Washington, Personnel Analyst II Gretchen Guisbert, Secretary III Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was 09-45 RESOLVED, That the minutes of the 1257th Regular Meeting held Wednesday, February 18, 2009, be approved as submitted. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was 09-46 RESOLVED, That the minutes of the 99th Special Meeting held Tuesday, March 3, 2009, be approved as submitted. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and adopted, it was 09-47 RESOLVED, That having reviewed the letter of February 23, 2009, from Martin Donnelly, Senior Police Officer, as approved for submission by Robert Stevenson, Police Chief, requesting carry over of vacation days based on a projected retirement date of February 28, 2012, the Civil Service Commission does hereby confirm the administrative approval to carry over excess vacation days; AND BE IT FURTHER RESOLVED, that the maximum number of days permitted for payoff at retirement is sixty-eight (68) as established in accordance with the Livonia Police Officers Association contract, Article 22.9, Vacation Accrual and Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), paragraph (f), AND BE IT FURTHER RESOLVED, that the maximum number of days is based upon the employee qualifying for the bonus vacation days for not using more than five (5) sick leave days annually in the three (3) years immediately prior to retirement. Paget 1258'" Regular Meering March 18,2009 09-48 RESOLVED, That having reviewed the letter of February 09, 2009, from Linda Gosselin, Commercial/Industrial Appraiser, as approved for submission by Shenon Schultz, City Assessor, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Gosselin's request to carry over thirty-nine and one-quarter (39.25) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-49 RESOLVED, That having reviewed the letter of February 09, 2009, from Katherine Siterlet, Assessment Clerk, as approved for submission by Shenon Schultz, City Assessor, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Siterlet's request to carry over sixty-five and one-quarter (65.25) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 0950 RESOLVED, That having reviewed the letter of February 09, 2009, from Susan Anderson, Program Supervisor, as approved for submission by Linda McCann, Director of Community Resources, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Anderson's request to carry over twenty-two (22) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-51 RESOLVED, That having reviewed the letter of February 09, 2009, from Felicia Cross, Program Supervisor, as approved for submission by Linda McCann, Director of Community Resources, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Cross's request to carry over seventeen and one-quarter (17.25) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 0952 RESOLVED, That having reviewed the letter of February 09, 2009, from Linda McCann, Director of Community Resources, as approved for submission by Jack Kirksey, Mayor, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. McCann's request to carry over eighteen (18) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. Page 3 1258'" Regular Meeting March 18, 2009 0953 RESOLVED, That having reviewed the letter of February 09, 2009, from Sharon Sabat, Recreation Supervisor, as approved for submission by Linda McCann, Director of Community Resources, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Sabal's request to carry over forty-seven and one-half (47.50) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-54 RESOLVED, That having reviewed the letter of February 09, 2009, from David Benson, Park Maintenance Worker III, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Benson's request to carry over fourteen (14) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 0955 RESOLVED, That having reviewed the letter of February 6, 2009, from Keith Besonen, Sewer Maintenance Worker I, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Besonen's request to carry over fifteen and one-quarter (15.25) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 0956 RESOLVED, That having reviewed the letter of January 13, 2009, from Michael Boyle, Building Maintenance Foreman, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Boyle's request to carry over seventy-nine and one-half (79.5) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 0957 RESOLVED, That having reviewed the letter of January 14, 2009, from Robert Dunklee, Custodian, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Dundee's request to carry over eighteen (18) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Giedrojcs request to carry over twenty-seven and one-quarter (27.25) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 0959 RESOLVED, That having reviewed the letter of January 13, 2009, from Brian Gnagey, Equipment Mechanic II, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Gnagey's request to carry over twelve (12) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-60 RESOLVED, That having reviewed the letter of January 13, 2009, from Charles Hirst, Roads Foreman, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Hirst's