HomeMy WebLinkAbout2020-12-02 41514 REV. 12-10-20 MINUTES OF THE ONE THOUSAND NINE HUNDRED TENTH REGULAR MEETING OF DECEMBER 2, 2020 On December 2, 2020, the above meeting was called to order via remote Zoom technology by President Kathleen McIntyre at 7:00 p.m. Councilmember Jim Jolly led the meeting in the Pledge of Allegiance. Roll was called with the following result: Jim Jolly (Livonia, Michigan), Laura Toy (Livonia, Michigan), Scott Bahr (Livonia, Michigan), Cathy White (Lehigh Acres, Florida); Brandon McCullough (Livonia, Michigan), Rob Donovic (Arrived 7:05) (Deployed); and President Kathleen McIntyre (Livonia, Michigan). Absent: None. Elected and appointed officials present: Mark Taormina, Director of Planning and Economic Development; Dave Lear, Assistant City Engineer; Paul Bernier, City Attorney; Susan M. Nash, City Clerk; Lynda Scheel, Treasurer; LaShawn Thomas, Director of Governmental Affairs; Sara Kasprowicz, Administrator of Council Office; Casey O'Neil, Director of Information Systems; Ted Davis, Superintendent of Parks and Recreation; and Jacob Rushlow, Superintendent of Public Service. On a motion by Bahr, supported by Jolly, and unanimously adopted, it was- #348-20 RESOLVED, that the minutes of the 17909th Regular Meeting of Council held November 16, 2020 are approved as presented. Councilmember Jolly announced the retirement of Senior Police Officer Richard Ostrowski who has served 23 years with the Livonia Police Department and wished him well and thanked him for his service. President McIntyre announced there is New Data on Item No. 13. 41515 Regular Meeting Minutes of December 2, 2020 She then wished former Mayor Dennis Wright a happy birthday coming up on December 13th Ted Davis, Superintendent of Parks and Recreation, stated that at this time of year they would normally be gearing up for the City's Annual Holiday Parade. Unfortunately, with the current Health and Human Services guidelines, that event will not take place. There are some events going on in other areas such as the sold out event at Greenmead this Saturday, and "Night of Lights" will be at Greenmead in the evening from 5:00 p.m. to 8:00 p.m. on December 5th 6th 12th 13th and the 20th. There is also a contest "Light up Livonia" which was orchestrated by Councilmembers Jolly and McCullough, where homeowners and businesses can decorate, there will be an interactive GIS map available for everyone if you would like to register your home or business, you can do that at the Parks and Recreation website. Councilmember Cathy White, as Parliamentarian of Council, went over the rules of order for Audience Communication. During Audience Communication Connie Dickey brought up the subject of leaf pickup and excessive cars on Rayburn causing failed pick-ups. On a motion by Jolly, supported by Toy, it was- #349-20 RESOLVED, that upon the motion by Councilmember Jim Jolly, seconded by Councilmember Laura Toy, at the Regular Meeting held December 2, 2020, the Council does hereby refer the subject matter of parking restrictions during the period of bulk leaf pickup to the Department of Law for its report and recommendation. A roll call vote was taken on the foregoing resolution with the following result: AYES: Jolly, Toy , McCullough and Donovic NAYS: Bahr, White and McIntyre The President declared the resolution adopted. Dena Hallas also discussed leaf pickup on Rayburn and continued noise issues at Planned Parenthood. A communication from the Department of Finance, dated November 9, 2020, re: forwarding various financial statements of the City 41516 Regular Meeting Minutes of December 2, 2020 of Livonia for the month ending September 30, 2020, was received and placed on file for the information of the Council. On a motion by McCullough, seconded by Jolly, it was- #350-20 WHEREAS, Wayne County and its communities are at risk of natural, technological and human hazards; and WHEREAS, the Disaster Mitigation Act of 2000 requires communities to have a five year Hazard Mitigation Plan approved by the Federal Emergency Management Agency (FEMA) in order to receive funds made available through certain mitigation grant programs; and WHEREAS, the Wayne County Hazard Mitigation Plan, prepared in cooperation with the Wayne County communities, identifies the hazard threats to the County and feasible mitigation projects to minimize hazard impacts; and WHEREAS, the contents of the Hazard Mitigation Plan were reviewed by, and eceived input from, residents and local officials representing the local units of government within Wayne County. THEREFORE BE IT RESOLVED, that the City of Livonia City Council hereby adopts the Wayne County Hazard Mitigation Plan dated September 14, 2020, pursuant to the Code of Federal Regulations, Title 44, Chapter 1, Subchapter D, Part 201, Section 201.6.c.5. #351-20 RESOLVED, that having considered a communication from the Department of Assessment, bearing the signatures of the Planning Director and the City Engineer, dated October 28, 2020, and approved for submission by the Mayor, with regard to a request from Jeffrey Joyce, 11316 Merriman Road, Livonia, MI 48150, and in accordance with the provisions of 1967 PA 288, as amended, as well as Code of Ordinances Section 