced the Youth Making A Difference Program will be held April 17, 2012 at 6:30 p.m. at Franklin High School. Edward Collins, 9659 Wayne Road, expressed his concerns about the accuracy of assessments. He inquired about the credentials of the members of the Board of Review. Mayor Kirksey said he will have the Board of Review take Mr. Collins concerns under advisement. Christopher Martin, 12275 Inkster Road, commented on the Board of Review meetings. nd SYNOPSIS OF THE MINUTES OF THE 1,702 REGULAR MEETING 2 LIVONIA CITY COUNCIL – April 4, 2012 The following items were received and filed: Communication from the Director of Finance, dated March 16, 2012, re: various financial statements for the month ending December 31, 2011, reflecting a quick financial overview of the various funds. Communication from the Director of Finance, dated March 23, 2012, re: a summary of investments for the City of Livonia as of February 29, 2012. Communication from Joanna Hardesty, Planning & Marketing for Wade Shows, Inc., dated March 28, 2012, re: request to change dates of carnival to Wednesday, May 23, 2012 through Monday, May 28, 2012, so as not to conflict with St. Mary’s Church festival. Communication from Council member Thomas Robinson, dated March 13, 2012, re: outlining specific goals for “Advance Budget Reviews” (“ABR’s”) regarding miscellaneous budget issues to be addressed by the Finance, Budget and Technology Committee. (CR 171-05). Communication from the Department of Law, dated March 30, 2012, re: additional thoughts and explanation for the reason to amend Section 10.03.030 of the Livonia Code of Ordinances. At the direction of the Chair, Item #7 was removed from the Consent portion of the agenda. The following resolutions were offered by Brosnan and Laura: MAD #142-12 Approving the request of Kathleen A. Fitzgerald to hold a block party and FAT close Cranston, between Elmira and Orangelawn, on Monday, May 28, 2012, from 2:00 Police p.m. to 8:00 p.m., subject to the approval of the Police Department. #143-12 Approving the request of Fred E. Sackllah, Festival Chairperson, The MAD FAT Basilica of St. Mary Antiochian Orthodox Church, to waive Section 8.32.070 (Noise Police Control) of the Livonia Code of Ordinances, between the hours of 10:00 a.m. and 10:00 OrdEnf p.m., except on Sunday ending at 9:00 p.m., in connection with their Fourth Annual Sahara Fest scheduled for Thursday, May 31, 2012 through Sunday, June 3, 2012, at Bryant Park located at 18000 Merriman Road; FURTHER, granting and approving three (3) 4’ x 4’ signs on St. Mary’s property and at Bryant Park, no earlier than Thursday, May 17, 2012 and removed no later than Thursday, June 7, 2012 #144-12 Approving a request submitted by Sharon Bass, 20914 W. Glen Haven MAD FAT Circle, Northville, MI 48167, for a massage therapist permit in accordance with Chapter Police 5.49 of the Livonia Code of Ordinances, as amended. OrdEnf nd SYNOPSIS OF THE MINUTES OF THE 1,702 REGULAR MEETING 3 LIVONIA CITY COUNCIL – April 4, 2012 #145-12 Amending and revising Council Resolution No. 263-10, in connection with MAD FAT Petition 2010-04-02-09 and to be in compliance with the Michigan Liquor Control Insp Commission rules with respect to separation requirements between SDD-licensed Planning establishments, an addition to the shopping center (CR 362-11) moved the storefront of Police J&M Beverages approximately 40 feet to the west changing the address to 34746 Fire Plymouth Road, subject to conditions. (CRS 263-10 and 362-11) (Pet. 2010-04-02-09) MAD #146-12 Approving the reappointment of Elizabeth H. McCue, 11311 Berwick, FAT Livonia, Michigan 48150 to the Plymouth Road Development Authority, for a four-year CivSvc term expiring on May 16, 2016. Planning #147-12 Proclaiming Friday, April 27, 2012 as Arbor Day in the City of Livonia; MAD FAT FURTHER, inviting citizens to join in the commemoration planned by the Tree City Committee at Kennedy Elementary School at 1:30 p.m. on Friday, April 27, 2012 to support efforts to protect trees and woodlands. #148-12 Extending the contract with American Fence & Supply, 21200 Schoenherr, MAD FAT Warren, MI 48089, for the removal and replacement of up to three (3) additional Pk&Rec backstops at Wilson Acres, Mies and Country Homes Parks at 2011 conditions and prices; FURTHER, the Council does hereby appropriate and authorize an expenditure in the amount of $18,387.15 from budgeted funds to be reimbursed through the Wayne County Grant. (CR 191-11) MAD #149-12 Approving participation in the Alliance of Rouge Communities (ARC) and FAT for payment to the Alliance of Rouge Communities, C/O ECT, 719 Griswold St., Suite Eng 820, Detroit, Michigan 48226, in the amount of $29,013.00 for the City’s annual ARC Assessment for 2012; FURTHER, authorizing such expenditure from budgeted funds. #150-12 Accepting the bid of Heights Machinery, 8434 M-72 E., Williamsburg, MI MAD 49690, for supplying the Public Service Division with two (2) tow-behind batwing wide- FAT area mowers