Washington, Personnel Analyst II Gretchen Guisbert, Secretary III Upon a motion by Ms. Mahoney, seconded by Mr. Campau and unanimously adopted, it was 06-116 RESOLVED, That the minutes of the 1225th Regular Meeting held Wednesday, June 14, 2006, be approved as submitted. Upon a motion by Ms. Mahoney, seconded by Mr. Campau and unanimously adopted, it was 06-117 RESOLVED, That the minutes of the 92nd Special Meeting held June 28, 2006, be approved as submitted. The Commission received and fled the Status of Temporary Employees Report for June 2006. The Commission received and fled the Non -Resident Report as of July 1, 2006. Ed Hoffman, Chief Roads Steward, AFSCME Union Local 192 requested that the Civil Service Commission approve a three (3) month extension for Temporary Clerks employed at the Library, instead of the usual six (6) month extension. He stated there is a Clerk I examination in process with the expectation of the Clerk I eligible list being complete by that time. Ms. Mahoney inquired if the Personnel Review Committee (PRC) will allow for the permanent filling of these jobs or if a request to extend would be repeated in three (3) months. Mr. Biga advised that PRC has given the approval to fill three (3) positions permanently; but not the others. Page 2 1226th Regular Meeting July 19, 2006 Mr. Hoffman responded that some temporary employees could place on the new Clerk I list and it was possible they could gain status as a Clerk 1. Kathleen Monroe, City Librarian, advised the positions that are being requested for extension have long been filled by temporary employees. There are several positions that the PRC has approved for filling with permanent employees from the Clerk I list, but this would be a question of going back and retroactively filling multiple positions. Mr. Biga stated these four (4) positions have been filled on a temporary basis for a long time. They will continue to be filled on a temporary basis because the PRC has not authorized them to be filled on a permanent basis. He stated there are three (3) other positions that the PRC has given authorization to be filled permanently; two are full-time and one is a part-time position in the Library. None of the PRC -authorized positions are the four (4) referenced. Mr. Campau inquired what the difference in pay and benefits was for a temporary versus permanent employee. Mr. Biga replied the pay was the same, but with regard to benefits, the temporary employees would get mandatory benefits such as workers' compensation, social security, unemployment compensation and holiday pay after they have worked 480 hours, but they would have no health care benefits, no retirement benefits, no vacation and no paid time off. Ken Grzembski, Chief Parks Steward, AFSCME Union Local 192, stated it sounds like the positions were needed and something should be done. If the Commission grants the extension, he hoped it was for the last time. This extension gives them six (6) months to decide to fill them or not. He added that it hurts the 192 union because temporary employees are displacing union employees in union positions. Ms. Mahoney inquired if these positions have been brought to PRC. Mr. Biga replied they had and the decision was made not to fill them on a permanent basis due to budgetary constraints. Mr. Biga advised that it was possible that some of the temporary employees could be hired permanently if they place high enough on the list. If the Civil Service Commission were to deny the extension, then these people would leave those positions and the Department would hire replacement temporary Clerks and after six months, those individuals would have to be let go or granted an extension. Mr. Grzembski commented that Mr. Biga was using the term `temporary" but it didn't seem like they were temporary at all and something should be done. Steven Schoonover, Roads Steward, AFSCME Union Local 192, inquired how long these temporary positions been extended. Mr. Tatigian clarified that some had been employed on a temporary basis for two (2) years. Mr. Schoonover replied that by shortening the extension or by denying the request to extend, it still shows there is a need. He stated that three (3) months should give the Civil Service Department enough time to test for and establish a Clerk I eligibility list. Mr. Grzembski added that by approving the extension, the Civil Service Commission was enabling them to undermine the 192 union. Mr. Hoffman stated if the Civil Service Commission keeps on extending the temporary employees, the job will get done but if there isn't a body there, hopefully PRC will realize that it had been extended two (2) years and the position is vital and should be filled permanently. Page 3 1226th Regular Meeting July 19, 20D6 Upon a motion by Mr. Campau, 06-118 RESOLVED, That having reviewed the letter of July 7, 2006, from Kathleen Monroe, City Librarian, requesting an additional six (6) month extension of Temporary Clerk I positions, the Civil Service Commission does hereby deny the request. The motion died for lack of support Mr. Campau responded that it wasn't fair to the temporary employees. Ms. Mahoney replied that it would put the temporary employees on the street and it doesn't mean that the PRC is going to have any more money to move those positions to permanent. Ms. Mahoney asked Ms. Monroe what happens in the Library if these four (4) positions are not extended. Ms. Monroe explained that these Clerks do basic tasks like answering the phones, or