16.32.030 and Section 18.46 of Ordinance No. 543, both as amended, the Council does hereby approve of the proposed division of Tax Item No. 138-99-0058-000, located on the east side of Merriman Road, between West Chicago and Plymouth Roads, in the northwest '/4 of Section 35, 11316 Merriman Road, into two (2) parcels, the legal descriptions of which shall read as follows: PARCEL A (11316 Merriman) Part of the Northwest quarter of Section 35, Town 1 South, Range 9 East, City of Livonia, Wayne County, Michigan, described as: commencing at the Northwest quarte corner of Section 35; thence along the West line of Section 35 and the centerline of Merriman Road due South 595.00 feet; 41517 Regular Meeting Minutes of December 2, 2020 thence South 89 degrees 58'45" East 60.00 feet to the point of beginning; thence continuing South 89 degrees 58'45" East 226.00 feet; thence due South 90.00 feet; thence North 89 degrees 58'45" West; thence due North 90.00 feet to the point of beginning. Lot contain 20,340 square feet or 0.467 acres, subject to easements and restrictions of record. the map attached to the aforesaid communication which is made a part hereof by reference; FURTHER, in accordance with Section 16.32.030 of the Livonia Code of Ordinances, as amended, and Section 18.46 of Zoning Ordinance No. 543, as amended, the Council does hereby waive the minimum lot area requirement set forth in Zoning Ordinance No. 543, as amended, with respect to this property division, and does hereby find that 1) the proposed lots substantially comply with the lot width requirement, and 2) the proposed lots would be consistent with the size, shape and width of lots existing in the vicinity; and the City Clerk is hereby requested to cause a certified copy of this resolution to be recorded in the Office of the Wayne County Register of Deeds. #352-20 RESOLVED, that having considered the report and recommendation of the Director of Inspection, dated October 20, 20207 which bears the signature of the Director of Finance and is approved for submission by the Mayor, the Council does hereby accept the bid of Graphic Services, 1551 East Lincoln St., Madison Heights, MI 48071 to provide building plan scanning services into electronic media in an amount not to exceed $79,280.47, for use by the Inspection Department to retain the building plans in accordance with the rules and regulations of the State of Michigan and to avoid losing the paper history files due to unfortunate events; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $79,280.47 from funds already budgeted in Account No: 401-000-971-000 (Capital Outlay — Minor) for this purpose; FURTHER, the Council does hereby determine to authorize the said purchase without competitive bidding inasmuch as the same is based upon the low State of Michigan extended purchasing program under Contract #071-180000000749; and no advantage to the City would result from competitive bidding, and 41518 Regular Meeting Minutes of December 2, 2020 such action is taken in accordance with the provisions set forth in Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended., FURTHER, the Director of Inspection is hereby authorized to approve minor adjustments in the work as it becomes necessary but this authorization does not entitle the Director of Inspection to authorize any increase in the not to exceed amount or to contract with other parties. #353-20 RESOLVED, that having considered a communication from the Fire Chief, dated November 4, 2020, which bears the signature of the Director of Finance and is approved for submission by the Mayor, the Council does hereby authorize the purchase of one (1) 2020 Life Line Type-1 Superliner Ambulance on a 2020 Ford F-450 XLT Chassis, from R & R Fire Truck, 751 Doheny Drive, Northville, MI 48167 (Representative of Life Line emergency vehicles, 1 Lifeline Drive, PO Box 299, Sumner, IA 50674), for a total amount not to exceed $226,902.00, to replace a current frontline ambulance which is a 2011 model with 104,340 miles which will be downgraded to reserve squad status and from trade-in of a 2006 Freightliner ambulance that is no longer in proper working order for emergency response; FURTHER, an amount not to exceed $226,902.00 is hereby authorized to be expended from funds already budgeted for this purpose in Account No. 101-338-985-000 (Capital Outlay-Vehicles); FURTHER, the Council does hereby authorize said purchase without competitive bidding inasmuch as the same is being purchased through the Houston- Galveston Area Council (HGAC-Buy) cooperative purchasing consortium, pursuant to Council Resolution 61-17, adopted on February 27, 2017, and such action is taken in accordance with the provisions set forth in Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended. #354-20 RESOLVED, that having considered a communication from the Director of Public Works, dated November 3, 2020, which bears the signature of the City Attorney and is approved for submission by the Mayor, the Council does hereby authorize the Mayor and City Clerk to renew a five (5) year service agreement, for the period December 15, 2020 to December 14, 2025, with an automatic five-year extension, with Sensus USA, 8537 Six Forks Road, Suite 400, Raleigh, NC 27615, for supplying the Public Service Division with software and equipment to obtain remote water meter reads, with said funding for the software, monitoring and training provided through the City of Livonia's agreement with Etna Supply Company, 1090 36th Street SE, Suite 630, Grand Rapids, MI 49548, pursuant to CR #79- 19, adopted on March 11, 2019; and the Mayor and City Clerk are hereby authorized for and on behalf of the City of Livonia to execute a contract with Sensus USA, approved as to form and substance by the Department of Law, and to do all things necessary or incidental to the full performance of this resolution. 