HomeMy WebLinkAbout1279th CSC Meeting (December)1279" REGULAR MEETING OF THE CIVIL SERVICE COMMISSION The 1279th Regular Meeting of the Civil Service Commission was held on Wednesday, December 8, 2010. The meeting was called to order at 5:30 p.m. Members Present: Charlotte S. Mahoney, Chairperson Harry C. Tatigian Ronald E. Campau Also Present: Robert F. Biga, Human Resources Director Derrick L. Washington, Personnel Analyst II Gretchen Guisbert, Secretary III Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 10-419 RESOLVED, That the minutes of the 1278" Regular Meeting held Wednesday, November 17, 2010, be approved as submitted. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 10-420 RESOLVED, That having reviewed the Departmental Correspondence of November 9, 2010 from Timothy Chalk, Senior Police Officer, as approved for submission by Robert Stevenson, Police Chief, requesting to carry over vacation days in excess of the maximum allowed by contract, based on a projected retirement date of November 9, 2013, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee is advised of the maximum number of days to be paid off at retirement as cited in the Livonia Police Officers Association Contract, Article 22.7, Vacation Accrual, and as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), Paragraph (f); AND BE IT FURTHER RESOLVED, that the employee is advised that the maximum number of days will be increased by the number of bonus vacation days earned in the last three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of nine (9) days; AND BE IT FURTHER RESOLVED, that the employee is notified it is the employee's responsibility to manage his vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. 10-421 RESOLVED, That having reviewed the Departmental Correspondence of November 16, 2010, from Nicholas Kerchoff, Senior Police Page 2 127M Regular Meeting December 8, 2010 Officer, as approved for submission by Robert Stevenson, Police Chief, requesting to carry over vacation days in excess of the maximum allowed by contract, based on a projected disability retirement date in 2011, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee is advised of the maximum number of days to be paid off at retirement as cited in the Livonia Police Officers Association Contract, Article 22.7, Vacation Accrual, and as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), Paragraph (f); AND BE IT FURTHER RESOLVED, that the employee is advised that the maximum number of days will be increased by the number of bonus vacation days earned in the last three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of nine (9) days; AND BE IT FURTHER RESOLVED, that the employee is notified it is the employee's responsibility to manage his vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. 10-422 RESOLVED, That having reviewed the Departmental Correspondence of October 22, 2010, from Barbara Scherr, Assistant City Attorney, as approved for submission by Donald Knapp, City Attorney, requesting to carry over vacation days in excess of the maximum allowed by contract, based on a projected retirement date of October 22, 2013, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee is advised that maximum number of days to be paid off at retirement is fifty-one (51), as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), paragraph (f); AND BE IT FURTHER RESOLVED, that the maximum number of days will be increased by the number of bonus vacation days earned in the last two (2) out of three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of six (6) days; AND BE IT FURTHER RESOLVED, that the employee is notified that it is the employee's responsibility to manage her vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. 10-423 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for Account Clerk I (931 o.c.). Page 3 1219th Regular Meeting December 8, 2010 The Commission received and fled the following: Status of Temporary Employees Report for November 2010. Non -Resident Report as of December 1, 2010. Current Open -Competitive and Promotional Eligible Lists as of December 1, 2010. Affirmative Action Report for November 2010. Removal of names from active eligible list report for the month of November2010. Nochanges. Council Resolutions from the meeting of November 17, 2010, with minutes to be approved December 1, 2010: #404-10, authorizing an agreement on behalf of the City of Livonia to execute a contract with Hartford Insurance Company to provide life insurance and accidental death and dismemberment coverage for a three year period ending November 30, 2013. City of Livonia — and — Michigan AFSCME Council 25 MERC Case No. C07 G-156 Decision and Order. Letters of November 30, 2010, to AFSCME Union Locals 192 and 1917 regarding the City's intention to terminale the respective bargaining agreements effective midnight November 30, 2010. 10-424 RESOLVED, That having reviewed the expiring eligible lists for the month January 2011 — Chief Accountant (926 o.c.), Police Service Aide (927 o.c.), Sign Maintenance Worker 1 (1287 p.) and Water Meter Repairer 1 (1297 p.), the Civil Service Commission does hereby affirm the administrative approval of the extension of the Police Service Aide (927 o.c.) eligible list for six (6) months to July 22, 2011. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 10-425 RESOLVED, That having reviewed the letter of December 6, 2010, from Brian Wilson, Superintendent of Public Services, and Kevin Maillard, Director of Public Works, requesting an extension of unpaid medical leave of absence for Louis Rivas, Water Meter Repairer 11, the Civil Service Commission does hereby approve Mr. Rivas' request for an extension of an unpaid medical leave of absence beginning December 23, 2010 through January 31, 2011; with the understanding that Mr. Rivas is responsible during the unpaid leave to pay any copayment for his medical insurance; AND BE IT FURTHER RESOLVED, that should Mr. Rivas not return to work for at least thirty (30) calendar days after the approved extension of the unpaid medical leave of absence, he will reimburse the City of Livonia for any costs for benefits paid for Mr. Rivas during his time off, in accordance with Section 25.6(c), Insurance Premium Payments, of the Civil Service Commission Rules and Regulations. Page 1219th Regular Meeting December 8, 2010 AND BE IT FURTHER RESOLVED, that this action constitutes the final extension of an unpaid medical leave of absence for Mr. Rivas and this approval is not precedent setting. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 10-426 RESOLVED, That having reviewed the letter of December 1, 2010, from Debra Seeman, Account Clerk III, as approved for submission by Michael Slater, Director of Finance, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby approve Ms. Seeman's request for an unpaid medical leave of absence not to exceed ninety (90) calendar days, beginning December 4, 2010 through March 3, 2011, with the understanding that Ms. Seeman is responsible during the unpaid leave to pay any copayment for her medical insurance; AND BE IT FURTHER RESOLVED, that should Ms. Seeman not return to work for at least thirty (30) calendar days after the approved ninety (90) day unpaid medical leave of absence, she will reimburse the City of Livonia for any costs for benefits paid for Ms. Seeman during her time off, in accordance with Section 25.6(c), Insurance Premium Payments, of the Civil Service Commission Rules and Regulations. On behalf of the Civil Service Commission, Chairperson Mahoney wished everyone a Happy Holiday.
