HomeMy WebLinkAboutSYNOPSIS - 2014-10-06 nd SYNOPSIS OF THE MINUTES OF THE 1,762 REGULAR MEETING LIVONIA CITY COUNCIL – OCTOBER 6, 2014 Meeting was called to order at 7:00 p.m. by President Brosnan. Present: Susan Nash, Brandon Kritzman, John Pastor, Brian Meakin, Laura Toy, Lynda Scheel, and Maureen Miller Brosnan. Absent: None. MAD st #288-14 Resolution by Pastor and Scheel, approving the minutes of the 1,761 FAT Regular Meeting of the Council held September 15, 2014. A roll call vote was taken on the foregoing Resolution: AYES: Nash, Kritzman, Pastor, Toy, Scheel, and Brosnan. NAYS: None. PRESENT: Meakin. President Brosnan announced there is new data on Items #6 and #9; also, Item #2 is being removed from the Consent portion of tonight’s Agenda and will be discussed immediately after. Pastor wished Councilmember Scheel a Happy Birthday. Meakin announced Livonia Community Foundation will be having a fundraiser, The Best Craft Beers in Michigan, on Wednesday, October 29, 2014, from 7:00 – 8:30 PM at One Under Bar & Grill, tickets are $35 per person and can be purchased at the Livonia Chamber of Commerce or his office, Meakin and Associates, 33300 Five Mile Road, Suite 102, Livonia. Additional information is available by calling (734) 425-7555. Toy congratulated the Mayor, MDOT, Council and all others involved with the I-96 Reconstruction Project for a job well done in a timely manner. President Brosnan wished a Happy Birthday to Mark Taormina, Director of Planning, his birthday was last week and also to Todd Zilincik, City Engineer, his birthday is today. President Brosnan congratulated the Town Hall Inductees, she gave a special thank you to Bill Joyner for putting that event together. President Brosnan welcomed Paul Sutherland to the Channel 8 staff. President Brosnan announced there will be three (3) Public Hearings held in the Auditorium of Livonia City Hall, 33000 Civic Center Drive, Livonia, MI for the following items: nd SYNOPSIS OF THE MINUTES OF THE 1,762 REGULAR MEETING 2 LIVONIA CITY COUNCIL – October 6, 2014 Wednesday, October 22, 2014, at 7:00 p.m. Daniel Laible, CFO & Executive Vice President, NYX Incorporated is requesting approval of an Industrial Facilities Tax Exemption Certificate for building improvements, machinery and equipment, as well as furniture and fixtures at their facility located at 38900 Plymouth Road, Livonia, MI 48150. (Industrial Development Overlay District #112) Monday, October 27, 2014, at 7:00 p.m. Petition 2014-08-01-06 submitted by Kucyk Soave and Fernandes, P.L.L.C., requesting to rezone property located on the south side of Plymouth Road between Newburgh Road and Eckles Road (38801 and 38901 Plymouth Road), in the Southwest ¼ of Section 30 from R-U-F (Rural Urban Farm) to R-1 (One Family Residential). Monday, October 27, 2014, at 7:00 p.m. Proposed Revised Special Assessment District for Levan Road Sanitary Sewer for the installation of a new 10-inch sanitary sewer main located on the east side of Levan Road (15160, 15200 and 15230 Levan Road), in the Northeast ¼ of Section 20. (CR 448-12, CR 107-13, CR 178-13, CR 342-13, CR 190-14, CR 236-14, and 285-14) Establishment of the Assessment Roll AUDIENCE COMMUNICATION: John Grzebik, 11301 Hubbell, gave an update of current events with Livonia Public Schools PTSA. He invited the public to the Board of Education Forum for school board candidates that will be held on Tuesday, October 7, 2014 at the Board of Education board room. Police Chief Curtis Caid informed the audience of a new synthetic drug called Cloud 9. He said Wayne County has declared it a health emergency. He said police have been very aggressive at stores and fortunately they haven’t seen any in Livonia at this time. They will continue with their efforts to keep this hazardous substance out of Livonia. Christopher Martin, 11037 Hubbard, commented on the numerous street lights out along Plymouth Road. Janice Centers, 18221 Farmington, member of Livonia Jaycees, invited Council and their guests to the “Lagers for Lunches” fundraising event to be held Friday, November 21, 2014 from 7:00 p.m. – 11:00 p.m. at One Under Banquet Hall. Tickets are $40 per person; proceeds to pay off lunch debts of schools within Livonia. Communication from the Department of Finance dated September 17, 2014, re: forwarding the Quarterly Investment Report for the City of Livonia as of August 31, 2014. Correspondence from the Department of Law, dated September 26, 2014, re: an administrative response to questions raised at the Legislative Affairs Committee Meeting of Monday, September 22, 2014. (CR 253-14) Communication from Steven Cohen, Cohen & Associates PC, dated August 26, 2014, regarding the Livonia Dog Ordinance. (CR 253-14) Correspondence from Planning Commission, dated October 2, 2014, re: sign package for the Michigan Schools and Government Credit Union. (Pet. 2014-07-02-10) Correspondence from Mike Blanek, Stucky Vitale Architects, dated September 29, 2014, re: updated plans