checking books out or processing books to be put back on the shelves. She added the Library is at a skeletal staff already. If the request is denied, it would be devastating with the low level of staff they already have; especially with the number of hours the public expects the library to be open. Mr. Biga stated the Department can choose not to continue these temporary employees, but the Department would hire four (4) other temporaries. They are authorized to f11 them at a temporary level only. New people coming on board would have to be trained and then after another six (6) months, if the Department opted not to continue those employees, they could terminate them and hire more. Mr. Grzembski commented it sounded like these are permanent positions that are going to be filled temporary permanently. Mr. Tatigian passed the gavel to Mr. Campau. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 06-118 RESOLVED, That having reviewed the letter of July 7, 2006, from Kathleen Monroe, City Librarian, requesting an additional six (6) month extension of Temporary Clerk I positions, the Civil Service Commission does hereby approve the request to extend the four (4) Temporary Clerk I employees for an additional six (6) months. AYE: Mahoney and Tatigian NAY: Campau The Commission took no action regarding the letter of July 7, 2006, from Linda McCann, Director of Community Resources, requesting an additional Clerk I position at Greenmead. Yvonne Lillibridge, President, AFSCME Union Local 192, inquired if Ms. McCann had authorization to get one permanent position. Mr. Biga replied he didn't recall a permanent authorization. The position was posted for permanent but there were no employees interested so Ms. McCann had to fill it with temporary employees. Page 4 1226th Regular Meeting July 19, 20D6 Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was 06-119 RESOLVED, That having reviewed the letter of July 7, 2006, from Linda McCann, Director of Community Resources, requesting an additional six (6) month extension of Temporary Clerk I positions, the Civil Service Commission does hereby approve the request to extend the Temporary Clerk I positions for an additional six (6) months. Ken Grzembski inquired if these positions would be posted again. Mr. Biga responded that they were posted once, but have not been reposted. Mr. Grzembski staled there may be Custodians with the qualifications. Mr. Tatigian clarified that tonight's action was only pertaining to an extension for six (6) months for Temporary Clerks and he wondered if a Custodian would give up a full-time job for part -lime. Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was 06-120 RESOLVED, That having reviewed the letter received July 13, 2006, from Jo Ann Polovich, Custodian, as approved for submission by Brian Wilson, Assistant Superintendent of Public Service, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby approve Ms. Polovich's request for an unpaid medical leave of absence to September 8, 2006, pursuant to Civil Service Commission RULE 25, LEAVES, Section 25.5 Leaves of Absence. Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was 06-121 RESOLVED, That having reviewed the letter of July 1, 2006, from Danielle M. Price, Police Dispatcher, as approved for submission by Robert Stevenson, Police Chief, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby approve Ms. Price's request for an unpaid medical leave of absence, based on her physician's statement and it is with the understanding that Ms. Price's probationary period will be extended the amount of time she has been on a leave of absence without pay. Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was 06-122 RESOLVED, That having reviewed the letter of June 22, 2006, from Susan Semposki, Account Clerk I, as approved for submission by Brian Wilson, Assistant Superintendent of Public Service, requesting an extension of an unpaid medical leave of absence, the Civil Service Commission does hereby approve Ms. Semposki's request for an unpaid medical leave of absence through July 23, 2006, pursuant to Civil Service Commission RULE 25, LEAVES, Section 25.5 Leaves of Absence. Ms. Mahoney referenced the request for an open -competitive examination for Secretary I and inquired if the new language on the announcement would be the same on all future announcements. Mr. Biga replied it would. Page 5 1226th Regular Meeting July 19, 2006 Ms. Lillibridge commented that the position being vacated by a retirement of one of the 192 members is currently at the Secretary II level and she questioned why it is being downgraded to a Secretary I if this is what the open -competitive exam is for. Ms. Lillibridge referenced the posting that is attached to the request and stated it is a description of work for the Secretary I in the Mayor's office and is not relevant to the City Clerk's office and the union objected to downgrading the position. In comparing the description of work in the Citywide posting and the exam, the dictation or Dictaphone transcription is 90 words per minute for Secretary II and is only 80 words per minute for Secretary 1. Derrick L. Washington, Personnel Analyst II, stated he had a Description of Work from Val Vandersloot to provide to Ms. Lillibridge and that earlier today when Ms. Lillibridge requested this information, without having discussed it with Ms. Vandersloot, he didn't wish to pass along Ms. Vanderslool's information, but with the Civil Service Commission's approval he would pass this Description