request to carry over ten (10) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-61 RESOLVED, That having reviewed the letter of January 14, 2009, from Vickey Locke, Sewer Foreman, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Locke's request to carry over seven (7) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-62 RESOLVED, That having reviewed the letter of January 13, 2009, from Steven Made, Building Maintenance Supervisor, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Made's request to carry over sixty-four (64) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-63 RESOLVED, That having reviewed the letter of January 7, 2009, from Sharon McGrady, Account Clerk III, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Raitanen's request to carry over seventy-nine and one-half (79.50) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-65 RESOLVED, That having reviewed the letter of January 13, 2009, from Timothy Richards, Water and Sewer Supervisor, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Richard's request to carry over thirty-one and one-half (31.50) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-66 RESOLVED, That having reviewed the letter of January 14, 2009, from David Robertson, Water Foreman, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Robertson's request to carry over eighty-eight (88) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-67 RESOLVED, That having reviewed the letter of January 7, 2009, from James Swan, Equipment Operator II, as approved for submission by Patrick A. Whitehead, Fire Chief, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Bailey's request to carry over forty-eight (48) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-71 RESOLVED, That having reviewed the Departmental Correspondence of February 6, 2009, from David Dobiesz, Senior Fire Equipment Mechanic, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Dobiesi s request to carry over fifty-two (52) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-72 RESOLVED, That having reviewed the Departmental Correspondence of January 27, 2009, from Scott Graham, Fire Lieutenant, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Graham's request to carry over ninety-six (96) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-73 RESOLVED, That having reviewed the Departmental Correspondence of January 27, 2009, from Brian McLaren, Firefighter, as approved for submission by Shadd A. AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-87 RESOLVED, That having reviewed the Departmental Correspondence of December 10, 2008, from Gregory Yon, Police Sergeant, as approved for submission by Robert Stevenson, Police Chief, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Yon's request to carry over sixteen (16) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. 09-88 RESOLVED, That having reviewed the Departmental Correspondence of December 5, 2008, from Paul Zoski, Police Sergeant, as approved for submission by Robert Stevenson, Police Chief, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Zoski's request to carry over forty-eight (48) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. Page 10 1258' Regular Meeting March 18, 2009 09-89 RESOLVED, That having reviewed the letter of February 6, 2009, from Barb Vaden, Teller III, as approved for submission by Dennis Wright, City Treasurer, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Vaden's request to carry over eight (8) excess vacation hours into 2009; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation into 2010. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was 09-90 RESOLVED, That having reviewed the letter of February 5, 2009, from Brian Buda, Equipment Operator 11, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby deny Mr. Buda's request because the resolution approving Mr. Buda's request from last year specifically stated no request would be considered to carry over excess vacation into 2009. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was 09-91 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the passing point of a raw score of 156 out of the maximum score of 250 for the combined Short Employment Tests for Numerical and Clerical Aptitude and a minimum score of 24 on the Wondedic Personnel Test on the written test for Account Clerk III (921 o.c.). 09-92 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the passing point of 70% of the maximum raw score of 175 or a whole raw score of 123 on the written test for Police Sergeant (1292 p.). 09-93 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the passing point of 70% of the maximum raw score of 175 or a whole raw score of 123 on the written test for Police Lieutenant (1291 p.). 09-94 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for Parks Foreman (1288 p.). 