HomeMy WebLinkAboutSYNOPSIS - 2020-09-21 SYNOPSIS OF THE MINUTES OF THE 1,905th REGULAR MEETING LIVONIA CITY COUNCIL — SEPTEMBER 21, 2020 Meeting was held via Zoom and called to order at 7:00 p.m. by President McIntyre. Present: Laura Toy, Scott Bahr, Cathy White, Brandon McCullough, Rob Donovic, Jim Jolly, and Kathleen McIntyre. Absent: None. #263-20 Resolution by Bahr and White, unanimously adopted, approving the minutes of the 1,904th Regular Meeting of the Council held September 9, 2020. President McIntyre wished City Treasurer Lynda Scheel a happy birthday, as well as Mark Taormina, Director of Planning and Economic Development. Vice President Bahr pointed out that Councilmember Donovic is joining the meeting via Zoom from his deployment with the U.S. Army. Councilmember McCullough welcomed two new members to the City's staff, Lashon Thomas and Josh Sabo. Clerk Nash gave an update on the upcoming November 3rd General Election. President McIntyre spoke about her experience in helping with the process and Councilmember Toy thanked Clerk Nash and her staff for their hard work. Cathy White, as Parliamentarian of Council, went over the rules of order for Audience Communication. President McIntyre announced one (1) Public Hearing to be held Wednesday, October 7, 2020 via Zoom remote technology on the following matter: Petition 2020-07-01-04 submitted by Adams Park Development, L.L.C., pursuant to Section 23.01 of the City of Livonia Zoning Ordinance #543, as amended, requesting to rezone the properties at 14416 Harrison Avenue and 28201 Lyndon Avenue (former Adams Elementary School site) located on the south side of Lyndon Avenue between Inkster and Middlebelt Roads in the Southeast '/4 of Section 24 from PL (Public Lands) to R-1 (One Family Residential) She then stated there is New Data on Item Nos. 16-20 and Item No. 21, and that there will be one X-item heard at the end of the Regular Agenda. AUDIENCE COMMUNICATION Several residents brought up issues with noise problems and protests at Planned Parenthood. The following items were received and filed: A communication from the Department of Finance, dated September 2, 2020, re. various financial statements for the month ending July 31, 2020. A Diversity & Inclusion Training Report & Recommendation from the Office of the Mayor, dated September 9, 2020. SYNOPSIS OF THE MINUTES OF THE 1,905th REGULAR MEETING 2 LIVONIA CITY COUNCIL-SEPTEMBER 21,2020 A communication from the Department of Finance, dated September 16, 2020, re. additional information regarding factors impacting water and sewer rates. A communication from the Director of Finance, dated September 17, 2020, re. delinquent water bill balances for 28700 Plymouth Road. The following resolutions were offered by Bahr and Jolly: #264-20 Approving acceptance of bid from Tech Mechanical for purchase and installation of HVAC System for City Hall Data Center. #265-20 Approving Animal Sheltering Agreement between City and Michigan Humane Society for three years. #266-20 Approving acceptance of bid from Brendel's Septic Tank Service, LLC for portable toilet service for three years. #267-20 Authorizing additional expenditure to Environmental Recycling Group for Household Hazardous Waste and Electronic Waste Drop-Off Program. #268-20 Referring vacation of public utility easement at 17117 and 17123 N. Laurel Park Drive to the Planning Commission for action and recommendation. #269-20 Approving one-year extension of Waiver Use Approval for Piano Shoe Properties, L.L.C., for property located at 27717 and 27719 Seven Mile Road. #270-20 Approving Petition 2020-07-03-03 for vacation of a section of an existing public utility easement at 19700 and 19750 Haggerty Road. A roll call vote was taken on the foregoing resolution with the following result: AYES: Bahr, White, McCullough, Donovic, Jolly, Bahr and McIntyre NAYS: None #271-20 Motion by Bahr and Toy, unanimously adopted, approving one-year extension of waiver use approval for property at 34350 Ann Arbor Trail. White gave second reading to the following Ordinance: AN ORDINANCE VACATING THE USE OF PORTIONS