41519 Regular Meeting Minutes of December 2, 2020 #355-20 RESOLVED, that having considered the report and recommendation of the City Engineer, dated October 28, 2020, which is approved by the Director of Public Works, approved as to form by the City Attorney and approved for submission by the Mayor, with regard to a request from MCM 12001 Farmington, LLC, in conjunction with the construction of a storm drainage system that provides adequate drainage for property developed at 11999 and 12001 Farmington Road, Livonia, Michigan, the Council does hereby determine as follows: 1. To accept on behalf of the City of Livonia, the jurisdiction and maintenance of the storm sewer within the property located north of Plymouth Road, west of Farmington Road, in the S.E. '/4 of Section 28, for Quality Metalcraft, which accommodates storm water from property developed at 11999 and 12001 Farmington Road, with the maintenance agreement from the proprietor, MCM 12001 Farmington, LLC, a Delaware limited liability company, 301 Yamato Road, Suite 4160, Boca Raton, Florida 33431, attached to said report and recommendation, indicating a corporate commitment to maintain the system and reimburse the City for any maintenance the City performs; and To authorize the Mayor and City Clerk to execute the Storm Water Facilities Maintenance Agreement on behalf of the City. #356-20 RESOLVED, that having considered the report and recommendation of the City Engineer, dated October 29, 2020, which bears the signature of the Director of Public Works, the Director of Finance and the City Attorney, and is approved for submission by the Mayor, the Council does hereby approve the proposed 2021 Road Repair Program as proposed by the Department of Public Works and as reviewed by the Citizens Advisory Committee on Roads for the ninth year of the ten- year road paving millage approved by Livonia residents, as shown in the attachment to that report. #357-20 WHEREAS, the City of Livonia believes quality roads are a vital part of any community; and WHEREAS, the City of Livonia has a Citizens Advisory Committee on Roads which identifies City streets most in need of repair in order to prioritize repairs; and WHEREAS, said Committee has also observed the deterioration of County roads in Livonia; and WHEREAS, said Committee has identified certain improvements in the jurisdiction of the Wayne County Department of Public Service 41520 Regular Meeting Minutes of December 2, 2020 (WCDPS) which are necessary to increase traffic safety and to encourage economic development; and WHEREAS, said improvements are, in order of priority: 1. Rehabilitation of Merriman Road from Plymouth Road to Joy Road; and 2. MDOT — reconstruction of 1-275 from Six Mile Road to Ford Road, Rehabilitation from Ford Road to Northline Road along with the rehabilitation of the bridges (MDOT anticipates that this will be a 3-year project). WHEREAS, the Citizens Advisory Roads Committee has advised that the roads identified above are in critical need of repair; NOW, THEREFORE, BE IT RESOLVED, that City Council hereby accepts the report of the Citizens Advisory Roads Committee and directs the City Clerk to deliver this resolution to Wayne County Executive Warren Evans, the Wayne County Department of Public Service Engineering and Roads Division, and Wayne County Commissioners Diane Webb and Terry Marecki. #358-20 RESOLVED, that having considered a communication from the City Engineer, dated October 29, 2020, which bears the signatures of the Director of Public Works, the Director of Finance and the City Attorney, and is approved for submission by the Mayor, concerning the inclusion in the local street system, for Act 51 revenue computation purposes, of the following streets: Capri Court (Addition) Length: 600 I.f. Termini: Farmington Road to End Legal Description: Part of the Northeast '/4 of Section 4, T. 1 S., R. 9 E., City of Livonia, Wayne County, Michigan described as follows: Commencing at the Northeast corner of said Section 4; thence S 00003'10" W (recorded as N 00027'50" W), 825.00 feet along the East line of Section 4; thence S 89041'39" W, 60.00 feet to the Southeast corner of Medical Plaza Condominium, W.C.C.S.P. AND BE IT FURTHER RESOLVED THAT the street is an approved public street and is open for public purposes; and FURTHER, that said streets are accepted into the City's local street system and are located within a right-of-way under the control of the City of Livonia and that said streets were open to the public as of December 31, 2020. #359-20 RESOLVED, that having considered the report