MINUTES OF THE ONE THOUSAND EIGHT HUNDRED AND EIGHTY-NINTH
REGULAR MEETING OF JANUARY 27, 2020
On January 27, 2020, the above meeting was held at the City Hall, 33000
Civic Center Drive, Livonia, Michigan, and was called to order by President
Kathleen McIntyre at 7:00 p.m. Councilmember Cathy White led the meeting in
the Pledge with Boy Scout Troop 782.
Roll was called with the following result: Cathy White, Brandon
McCullough, Rob Donovic, Jim Jolly, Laura Toy, Scott Bahr and President
Kathleen McIntyre.
Elected and appointed officials present: Mark Taormina, Director of
Planning and Economic Development; Dave Lear, Assistant City Engineer; Paul
Bernier, City Attorney; Susan M. Nash, City Clerk; Dave Heavener, Fire Chief;
Judy Priebe, Director of Legislative Affairs; and Dave Varga, Director of
Administrative Services.
On a motion by Toy, supported by White, and unanimously
adopted, it was:
#18-20 RESOLVED, that the minutes of the 1,888th
Regular Meeting of Council held January 15, 2020 are
approved as presented.
The President declared the resolution adopted.
Councilmember McCullough wished his wife a Happy Birthday.
Vice President Bahr sent birthday greetings to his son Caden.
Councilmember Donovic stated he wanted to recognize a high school teacher
who is in the audience tonight, Mr. Demarco, who was his teacher, JV football
coach, driver’s ed instructor, who he hasn’t seen in a long time and it was nice to
see him here tonight.

President McIntyre stated there is New Data on Item No. 8.
During Audience Communication, James Jackson, Commander of Flotilla 1805
of the United States Coast Guard Auxiliary, came to the podium to address
Council. He first asked the members of the Coast Guard Auxiliary who were in
the audience to stand and be recognized. He then gave a dissertation of what
services the Coast Guard Auxiliary provides on a volunteer basis, being first
established in 1939 by an Act of Congress as the U.S. Coast Guard Reserves,
and re-designated the Auxiliary in 1941. Today they are 26,000 strong and they
donate millions of hours in support of Coast Guard missions. As they support all
of these missions, they become a force multiplier, extending the resources and
reach of our active duty shipmates in our area. Collectively the Auxiliary
contributes over 3.8 million hours of service each year and has completed nearly
500,000 missions in service to support the Coast Guard. Every year Auxiliarists
help to save approximately 500 lives, assist 15,000 distressed boaters, conduct
over 150,000 safety examinations on recreational vessels and provide boater
safety instruction to over 500,000 students. In total the Coast Guard Auxiliary
saves taxpayers hundreds of millions of dollars each year. Last year the Coast
Guard Auxiliary celebrated 80 years of service to the Coast Guard and to the
nation. Here in Livonia, their Flotilla has celebrated over 25 years of service and
to the community. The Flotilla is the basic organizational unit of the Auxiliary and
carries out the day to day missions of Team Coast Guard. That is what brings
me here this evening. The intent of my visit here tonight is to start what I hope
will be a new annual tradition for our unit and with two primary objectives. First
and foremost, on behalf of the 53 men and women of Flotilla 1805, he’d like to
thank the City of Livonia for being our host and the home of our unit for over 25
years. We truly appreciate the hospitality of the Livonia Senior Center where we
meet. The management of the Center has been extremely accommodating to
us through the years. Last year, that hospitality was extended further when they
provided us space at the center to set up our unit’s quarter deck. In the C-
services, the quarter deck is an area neither shore side or afloat where all of the
unit awards, citations, and commendations are displayed for the public to see. If
you visit the Senior Center, be sure to check out 1805’s quarter deck. I’d also
like to thank the Livonia Police Department for providing a space to hold our
boating safety classes. Over the years, we’ve provided boating instruction to
hundreds of beginning and seasoned recreational boaters. We’d also like to
thank Councilwoman Toy for joining us last year at our annual Flotilla picnic
where she shared kind and inspiring words on behalf of the City. The second
objective of my visit is to highlight for you some of our local initiatives and unit
achievements. For the past several years we participate in Livonia’s Passport to
Safety Event, along with our active duty shipmates we’ve been able to share
important boating information as well as provide an opportunity for members of
the community to climb on board an actual Coast Guard Response Boat. As
previously mentioned, we have provided boating instructions to hundreds of
recreational voters from Livonia and the Greater Metropolitan Area. The next one
is scheduled for February 22, 2020 at the Livonia Police Station. The members
of 1805 are also engaged in several key Coast Guard missions, including surface