OF STREET, ALLEY AND PUBLIC GROUND. (Petition 2019-01-03-01) A roll call vote was taken on the foregoing ordinance with the following result: AYES: Bahr, White, McCullough, Donovic, Jolly, Toy and McIntyre NAYS: None Jolly gave second reading to the following Ordinance: AN ORDINANCE AMENDING SECTION 3 OF THE ZONING MAP OF THE CITY OF LIVONIA AND AMENDING ARTICLE III OF ORDINANCE NO 543, AS AMENDED, KNOWN AND CITED AS "THE CITY OF LIVONIA ZONING ORDINANCE" BY ADDING SECTION 3. THERETO. (Petition 2020-02-01-02) SYNOPSIS OF THE MINUTES OF THE 1,905th REGULAR MEETING 3 LIVONIA CITY COUNCIL-SEPTEMBER 21,2020 A roll call vote was taken on the foregoing ordinance with the following result: AYES: Bahr, White, McCullough, Donovic, Jolly, Toy and McIntyre NAYS: None #272-20 Motion by Bahr and Donovic, unanimously adopted, approving Petition 2020-07-08-05, submitted by Belaggio Homes, to develop site condominium (Livonia Manor 3), at 31670 Seven Mile Road. #273-20 Motion by McCullough and Jolly, unanimously adopted, approving sidewalk waiver at 29614 Greenland. #274-20 Motion by White and Bahr, unanimously adopted, approving sidewalk waiver at 29648 Greenland. #275-20 Motion by McCullough and Donovic, unanimously adopted, approving sidewalk waiver at 14950 Lyons Avenue. Bahr gave first reading to the following Ordinance: AN ORDINANCE AMENDING SECTION 040 OF TITLE 13, CHAPTER 08 (WATER SERVICE RATES AND REVENUES) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Bahr invoked Emergency Clause and gave second reading and roll call vote with the following result: AYES: Bahr, White, McCullough, Donovic, Jolly, Toy and McIntyre NAYS: None McCullough gave first reading to the following Ordinance: AN ORDINANCE AMENDING SECTION 050 OF TITLE 13, CHAPTER 08 (WATER SERVICE RATES AND REVENUES) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. White invoked the Emergency Clause and gave second reading and roll call vote with the following result: AYES: Bahr, White, McCullough, Donovic, Jolly, Toy and McIntyre NAYS: None Jolly gave first reading to the following Ordinance: AN ORDINANCE AMENDING SECTION 120 OF TITLE 13, CHAPTER 20 (LIVONIA SEWAGE DISPOSAL SYSTEM) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Jolly invoked the Emergency Clause and gave second reading and roll call with the following result: AYES: Bahr, White, McCullough, Donovic, Jolly, Toy and McIntyre NAYS: None Donovic gave first reading to the following Ordinance: AN ORDINANCE AMENDING SECTION 050 OF TITLE 13, CHAPTER 28, (INDUSTRIAL WASTE SURCHARGE) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. White invoked the Emergency Clause and gave second reading and roll call with the following result: AYES: Bahr, White, McCullough, Donovic, Jolly, Toy and McIntyre NAYS: None #276-20 Motion by Toy and Jolly, unanimously adopted, approving an Industrial Facilities Exemption Certificate for Mastronardi Produce USA, for expansion of their warehouse space located at 28700 Plymouth Road. #277-20 Motion by Bahr and Jolly, unanimously adopted, referring the matter of an education session regarding water rates and how they are determined, to the Capital Outlay and Infrastructure Committee. #278-20 Motion by Toy and Jolly, unanimously adopted, suspending the rules for procedure. #279-20 Motion by Jolly and Toy, unanimously adopted, referring the subject matter of exploring the laws regarding time(s), place(s), and manner restrictions for protest in the City to the Law Department. #280-20 Motion by Bahr and White, referring the organizational restructuring of the City Council Office to the Committee of the Whole. A roll call vote was taken on the foregoing resolution with the following result: AYES: Bahr, White, Donovic, Jolly, Toy and McIntyre NAYS: McCullough SYNOPSIS OF THE MINUTES OF THE 1,905th REGULAR MEETING 5 LIVONIA CITY COUNCIL—SEPTEMBER 21,2020 AUDIENCE COMMUNICATION Several individuals discussed perceived racism in the City. By Toy and McCullough, unanimously adopted, adjourned this 1,954th Regular Meeting of the Council of the City of Livonia at 8:28 p.m. on September 21, 2020. SUSAN M.