of Work to Ms. Lillibridge. Ms. Mahoney explained that the Description of Work in Ms. Vandersloot's letter dated July 10, 2006, varied from the posting, but that was the appropriate Description of Work for the position. The last Secretary I announcement was for the Mayor's Office and it was attached as an example. Ms. Lillibridge inquired if it was the same Description of Work as the Citywide posting. Mr. Biga explained that in general when you are posting, there is a difference between a classification description and a position description. A position description is the specific assignment, a classification description is general. For example, typing correspondence may be part of a Secretary job; in the Clerk's office it might be typing Council Minutes; in the Mayors office it might be typing correspondence to City Council. The position description is much more exact. When you have a classification description, it is broad based. When you are dealing with a position description, it becomes much more specific. Mr. Biga explained the Civil Service Department is reviewing changes in functions of Secretaries. No longer do Secretaries take dictation in the traditional sense, using shorthand. Most people are taking dictation from a tape recorder and using a tape recorder playback system. This change requires the Civil Service Department staff to review how we are going to examine. He has spent much time talking to Mr. Washington as to how we are going to do this in the future. Shorthand is no longer a skill that is taught and most people in the City use tape recorders and generically call them Dictaphones. Mr. Campau inquired how long it would take to move from a Secretary I to a II. Mr. Biga replied it would depend on the person. In his opinion, the entire clerical classification group needed to be reviewed to see what the real differences are between the levels. Also it was his opinion there are too many levels. He wanted to find out what the difference is for 80 wpm shorthand experience or dictation and 90 wpm. Mr. Tatigian inquired if the Civil Service Commission could dictate to a Department whether they can hire a Secretary I or a Secretary 11? Mr. Biga said he didn't think so. Mr. Tatigian asked if the Secretary I had been approved by the PRC. Mr. Biga stated it has. Ms. Lillibridge spoke to Ms. Vandersloot and she agreed with Mr. Biga that she didn't want to negotiate classifications at this meeting. The indications she got from the City Clerk is, this is what PRC approved so this is what she is going to get. She referenced the 1999 open - competitive examination announcement for Secretary 11 from which the current employee was hired. The Description of Work includes all of what is listed and even has additional duties and that person is expected in the absence of the City Clerk and the Deputy City Clerk to take care Page 6 1226th Regular Meeting July 19, 2006 of that office. She agreed with Mr. Tatigian that shorthand is a lost skill. The difference between 10 wpm of dictation is the difference between the Secretary I and II and for the responsibility this person has, it was reprehensible to the union that it would be downgraded without sitting down and talking about it. Jackie Eroh, Secretary 1, stated that she worked in DPW and if there is any exam to be moved to a Secretary 11, she would take it and she stated she could pass it. The difference to her of anybody else that performs the quality of work required with the additional 10 words is significant. There is no reason it should not be offered if it's open and an employee is available and able to pass that level of skill. Mr. Tatigian replied that everything she said was probably true; but they could only approve or deny this request for Secretary 1. Mr. Campau didn't agree with Mr. Tatigian and made a motion to approve the qualifications for Secretary 11. Ms. Mahoney inquired if they left tonight and this ought to be a Secretary 11, Ms. Vandersloot could not proceed with the Secretary 11 until PRC approves a Secretary 11 position. If the Civil Service Commission believes it ought to be a Secretary 11, then if PRC disagrees, they might be better off denying this. What concerned Ms. Mahoney is if what is in a Secretary I job description is equal to or greater than what is in the existing Secretary 11 description of work, there is a problem with the PRC. Mr. Tatigian stated before they do anything further, they should consider NB item #10 from Ms. Vandersloot to f11 this position from the Legal Stenographer list at the Secretary I level. Mr. Tatigian stated if they tum this down, they are denying somebody work and denying the Department a person that they need and he thought that was counterproductive. Mark Eroh, Building Mechanic IV, replied that the vacancy created by the retirement was for Secretary 11 and that now the Department wants to f11 it as a Secretary 1. They also want the option to use the Legal Stenographer list that is higher than a Secretary 11 position to f11 that. Mr. Tatigian stated that was from a list of people that are unemployed. Mr. Eroh countered that there was an employee on the list. Mr. Tatigian stated that when he was a former Department Head for the City he didn't fill positions at the top level; he hired them from the lowest position and people got promoted. He believes the Department Head has the right to decide to hire at the lower level. Jackie Eroh stated she was number two (2) on the Legal Stenographer I list and she went through a