and recommendation of the City Engineer, dated October 29, 20207 submitted pursuant to Council Resolution 365-16, which bears the 41522 Regular Meeting Minutes of December 2, 2020 signatures of the Director of Public Works, the Director of Finance and the City Attorney, and is approved for submission by the Mayor, to which is attached a proposed amendment to the Engineering contract between the City of Livonia and Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315 for the 2021 Concrete Road Program (Contract 21-C), the Council does hereby authorize the Mayor and City Clerk, for and on behalf of the City of Livonia, to execute the attached contract amendment between the City of Livonia and Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315, to provide design engineering services for the 2021 Concrete Road Repair Program (Contract 21-C) in an amount not to exceed $210,700.00, said amount being based on the preliminary cost estimates and subject to adjustment based on the actual bids; FURTHER, the aforesaid proposal is accepted without competitive bidding pursuant to Code of Ordinances Section 3.04.140.D.2.b; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $210,700.00 from funds budgeted in Account No. 204-441-818-102 (Road, Sidewalk and Tree Fund) for this purpose; and the City Engineer is hereby authorized to approve minor adjustments in the work as it becomes necessary but this authorization does not entitle the City Engineer to authorize any increase in the not to exceed amount or to contract with other parties #360-20 RESOLVED, that having considered the report and recommendation of the City Engineer, dated October 29, 20207 submitted pursuant to Council Resolution 365-16, adopted on September 19, 2016, which bears the signatures of the Director of Public Works, the Director of Finance and the City Attorney, and is approved for submission by the Mayor, to which is attached a proposed amendment to the Engineering contract between the City of Livonia and Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315 for design engineering services for the 2021 Concrete Road Maintenance/Selective Slab Program (Contract 21-J), the Council does hereby authorize the Mayor and City Clerk, for and on behalf of the City of Livonia, to execute the attached contract amendment between the City of Livonia and Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315 to provide design engineering services for the 2021 Concrete Road Maintenance/ Selective Slab Program (Contract 21-J), in an amount not to exceed $42,400.00, said amount being based on the preliminary cost estimates and subject to adjustment based on the actual bids; FURTHER, the aforesaid proposal is accepted without competitive bidding pursuant to Code of Ordinances Section 3.04.140.D.2.b; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $42,400.00 from funds budgeted in Account No. 204-441-818-102 (Road, Sidewalk 41523 Regular Meeting Minutes of December 2, 2020 and Tree Fund) for this purpose; and the City Engineer is hereby authorized to approve minor adjustments in the work as it becomes necessary but this authorization does not entitle the City Engineer to authorize any increase in the not to exceed amount or to contract with other parties. On a motion by McCullough, seconded by Toy, it was- #361-20 RESOLVED, that having considered a communication from Yangkai Yuan, 17142 Farmington Road, Livonia, MI 48152, dated October 23, 2020, wherein a request is submitted to transfer the waiver use approval which was granted in response to Petition 2016-05-02-09, submitted by Omorfia Esthetics, which petition was approved by City Council on July 25, 2016, pursuant to Council Resolution 305-16, to operate a massage establishment (Omorfia Esthetics) within the Burton Hollow Shopping Center located on the east side of Farmington Road between Six Mile Road and Curtis Avenue (17142 Farmington Road) in the Southwest '/4 of Section 10, the Council does determine to deny the request to transfer waiver use approval to operate a massage establishment (Omorfia Esthetics) within the Burton Hollow 41526 Regular Meeting Minutes of December 2, 2020 Shopping Center located on the east side of Farmington Road between Six Mile Road and Curtis Avenue (17142 Farmington Road), in the Southwest 1/4 of Section 10, for the following reason: 1. The Petitioner failed to appear before Council to present his/her request. A roll call vote was taken on the foregoing resolution with the following result: AYES: Jolly, Toy, Bahr, White, McCullough and McIntyre NAYS: Donovic The President declared the resolution adopted. On a motion by Bahr, seconded by Jolly, and unanimously adopted, it was- #362-20 RESOLVED, that having considered an email communication from resident, Louis Csizmadia, dated November 5, 2020, requesting approval to construct a 50 ft x 80 ft ice rink with lights for public use within Dover Arbor Park, the Council does hereby determine to deny this request for the following reasons- 1. easons:1. The Department of Parks and Recreation lacks sufficient personnel to staff the rink to assure public safety; and 2. Liability concerns naturally arise where private individuals or entities create facilities on public land.