09-95 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for Water Operations Mechanic 1 (1293 p.). Letters of February 20, 2009, from Charles Locke, President, AFSCME Union Local 192, to Brian Wilson, Superintendent of Public Service and Robert Biga, Human Resources Director, regarding Labor -Management Meeting request concerning vacant Storekeeper position. I. Letter of February 25, 2009, from Charles Locke, President AFSCME Union Local 192, to Brian Wilson, Superintendent of Public Service, regarding Open Grievances, #09-04 (Roads Department), #09-06 (B- Shift/Snow Policy), #09-07 (Roads/Snow Policy), #09-09 (E. Hoffman) and #09-10 (M. Trybus). Charles Locke, President, AFSCME Union Local 192, asked the Commission about the Status of the Temporary Report for February 2009. He indicated there is one (1) person working in a temporary position in the Clerk's office and this would be the seventh month. He staled the agreement was that it should not exceed six (6) months. Mr. Campau inquired if Mr. Biga knew what the circumstances were. Mr. Biga did not know what the issue was and inquired if Mr. Washington was familiar with this situation. Mr. Washington stated he was not familiar with it and stated he would research this. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was 09-96 RESOLVED, That having reviewed the letter of February 25, 2009, from Stanley Nowak, Planner IV, as approved for submission by Mark Taormina, Planning director, requesting permission to carry over vacation days in excess of the maximum based on a new projected retirement dale of February 18, 2012, the Civil Service Commission does hereby approve Mr. Nowak's request to carry over excess vacation days up to a maximum payout of fifty-seven (57) days as provided by Civil Service RULE 25, LEAVES, Section 25.1. Robert F. Biga, Human Resources Director, explained that he wrote a memorandum to the Commission regarding vacation carry over for Mr. Kwasniuk, Engineering Assistant I, prior to receiving a letter from Mr. Kwasniuk. He stated that Mr. Kwasniuk was injured on the job and has been off work for approximately two (2) years. He informed the Commission that in 2008 they authorized a carry over of excess vacation and the Rules provide thirty (30) days as a maximum. He explained that Mr. Kwasniuk was not anticipating retirement, it was just the fact that he couldn't use the vacation time. He was not able to return to work so he couldn't use Page 13 1258'" Regular Meeting Mauer 18, 2009 any time last year, so all the time after the 560 hours that the Commission already authorized would be deemed lost. Mr. Biga further explained that in his letter of March 9, 2009, Mr. Kwasniuk asked to be paid for 296 hours of unused vacation time, but payout for unused vacation time cannot occur until he retires or he terminates employment. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was 09-97 RESOLVED, That having reviewed the memorandum of March 2, 2009, from Robert F. Biga, Human Resources Director, and letter of March 9, 2009, from Alex Kwasniuk Engineering Assistant I, regarding carry over of excess vacation, the Civil Service Commission does hereby deny Mr. Kwasniuk's request to be paid for unused vacation time since an employee can only be paid out for accumulated vacation at the time of retirement or at the commencement of a military leave of absence. Steve Schoonover, Vice -President, AFSCME Union Local 192, presented AFSCME Union Local 192 Grievance #09-03, dated January 16, 2009, from Peter Butler, Gordon Hollaway, Lindsay Kantzler, Kenneth Sydor, Mark Trybus, and Audrey Young, regarding the call -out procedures for the Roads Maintenance section. He staled that the Union was concerned about a standard in place when it started snowing how the DPW management calls personnel in. He referenced Mr. Wilson's Step II response and said it was a convenient excuse of why this procedure wasn't used property. He stated there have been times when management showed no concern for an employee's fatigue. There have been trucks on the road for over twenty (20) hours at a time. It seemed like it was a mishandling by the Foreman in contacting the correct personnel. The Union believed they should use the standard procedure for call -out and the people that were skipped over on the call -out sheet should be compensated for the time the persons who were improperly called in. Mr. Campau asked why these six (6) individuals should have been called in instead of others. Mr. Schoonover replied it was because of the call -out list and where they are on the list due to hours worked up to that point in the year. They would have been called before some of the employees that were called and came into work. He explained that if procedures were followed properly, people with lower charged hours would have been called in before people with higher hours. Ms. Mahoney stated that the fact that these employees didn't receive a call doesn't mean they were home, if they would have answered the phone, or if they would have come in. So there is no way to know if these employees would have accepted the overtime opportunity. Mr. Schoonover reiterated that there is a procedure that the City has always gone by to bring people in and when they fail to do so they harm the employee by not giving them the opportunity. Ms. Mahoney agreed the call -out procedure should be used, but she had trouble paying individuals for work they did not perform. Page 14 1258'" Regular Meeting March 18, 2009 Mr. Schoonover had two (2) other issues; one of which was that on this