Washington, Personnel Analyst II Gretchen Guisbert, Secretary III Mr. Campau could not be in attendance at the meeting; therefore, the Chairperson stepped down to second the motions for the entire meeting. Ms. Mahoney was en route to the meeting and was reached via cell phone for the first portion of the meeting. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was 0735 RESOLVED, That the minutes of the 1232nd Regular Meeting held Wednesday, January 17, 2007, be approved as submitted. Mr. Tatigian stated there was a question relative to the meaning of the step increases granted in Civil Service Commission Resolutions 07-02, 07-03 and 07-04, where two-step increases were granted to three Firefighters at the January 17, 2007 Civil Service Commission meeting. Mr. Tatigian explained to the Firefighters and the Fire Chief that he thought when the resolutions were approved the action was consistent with the increase granted to Mr. Biga. Mr. Tatigian clarified that was his intention and he inquired if that was Ms. Mahoney's intention and she replied that it was. It came to Mr. Tatigian's attention that was not the way some people interpreted the resolutions. He recommended a resolution be made for clarification on the issue due to difference in the salary. Mr. Biga explained that the question was, do you go from step one to step three, or from step one to step four? Was the two-step increase over and above the probationary step or is it two steps above step one? When he clarified it with the Chief, the Chief said it was two steps above the probationary step, which would take you from step one to step four. Chief Whitehead interpreted this to be to step 4 because when Firefighters complete the one-year probationary period they are at step 2. He explained that the request was to take it two steps from that point. He stated that was how it was done previously. Ms. Mahoney interpreted this to mean there is a need for an individual coming in the door with experience that needs to be counted, but the fact that an individual goes through a probationary period should not give him a three step increase. It should take the individual from step one to step three for a total of a two-step increase. Mr. Tatigian responded that was exactly what they did for Mr. Biga. Page 1233'° Regular Meeting February 1, 2007 John Orzech, President, Livonia Fire Fighters Union (LFFU) stated that historically the practice was to go from step two to step four. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-36 RESOLVED, That having reviewed Civil Service Commission resolutions 07-02, 07-03 and 07-04 adopted at the January 17, 2007 meeting, and having discussion for purposes of clarification, the Civil Service Commission does hereby grant an additional one step increase after the probationary step increase which will take the employee to step 3 as a Firefighter. The Commission received and fled the Temporary Report for January 2007. Mr. Orzech commented on the clarification of Civil Service Commission resolutions 07-02, 07-03 and 07-04, stating the Union wasn't made aware this was contested. Mr. Tatigian responded that the issue can be revisited in the future. Shadd A. Whitehead, Fire Chief clarified that in the future, his written requests should be for a one-step increase, since the employee already would have completed the probationary period. Ms. Mahoney stated she believed the concem was that the Fire Department was being treated differently due to the letter that had been written. Mr. Tatigian responded that the Civil Service Commission was trying to be consistent with what they do throughout the City. The Commission received and fled the Non -Resident Report as of February 1, 2007. Mr. Biga stated that with regard to AFSCME Union Local 192 Grievance #06-29, dated November 22, 2006, from Thomas Bok, Building Inspector, regarding sick leave, he received a letter from the Department removing the letter in question from Mr. Bok's file. Therefore, the grievance has been withdrawn. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 0737 RESOLVED, That having reviewed AFSCME Union Local 192 Grievance #06-29, dated November 22, 2006, from Thomas Bok, Building Inspector and the letter of January 30, 2006, from David Woodcox, Director of Inspection and Randy Abrahamson, Sr. Building Inspector, the Civil Service Commission approved removing the letter regarding absenteeism from Mr. Bok's file and will take no further action without prejudice. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-38 RESOLVED, That having reviewed the letter of January 24, 2007, from Brian Beerbower, Custodian, as approved for submission by Patrick Hogan, Director of Public Service, requesting an extension of an unpaid medical leave of absence, the Civil Service Commission does hereby approve an extension of an Page 1233' Regular Meeting February 1, 2007 unpaid medical leave of absence for Mr. Beerbower from January 20, 2007, through March 12, 2007, pursuant to Civil Service Commission RULE 25, LEAVES, Section 25.5 Leaves of Absence. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 0739 RESOLVED, That having reviewed the letter received on January 31, 2007, from Linda McCann, Director of Community Resources requesting approval of the revised grant classifications and pay rates for the fiscal year 2007, the Civil Service Commission does hereby approve a 5% rate increase over the current rates, which were effective October 1, 2004, for these grant classifications to be effective December 1, 2006. AND BE IT FURTHER RESOLVED, That the only benefit received, is holiday pay after the completion of 480 hours in a grant classification and subject to sufficient funding; AND BE IT FURTHER RESOLVED, These positions shall terminate at such time funding is no longer available; AND BE IT FURTHER RESOLVED, the Civil Service Commission submits same to City Council for its review and consideration. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-40 RESOLVED, That having reviewed the letter of January 23, 2007, from Patrick Hogan, Director of Public Works and Brian Wilson, Assistant Superintendent of Public Service, requesting the re -announcement of the promotional examinations for Sewer Maintenance Worker I and Sewer Maintenance Worker It and revised qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: SEWER MAINTENANCE WORKER I QUALIFICATIONS This examination is open only to employees of the City of Livonia who, by the closing date of this announcement, are: Employed in the Public Service Division of the Department of Public Works; and Have regular status in a permanent classification; and Eligible for either a Temporary Instruction Permit (TIP) for, or have a valid Group "A" or "B" Commercial Drivers License with Air Brake, "N" endorsement and must have or be eligible for, a valid Industrial Truck Driving Permit for operation of a forklift. Page 1233' Regular Meeting February 1, 2007 An employee in this classification is subject to all requirements of the Federal Omnibus Transportation Employee Testing Act of 1991, as amended. Written Test - 80% Departmental Rating - 20% Candidates must pass the Written Examination in order to be placed on the eligible list. Pursuant to AFSCME Local 192, Promotions 20.B. in competitive examinations which include Departmental Ratings, the Departmental Rating from 0 to 100 will count 20% of the examination, but a score under 70 will not disqualify the candidate from continuing in the process. SEWER MAINTENANCE WORKER II QUALIFICATIONS This examination is open only to employees of the City of Livonia who, by the closing date of this announcement, are: Employed in the Public Service Division of the Department of Public Works; and Have regular status and one (1) year of experience as a Sewer Maintenance Worker I; and Eligible for either a Temporary Instruction Permit (TIP) for, or have a valid Group "A" or "B" Commercial Drivers License with Air Brake, "N" endorsement and must have or be eligible for, a valid Industrial Truck Driving Permit for operation of a forklift. An employee in this classification is subject to all requirements of the Federal Omnibus Transportation Employee Testing Act of 1991, as amended. PARTS OF EXAMINATION AND WEIGHTS Performance Test - 80% Departmental Rating - 20% Candidates must pass the Performance Test in order to be placed on the eligible list. Pursuant to AFSCME Local 192, Promotions 20.B. in competitive examinations which include Departmental Ratings, the Departmental Rating from 0 to 100 will count 20% of the examination, but a score under 70 will not disqualify the candidate from continuing in the process. Ms. Mahoney entered the meeting at 6:10 p.m. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-41 RESOLVED, That having reviewed the letter of January 24, 2007, from Patrick Hogan, Director of Public Works and Brian Wilson, Assistant Pages 1233' Regular Meeting February 1, 2007 Superintendent of Public Service, requesting a promotional examination for Service Representative (Water) and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open only to employees of the City of Livonia who, by the closing date of this announcement, are: Employed in the Public Service Division of the Department of Public Works; and Have regular status as a Water Meter Repairer; and Have a minimum of six (6) months experience as a Water Meter Repairer with the City of Livonia. PARTS OF EXAMINATION AND WEIGHTS Written Test -40% Interview -40% Departmental Rating -20%' Candidates must pass the Written Test and the Interview in order to be placed on the eligible list. Pursuant to AFSCME Local 192, Promotions 20.B. in competitive examinations which include Departmental Ratings, the Departmental Rating from 0 to 100 will count 20% of the examination, but a score under 70 will not disqualify the candidate from continuing in the process. 