operations on the Detroit River, air operations, incident management, and search
and rescue. We also provide free vessel safety inspection for local boat owners.
I’m proud to report that our Flotilla has been awarded the Coast Guard
Bicentennial Unit Commendation, Presidential Unit Citation, Coast Guard Unit
Commendation, and Meritorious Flotilla Commendation. In addition to that, we
were named 2019 Flotilla of the Year by our division. For more information about
upcoming classes, requesting a free vessel safety check or even learning more
about the Auxiliary you can go to our national website which is www.cgaux.org.
We’re always looking for perspective shipmates ready to serve. Looking forward
we plan to continue to be an active member of the Livonia community and look
for more opportunities to expand our involvement in local events. As I close, I
want to again thank you for your support of our Flotilla and our mission. Thank
you for continuing to be our partner as we promote recreational boating safety
here in Livonia as well as out on the water. The Coast Guard’s core values are
honor, respect and devotion to duty. You can be assured that the Coasties of
Flotilla 1805, your hometown Coast Guard, will always live by and display those
values as we stand the watch and make the City proud. Thank you all for your
time and attention.
Councilmember White asked Jackson and the members of his Flotilla, with all of
the hours of experience that you have, if you could give one piece of advice to
the recreational boaters, the swimmers, those folks in our community, what
would it be.
Jackson replied first and foremost is wear a lifejacket. That’s probably the one
thing that we stress the most. Most of the fatalities out on the water are due to
the fact that the person in the water did not have on a lifejacket.
Councilmember White stated she can attest to the importance of that because
she took sailing lessons this summer on the Detroit River and one of our sailors
fell out of the boat and fortunately had a life vest on, and we do have boats that
circle the students to make sure that if anything happens they can go and grab
somebody out of the water so they did that. But the fact that he had a life vest
on I think was extremely important.
Jackson said it is extremely important, yes, ma’am.
President McIntyre thanked Jackson for choosing Livonia and for his volunteer
service which reaches far and wide and especially for his participation every year
in Passport to Safety. That’s a fantastic program, it draws hundreds and
hundreds of local families and the effort that you make in bringing a Coast Guard
vessel there for families and kids to see, adds a lot to the excitement of the day
and a lot of good education. She then asked him to keep Council apprised of
their local events so that they may participate in them.

City Clerk, Susan M. Nash, stated she would like the residents to know that this
week they’ll be mailing out the first round of absentee ballots for the March
Presidential Primary. But she really wants to let people know that there are new
envelopes. The State of Michigan, Bureau of Elections changed the envelopes
and she wants people to be aware of what they’re looking for. The new
envelopes now are white with a blue block on the side, they are no longer the
manilla envelope, so please keep an eye out. If you’ve requested a ballot, this
is what it will be in now and then the return envelope that is inside clearly says
return envelope, it is white with a green block and it has all the instructions on it
for you. Again, please keep an eye out, the first batch of ballots goes out this
week and then we’ll be continuing to mail up until the Friday prior to the Election.
Also, this week the Livonia Magazine will be coming out. Inside the magazine I
have put in a tear out page, you can go ahead and fill that out and you can
request to be put on the permanent absentee ballot application list. You can
copy this or write it down and just drop it off at the Clerk’s office and then we can
send you out an application. For every election we have to have a signed
absentee ballot application for every election. So this does not stop you from
having to sign an application, but this does get you on the list so you will be able
to get an application mailed to your house. Thank you, Madam President, for
allowing me to say that, I just wanted to let the residents know the new stuff that
is coming out.
President McIntyre asked for a clarification of the permanent absentee list. If
people requested an absentee ballot in the last election which was our first
election for no reason absentees, are you automatically on the permanent?
Clerk Nash replied only if you requested to be put on the permanent absentee
list, that’s correct. McIntyre then expounded on her question by asking just by
requesting a no reason absentee ballot at the last election does not put you on
the permanent list and Clerk Nash replied that’s correct. Nash went on to state
that once you’re on the permanent list, again, that says that you’re going to get
an application, we have to have a signed application by law for every election.
So you can have one for the August primary and can indicate you want one for
the November General as well.
President McIntyre thanked Clerk Nash for sharing the information and asked
what the date of the election is and Nash replied the Presidential Primary is