lot of work to get on that list. Secretary I would be lower than the Legal Stenographer 1. Ms. Lillibridge's understanding of this would be that if they used a name from the Legal Stenographer list, they would be hired as a Secretary I so it wouldn't be a promotion for Ms. Eroh. Ms. Lillibridge added that the Secretary 11 position was an open -competitive in 1999 and a 192 member got that job so she got a promotion. She added that with all the duties associated with this job there should be no reason for it to be downgraded and she believes it was budgeted this year for Secretary 11. Mr. Washington pointed out that the position was posted Citywide as a Secretary I and there were no takers. Arica Flores, Construction Worker 1, explained that downgrading this hurts the union because it hurts the people. Employees are given more responsibilities and more duties and they are being paid at a lower rate. That hurls people because employees may work next to a person knowing they are doing the job for less money. People expect opportunities to move up through the ranks, but after you work for two years, and you realize you're never Page ] 1226th Regular Meeting July 19, 2006 going to go anywhere, then you're constantly getting turnover. When employing temporary employees, you don't get quality work. Ms. Mahoney asked Mr. Biga if the Secretary I description of work is in fact a Secretary II description of work and asked if that issue should have been negotiated. Mr. Biga replied no. Mr. Washington stated he spoke with Ms. Vandersloot that afternoon and even though transcription is listed, the level of transcription is not at the level it was when the position first was opened. Employees now use tape recorders. The current Secretary 11 employee was required to attend meetings and take transcription and now the person doesn't need to attend the meeting. It is either Ms. Tesner or Ms. Vandersloot that attends the meeting and they tape it. The tape is given to the Secretary to transcribe from. Mr. Tatigian clarified that Ms. Vandersloot was requesting a Secretary 1. Mr. Campau disagreed and stated attendance at meetings was not listed in the description of work. Mr. Biga explained that the Secretary I would be the third person in line required in attendance at the meetings. Ms. Eroh stated she thought after going through the process of trying to get on the Legal Stenographer I list that if they are only going to hire a Secretary 1, the Commission should deny letting the Department use the list of people having that high of quality and skill. Mr. Tatigian explained that was the next Agenda item, not this particular item. Upon a motion by Mr. Campau, it was 06-123 RESOLVED, That having reviewed the letter of July 10, 2006, from Val Vandersloot, City Clerk, requesting an open -competitive examination for Secretary I and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby refer this back to the Personnel Review Committee (PRC) with the recommendation to make it a Secretary 11. The motion died for lack of support. Mr. Tatigian passed the gavel to Mr. Campau. Upon a motion by Mr. Tatigian, it was 06-123 RESOLVED, That having reviewed the letter of July 10, 2006, from Val Vandersloot, City Clerk, requesting an open -competitive examination for Secretary I and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following parts of examination and weights: QUALIFICATIONS By the closing date of this announcement, applicants must: 1. Be a citizen of the United States or a resident alien with the right to work in the United States; and 2. Have a high school diploma or a valid equivalency certificate; and 3. Have had a minimum of two (2) years responsible full-time paid work Page 8 1226th Regular Meeting July 19, 20D6 experience as a secretary or in a similar classification which involves word processing and shorthand dictation or Dictaphone transcription as requirements. (Part-time experience may not be substituted for full- time experience.); and 4. Have had a minimum of two (2) years full-time paid work experience utilizing Microsoft Ward. PARTS OF EXAMINATION AND WEIGHTS Performance -20% Written Test -40% Interview -40% Required Minimum speed: Typing 50 WPM Shorthand 80 WPM Dictation A minimum of twenty (20) applicants who scare highest on the Performance and Written Tests will be invited to the Interview part of the examination. Candidates must pass the Written Test, Performance Test and Interview in order to be placed on the Eligible List. The motion died for lack of support. Ms. Mahoney stated she was struggling with the description of work and she believes a Secretary I position needs to have different qualifications than that of a Secretary II. Upon a motion by Ms. Mahoney, it was 06-123 RESOLVED, That having reviewed the letter of July 10, 2006, from Val Vandersloot, City Clerk, requesting an open -competitive examination for Secretary I and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby request Ms. Vandersloot to provide the appropriate description of work for a Secretary I and then bring it back to the Civil Service Commission. Ms. Mahoney stated if the job can be a Secretary I that is fine, but it should have Secretary I qualifications and description of work. Mr. Tatigian referred to the file and stated that in August of 2004 the Civil Service Commission approved the Secretary I. Mr. Washington informed the Commission the job announcement attached to the memorandum was for the Mayor's office. Ms. Mahoney stated that if the Secretary