'In the event there is only one qualified applicant for the position, the Parts of Examination and Weights will be 100% Departmental Rating. Additional discussion ensued regarding the Departmental Correspondence of January 22, 2007, from Shadd A. Whitehead, Fire Chief, requesting a pay step increase for James Naif, Firefighter. John Orzech inquired if it was customary that if a Department Head recommended something that the Civil Service Commission could change it. Mr. Tatigian responded that the Civil Service Commission could change it or they could deny it. Mr. Biga added that was why the Civil Service Commission is involved in appeal processes. They can affirm, modify or deny requests. Mr. Biga continued that this request is being brought to the Civil Service Commission because the request is to grant a step increase early because the Department is mirroring the previous requests for step increases and if the Department had brought this request earlier Mr. Naif would have received his step increase a -month-and-a- half early. Mr. Orzech asked Mr. Biga his opinion of this and Mr. Biga responded that he was in agreement with the one-step increase as clarified. He added that this request was a catch up. Mr. Orzech asked if they could go back to 2000 and pick up the employees that did not receive the step increase if this was a catch up provision. Ms. Mahoney commented that the Commission raised the question of how many other employees this would affect at the January 17, 2007 meeting and they were told only two or three employees. Page 1233' Regular Meeting February 1, 2007 Mr. Tatigian explained the reason the Civil Service Commission was granting the request was because the Chief indicated to them that he wanted to retain employees he feels are important to the Fire Department that have experience and he doesn't want to lose them. He added that when a person accepts a job they come in at the beginning wage the City is paying at that time, not because of any prior experience. Mr. Naif replied that when he started the job he took a pay cut and still opted to come to the City of Livonia. Mr. Naif added that at the time he was hired, this option did not exist and it was difficult to all of a sudden watch other employees at the same level get an increase. Mr. Tatigian reminded the Fire employees that the Civil Service Commission doesn't appropriate the money and from what he understood, the City was not exactly rolling in money. He explained that the Civil Service Commission can grant requests for step increases within the limits of their authority and this request is at the request of Chief Whitehead. Ms. Mahoney commented that every employee is an asset. Up to the last Civil Service Commission meeting, the Fire Department staff had no opportunity to get credit for prior work experience and they were under the impression the rest of the City would not get additional pay steps. The Civil Service Commission determined that whether the Fire Department was told that or not, the rest of the City was not living by the grievance settlement of June 15, 2000. The Civil Service Commission agreed to allow the Fire Department to be recognized for prior experience, but to treat this at the same level as the rest of the City, as opposed to being a step above that. The Fire Department would have to decide within their budget how that is handled and the Civil Service Commission will consider the requests on a case-by-case basis. Mike Bailey, Vice -President, LFFU, stated the concern he had is that the City was very clear when they were going to stop this program, due to the hiring freeze to cut the budget. When the Fire Department could request the step increases again, he believed a memo should have been distributed stating that this program was going to be reinstituted on a case-by-case basis. Ms. Mahoney stated the reason that stopped the practice was a grievance determination with the Firefighters Union. Mr. Tatigian stated the Mayor and the City Council manage the City and if the Civil Service Commission received hundreds of requests they would have to turn them down because the City doesn't have that kind of money. Mr. Tatigian stated the Civil Service Commission was just trying to be fair. Derrick Washington inquired how to treat advance step increases with regard to applicants for Clerk I and Clerk -Typist in possession of a Bachelors or Master's Degrees. Ms. Mahoney explained it is up to the Department and the hiring body to determine whether or not the added experience is applicable toward the job they are in. The fact that someone has a Master's Degree and applied for Clerk -Typist is the employee's prerogative, but it wouldn't necessarily make them a better Clerk -Typist. When you have experience in a Fire Department, where someone has dealt with burning buildings and people being injured, this experience directly impacts on the job that is being done. The fact that Mr. Biga had personnel experience that would take him to the level of dealing with things we needed here, that is what caused the Civil Service Commission to grant his step increase. Mr. Tatigian stated this