March the 10 and they will be mailing absentee ballots up until the Friday before

the election and the office will be open Saturday, March 7 for election purposes
only.
On a motion by Bahr, supported by Toy, it was:
#19-20 RESOLVED, that having considered a communication from
Robert H. Rais, Knights of Columbus, dated January 2, 2020, which
requests permission to waive Section 8.32.070 (Noise Control) of the
Livonia Code of Ordinances, as amended, to allow a car show with a DJ

at Saint Colette’s Catholic Church, 17600 Newburgh Road, on Saturday,
June 6, 2020, from 9:00 a.m. to 3:00 p.m., the Council does hereby grant
permission as requested.
#20-20 RESOLVED, that having considered a communication from
the Fire Chief, dated January 2, 2020, which bears the signature of the
Director of Finance and is approved for submission by the Mayor, to which
is attached a proposed Billing Service Agreement between the City of
Livonia and AccuMed Billing, Inc., the Council does hereby accept the
proposal submitted by AccuMed Billing, Inc., PO Box 2122, Riverview, MI
48192, to perform emergency medical transportation billing services for a
period of five (5) years at the rate of 5.9% of each bill collected, such costs
to be expended from funds already budgeted in Account No. 101-336-
818-336 for this purpose; FURTHER, the Livonia Fire Department has
contracted for professional services for Emergency Medical
Transportation billing services with AccuMed Billing Inc. since 2014, and
it is imperative that a) the City partner with a company who utilizes best
practices with regard to data collection, customer service, cash handling,
and training, and b) a cohesive relationship remains intact to ensure the
highest quality of patient care while providing the consistent platform to
enhance efficiency; FURTHER, AccuMed is proposing to reduce the cost
they charge from 6.4% of the amount collected to 5.9%, and this reduced
rate represents an approximate savings of $139,000 over the term of the
contract; and the Mayor and City Clerk are hereby authorized, for and on
behalf of the City of Livonia, to execute a contract with the aforesaid
company, subject to approval as to form and substance by the
Department of Law, and to do all other things necessary or incidental to
the full performance of this resolution; FURTHER, the Council does
hereby authorize the action herein without competitive bidding in
accordance with the provisions set forth in Section 3.04.140(D)(2)(a) of
the Livonia Code of Ordinances, as amended.
#21-20 RESOLVED, that having considered a communication from
the Superintendent of Parks and Recreation, dated January 2, 2020,
which bears the signature of the Director of Finance and is approved for
submission by the Mayor, the Council does hereby accept the unit price
bids of the following companies for supplying the Parks and Recreation
Department with clothing for the 2020 and 2021 Fiscal Years as indicated
on the attachment to the aforesaid communication, the same having been
the lowest bid submitted for each item listed and meets all specifications:

FURTHER, the Council does hereby authorize such purchases from funds

040 for this purpose.
#22-20 RESOLVED, that having considered the report and
recommendation of the Superintendent of Parks and Recreation, dated
January 2, 2020, which bears the signature of the Director of Finance and