occasion there was a concern they didn't want to wear employees out. That's why they were trying this new procedure, but yet he has worked twenty-two (22) hours because he was allowed to switch and work that marathon shift. A second issue was on another snow emergency the new plan went right out the window. Ms. Mahoney asked if there was a new Foreman. Mr. Wilson replied no, and it was not done in error, this was done intentionally. It was set up in a planning meeting before the first snowfall. Mr. Campau stated they don't have contract language that states what provision is being violated. Mr. Schoonover stated that there is a section that states the City will equalize overtime. Mr. Campau confirmed it is past practice. Mr. Tatigian clarified that they did call in members of the Union who worked and were paid overtime. He asked what advantage there was for the City in doing this. Mr. Schoonover did not know if there was an advantage for the City financially. Mr. Wilson clarified that the employees and managers that have dealt with these conditions all winter long are to be commended for their hard work. He explained that in December there was a snow emergency with a lot of problems. There were many streets and neighborhoods that did not get serviced in a timely manner. After that DPS management did an analysis of what went right and wrong in that situation. This is what precipitated looking at how they could do things better to make sure there is a full complement of equipment and available personnel to meet that goal. Mr. Campau asked what conclusion they came to as to why there weren't enough employees on the back end of the snow emergency. Mr. Wilson replied that part of the problem was sending people to the Water Department that should have been plowing snow and another part of the problem was allowing people to work in the front end of the shifts even though there are two shifts; an "A" shift and a "B" shift. They had inadequate resources on "B" shift at that time to do this during the December storm. Both shifts work 12 hours on and 12 hours off. The "A" shift works 11:00 a.m. to 11:00 p.m.; the "B" shift works 11:00 p.m. to 1100 a.m. Audrey Young, Equipment Operator II, stated she comes in for every snow policy and she works 20 or 22 hours. She is on "A" shift and she said they could have called her and she would have worked. Mr. Wilson explained he was trying to establish the thought process that led up to the planning for the second event. One of the things that was heard with this situation is that they brought in "B" shift people at 4:00 a.m. instead of "A" shift people because "A" shift people were coming in at 11:00 a.m. and were going to be working a 12 -hour shift. If those people were brought in at 4:00 a.m., then they would actually be planning to have them work 19 hours. Mr. Wilson said he realizes that they ask for marathon hours out of employees at times in the Water Department as well as the Roads Department, but they shouldn't plan on doing that to people. The "B" shift people went home at 11:00 a.m. to have a 12 -hour rest period and then the "A" shift people came in at 11:00 a.m. The Union's position in this matter is that regardless of circumstances you have to follow the call -out list. But contract language differs from that. The contract language is specific in a couple of places. We spoke about equalization of Page 15 1258'" Regular Meeting March 18, 2009 overtime and in the contract there is specific verbage that says it is "to the extent that it is feasible and practical, that overtime is to be equalized." It doesn't say in the middle of a snow emergency it has to be equalized, it says "feasible and practical." This was looked at as a way of insuring that there were fresh people and that we had people in trucks, unlike the first snow emergency where they didn't. He cited language in Management Rights about work assignments that says under emergency situations that Management can make work assignments. So the decisions were made on the basis of contract. Mr. Schoonover stated the 6.5 hours they were originally discussing was not a snow emergency. This was a snow event, but until they hit the 4" mark, it is not a snow emergency. Mr. Wilson said it is an emergency situation because there would be no reason to pull people in on overtime to plow snow if it wasn't. Whether they are under a snow cycle or not, it is still under contract. Mr. Schoonover stated at 4:00 a.m. when the call came out they were not under a snow emergency, rather the official snow emergency came out at 11:00 a.m. or 12:00 p.m. on Saturday, so from 4:00 a.m. until the snow emergency started they are just on regular plow and salt schedule. Mr. Wilson responded that contract language doesn't speak to a snow emergency, it speaks to an emergency. If it wasn't an emergency there would be no reason to call in people. Mr. Schoonover pointed out that Mr. Wilson stated that part of the reason they wanted to restructure this was due to the amount of trucks in the previous snow cycle that sat in the barn empty. Mr. Schoonover said he worked the previous one and the second one and he felt there were the exact amount of trucks sitting