was not a question of fairness. It was not a question of experience. He stated he was going along with this because the Fire Chief requested this to keep the good Firefighters he has and he needs it to maintain the Fire Department. Pagel 1233'° Regular Meeting February 1, 2007 Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-42 RESOLVED, That having reviewed the Departmental Correspondence of January 22, 2007, from Shadd A. Whitehead, Fire Chief, requesting a pay step increase for James Naif, Firefighter, and having discussion with Shadd A. Whitehead, Fire Chief, John Orzech, President, LFFU; Michael Bailey, Vice -President, LFFU; James Naif, Firefighter; and Robert Biga, Human Resources Director, the Civil Service Commission does hereby grant a one-step pay increase effective January 17, 2007 from step 4 to step 5. The Commission reviewed the Departmental Correspondence of January 25, 2007, from Shadd A. Whitehead, Fire Chief, requesting a pay step increase for Kurt Pernick, Firefighter. Mr. Tatigian inquired if this was different than the last request. Mr. Biga responded it was the same as the last requests, except the question is whether Mr. Pernick would go to step 4 or step 3. The clarification identified earlier was that the step increase would take an employee to step 3. Ms. Mahoney inquired if Mr. Pernick was at step 2 now. Mr. Pernick was present and stated he was currently at step 3. Mr. Biga clarified Mr. Pernick went to step 3 on August 30, 2006. Mr. Biga explained that Mr. Pernick could be advanced to step 4. Normally, Mr. Pernick would be advanced to step 4 in August of 2007. The effective date of the increase was in question. If the Civil Service Commission advanced Mr. Pernick, what would be the effective date? Ms. Mahoney made a motion to advance Mr. Pernick to step 4 effective immediately. The motion died for lack of support. Mr. Orzech staled the Union had an issue on this subject and wanted to know if the requests were submitted while the Chief was on vacation and the Civil Service Commission postponed the item for a month or two, the Union filed an arbitration and it was ruled that the step increase would be on the anniversary to prevent four or five months of pay loss, which is a substantial amount. Now because Mr. Naif, Mr. Pernick and Mr. Price didn't get on the Agenda, they are out another month's step increase. Mr. Tatigian explained that on August 31, 2007 Mr. Pernick would go to step 5. Mr. Biga asked if the request from the Union was to make this effective as of last month, like the other requests were. Mr. Orzech responded that in the past they have been effective on anniversary date, that way if there was a delay, the employee would not miss the step increase. He added the Fire Department uses anniversary dates for most things. Mr. Tatigian recommended approving Mr. Pernick's step increase effective immediately and on August 31, 2007, he will go to step 5. Ms. Mahoney stated she thought using the anniversary date was a great idea and the Department should continue to do that. She thought this request was something outside of the norm because at the last meeting the Union the Civil Service Commission made a change that impacted some employees in the Fire Department. Mr. Pernick indicated he didn't hear what the earlier motion was regarding the clarification of the step increase and asked that it be repeated. Ms. Mahoney reiterated that the motion was to approve a one-step increase, not a two-step increase for prior experience. Mr. Orzech inquired if the step increase date should continue to coincide with the anniversary date. Ms. Mahoney gave an example if someone required an extension of the probationary period, the individual would lose six months of the step increase. Mr. Biga stated that if you Page 1233' Regular Meeting February 1, 2001 had someone with past experience who didn't pass the probationary period, he doubted the Chief would request an advance step increase based on their prior experience because obviously there was a problem. Mr. Biga stated that some of the requests may have been delayed in being placed on the agenda and he suggested making all of the requests for step advancement effective at the last meeting, all at the same time, so there isn't a situation where someone could say their request sat, wasn't processed and was not put on the agenda. He recommended approving this for both Mr. Naif and Mr. Pernick. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-43 RESOLVED, that having reviewed Departmental Correspondence of January 25, 2007, from Shadd A. Whitehead, Fire Chief, requesting a pay step increase for Kurt Pernick, Firefighter, and having discussion with John Orzech, President, LFFU; Kurt Pemick, Firefighter; and Robert Biga, Human Resources Director, the Civil Service Commission does hereby grant a one-step pay increase for Mr. Pernick effective January 17, 2007. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-44 RESOLVED, That having review Departmental Correspondence of January 29, 2007 from Shadd A. Whitehead, Fire Chief, requesting a pay step increase for Anthony Price, Firefighter, the Civil Service Commission does hereby grant a one-step pay increase for Mr. Price effective January 17, 2007. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-45 RESOLVED, That having reviewed Departmental Correspondence of January 19, 2007, from Kevin Church, Firefighter, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting permission to use three (3) additional paid Family Illness days chargeable to sick leave for 2007, the Civil Service Commission does hereby approve the use of three (3) additional twenty- four (24) hour paid Family Illness days, beyond the maximum four (4) twenty-four (24) hour paid Family Illness days allowed per calendar year, subject to Firefighter Church submitting medical documentation that his presence is necessary to care for a seriously ill family member. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-46 RESOLVED, That having reviewed the letter of January 23, 2007, from Patrick Hogan, Director of Public Works and Brian Wilson, Assistant Superintendent of Public Service, requesting a promotional examination for Water Operations Mechanic I and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open to employees of the City of Livonia, who, by the closing date of this announcement, are: Page 1233'° Regular Meeting February 1, 2001 Employed in the Public Service Division of the Department of Public Works; and Have regular status in a permanent classification; and Be eligible for either a Temporary Instruction Permit (TIP) for, or a valid Group "A" or "B" Industrial Truck Commercial Driver's License with Air Brake, and must have or be eligible for, a valid Industrial Truck Driving Pennit for operation of a forklift. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-48 RESOLVED, That having reviewed the letter of January 29, 2007, from Shadd A. Whitehead, Fire Chief, requesting an open -competitive examination for Firefighter and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS By the closing date of the announcement, applicants must: 1. Be a citizen of the United States or a resident alien with the right to work in the United States. 2. Have a high school diploma or valid equivalency certificate. Preference will be given applicants that have a Bachelors Degree or an Associate's Degree in Fire Science or an EMS curriculum. 3. Hold a current State of Michigan Paramedic License or National Registry EMT - Paramedic and be ACLS (Advanced Cardiac Life Support) certified. 4. Possess the Conference of Western Wayne Firefighter Written and Physical Agility Test Certificates. THE AGILITY TEST CERTIFICATE MUST HAVE BEEN ISSUED IN THE TWELVE (12) MONTHS PRIOR TO THE CLOSING DATE OF THE ANNOUNCEMENT. 5. Possess normal visual functions and acuity in each eye of 20/100 or better, correctable to 20/20 with eyeglasses. NOTE: Applicant must submit a completed City of Livonia Firefighter Visual Acuity form dated after October 23, 2006, signed by a physician, optometrist or ophthalmologist attesting to the applicant's visual acuity in each eye corrected and uncorrected. 6. Be free from any physical defects, chronic diseases, organic or functional conditions or mental and emotional instabilities which may tend to impair the efficient performance of duties or which might endanger the lives of others or the individual employee. 7. Possess and maintain a valid motor vehicle operators or a basic commercial driver's license and have an acceptable driving record. B. AT THE TIME OF CERTIFICATION TO THE DEPARTMENT FOR FINAL INTERVIEW AND HIRING CONSIDERATION, CANDIDATES MUST POSSESS: A. A current State of Michigan Paramedic License or National Registry EMT - Paramedic, and be currently ACLS certified. B. A State of Michigan Firefighter II Certificate or equivalent certification in a state that has reciprocity. Page 11 1233' Regular Meeting February 1, 2007 PARTS OF EXAMINATION AND WEIGHTS Written Test — 50%` Oral Interview — 50% Background Investigation — Pass/Fail 'NOTE: The thirty (30) candidates with the highest passing scores on the written test will be invited to continue to the Interview portion of the examination process. Remaining candidates who pass the Written Test will have their names kept on file for future reference during the life of the eligible list. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-49 RESOLVED, That having reviewed the expiring eligible list for the month of March 2007 — Building Mechanic IV (866 o.c.), Police Vehicle Maintenance Coordinator (876 o.c.), Recreation Supervisor (872 o.c.) and Recreation Supervisor — Cable Video (878 o.c.), the Civil Service Commission does hereby extend the eligible list for Building Mechanic IV (866 o.c.) for an additional three (3) months. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was 07-50 RESOLVED, That the Civil Service Commission does hereby approve the eligible list for Library Aide 1 (89 o.c.).