is approved for submission by the Mayor, the Council does hereby accept
the bid of Aquatic Source L.L.C., 190 Summit St., Brighton, MI 48116, for
performing all work required in connection with the Botsford Pool Pump
replacement in an amount not to exceed $29,635.96, the same having
been in fact the lowest bid received and meets all specifications;
FURTHER, the Council does hereby authorize the expenditure of a sum
not to exceed $29,635.96 from funds already budgeted in Account No.
208-720-987-000 for this purpose; and the Mayor and City Clerk are
hereby authorized to execute a contract, subject to approval as to form
and substance by the Department of Law, for and on behalf of the City of
Livonia, with the aforesaid bidder and to do all things necessary or
incidental to the full performance of this resolution.
#23-20 RESOLVED, that having considered the report and
recommendation of the Chief of Police, dated January 1, 2020, which
bears the signature of the Director of Finance, is approved as to form by
the City Attorney and is approved for submission by the Mayor, the
Council does hereby accept the bid of Upright Fence, 37915 Ford Road,
Westland, MI 48185, for performing all work required in connection with
the purchase and installation of perimeter security fencing for the Public
Safety Complex of the Police Department in an amount not to exceed
$242,790.00; FURTHER, the Council does hereby reject the bids
submitted by Action Traffic and Motor City Fence for the reason that a
committee from the Police Department identified areas of concern
pertaining to prior experience and warranty of product; FURTHER, the
Council does hereby authorize an expenditure in an amount not to exceed
$242,790.00 from funds already budgeted in Account No. 401-000-987-
000 (Capital Outlay – Other) for this purpose; and the Mayor and City
Clerk are hereby authorized for and on behalf of the City of Livonia to
execute a contract with Upright Fence, approved as to form and
substance by the Department of Law, and to do all things necessary or
incidental to the full performance of this resolution.
#24-20 RESOLVED, that having considered the report and
recommendation of the Chief of Police, dated January 2, 2020, which
bears the signature of the Director of Finance, is approved as to form by
the City Attorney and approved for submission by the Mayor, the Council
does hereby accept the quote of Dell, Inc., One Dell Way, Mail Stop 8129,
Round Rock, TX 78682, for the purchase of forty (40) Dell Precision 3630
Tower Desktop Workstations, for a total amount not to exceed
$36,337.60, to replace approximately 50% of the current workstations
which are out of warranty and at the end of their life expectancy, and
replacement parts are no longer available; FURTHER, the Council does
hereby authorize an expenditure in an amount not to exceed $36,337.60
from funds already budgeted in the Police Data Processing (Capital
Outlay Minor) Account No. 101-306-971-000 for this purpose; FURTHER,
the Council does hereby determine to authorize the said purchase without

competitive bidding inasmuch as the same is based upon the low State of
Michigan Contract Pricing Bid under Contract No. 071B6600111 for the
new purchase, and such action is taken in accordance with the provisions
set forth in Section 3.04.140.D.4 of the Livonia Code of Ordinances, as
amended.
A roll call vote was taken on the foregoing resolutions with the following
result:

White took from the table, for second reading and adoption, the following
Ordinance:
AN ORDINANCE AMENDING SECTION 020 AND 070 OF TITLE
8, CHAPTER 40 (NOXIOUS WEEDS AND REFUSE) OF THE
LIVONIA CODE OF ORDINANCES, AS AMENDED.
A roll call vote was taken on the foregoing Ordinance with the following result:
AYES: White, McCullough, Donovic, Jolly, Toy, Bahr and McIntyre
NAYS: None
The President declared the foregoing Ordinance duly adopted, and would
become effective on publication.
A communication from the Director of Finance, dated January 20, 2020,
re: delinquent water bill balance for 19265 Victor Parkway, was received and
placed on file for the information of the Council.
A communication from Anthony G. Antone, Esq., Executive Vice
President, Kojaian Management Corporation, dated January 20, 2020, was
received and placed on file for the information of the Council.