for a total price of $23,988.00, the same having been in fact the lowest bid received and meets all specifications, and the amount of $23,988.00 is hereby authorized to be expended from budgeted funds. #151-12 Accepting the low unit prices bid meeting all specifications of Calo & Sons MAD Construction, Inc., P.O. Box 530563, Livonia, MI 48152; Ellsworth Industries, Inc., P. O. FAT Box 5366, Plymouth, MI 48170; and Freeport Supply Co., 20091 Pennsylvania, Brownstown, MI 48193; for aggregates (road gravel, slag and stone) for the 2012 calendar year from budgeted funds; FURTHER, accepting the second lowest bids of Calo & Sons Construction, Inc., P.O. Box 530563, Livonia, MI 48152; Ellsworth Industries, Inc., P. O. Box 5366, Plymouth, MI 48170; and Freeport Supply Co., 20091 Pennsylvania, Brownstown, MI 48193, and Osburn Industries, 5850 Pardee, Taylor, MI 48180, if the low bidders are unable to furnish the materials. nd SYNOPSIS OF THE MINUTES OF THE 1,702 REGULAR MEETING 4 LIVONIA CITY COUNCIL – April 4, 2012 #152-12 Accepting the lowest unit prices bid of Nagle Paving Company, 36780 MAD Amrhein, Livonia, MI 48150, to complete all work required with regard to the 2012 FAT Eng Asphalt Pavement Rehabilitation and Reconstruction Program, Contract 12-A, on various streets throughout the City for an amount not to exceed $1,573,385.33 from budgeted funds; FURTHER, authorizing the City Engineer to approve any minor adjustments in the work, as necessary. #153-12 Accepting the lowest unit price bid of Tiseo Brothers, 68660 Hillside, MAD Washington Township, MI 48095, to complete all work required on various streets FAT Eng throughout the City in connection with the 2012 Concrete Road Repair Program – Reconstruction Project (Contract 12-C) for an estimated cost of $1,501,614.70 from budgeted funds, based on Engineering Division’s estimate of units involved; FURTHER, authorizing the City Engineer to approve any minor adjustments in the work as necessary. #154-12 Approving a one-year extension of the existing contract with R. S. MAD Contracting, Inc., 9276 Marine City Highway, Casco Township, MI 48064, to complete FAT Eng all work required for the 2012 Lane Line Marking Program (Contract 12-H) in an amount not to exceed $95,000.00 from budgeted funds, and subject to final payment based on actual units completed; FURTHER, authorizing the City Engineer to approve minor adjustments in the work, as necessary. (CR 109-11) #155-12 Authorizing the Mayor and City Clerk, for and on behalf of the City of MAD FAT Livonia, to execute the agreement between the City of Livonia and the Michigan Eng Department of Transportation (MDOT) for the milling and resurfacing work on portions of eastbound Highway M-102 (Eight Mile Road) from Highway M-5 (Grand River Avenue) to the east City limits (Inkster Road) including ramp and crossover work and sidewalk ramp upgrades, together with necessary related work; FURTHER, the total project cost is estimated at $519,150.00 with the City of Livonia participation (2% of the total project cost) estimated at $11,800.00; FURTHER, the Council does hereby authorize an expenditure in the estimated amount of $11,800.00 from funds already budgeted for this purpose. #156-12 Approving and granting waiver use approval in connection with Petition MAD FAT 2012-02-02-03 submitted by Wade Shows, Inc., to conduct a carnival sponsored by the Police Livonia Rotary Club consisting of amusement rides, games and food concessions to be OrdEnf held from May 23 through May 28, 2012, inclusive, in the parking lots of Sears, located at 29500 Seven Mile Road, subject to conditions. (Petition 2012-02-02-03) MAD #157-12 Referring the subject of communication at the meetings to the Committee FAT of the Whole for its report and recommendation. MAD #158-12 Referring the subject of a Plymouth Road Development Authority (PRDA) FAT Art Show on Plymouth Road to the Economic Development, Community Outreach and Planning Strategic Planning Committee for its report and recommendation. nd SYNOPSIS OF THE MINUTES OF THE 1,702 REGULAR MEETING 5 LIVONIA CITY COUNCIL – April 4, 2012 A roll call vote was taken on the foregoing resolutions: AYES: Brosnan, Kritzman, McCann, Laura, Pastor, Robinson, and Toy. NAYS: None. #159-12 Resolution by Laura and Brosnan, unanimously adopted, authorizing the MAD FAT Mayor and City Clerk, for and on behalf of the City of Livonia, to execute the Pk&Rec Intergovernmental Agreement between the Charter County of Wayne and the City of Livonia for improvements at Wilson Acres Park, Kleinert Park, Country Homes Park and Mies Park, utilizing grant funds not to exceed $76,000.00. MAD #160-12 Resolution by Robinson and Kritzman, unanimously adopted, determining FAT to take no further action regarding the subject of miscellaneous budget issues. (CR 171- 05) #161-12 Resolution by Robinson and Laura, referring the subject of advance MAD FAT budget reviews to the Finance, Budget and Technology Committee for its report and recommendation.