for the Michigan Schools and Government Credit Union. (Pet. 2014-07-02-10) The following resolutions were offered by Toy and Scheel: MAD #289-14 Approving the request of Abigail Edwards and Deb Strautz, to close FAT Woodside Street between Roycroft and Sherwood on Sunday, October 19, 2014, from Poilce 11:00 a.m. to 5:00 p.m. for the purpose of conducting a block party, with a rain date of Sunday, October 26, 2014, subject to the approval of the Police Department. MAD #290-14 Extending the agreement between the City of Livonia and Wayne County FAT Office of Senior Citizen Services for the distribution of U.S.D.A. TEFAP commodities to ComRes low income residents through September 30, 2016. (CR 353-85) #291-14 Approving a three year extension of the existing contract with Brendel’s MAD FAT Septic Tank Service, LLC, 9481 Highland Road, White Lake, MI 48386, for providing portable toilet service through the 2017 season at the unit prices agreed upon in November 2011 with a price freeze for the next three years. (CRS 389-11, 348-10 and 165-07) MAD #292-14 Waiving the street lighting at Livonia Manor II Site Condominiums and to FAT keep the lighting consistent with Livonia Manor Site Condominiums directly to the east Insp of this subdivision. (CR 452-06) Eng Plan A roll call vote was taken on the foregoing Resolutions: AYES: Nash, Kritzman, Pastor, Meakin, Toy, Scheel, and Brosnan. NAYS: None. nd SYNOPSIS OF THE MINUTES OF THE 1,762 REGULAR MEETING 4 LIVONIA CITY COUNCIL – October 6, 2014 MAD #293-14 Resolution by Meakin and Toy, unanimously adopted, approving the FAT request of Tina Schiller, Valassis, to conduct a 5K Fun/Run/Walk Wellness Challenge Police and granting permission to barricade one half of Victor Parkway between Seven and Eight Mile and Pembroke off of Newburgh, on Saturday, November 1, 2014, between 7:00 a.m. and 10:30 a.m., subject to the approval of the Police Department. Toy gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 260 OF TITLE 6, CHAPTER 04 (DOGS) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. MAD #294-14 Resolution by Toy and Meakin, unanimously adopted, referring the subject FAT of the regulation of veterinary hospitals to the Legislative Affairs Committee for its report OrdEnf and recommendation. Toy gave SECOND READING to the following Ordinance: AN ORDINANCE AMENDING SECTIONS 040, 120, 130, 180, 230, 261, 270, AND 280, OF TITLE 6, CHAPTER 04 (DOGS) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. A roll call vote was taken on the foregoing Ordinance: AYES: Nash, Kritzman, Pastor, Meakin, Toy, Scheel, and Brosnan. NAYS: None. MAD #295-14 Resolution by Pastor and Meakin, unanimously adopted, approving FAT Petition 2014-07-06-01, to amend Section 11.03(p) of Article XI to require as a Insp condition of the granting of any waiver for a retail building or space of thirty thousand Eng (30,000) square feet or more intended to be a single unit, a statement that the building Plan as proposed will be attractive to other tenants in the event the initial tenant ceases its occupancy of the building, including a description of the features of the building which will make it attractive to prospective replacement tenants. (CR 174-14) MAD #296-14 Resolution by Toy and Pastor, unanimously adopted, approving the FAT establishment of improvement bonds to assure the installation of public improvements Insp at Livonia Manor II Site Condominiums, located at 31700 and 31750 Seven Mile Road. Eng (CR 452-06 and Petition 2006-07-08-13) Plan Assessr #297-14 Resolution by Toy and Kritzman, unanimously adopted, approving MAD Petition 2014-07-02-10, to construct and operate a credit union with drive-thru facilities FAT Insp (Michigan Schools and Government Credit Union), located on the southwest corner of Eng Farmington and Eight Mile Roads (20595 Farmington Road), subject to conditions. Plan nd SYNOPSIS OF THE MINUTES OF THE 1,762 REGULAR MEETING 5 LIVONIA CITY COUNCIL – October 6, 2014 MAD #298-14 Resolution by Toy and Meakin, waiving the drive-up width requirement in FAT connection with Petition 2014-07-02-10, to construct and operate a credit union with Insp drive-thru facilities (Michigan Schools and Government Credit Union), located on the Plan Eng southwest corner of Farmington and Eight Mile Roads (20595 Farmington Road). A roll call vote was taken on the foregoing resolution: AYES: Nash, Kritzman, Pastor, Meakin, Toy, Scheel, and Brosnan. NAYS: None. MAD #299-14 Resolution by Toy and Scheel, unanimously adopted, amending Council FAT Resolution No. 166-14 to add additional verbiage required by the State of Michigan Assessr Department of Treasury pertaining to personal property exemptions. (CR 166-14) Plan AUDIENCE COMMUNICATION: Christopher Martin, 12275 Inkster, expressed his views on adopting a leash law and prohibiting dogs at City events. nd By Toy and Meakin, unanimously adopted, adjourning this 1,762Regular Meeting of the Council of the City of Livonia at 7:34 p.m. on October 6, 2014.