empty through different parts of the snow cycle because of lack of operators holding CDLs. Referring to contract language, Mr. Schoonover further stated that he could see nowhere that they went to the extent it was feasible or practical to make any accommodations of what is the traditional standard plan. He also said the City at one time shifted the schedule to a 3:00 p.m. to 3:00 a.m. and 3:00 a.m. to 3:00 p.m. so it was possible to go to a different shift under Management Rights. Mr. Wilson returned to contract language because he staled there is contract language that addresses this situation but no Civil Service Commission Rules and no contractual Articles were cited in this grievance, only the call-in procedure. Mr. Campau asked if they followed the plan on the next snow emergency. Mr. Wilson advised that the next snow emergency was a weekend. Weekend procedures may have an entirely different timing than this one and they knew this one was coming. Mr. Schoonover said Mr. Wilson indicated they didn't know. Ms. Mahoney asked what prompted the action at 4:00 a.m. Mr. Wilson explained that for this event they actually worked the evening before until 8:00 p.m. At about 3:30 a.m. the Livonia Police Department called and said the roads were icing back up so people were brought in to salt and plow the routes. These six (6) individuals felt they should have been called in. Ms. Mahoney clarified that it was the "B" shift people who were called to come in and do that. Mr. Campau and Mr. Wilson discussed how many trucks the City utilized and what areas they have responsibility for. Mr. Biga explained how the twelve (12) hour shifts work, stating there is an "A" shift and a "B" shift. The Department is divided into two (2) twelve (12) hour shifts for snow emergencies when a snow emergency is declared. There is an 11:00 a.m. starting time Page 16 1258'" Regular Meeting March 18, 2009 for one shift and an 11:00 p.m. starting time for a second shift. At the beginning of the season, the employees are given the opportunity to select which shift they want to be on, based on seniority and where their vehicle is assigned. This schedule was set up because it split a normal work day in half and over the years there has been some change in the policy and in the details, but he wanted to make sure the Commission understood how that policy worked. Ms. Mahoney confirmed that the normal starting time is 7:00 a.m., and if a snow emergency is declared before 7:00 a.m., then an employee from "A" shift knows they will be going in. Mr. Wilson clarified the same thing happens on the back end for the "B" shift employees. They come in at 11:00 p.m. and work until 11:00 a.m., but then they have four (4) hours at the end of the shift. He added that many people elect to take leave time at that point, because they have done twelve (12) hours overnight and then they take four (4) hours leave time and it was not unusual at the end of a storm. Mr. Schoonover staled there were limes when he worked from 11:00 p.m. to 11:00 a.m. and generally he is sent home to come back in at 11:00 p.m., but he has in the past worked until 6:00 p.m. or 7:00 p.m., then has gone home and slept and returned at 11:00 p.m. The point Mr. Schoonover was trying to make was that it shows that the Foreman or Supervisor has allowed this and there has been no show of concern of people being too tired. Mr. Wilson said the argument was they didn't want to plan to have people work the marathon hours. Mr. Schoonover recalled being told by Mr. Wilson three (3) years ago that they would not allow people to work beyond sixteen (16) hours, but he has not seen that enforced. Mr. Tatigian thanked the Union for their presentation; however, he could find no violation of any contract provision. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was 09-98 RESOLVED, That having reviewed AFSCME Union Local 192 Grievance #09-03, dated January 16, 2009, regarding call out procedures, from Peter Butler, Gordon Hollaway, Lindsey Kantzler, Kenneth Sydor, Mark Trybus and Audrey Young, and having discussion with Steven Schoonover, Vice - President, AFSCME Union Local 192; Audrey Young, Equipment Operator II; Charles Locke, President, AFSCME Union Local 192; and Robert F. Biga, Human Resources Director, the Civil Service Commission does hereby deny the grievance, based on no contract language being violated. Robert Biga, Human Resources Director, commented that in the previous grievance there were many facts that were not brought out in the meeting like what time the people were called, the day the people were called, giving the background as to how the snow policy works and some of terminology of snow "cycle" vs. "shift' He hoped in the future that when grievances are submitted, that both sides provide as much background information as possible. Charles Locke, President, AFSCME Union Local 192, presented AFSCME Union Local 192 Grievance #09-04, dated January 16, 2009, from Herman Legg, Equipment Operator II, regarding overtime, and stated that Herman Legg is assigned to the Water Department as a Page 17 1258'" Regular Meeting March 18, 2009 driver of one of the trucks. There used to be three (3) drivers, but due