On a motion by Toy, supported by Donovic, it was:
#25-20 WHEREAS, pursuant to Act No. 210 of the Public Acts of
2005, as amended, this Council has the authority to establish commercial
rehabilitation districts within the boundaries of the City of Livonia; and
WHEREAS, a proposal was made by Paul F. Bohn, Fausone Bohn, LLP,
on behalf of Livonia Hotel Group, LLC, regarding the establishment of a
commercial rehabilitation district encompassing land situated in the City
of Livonia and comprised of an area of approximately 3.206 acres lying in
the Southeast ¼ of Section 6, as more particularly described in Exhibit A,
incorporated by reference herein, which area is hereinafter referred to as
"City of Livonia Commercial Rehabilitation District No. 5"; and
WHEREAS, written notice has been given by certified mail to Paul F.
Bohn, Fausone Bohn, LLP, on behalf of Livonia Hotel Group, LLC, of the
Council's pending action on this resolution and of said petitioner’s right to
a hearing on the establishment of proposed City of Livonia Commercial
Rehabilitation District No. 5; and
WHEREAS, notice has been given to all interested owners, residents and
taxpayers in the Livonia area of a public hearing on the establishment of
the proposed City of Livonia Commercial Rehabilitation District No. 5; and
WHEREAS, on January 8, 2020 a public hearing was held on the
establishment of proposed City of Livonia Commercial Rehabilitation
District No. 5, at which time Paul F. Bohn, Fausone Bohn, LLP, on behalf
of Livonia Hotel Group, LLC, and other taxpayers and residents of the City
of Livonia had an opportunity to be heard (a copy of the statements both
written and oral made at such hearing being on file with this City Council),
attended said hearing and acknowledged receipt of notice of such hearing
on behalf of the said corporation; and
WHEREAS, the aggregate SEV of real and personal property exempt
from ad valorem taxes within the City of Livonia after granting the
establishment of proposed City of Livonia Commercial Rehabilitation
District No. 5 will not exceed 5% of an amount equal to the sum of the
SEV of the unit, plus the SEV of personal and real property thus
exempted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
LIVONIA, AS FOLLOWS:
1. A Commercial Rehabilitation District is hereby established, such
district to consist of the area described in Exhibit A.

2. Such Commercial Rehabilitation District is hereby designated as the
"City of Livonia Commercial Rehabilitation District No. 5."

3. It is hereby determined that the subject property meets the statutory
requirement of functional obsolescence.
4. The City Assessor has submitted a statement showing the SEV of the
property, which indicates that the 2020 SEV of the property is:
19265 Victor Parkway $838,600.00
5. That the City Council, on the basis of the information received from the
applicant, Livonia Hotel Group, LLC, finds and determines that the
granting of this Commercial Rehabilitation District shall not have the
effect of substantially impeding the operation of the local governmental
unit or impairing the financial soundness of any taxing unit which levies
an ad valorem property tax in the local governmental unit in which the
facility is to be located.
Following discussion by Council, a roll call vote was taken on the foregoing
resolution with the following result:

On a motion by Toy, supported by Jolly, and unanimously adopted, it was:
#26-20 RESOLVED, that having considered a communication from
the Director of Community Resources, dated January 7, 2020, which
bears the signature of the Director of Finance and is approved for
submission by the Mayor, the Council does, for and on behalf of the City
of Livonia, accept various gifts and cash donations in the amount of
$11,570.66 from the sources indicated therein; FURTHER, the Council
does hereby appropriate and credit the amount of $504.00 to Account No.
702-285-219 (Emergency Services); credit $580.00 to Account No. 702-
285-214 (Youth Commission Trust); credit $300.00 to Account No. 724-
000-690-010 (Arts Commission Contribution/Gift/Donations; credit
$2,811.66 to Account No. 723-000-690-010 (Historical Commission
Contributions-Donations); credit $6,000.00 to Account No. 702-285-135
(Greenmead Restoration), and credit $1,375.00 to Account No. 702-285-

216 (Senior Citizen Programs), representing the total cash donation, for
the purposes designated by the donors.
On a motion by Jolly, supported by Bahr, and unanimously adopted, it
was:
#27-20 RESOLVED, that upon the request of Councilmember Jim
Jolly at the Study Meeting held January 15, 2020, the Council does hereby
refer to the Department of Law the preparation of a proposed ordinance
to enable the participation in meetings of City Council and the various
boards and bodies of the City by members of same who are absent due
to military duties outside the City.
President McIntyre announced there will be a Public Hearing being held in the
Auditorium of City Hall, 33000 Civic Center Drive, Livonia, MI on Wednesday,
February 12, 2020 at 7:00 p.m. on the following matter:
PETITION 2019-12-01-07 submitted by Unleashed Pet Care Real Estate,
L.L.C., requesting to rezone the property located on the east side of
Middlebelt Road between Joy Road and West Chicago Avenue (9300