II description of work is equal to or greater than a Secretary I description of work, then there is a problem with the title on one of them. She explained that is why she was having trouble making any kind of motion on this and she wasn't sure if PRC acted on it without reviewing it. Ms. Lillibridge wasn't sure how much dictation that Secretary I in the Mayors office takes. The Secretary II in the City Clerk's office does take minutes at the Municipal Building Authority and she does take dictation at 90 wpm. She believes there is a need for it and there is a lot of Page 9 1226th Regular Meeting July 19, 2006 responsibility with this job. Mr. Tatigian discussed that when some of these classifications were created, they were created by politicians. Ms. Mahoney's motion died for lack of support. Mr. Biga clarified that the specific position descriptions are a function of the department. A classification description is a function of the Human Resources department. For specific duties, we rely on the department to provide that information. Ms. Mahoney stated what they had before them was a description of work with specific duties for the position being recruited for. If there was an examination for a generic Secretary I, it would list typing correspondence, take dictation, etc. In the future there will be very few positions in the City that have to take dictation because they use mechanical devices. It could be digital, it could be a tape; it could be listening to a DVD of a meeting. That is a different skill than taking dictation. You don't pay if you don't have the skill. He could see reclassifying many of the positions within the City as a result of changing technology and based on assigned duties and responsibilities. Mr. Tatigian inquired if this was limited to one department. The open -competitive examination is strictly for the City Clerk's office. Mr. Biga stated they could open it with a job description that would be generic in which case that examination would be used. But it will be used Citywide, so it could be announced with a general description of work. Mr. Tatigian inquired what is different about this other than the minor changes in language from the Secretary I position as posted in the past. Mr. Biga replied there is no difference. Ms. Mahoney stated if they were to approve this open -competitive examination for Secretary 1, and the individuals don't fit whatever Ms. Vandersloot needs, then she just wouldn't take them. Mr. Biga replied that was correct and she could request another examination at a higher level. Mr. Tatigian responded that Item 10 concerns the Clerk's office, but Item 9 does not. Mr. Campau stated that Ms. Vandersloot was the person requesting the exam. Mr. Tatigian staled that Secretary I was the only position approved to be filled by the PRC, but the classification itself is generic. Mr. Biga stated if the Civil Service Commission wanted a generic job description that could be done. Ms. Mahoney stated she could live with a generic job description, but the job description they were reviewing looked like that of Secretary 11 additional definition to it. If that is what they intended, that's fine, but you couldn't convince her that it is a Secretary I. The fad that the City believes that in the future it will need some additional Secretaries and they need to open this up, she could support that. AYE: Mahoney and Tatigian NAY: Campau Ms. Mahoney requested that Ms. Vandersloot review the Secretary I and Secretary II job qualifications. Ms. Mahoney inquired why Ms. Vandersloot wants to use the Legal Stenographer I eligible list for a position that isn't the same job classification as the vacancy in the City Clerk office. Mr. Tatigian inquired why the Commission reviewed Item 9 if Ms. Vandersloot is considering hiring someone from the Legal Stenographer I eligible list. Mr. Biga clarified that one of the individuals has been hired from the Legal Stenographer I list. Mr. Tatigian further clarified that there were two remaining on the list but one person in the audience stated they were not interested. Mr. Biga responded they won't know if the remaining person on the list was interested until the Civil Service Commission gave permission to use the list. If the person is not interested, then the Civil Service Department would proceed with announcing the Secretary I. Mr. Biga explained that the reason for proceeding with this is so that the Department can fill their position more rapidly than going through the announcement process. Ms. Eroh reiterated that the ability to get on the eligible list for Legal Stenographer and for Secretary II is above what is needed for a Secretary I. She stated she is a Secretary I and worked very hard to get on the Legal Stenographer I list. She continued that the Department needs to figure out what the qualifications are in the City Clerk's office. Page 11 122BIh Regular Meeting July 19, 2GD6 Mr. Biga stated it is not uncommon for the Civil Service Commission to utilize an eligible list for a higher level position to fill a lower level position if the persons on the list are interested in employment and the Department finds them to be satisfactory. It saves the Civil Service staff a considerable amount of time, effort and money than to proceed with the examination process. This was to give Ms. Vandersloot as an option. Ms. Mahoney stated she had a problem with this because she didn't feel that Ms. Vandersloot and the PRC had done a good job in determining what they want.