to attrition, they are now down to only two (2). Mr. Legg's primary responsibility is to the Water Department. On the day in question, Mr. Legg was put on a "B" shift snow cycle when a water break occurred. The Department tried to utilize other truck drivers, but they couldn't find any and by default, the job should have gone to Mr. Legg since he was on duty. Mr. Locke stated that if you are assigned to the Water Department and you are in, you're overtime is first to your Department, or your assignment. Mr. Tatigian clarified that Mr. Legg would have worked an extra hour -and -a -half on this particular job. Based on the Letter of Understanding, it states that Mr. Legg was entitled to it. Mr. Wilson disagreed with this. He detailed how this event happened to be during the same time as the aforementioned grievance, January 10 and 11, 2009. There were two (2) shifts working around the clock. Mr. Legg was assigned to the "B" shift so he was in from 11:00 p.m. on Saturday, January 10, 2009 until 11:00 a.m. on Sunday, January 11, 2009. A water break occurred at 6:15 a.m. on Sunday morning and Brian Molnar was brought in, who is assigned to the Water section, to drive an unassigned dump truck for this water main break. The truck drivers that normally would be doing this service were assigned to their first priority, the snow emergency. The Letter of Understanding speaks specifically to Vehicle 314 and Vehicle 321. They are to be first made available to Water and Sewer sections. It also refers to their replacements, because those vehicles are now in the "truck grave' due to this Letter of Understanding being from 1992. Mr. Wilson stated that neither of these vehicles were used, nor their successors. They used an unassigned vehicle due to their priorities. If they took an individual out of a neighborhood and park the snow truck and have the individual work on the water main break, it would have meant snow plowing services being interrupted. They didn't want to do that. Ms. Mahoney said assuming Mr. Wilson had decided to move Mr. Legg over to the water break; he would have had to call somebody in to drive the snow truck. Mr. Wilson replied it was a timing issue and there was already someone working that could handle it over in the Water section. So rather than interrupting snow plowing services, they handled it in this fashion. Mr. Tatigian identified that unlike the previous grievance where the six (6) employees did not do the work, this man did work and he was being penalized because he was on snow plowing instead of going out where he was qualified to work, that is, on the water break. He also stated that he could have worked another hour -and -a -half. Mr. Wilson indicated that was the contention, because the water main break went an hour -and -a -half longer than his "B" shift. Mr. Wilson believed that was Management's right and ability to prioritize and assign these employees. Mr. Tatigian understood that was his ability, but Mr. Wilson could have assigned Mr. Legg right off the bat to do the work. Mr. Biga inquired who was called in to run the dump truck in the Water Department, and Mr. Wilson replied it was Brian Molnar, Water Meter Repairer I. Mr. Biga also inquired if he was qualified to operate that particular vehicle. Mr. Wilson advised that Mr. Molnar has a CDL and was checked out. Mr. Biga further inquired if Mr. Molnar worked the snow emergency and Mr. Wilson advised he did not. Mr. Biga clarified that Mr. Legg had opted to be part of the snow emergency and he was already working his assigned twelve (12) hour shift when the other emergency arose while he was operating. The Union alleged that a successor vehicle to 314 and 321 was used for the water break. Mr. Biga also clarified that Mr. Wilson indicated an Page 18 1258'" Regular Meeting March 18, 2009 unassigned vehicle from the Water Department was used. Mr. Biga asked if Mr. Legg's assigned vehicle was utilized and Mr. Wilson replied that it didn't have a plow so it was parked. Mr. Wilson stated this wasn't Mr. Legg's truck. Mr. Biga stated the Letter of Understanding doesn't apply. The successor to these two (2) vehicles was not used. What the Department did was that it operated within the manpower it had available for the emergency and took someone from their own unit to work and put him on a piece of equipment that was unassigned so there was no one adversely impacted. Mr. Legg may or may not have been called in to work, he was already assigned. Ms. Mahoney inquired if in 1992 we only had three (3) trucks. What she heard Mr. Wilson saying was there are trucks 314, 315, 321 and/or their successors, but some others. Mr. Wilson said they only have three (3) Water Department trucks. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was 09-99 RESOLVED, That having reviewed AFSCME Union Local 192 Grievance #09-04, dated January 16, 2009, from Herman Legg, Equipment Operator II, regarding overtime, and having discussion with Charles Locke, President, AFSCME Union Local 192 and Brian Wilson, Superintendent of Public Service, the Civil Service Commission does hereby grant the grievance to approve the payment of one and one-half (1-%) hours of overtime to Mr. Legg.
